Abstract

Objectives of this study: 1) To know more clearly the Tagan practice system at the walimah urusy of the community from Selakau District of Sambas Regency in Parit Baru Village. 2) Legal firmness sourcedfrom the Qur’an, hadith, ijma', or qiyas as well as local personalities of ulama who explain the Tagan tradition in terms of the principle of dain (debt) or similar as a syara' argument. This study uses a qualitative method with the type of empirical-normative research. The techniques for collecting data are library research, interviews, observations, and documentation with primary data sources from the expert and secondary data sources from literacy references. The technique to validate the data is a reliability test with a research site in Parit Baru Village, Selakau District, Sambas Regency. The results of the study: 1) There is a tradition in Barit Baru village called Tagan, and the practice of Tagan was held by the wedding ceremony, the community donates goods, food ingredients, food, drinks, tents, sound music, etc. to the practice organizers as much as they can from the donation, where this donation must be exchanged Later with the same item while the donors are holding the wedding. 2) Tagan traditions based on the dain principle must be paid exactly as they are due, without reducing the level, price, amount and taste. However, with the times that are increasingly advancing and changing, there will of course be significant changes in the quality of the merchandise. So the Tagan should be paid at the fair price of the goods at that time and not following the previous price. The rule of Tagan crowns is permissible and does not contain the elements of usury. The law of Tagan is permissible and does not contain the elements of usury. So linearly, walimatul 'ursy which uses the Tagan tradition is halal.

Abstract

This study aims to examine: (1) Which marriage customs are still practiced by the Dayak Kanayatn tribe today, and (2) The Islamic legal perspective on the implementation of the Dayak Kanayatn wedding ceremony based on the concept of al-‘urf for Muslim adherents. This research employed a qualitative field research method, utilizing direct observation and in-depth interviews as primary data collection techniques. The primary data were obtained through documented interviews with key informants, including two traditional leaders and one religious figure, while secondary data were gathered from relevant books, articles, and scholarly sources. Data collection was conducted through interviews and documentation, and data validity was ensured through triangulation. The findings indicate that (1) The marriage customs currently practiced by the Dayak Kanayatn tribe are Picaraatn, Ngomok, and the Wedding Feast, each involving a picara (spokesperson) and a paraga tool used as a medium for prayer to Jubata (God); and (2) From the perspective of al-‘urf in Islamic jurisprudence, the practice of this wedding ceremony is considered contrary to Islamic teachings when performed by Muslims and is classified as ‘urf fasid (corrupt custom) due to elements of shirk (polytheism), the permissibility of prohibited acts (such as the slaughter of pork), and the risk of leading to fornication if conducted prior to a valid Islamic marriage contract. Consequently, the practice is deemed haram (forbidden) under Islamic law, as it contradicts core principles of tawhid and Sharia, despite certain elements like Picaraatn being individually permissible, since the entire ceremony is inseparable and embedded within practices that violate Islamic doctrine.

Abstract

This study aims to uncover and clarify the actual practice of the customary marriage known as salep tarjhe, including the underlying philosophy and reasons for its prohibition, as well as its perspective from Islamic law within the Madurese community of Batu Layang. The research employs two main analytical frameworks: symbolic interactionist theory and Islamic law concerning marital issues. Using a sociological approach, this field research is supported by a literature review, with the author collecting primary data directly through interviews and documentation. The informants for this study include the couples involved, their parents, religious leaders, traditional elders, and the local community. The findings indicate that religious and community leaders in Batu Layang widely permit salep tarjhe marriages, asserting that they do not contradict Islamic sharia. The prohibition is found to stem from myths passed down through generations, such as beliefs that the marriage could lead to financial hardship, divorce, or infertility. This myth is classified as ‘urf fasid (corrupt custom) because it is inconsistent with Islamic principles. Conversely, some members of the general public still forbid this practice due to their belief in these myths. From an Islamic legal standpoint, the salep tarjhe marriage is deemed permissible (mubah) as there is no specific prohibition mentioned in the Quran, Hadith, or the views of codified fiqh scholars.

Abstract

Perkembangan teknologi informasi telah memberikan dampak yang signifikan terhadap sektor telekomunikasi, termasuk dalam pengelolaan infrastruktur jaringan. Telkomsel sebagai penyedia layanan telekomunikasi terbesar di Indonesia menghadapi tantangan dalam pengelolaan tower di Kabupaten Labuhan Batu Utara, seperti kerusakan perangkat, pencurian, dan dampak bencana alam. Belum tersedianya sistem yang mampu menampilkan lokasi tower secara akurat dan melakukan pelaporan menjadi kendala dalam penanganan permasalahan di lapangan. Penelitian ini bertujuan untuk membangun sistem informasi geografis (SIG) berbasis web untuk memetakan lokasi tower Telkomsel di Labuhan Batu Utara. Metode pengembangan menggunakan waterfall yang meliputi analisis kebutuhan, perancangan sistem, implementasi, dan pengujian. Sistem dikembangkan menggunakan PHP dengan framework CodeIgniter 3, database MySQL, dan perancangan UML. Hasil penelitian berupa aplikasi WebGIS yang dapat menampilkan lokasi tower berdasarkan koordinat dan menyediakan fitur pelaporan untuk perawatan, pencurian, dan kerusakan. Sistem memiliki dua jenis pengguna yaitu admin untuk mengelola data tower dan teknisi lapangan untuk melaporkan kondisi tower. Hasil pengujian menunjukkan bahwa sistem berjalan dengan baik dan sesuai dengan kebutuhan pengguna. Sistem ini membuat proses pencarian informasi lokasi tower menjadi lebih efisien dan pelaporan insiden dapat dilakukan secara berkala, sehingga diharapkan dapat mendukung kinerja Telkomsel dalam menjaga infrastruktur jaringan.

Abstract

Water is one of the basic necessities used by living things on this earth. Along with the population growth with climate change, there are several cases of water crisis in Java and Bali, especially in the dry season. The purpose of this research is to project water demand and availability based on climate change scenarios, develop an analysis model for the impact of climate change on the water sector based on the water balance, and calculate environmental economic losses resulting from water deficit losses. The type of scenario used in climate analysis is RCP (Representative Carbon Pathway) 4.5 with two types of models. Provinces experiencing very critical water conditions in the 2021-2050 period using the CSIRO model are DKI Jakarta, East Java and Bali, with water criticality indexes of 296.25%, 113.88% and 123.64%, with a water deficit loss of IDR 1.2 billion, IDR 7.93 billion and IDR 0.87 billion. Whereas with the MIROC model, the areas that have very critical water conditions are DKI Jakarta Province with a water criticality index of 220.36%, with a water deficit loss of IDR 0.42 billion.

Abstract

The reclamation of Island G in Jakarta Bay has sparked various controversies that eventually led to a lawsuit filed by Mr. Nelayan Muara Angke and several environmental groups against the Governor of DKI Jakarta and PT Muara Wisesa Samudra as the developer. Based on various considerations, the Jakarta Administrative Court (PTUN) decided to annul the Decree of the Governor of DKI Jakarta Number 2238 dated December 23, 2014, concerning the Implementation Permit for the Reclamation of Island G. One of the judges argued that the Governor of DKI Jakarta had the right to issue the reclamation permit for Island G, even though the authority to grant such permits formally belongs to the central government, as stipulated in Presidential Decree Number 52 of 1995 concerning the Reclamation of the Northern Coast of Jakarta, which has already expired. The revocation of the decree also created new legal consequences, particularly regarding the nullification of sale and purchase transactions that occurred prior to the revocation of the decree.

Abstract

Kelompok Tani Margo Utomo di Dukuh Gumul menghadapi tantangan dalam mempertahankan keberlanjutan pertanian akibat ketergantungan pada pupuk kimia, yang berdampak negatif terhadap lingkungan dan kualitas tanah. Sebagai solusi, program pengabdian ini dirancang untuk mendukung transisi ke pupuk kompos yang lebih ramah lingkungan. Metode yang diterapkan meliputi pelatihan teknik pengomposan dan penerapan teknologi sederhana, seperti penggunaan alat pengaduk kompos dan bioaktivator untuk meningkatkan kualitas dan efisiensi produksi. Selain aspek produksi, program ini juga mencakup pelatihan branding dan pemasaran digital guna memperkuat daya saing produk di pasar. Hasil evaluasi menunjukkan peningkatan keterampilan teknis petani dalam produksi kompos, dengan 90% peserta mencapai pemahaman yang baik. Program ini menunjukkan potensi sebagai model pemberdayaan yang dapat diadaptasi di wilayah lain untuk mendorong pertanian berkelanjutan.

Abstract

This research was motivated by the practice of transforming contracts from renting to competitions that occurred at the Madun Fishing Club, Ketapang Regency. This research aims to find out how the Madun Fishing Club's fishing rental contract in Ketapang Regency became a competition and to find out how the Compilation of Sharia Economic Law (KHES) review transformed the object of the Madun Fishing Club's fishing rental contract in Ketapang Regency. The research approach in preparing this thesis is to use a qualitative approach with a type of empirical juridical research. Meanwhile, the secondary data in this research itself are business owners and competition participants or renters in the Madun Fishing Club. Primary data sources include journals and related documents, in this case, KHES. Data collection techniques are interviews, observation, and documentation. This data was analyzed using the theory of legal pluralism, while the technical data analysis used by researchers involved data collection, data reduction, data presentation, and drawing conclusions. Based on the data obtained, this research can conclude, namely, 1). The rental agreement for the competition held by the Madun Fishing Club in Ketapang Regency is carried out in writing individually using the Galatama competition system. In terms of implementation, this competition system as a whole uses a rental agreement. 2) The rental of the Madun Fishing Club fishing ground in Ketapang Regency, which turns into a competition, can be justified in the Compilation of Sharia Economic Law, namely in Article 29,7, which states that the ijarah contract can be changed, extended, and canceled based on agreement.

Abstract

This research aims to understand and qualify the gold savings product contract at Bank Syariah Indonesia (BSI) Ahmad Yani branch, referring to the KHES (Council of Islamic Scholars) regulations on murabahah sales. The gold savings product is a service that allows customers to buy and sell gold at affordable prices, with the facility of safekeeping. This service provides ease for the public to invest in gold. Gold savings at BSI use a murabahah contract. Generally, murabahah is a sales contract between the bank and the customer at the acquisition price plus an agreed profit margin. A qualitative research method with an empirical juridical approach was employed in this study. Primary data was collected through interviews with two informants from the BSI Ahmad Yani Pontianak branch. Secondary data was obtained from journals, articles, and the internet. Data collection techniques involved documentation and interviews. The collected data were analyzed systematically and presented in a research report.
