Abstract

This study discusses the land ownership trial between Defendant I, Defendant II, and Defendant III based on the Decision of the Pematang Siantar District Court Number 81/Pdt.G/2019/PN PMS. This dispute gives rise to different interpretations of the validity of the Kotapradja Letter which is used as evidence of land ownership. This study uses a normative legal method with a descriptive analytical nature, a normative approach, and secondary data collected through document studies, analyzed qualitatively. The results of the study indicate that the validity of the Kotapradja Letter is weak because after the enactment of the Basic Agrarian Law (UUPA), all land certificates must be re-registered to obtain strong legality. At the first level, the panel of judges granted the plaintiff's lawsuit based on documentary evidence and witness statements. However, at the appeal level, the defendant succeeded in overturning the initial decision with additional evidence. The case brought to the Supreme Court showed that SHM 326 of 1995 belonging to the plaintiff and SHM 0042 of 1984 belonging to Defendant I were in accordance with the measurement results, so that the land controlled by Defendant I was legally valid. This study emphasizes the importance of legal certainty in maintaining land and the need to verify the legality of documents to prevent ownership conflicts.

Abstract

Based on article 42 of Law Number 30 of 2002, KPK is given authority to coordinate and control investigation and prosecution of criminal cases of corruption carried out jointly by persons subject to the General and Military Court. However, KPK encounters problems in investigating TNI members together with civilians, as happened in the Basarnas case. This normative legal research uses statute approach and conceptual approach, in order to provide a view for harmonization of regulations related to the KPK's connectivity authority. The results show that it is necessary to change the definition of "military criminal offenses" in Military Court Bill, statutory regulations related to organizational structure of KPK and origin of institutions where KPK Investigators/Prosecutors come from, which can only be filled by National Police, Prosecutors, and Special Civil Servant. It is necessary for KPK to have a special Deputy for handling connectivity cases and Investigators who come from military.

Abstract

Penyimpangan kerap terjadi dalam proses pengadaan tanah bagi pelaksanaan pembangunan demi kepentingan umum. Proyek pengadaan tanah pada umumnya membutuhkan jumlah uang yang besar sehingga mengakibatkan sektor ini menjadi celah dan ladang tindak pidana di bidang pertanahan di Indonesia. Tindak pidana di bidang pertanahan atau kejahatan terhadap tanah, pada dasarnya merupakan kejahatan yang berhubungan dengan penguasaan tanah dan hak-hak atas tanah. Tujuan penelitian yaitu mengkaji dan menganalisis bagaimana esensi pengadaan tanah bagi pembangunan untuk kepentingan umum di Indonesia. mengkaji dan menganalisis bagaimana konstruksi tindak pidana korupsi terkait pengadaan tanah bagi pembangunan untuk kepentingan umum di Indonesia danmengkaji dan menganalisis analisis yuridis mengenai pembuktian unsur delik dalam tindak pidana korupsi dalam pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum studi Putusan Pengadilan Negeri Medan Nomor 105/Pid.Sus-TPK/2022/PN.Mdn. Metode penelitian yang digunakan adalah yuridis normatif. Dalam penelitian ini, data yang telah diperoleh akan dianalisis dengan menggunakan metode analisis data kualitatif. Hasil penelitian menemukan Bahwa pengadaan tanah hanya dapat dilakukan jika pembangunan yang dilaksanakan lebih banyak memberikan manfaat yang dapat dinikmati oleh masyarakat meskipun ada pihak yang kurang dapat menerima. Kegiatan pengadaan tanah bagi pembangunan untuk kepentingan umum hanya dapat dilakukan oleh pemerintah dan bukan untuk mencari keuntungan.Bahwa tindak pidana korupsi pada pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum sering terjadi karena panitia pengadaan tanah dalam menjalankan tugasnya kurang menerapkan prinsip kehati-hatian dan ketelitian dalam melaksanakan tugasnya seperti, pengumpulan data fisik dan yuridis dalam menentukan objek, pihak yang berhak untuk menerima ganti kerugian serta besaran ganti kerugian.Bahwa perbuatan terdakwa Bonar dalam proses penerbitan sertipikat tidak memenuhi unsur delik secara melawan hukum yang didakwakan oleh Jaksa Penuntut Umum. Perbuatan terdakwa bukan merupakan satu kesatuan rangkaian dengan perbuatan transaksi jual beli tanah yang dilakukan oleh Yulius Dakhi dan Martinus Telaumbanua yang mengakibatkan kerugian keuangan negara. Kedua perbuatan tersebut merupakan perbuatan yang berbeda dan tidak saling berhubungan satu sama lain, sehingga perbuatan terdakwa tidak mengakibatkan kerugian keuangan negara karena perbuatan terdakwa selesai saat sertipikat telah terbit.

Abstract

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.

Abstract

The high morbidity and mortality rate of the community is due to lack of knowledge in detecting health status and inability to make decisions to overcome health problems, causing delays in treatment. Providing education in the form of simulations and applying patents of a method of increasing independence for detecting health status and following up on appropriate treatment and patents of WEB site-based self-care methods is the application of information and communication technology in nursing services which is one solution to overcome this because it can optimize individual independence so that distance, time, place, and cost are not an obstacle to getting nursing services and achieving SDGs 3; ensuring a healthy life and improving the welfare of the population. Community service uses interview methods, health promotion about upper respiratory tract infections, hypertension, infections, rheumatism, dental caries, skin infections, refractive errors, pulmonary tuberculosis, pulp and pariapical tissue diseases and cataracts. Followed by simulations, assistance to all participants in using the WEB https://ariganursingselfcare.com/, observation and monitoring of the application of WEB to increase independence in detecting health status and following up on treatment. Community service was carried out from August to October 2023 in the community in the Medan Sunggal Health Center working area with a total of 173 people. The results showed 113 (65%) respondents were independent in detecting health status and following up on treatment, but there were still 60 (35%) respondents who needed continuous assistance in applying the WEB.

Abstract

The problems faced by MSME business actors are licensing and capital issues to continue their business in the midst of the COVID-19 pandemic. So special attention is needed for MSME actors from the Government during a pandemic. This research uses normative legal research and empirical legal research. Therefore, the data used include primary data and secondary data. Data were collected using library research and field research using interview methods. The results of the study indicate that the ease of doing business permits for MSME business actors according to the job creation law will be freed from business licensing fees and will provide cost relief for small businesses. The Government's policy is to provide social assistance to MSMEs affected by COVID-19 in the amount of 2.4 million Rupiah. Obstacles Faced First, there are obstacles in terms of licensing, the second is obstacles in distributing BPUM, and the third is the obstacles to providing capital credit for Micro, Small and Medium Enterprises (MSMEs).

Abstract

Penelitian ini dilakukan dengan tujuan utama untuk mengidentifikasi dan menganalisis pelanggaran hukum yang terjadi dalam konteks pelaksanaan parate eksekusi oleh perusahaan pembiayaan. Dalam metodologi penelitian, pendekatan yang diterapkan adalah penelitian normatif dengan menggunakan Pendekatan kasus, yang bertujuan untuk memperoleh pemahaman mendalam mengenai penerapan norma-norma hukum dalam praktik hukum sehubungan dengan kasus-kasus yang sudah menjadi subjek penelitian dan telah diputuskan dalam yurisprudensi. Hasil dan kebaruan dari penelitian ini menegaskan bahwa tindakan penyitaan tanpa kesepakatan terkait wanprestasi, serta tanpa melibatkan proses hukum, merupakan suatu pelanggaran hukum yang signifikan, wanprestasi tidak hanya ditentukan oleh kreditur, tetapi melalui kesepakatan antara kreditur dan debitur atau melalui proses hukum yang membuktikan adanya wanprestasi serta kesediaan debitur dalam memberikan objek jaminan kepada perusahaan pembiayaan jika tidak maka pelaksanaan eksekusi Sertifikat Jaminan Fidusia haruslah didasarkan pada keputusan pengadilan. Namun, Setelah Keputusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019, apabila kedua persyaratan di atas terpenuhi, kreditur diberi otoritas untuk langsung melakukan proses eksekusi pada objek jaminan fidusia yang bersangkutan. Hal ini merupakan konklusi penting dari penelitian terhadap fenomena parate eksekusi dalam konteks perusahaan pembiayaan.

Abstract

Sale and purchase agreements are one form of agreement that often occurs in society. An agreement will be valid if it has fulfilled the conditions stipulated in Article 1320 of the Civil Code. The sale and purchase binding deed is a preliminary agreement that binds the parties to the sale and purchase and has the right and obligation to fulfill the performance as agreed upon in the sale and purchase agreement. The research method used is normative juridical research. The nature of this research is descriptive analytical. The source of legal material used is secondary data with primary legal materials, secondary legal materials and tertiary legal materials. The research technique used is library research with a case approach to this research. The results of this study indicate that defaults caused by heirs who are reluctant to pay land and building tax and seller's tax from the late seller / heir in the deed of binding of sale and purchase even though the buyer has carried out his performance so as to obtain legal protection, he filed a lawsuit with the court in accordance with preventive legal protection.

Abstract

Abstract: Bullying in educational settings is a serious problem that has psychological, social, and academic impacts on children. Although various regulations governing child protection exist, their implementation in Medan City has not been fully effective. This study aims to analyze the applicable legal policies related to child bullying in schools, assess the implementation of legal protection for child victims, and identify obstacles and efforts taken by schools and related parties. The study used a juridical-normative method supported by empirical data, and data analysis was conducted qualitatively. The results show that legal policies regarding child bullying are basically regulated in Law Number 35 of 2014 concerning Child Protection, Regulation of the Minister of Education, Culture, Research, and Technology Number 46 of 2023, and several supporting regulations, but there are no specific rules that are consistently applied in madrasas. The implementation of legal protection at MAN 1 Medan City, SMAN 11 Medan City, and SMAS Utama Medan City is still not optimal, partly because the Violence Prevention and Handling Team (TPPK) has not been formed as required by the regulation. The main obstacles faced include low legal awareness among school residents, a weak reporting culture, and the predominance of family-based approaches to case resolution. Efforts, such as counseling, mediation, and outreach, remain fragmented and not systematically integrated. This study recommends strengthening sectoral regulations, establishing a protective implementation structure in schools, and developing a legal culture that favors children. These steps are expected to create a safe, inclusive, and violence-free educational environment. Keyword: Legal Protection, Child Bullying, Educational Units, Medan City Abstrak: Perundungan (bullying) di lingkungan satuan pendidikan merupakan persoalan serius yang menimbulkan dampak psikologis, sosial, dan akademik bagi anak. Meskipun telah terdapat berbagai regulasi yang mengatur perlindungan anak, pelaksanaannya di Kota Medan belum sepenuhnya efektif. Penelitian ini bertujuan untuk menganalisis kebijakan hukum yang berlaku terkait perundungan anak di sekolah, menilai pelaksanaan perlindungan hukum terhadap anak korban, serta mengidentifikasi hambatan dan upaya yang ditempuh oleh sekolah dan pihak terkait. Penelitian menggunakan metode yuridis-normatif dengan dukungan data empiris, dan analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa kebijakan hukum mengenai perundungan anak pada dasarnya telah diatur dalam Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak, Permendikbudristek Nomor 46 Tahun 2023, serta beberapa regulasi pendukung, namun belum terdapat aturan khusus yang diterapkan secara konsisten di madrasah. Pelaksanaan perlindungan hukum di MAN 1 Kota Medan, SMAN 11 Kota Medan, dan SMAS Utama Kota Medan masih belum maksimal, antara lain karena belum terbentuknya Tim Pencegahan dan Penanganan Kekerasan (TPPK) sebagaimana diwajibkan regulasi. Hambatan utama yang dihadapi mencakup rendahnya kesadaran hukum warga sekolah, lemahnya budaya pelaporan, serta dominannya penyelesaian kasus melalui pendekatan kekeluargaan. Adapun upaya yang dilakukan, seperti konseling, mediasi, dan sosialisasi, masih bersifat parsial dan belum terintegrasi secara sistematis. Penelitian ini merekomendasikan penguatan regulasi sektoral, pembentukan struktur pelaksana perlindungan di sekolah, serta pembangunan budaya hukum yang berpihak pada anak. Dengan langkah tersebut, diharapkan tercipta lingkungan pendidikan yang aman, inklusif, dan bebas dari kekerasan. Kata Kunci: Perlindungan Hukum, Perundungan Anak, Satuan Pendidikan, Kota Medan
