Abstract

The purpose of this study is to examine the basis of a judge's considerations and the form of legal protection related to the cancellation of the Nacepim trademark registration, as stated in Supreme Court Decision Number 639 K/Pdt.Sus-HKI/2020. The first-to-file system in Indonesia still leaves room for injustice for business actors who have used a trademark in practice but did not immediately apply for registration, thus requiring a reassessment of the trademark registration mechanism. The urgency of this research arises from the need to balance legal certainty and substantive justice for bona fide early users. The method used is normative legal research through a case study and legislation approach. The findings show that although the judge's considerations in the Nacepim case followed the provisions of the Trademark Law, the absolute application of first to file still has weaknesses, including the risk of trademark squatting and a lack of protection for first users. This study concludes that there is a need for a registration model that combines the first-to-file principle with the first-to-use element, accompanied by stricter substantive examinations and both preventive and repressive protection mechanisms by the DJKI. The novelty of this study lies in the proposed hybrid model and the analysis of the latest ruling that strengthens the position of early users in facing bad-faith registrations.   Tujuan penelitian ini mengkaji dasar pertimbangan hakim serta bentuk perlindungan hukum terkait pembatalan pendaftaran merek Nacepim sebagaimana tercantum dalam Putusan Mahkamah Agung Nomor 639 K/Pdt.Sus-HKI/2020. Sistem first to file di Indonesia masih menyisakan ruang ketidakadilan bagi pelaku usaha yang telah lebih dahulu memakai merek secara nyata, tetapi tidak segera mengajukan pendaftaran, sehingga diperlukan penilaian ulang terhadap mekanisme pendaftaran merek. Urgensi penelitian ini muncul dari kebutuhan menyeimbangkan antara kepastian hukum dan keadilan substantif bagi pengguna awal yang beriktikad baik. Metode yang digunakan adalah penelitian hukum normatif melalui pendekatan kasus dan peraturan perundang-undangan. Temuan penelitian menunjukkan bahwa walaupun pertimbangan hakim dalam perkara Nacepim telah mengikuti ketentuan UU Merek, penerapan first to file secara absolut tetap menyimpan kelemahan, termasuk risiko trademark squatting dan kurangnya perlindungan bagi pemakai pertama. Penelitian ini menyimpulkan perlunya model pendaftaran yang menggabungkan prinsip first to file dengan unsur first to use, disertai pemeriksaan substantif yang lebih ketat dan mekanisme perlindungan baik preventif maupun represif oleh DJKI. Kebaruan penelitian ini terletak pada tawaran model hibrida tersebut serta analisis putusan terbaru yang memperkuat posisi pengguna awal dalam menghadapi pendaftaran beriktikad buruk.

Abstract

Juvenile delinquency is a social phenomenon that often occurs during the transition from childhood to adulthood. Adolescence is known as a phase of identity discovery that is vulnerable to the influence of various external and internal factors. One of the main factors influencing adolescents' tendency to engage in deviant behavior is the family environment. The family plays a crucial role as the first social environment that provides values, norms, and controls for children's behavioral development. This study aims to determine the extent of family influence, particularly parenting styles, communication quality, and family unity, on the emergence of juvenile delinquency. The research method used is a descriptive qualitative approach with data collection techniques through literature review and in-depth interviews with several adolescents and their parents. Data were analyzed to identify the relationship between parenting styles and family dynamics with adolescent behavior. The results show that families with disharmony, minimal communication, and overly authoritarian or permissive parenting styles have a higher tendency to produce deviant behavior in children. Adolescents from such families are more vulnerable to negative associations, social pressure, and have difficulty controlling their emotions. Conversely, families that implement democratic parenting styles, provide emotional attention, and foster open communication tend to foster more emotionally, socially, and morally stable adolescents. This research confirms that strengthening the family's role is key to preventing juvenile delinquency. This can be achieved through improving the quality of communication between family members, implementing parenting styles that balance control and freedom, and maintaining harmony within the household. In this way, the family can function optimally as the first line of defense in shaping positive adolescent character and behavior, thereby minimizing the risk of delinquency.

Abstract

National defense is not only related to military defense, but also encompasses the active role of citizens in maintaining social and economic stability. Workers are a vital element in national development. Therefore, protecting workers' rights is an integral part of national defense efforts. This article aims to analyze the legal protection of workers' rights under Law Number 13 of 2003 concerning Manpower and relate it to the values ​​of national defense. The method used is a normative juridical approach through literature review. The results of the study indicate that labor regulations have regulated various workers' rights, but implementation challenges in the field remain high. The active role of all parties is needed to ensure legal protection is truly realized as a form of civil national defense. This indicates that legal protection for workers needs to be strengthened through the active roles of the government, employers, and workers themselves to create social and economic stability, which is an integral part of national defense. Therefore, an active role is needed from all parties, including the government, employers, and workers themselves, to realize optimal legal protection as a form of civil national defense that supports the sustainability of national development.

Abstract

Law Number 35 of 2009 concerning Narcotics provides legal space for drug addicts to receive rehabilitation as an alternative to imprisonment. This policy aims to restore addicts' condition so they can return to normal life and reduce overcrowding in correctional institutions. This study aims to analyze the effectiveness of implementing rehabilitation as a form of alternative punishment for drug addicts, both from a legal and practical perspective. The method used is normative legal research with a legislative approach and empirical studies in several rehabilitation institutions and law enforcement institutions. The results of the study indicate that although normative legal provisions already accommodate rehabilitation, in practice there are still various obstacles such as minimal coordination between agencies, a lack of facilities and infrastructure, and low public legal awareness. Therefore, strengthening regulations, increasing the capacity of rehabilitation institutions, and consistent law enforcement are needed so that rehabilitation can be an effective solution in dealing with drug abuse. Abstract

This study aims to conduct a comparative study of criminal acts of defamation on social media based on the provisions stipulated in Law Number 1 of 2024 concerning Electronic Information and Transactions (UU ITE). With the increasing development of information and communication technology, social media has become one of the main means of interaction, which at the same time increases the risk of spreading content that is detrimental to a person's good name. This study uses a qualitative method with a comparative approach to analyze changes, advantages, and disadvantages of legal provisions in the latest ITE Law compared to previous regulations. The results of the study show that Law Number 1 of 2024 provides more detailed and firm regulations regarding defamation on social media, with a clearer emphasis on legal boundaries and sanctions. These findings are expected to be a consideration for law enforcers and policy makers in improving legal protection for victims of defamation in the digital era.

Abstract

Penyuluhan hukum ketenagakerjaan merupakan upaya strategis untuk meningkatkan kesadaran dan pemahaman hukum masyarakat, khususnya di kalangan tenaga kerja, mengenai hak-hak normatif yang dijamin oleh peraturan perundang-undangan khususnya oleh Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan yang menjadi landasan utama dalam memberikan perlindungan hukum terhadap tenaga kerja di Indonesia. Dalam praktiknya terdapat berbagai macam permasalahan yang sering muncul dalam hubungan kerja, permasalahan tersebut tidak hanya disebabkan oleh lemahnya pengawasan, tetapi juga akibat rendahnya pemahaman masyarakat mengenai hak dan kewajiban tenaga kerja. Kegiatan pengabdian ini dilaksanakan di Kantor Kelurahan Pangkalan Jati yang bertujuan untuk melaksanakan penyuluhan hukum ketenagakerjaan kepada masyarakat serta menganalisis perannya dalam meningkatkan pemahaman hak-hak tenaga kerja berdasarkan Undang-Undang Nomor 13 Tahun 2003. Penyuluhan ini juga dihadiri oleh Assoc. Prof. Dr. Nazli Bin Ismail yang memberikan tambahan pemahaman bagaimana perlindungan tenaga kerja Indonesia yang bekerja di Malaysia. Metode yang digunakan adalah metode yuridis normatif yang dipadukan dengan pendekatan empiris melalui kegiatan penyuluhan hukum. Hasil kegiatan menunjukkan adanya peningkatan pemahaman peserta mengenai hak atas upah, jam kerja, jaminan sosial, keselamatan dan kesehatan kerja, serta mekanisme penyelesaian perselisihan hubungan industrial serta pemahaman mengenai bagaimana tenaga kerja Indonesia di Malaysia juga mendapat perlindungan. Dengan demikian, penyuluhan hukum ketenagakerjaan memiliki peran penting dalam mewujudkan hubungan industrial yang adil, harmonis, dan berkeadilan.

Abstract

The rapid development of blockchain technology has positioned cryptocurrency as a significant innovation within the global financial system. In Indonesia, its legal status remains controversial due to regulatory dualism between monetary and commodity authorities. This study examines the legal status of cryptocurrency as a payment instrument under Indonesian positive law, employing a normative juridical method that incorporates statutory and conceptual approaches. The findings show that cryptocurrency is explicitly prohibited as a means of payment under Law Number 7 of 2011 on Currency, particularly Article 21 paragraph (1), which mandates the Rupiah as the sole legal tender. Violations are subject to criminal sanctions under Article 33, including imprisonment of up to one year or fines of up to IDR 200 million. This prohibition is reinforced by Bank Indonesia Regulation No. 19/12/PBI/2017, which prohibits the use of virtual currencies in payment systems. Conversely, cryptocurrency is legally recognized as a tradable digital asset under Bappebti Regulation No. 8 of 2021 and supervised under OJK Regulation No. 27 of 2024 within the commodity and investment framework. This regulatory dualism creates legal uncertainty, exposing users to both criminal liability and consumer protection risks. The study concludes that regulatory harmonization among Bank Indonesia, OJK, and Bappebti is necessary to ensure legal certainty and financial system stability.

Abstract

This study examines the implementation of Government Regulation No. 6 of 2025 concerning the Amendment to Government Regulation No. 37 of 2021 on the Administration of the Job Loss Insurance Program (JKP), focusing on a case study of unilateral termination at PT X. The research is motivated by the increasing number of unlawful dismissals and the suboptimal enforcement of workers’ legal protection. The study employs an empirical juridical method, collecting data through interviews with the Department of Manpower and Transmigration of DKI Jakarta and qualitative analysis of relevant legislation. Findings reveal that although Government Regulation No. 6 of 2025 enhances worker protection by improving financial benefits, extending claim periods, and reducing employer contributions, its implementation remains hindered by low legal compliance and limited socialization among companies. The PT X case exemplifies violations of the termination procedures stipulated in the Manpower Law and Government Regulation No. 6 of 2025. This regulation reflects a proportional distribution of responsibility between the state, employers, and employees. This research emphasizes the need for stronger law enforcement and continuous evaluation to ensure that the regulation’s primary goals, worker welfare and business sustainability are effectively achieved.
