Abstract

After the enactment of Law no. 11 of 2020 concerning Job Creation, as has been followed up with PP No. 7 of 2021 concerning the Ease, Protection, and Empowerment of Cooperatives and Micro, Small, and Medium Enterprises, it has been regulated that "The Business Registration Number is valid as a single license, and is valid as identity and legality in carrying out business activities." With this legality, business actors can carry out their business activities with legal guarantees and certainty as regulated by applicable laws and regulations. The Nostalgia Coffee Shop Micro Business, which is owned by Barly Fahmi, does not yet have the NIB as referred to previously, therefore a socialization is needed in order to provide understanding to business actors, especially the owners of Nostalgia Coffee Shop in terms of the importance of business legality to provide legal guarantees and certainty for the implementation of a business. business activities. After conducting socialization, the author offers assistance in managing business legality in the form of NIB for Nostalgia Coffee Shop business actors, namely by submitting a PkM proposal and a guide to registering access rights for micro and small businesses on the OSS.go.id page. After being approved, the author provides assistance in managing the legality of the Nostalgia Coffee Shop micro business, namely by interviewing, observing and documenting methods.

Abstract

Employment contract is the binding connection between companies and its workers. Employment contract itself can be divided into two types which are the temporary employment contract and the permanent employment contract. Temporary employment contract often found in larger companies such as PT Goldwell Plastic Indonesia. Temporary employment contract is one of company’s legal document which is very crucial and must be drafted in accordance with provisions of applicable laws and regulations. With the legalization of UU No. 11 Tahun 2020 about Cipta Kerja which includes the revision of UU No. 13 Tahun 2003 about Ketenagakerjaan leads to the re-evaluation of the temporary employment contract that was used in PT Goldwell Plastic Indonesia in order to be accordance with the latest provisions of applicable laws and regulations. In order to achieve that, writer as student of law made an agreement with partner to revised the temporary employment contract in accordance with the latest provisions of applicable laws and regulations.

Abstract

Security rights of land are expected to be a strong security institution which can provide legal certainty. Security rights are done through the making of APHT, where the grantor of the rights himself comes directly to the PPAT or he can also use SKMHT made by a notary or PPAT as the basis for the APHT. The existence of these provisions basically implies that SKMHT is mandatorily made using an authentic deed. If SKMHT does not substantially meet the provisions required by UUHT, the legal consequences are the void of SKMHT by law and the PPAT is prohibited to make the APHT. Furthermore, if the SKMHT made by a notary does not meet the conditions stipulated in UUJN the legal consequences are that the strength of its evidence becomes a deed under the hand. If this happens, indeed the APHT made by PPAT based on SKMHT cannot be registered. That is because, the 2 SKMHT which forms the basis of making APHT violates the conditions implied in UUHT that is created by an authentic deed, so consequently the principle publicity of security rightsarenot fulfilled.
