Abstract

At the end of 2019, the world's first discovery of a highly contagious and rapidly growing virus called the Covid-19 virus. In legal terms, it is known as overmacht which means a forced state. The Covid-19 virus pandemic has grown rapidly since the beginning of 2019 until now. The biggest impact of the Covid-19 virus pandemic is the world economy. When it comes to the economy, the most influential field is banking. In the banking world, which provides loan services to customers, of course, it has had a big impact since the Covid-19 virus pandemic. Therefore, this paper aims to discuss the legal consequences of the overmacht condition in the banking sector, especially on the implementation of credit agreements in banking. The method used in this paper is normative law using a statutory approach, namely POJK and the Civil Code which contains the topic of discussion with secondary data types. With the overmacht condition, OJK as the authorized party issued a new POJK regulation regarding the implementation of credit in banking during this pandemic. Where overall the contents and provisions of the POJK are in accordance with applicable law, by emphasizing on the banking sector to continue to apply the precautionary principle in providing relaxation as an effort to relieve loans or debtor customer credit so that credit activities in banking remain organized and run well.

Abstract

The covid-19 pandemic has been affecting MSME actors significantly. One of the problems faced by MSME actors due to this pandemic, is difficulty in collecting business capital. Therefore, the Indonesian Government presents crowdfunding as a solution. The crowdfunding itself intends to strengthen MSME financially and encounter investors and MSME actors in one platform. Crowdfunding collects funds from the community and is managed by a crowdfunding provider institution. In this case, information technology-based crowdfunding is one of the MSME capital solutions during the COVID19 pandemic. This information technology-based crowdfunding provides alternative capital for MSMEs other than conventional banks and financing institutions, sourced from public funds (crowd funds). This study aims to provide an overview of how crowdfunding can be alternative funding in Indonesia and overcome MSME capital difficulties based on capital market laws and OJK regulations (The Indonesian Financial Services Authority). This legal research uses doctrinal research methods to analyze whether this crowdfunding policy can be an opportunity for economic recovery in Indonesia. The results of this study indicate that crowdfunding can be a funding solution in Indonesia and an alternative in economic recovery after the COVID-19 pandemic based on regulations issued by OJK in POJK (the Indonesian Financial Services Authority Regulation) Number 57 of 2020.

Abstract

This article examines the manifestation of trademarks as collateral to enhance the capacity of Micro, Small, and Medium-sized Enterprises (MSMEs) in Indonesia. The study employs a normative research approach, drawing upon legal sources derived from legislation, relevant legal theories, and concepts. Data is analyzed using a qualitative juridical method and deductive reasoning. The research findings suggest that trademarks should be eligible as collateral since they meet the criteria of intangible movable property that can contribute to the growth and development of SMEs in Indonesia. However, the practical application of trademarks as collateral is hindered by existing regulations and the absence of a specialized intellectual property asset appraisal institution. Such measures are crucial in fostering MSMEs and, ultimately, improving the welfare of the Indonesian society.
