Abstract

Until the mid-19th century, the Dutch colonialism (the Western world) began to intervene in the indigenous legal systems of Indonesia. The current situation marks the beginning of a decline in the civilization of Muslims, particularly in Indonesia. This development raises concerns about the future of Indonesian society as a whole. This decline permeated various aspects of life, including the field of mu’āmala law, which began to adopt usury-based concepts. This research aims to reconstruct the Islamic legal policy on Ultra-Micro (UMi) Financing as practiced by the Indonesian government, which still contains elements of usury (ribā) in its implementation. This study employs a qualitative approach using empirical-socio-legal research methods involving an analysis of UMi Financing contracts, interviews with stakeholders, and direct observations in Surakarta. The analysis is grounded in the theory of maqāṣid al-sharī’a, including the principles of ribā as outlined in classical Islamic jurisprudence (turāth). The findings reveal a research gap that the current legal policy on Sharia ultra-micro financing implemented by the government had ribā, which is found in classical Islamic texts.

Abstract

This service aims to increase employment opportunities for diasporas who take further education abroad, such as in Malaysia, Hong Kong, and Sweden, with manufacturing abroad, such as in Malaysia, Hong Kong, and Sweden, by creating and submitting articles to reputable journals. Abstract

This article aims to analyze the division of inheritance carried out by the royal family of the Surakarta Sunanate in Central Java Province. Data were collected through interviews and observations involving six royal families. The findings show that the descendants of the Surakarta Sunanate royal family divide inheritance based on agreements reached withing the family. Within the royal family, there are two types of inheritance. The first is the king’s personal property, which is divided according to Paugeran (royal customary law), using a ratio of 2:1 between sons and daughters, unless the king has left a testament. The king’s testament, known as sabda pandita ratu, is considered absolute. If the king issues a testament that removes the inheritance rights of a family member, that person’s rights are annulled. This stands in contrast to Islamic law, which limits the scope of a testament to one-third of the estate and prohibits the disinheritance of a rightful heir. The second type of inheritance is palace property, which may only be inherited by the son or heir who succeeds the late king. These practices illustrate the (dis)harmony between Islamic inheritance law and royal customary inheritance law in specific contexts. [Artikel ini bertujuan untuk menganalisis pembagian harta warisan yang dilakukan oleh keluarga kerajaan Kasunanan Surakarta Provinsi Jawa Tengah, Indonesia. Pengumpulan data dilakukan dengan metode wawancara dan observasi terhadap enam keluarga kerajaan keturunan Kasunanan Surakarta. Hasil penelitian menunjukkan bahwa keturunan keluarga kerajaan Kasunanan Surakarta membagi harta warisan berdasarkan kesepakatan yang dilakukan melalui musyawarah keluarga. Dalam keluarga raja, terdapat dua jenis warisan, yaitu harta pribadi raja, yang dibagi berdasarkan Paugeran (hukum adat) dengan perbandingan 2:1 bagi anak laki dan perempuan. Hal ini berlaku kecuali jika raja berwasiat. Wasiat raja yang disebut sabda pandita ratu bersifat mutlak, dimana jika ia menentukan pembagian rata, maka warisan akan dibagi rata. Atau, jika ia berwasiat menghapus hak waris salah satu anggota keluarga, maka akan terhapus. Di dalam hukum Islam, seorang pewaris hanya dapat wasiat maksimal 1/3 dari hartanya dan tidak bisa menghapus ahli waris. Jenis harta kedua adalah harta keraton yang tidak bisa diwariskan secara pribadi kepada semua keluarga raja, namun hanya akan diberikan kepada satu saja ahli waris yang menggantikan mendiang raja. Praktik-praktik ini menggambarkan adanya (ketidak)selarasan antara hukum waris Islam dan hukum waris adat kerajaan dalam konteks tertentu.]

Abstract

Trust in the performance of law enforcement officers, especially the police, is experiencing a crisis due to several actions taken that are not in favor of the community. This study aims to describe the public's response to the professional ethics of the police in carrying out their duties and authorities. The research data are public opinions regarding the police in carrying out their duties in the community. Data collection was carried out using an in-depth interview method with an accidental technique. Data validation techniques were carried out using triangulation to test the validity of the data. Analysis was carried out using an interactive method based on the results of in-depth interviews. The results of the study are (1) a positive public response to the police in protecting and caring for the community, especially in creating a sense of security from criminal acts in the community, (2) negative public response to the police who still commit irregularities, especially related to the practice of extortion and arrogance in law enforcement, and (3) the implementation of police duties is considered not to be in accordance with the professional code of ethics, so professionalism is required in every implementation of their duties.Keywords: professional ethics; public trust; law enforcement; duties; authority.

Abstract

Riza Restianti, Kelik Wardiono Faculty of Law and Political Science, Muhammadiyah University of Surakarta, Surakarta, Indonesia c100210168@student.ums.ac.id   Abstract   This study analyzes the juridical implications of Decision No. 150/Pdt.G/2021/PN Cbi concerning the legal status of guarantee institutions in online loan disputes and their impact on legal protection and certainty. The absence of valid collateral in fintech-based lending has led to an increasing number of disputes, weakening creditors’ legal standing and contractual enforcement. This research aims to evaluate how the court’s interpretation in this decision reshapes the validity and enforceability of guarantees in digital lending contracts. Using a normative juridical method supported by qualitative analysis of legislation and judicial reasoning, the study explores the court’s assessment of unsecured lending practices within the framework of civil law principles. The results indicate that the decision underscores the necessity of verifiable and enforceable collateral mechanisms to protect creditors’ rights while maintaining fairness for debtors. Furthermore, the study highlights the urgency of reforming digital credit agreements to include structured verification and legal compliance mechanisms that uphold both transparency and contractual balance. The novelty of this research lies in its critical reconstruction of guarantee validity in online loan arrangements through the lens of judicial precedent, contributing to the development of civil law and fintech governance in Indonesia. The findings provide normative recommendations for policymakers to strengthen legal certainty, accountability, and consumer protection in digital financial transactions.

Abstract

Digital transformation presents significant challenges in safeguarding the personal data of banking customers, particularly when banks collect and manage extensive personal information without ensuring adequate protection. This study examines the implementation of the accountability principle by personal data controllers within the banking sector. The objective is to assess how far this principle has been integrated into the obligations stipulated by data protection regulations. Using a qualitative legal research method combined with a comparative approach, this study analyzes the Personal Data Protection Law (PDPL) in Indonesia and the General Data Protection Regulation (GDPR) in Sweden. The findings reveal that Indonesia’s PDPL still demonstrates several deficiencies, including limited data leakage notifications, lack of transparency in third-party data disclosure, insufficient information technology security responses, and inefficient data updates. Similarly, under the GDPR framework, challenges persist in managing data shared with third parties and in providing timely written notices in cases of data breaches. The study concludes that the weaknesses identified in both jurisdictions highlight the need for strengthening the accountability principle to enhance the effectiveness of personal data protection in the banking sector. Reinforcing this principle will ensure greater responsibility among data controllers and foster public trust in digital financial systems.

Abstract

This study aims to determine the purpose of legal science for Muhammadiyah, specifically the Majelis Tarjih (Islamic Council of Muhammadiyah). This is highly urgent, because the Majelis Tarjih is an entity within Muhammadiyah that is responsible for providing solutions to the problems of the people's lives, especially Muhammadiyah members and Muslims in general. In general, the purpose of legal science is to ensure justice, legal certainty, and benefit. Legal scholars have provided an overview of justice, legal certainty, and benefit. Some argue that law is just if it has legal certainty. Meanwhile, the law is certain if it is written or codified. On the side of benefit, there are also many differences. Is the benefit for the victim only, or for the perpetrator as well? The above matters are constantly experiencing dynamics. Therefore, Muhammadiyah, in this case the Majelis Tarjih, wants to provide an alternative purpose of legal science. Based on this, this research has a fairly high urgency, considering that the Majelis Tarjih in its legal istbath should not deviate from the purpose of the law itself. This research method is normative research with a library approach. The research begins by analyzing Islamic sharia by classifying what is fixed (muthasibat) and what is changeable (muthaghoiroh). These two aspects are then discussed in dialogue with the objectives of sharia (maqasidu shari'ah). In the next stage, the author will study the istinbat method of the tarjih assembly's law to synchronize the objectives of law with the istinbath method of the Muhammadiyah tarjih assembly. The findings of this study are that the objectives of law from the Muhammadiyah perspective are flexible. This flexibility lies in achieving benefits and avoiding harm.

Abstract

Indonesia has passed Law No. 27 of 2022 on Personal Data Protection. However, this regulation is less effective in its implementation because it is hampered by supervisory institutions that have yet to be formed and will automatically impact the sanctioning mechanism. With the vulnerability of personal data theft that occurs in Indonesia, the urgency of this service is to provide insight into the protection of personal data and legal efforts made when personal data theft occurs to Indonesian Migrant Workers (PMI) in Hong Kong. The purpose of this community service is to increase legal awareness for workers because the condition of workers who have not returned to Indonesia for a long time may not understand the vulnerability of storing personal data in Indonesia because they are used to using personal data protection laws in Hong Kong which are robust and have been formed for a long time so that they are likely to experience culture shock when they return to Indonesia. The method used in this community service has two stages. The first stage is legal counseling for migrant workers in Hong Kong. The second stage is assisting with creating crisis centers both offline and online to assist PMI who intend to obtain information about personal data protection and victims who experience personal data theft.

Abstract

Penelitian yang bertujuan untuk mendiskripsikan dan mengeksplanasi keefektifan program yang telah dilakukan TP4D Kejaksaan Negeri Surakarta ini mendasarkan pada metode pendekatan non-doktrinal kualitatif. Oleh karena itu dalam penelitian ini lebih mengutamakan pada data primer yang dikumpulkan dengan wawancara dan observasi serta didukung data sekunder yang dikumpulkan dengan studi kepustakaan. Data yang sudah diolah untuk selanjutnya dianalisis secara kualitatif. Berdasarkan hasil penelitian ditemukan bahwa TP4D secara efektif telah mencapai tujuan terbentuknya TP4D melalui PERJA RI Nomor PER-014/A/JA/11/2016 dalam pencegahan tindak pidana korupsi. Efektivitas pelaksanaan TP4D tersebut, didukung oleh faktor sarana (fasilitas pendukung), masyarakat, dan kebudayaan Akan tetapi belum didukung oleh faktor hukum dan penegak hukum. Nilai kebaruan dari hasil penelitian ini adalah penegakan hukum dengan faktor masyarakat dan kebudayaan lebih mempengaruhi pelaksanaan TP4D.

Abstract

Konten animasi merupakan suatu video animasi yang diunggah oleh beberapa orang melalui chanel miliknya yang tersedia pada platform youtube untuk memasarkan atau mempromosikan hasil karyanya berupa video animasi. Namun semakin berkembangnya teknologi memudahkan siapa saja termasuk anak-anak untuk dapat mengakses konten animasi di youtube padahal tidak semua konten animasi di youtube sudah sesuai dengan ketentuan yang ada dalam UU Penyiaran dan UU ITE. Anak dalam hal ini adalah sebagai konsumen konten animasi pada plaftorm youtube sehingga seharusnya adanya perlindungan terhadap anak dapat dijadikan sebagai solusi untuk membatasi konten animasi youtube yang tidak sesuai dengan ketentuan yang berlaku. Dalam UU Perlindungan Anak pasal 1 angka 12 menyebutkan bahwa “Hak anak adalah bagian dari hak azasi manusia yang wajib dijamin dilindungi dan dipenuhi oleh orang tua, keluarga, masyarakat, pemerintah dan negara.” Berdasarkan hal tersebut maka perlindungan hukum terhadap konsumen anak perlu mendapat perhatian lebih karena perlindungan hukum yang diberikan saat ini masih sangat minim terhadap anak sebagai konsumen konten animasi youtube.
