Abstract

The main problem in this research is how the marriage of pregnant women with men who are not pregnant in Uraso Village, Kec. Mapdeceng, Kab. North Luwu According to Imam Malik and Shafi'i. The main problems that will be described from the sub-problems are: 1) What are the views of the people of Uroso Village, Kec. Mapdeceng, Kab. North Luwu regarding the marriage of a pregnant woman with a man who did not impregnate her? 2) What is the opinion of Imam Malik and Syafi'i on the marriage of a pregnant woman with a man who did not impregnate her in Uroso Village, Kec. Mapdeceng, Kab. North Luwu?. The type of research used is qualitative research or field research which describes the phenomena that occur in society and aims to produce descriptive data in the form of data, images and behavior of the people observed using a syar'i normative approach sourced from the arguments of the Qur'an, the hadith of the Prophet as well as the ijtihad of the Ulama and the sociological approach. The data sources in this research are sourced from primary data and secondary data. The results of this study indicate that: 1) Regarding the views from interviews with several community and religious leaders, they have different opinions regarding this phenomenon. 2) The scholars agree on the permissibility of marrying adulterers for those who commit adultery. Thus, the marriage of a pregnant woman with a man who impregnates her or commits adultery is legal and they may have intercourse as husband and wife. Meanwhile, the views of Imam Malik and Shafi'i regarding the marriage of a pregnant woman with a man who did not impregnate her have different opinions. Imam Malik is of the opinion that the marriage is invalid. This is because women who have sexual intercourse with adultery have exactly the same legal status as women who have sexual intercourse with syubhat. The woman must purify herself at the same time as the 'iddah of the woman whose husband divorced her, except when had (punishment) is required. Meanwhile, Imam Shafi'i allowed the marriage of a pregnant woman to a man who did not impregnate her.

Abstract

Ulama agreed that women who are Muslim (Muslimah) are forbidden to marry between men who are not from the same religion as her. However, in reality interfaith marriages still continue to occur in society. The main problem in this study is how to analyze interfaith marriage in Makassar City, Biringkanaya District. The purpose of this study is to determine interfaith marriage in the city of Makassar, Biringkanaya District and to know and understand the relevance of the application of interfaith marriage with the concept of Law No. 1 of 1974 and know and understand the validity of interfaith marriage according to Islamic Law. Researchers use qualitative methods, this research is field research, which is a direct review of the location studied to obtain data, then the data is used as the main data or primary data. While the nature of this research is descriptive, that is, it describes regularly the problem under study in accordance with the data obtained then analyzed. The results of this study show that authentically interfaith marriage according to the concept of Law No. 1 of 1974 concerning marriage states that a valid marriage is a marriage carried out according to their respective religions and beliefs. Law No. 1 of 1974 does not expressly prohibit interfaith marriage, resulting in a legal vacuum. According to Islamic Law on interfaith marriage in Indonesia explains that the legal basis for interfaith marriage is not permissible because it involves differences in faith.

Abstract

Abstrak Penelitian ini mengangkat pokok masalah tentang “Tinjauan Hukum Islam terhadap Penyelesaian Sengketa Tanah Ulayat secara Sederhana dan Ekonomis di Desa Bonto Biro, Kecamatan Tondong Tallasa, Kabupaten Pangkep” dengan menggunakan pendekatan historis, pendekatan sosiologis, dan pendekatan hokum syar’i. Sumber data dalam penelitian yaitu berasal dari data primer dan data sekunder. Untuk mendapatkan data yang dibutuhkan dalam penelitian ini dilakukan dengan cara reduksi data, penyajian data, teknik analis perbandingan, dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa konsep penyelesaian sengketa tanah ulayat dilaksanakan melalui beberapa tahapan. Di mana para pihak terlebih dahulu bersepakat untuk menyelesaikan sengketa secara sederhana dan ekonomis (non litigasi), setelah para pihak yang bersengketa sepakat menempuh jalur sederhana dan ekonomis (non litigasi) maka selanjutnya memilih mediator yang dianggap mampu menjembatani kepentingan para pihak. Kemudian, mediator yang telah dipilih akan berusaha membangun komunikasi dengan para pihak yang bersengketa sehingga diharapkan dapat memberikan solusi/jalan keluar dari permasalahan tersebut. Adapun penyelesaian sengketa tanah ulayat secara sederhana dan ekonomis (non litigasi) seperti yang dilakukan masyarakat Bonto Birao merupakan salah satu penyelesaian sengketa yang diperbolehkan dalam Islam karena mengandung unsur tolong menolong dan perdamaian. Kata Kunci: Penyelesaian Sengketa, Tanah Ulayat, Non Litigasi Abstract This research raises the subject of "Review of Islamic Law on Simple and Economic Settlement of Customary Land Disputes in Bonto Biro Village, Tondong Tallasa District, Pangkep Regency" using historical approaches, sociological approaches, and syar'i legal approaches. Data sources in research are derived from primary and secondary data. To obtain the data needed in this study, data reduction, data presentation, comparison analysis techniques, and conclusions are carried out. The results of this study show that the concept of customary land dispute resolution is implemented in several stages. Where the parties first agree to resolve the dispute simply and economically (non-litigation), after the disputing parties agree to take a simple and economical path (non-litigation), they then choose a mediator who is considered capable of bridging the interests of the parties. Then, the chosen mediator will try to build communication with the parties to the dispute so that it is expected to provide solutions to the problem. The settlement of customary land disputes in a simple and economical manner (non-litigation), as carried out by the Bonto Birao community, is one of the dispute settlements allowed in Islam because it contains elements of help and peace. Perspektif Hukum Ekonomi Syariah dan Bagaimana Ketentuan Hukum Ekonomi Syariah terhadap sistem    Peminjaman Uang suku  di Lamakera Kecamatan Solor Timur Kabupaten Flores Timur Provinsi NTT. Perspektif Hukum Ekonomi Syari’ah. Penelitian ini bersifat tinjauan lapangan (field research) dan menggunakan metode penelitian kualitatif. Pengumpulan data pada penelitian ini menggunakan metode wawancara, observasi dan dokumentasi. Peminjaman uang suku di  Lamakera Kecamatan Solor Timur Kabupaten Flores Timur Provinsi NTT. hukumnya haram karena adanya bunga yang ditetapkan kepada nasabah sesuai kesepakatan bersama. Namun apabila ketikai naisaibaih tidaik sainggup mengembailikain uaing selaimai waiktu yaing telaih ditentukain dailaim kesepaikaitain tersebut maikai konsekuensinyai aidailaih bungainyai aikain bertaimbaih duai kaili lipait, jikai tidaik bisai melunaisinyai jugai maikai aikain disitai bairaing berhairgai milik naisaibaih. Kata Kunci: Peminjaman, Uang Suku, Ekonomi Syariah   Abstract The law of riba or interest on tribal money loans in Lamakera, East Solor District, East Flores Regency, NTT province. Viewed from the Perspective of Sharia economic law in the Qur'an it is expressly stated as haram. The essence of prohibition (usurios) in Islam is based on moral and human considerations. because the essence of the prohibition of usury or interest on loans is the elimination of all forms of economic practices that give rise to tyranny and injustice. The formulation of the internal problem is: What is the system for borrowing tribal money in Lamakera, East Solor District, East Flores Regency, NTT Province. The Perspective of Sharia Economic Law and How the Provisions of Sharia Economic Law are towards the tribal money lending system in Lamakera, East Solor District, East Flores Regency, NTT Province. Perspective of Sharia Economic Law. This research is a field research and uses qualitative research methods. Collecting data in this study using interviews, observation and documentation. Borrowing tribal money in Lamakera, East Solor District, East Flores Regency, NTT Province. the law is unlawful because there is interest set on the customer according to a mutual agreement. However, if when the customer is unable to return the money during the time specified in the agreement, the consequence is that the interest will double, if you cannot pay it off, then the customer's valuables will be confiscated. Abstract

Analysis of the factors behind Sirri's marriage and strategies for dealing with Sirri's marriage at the KUA in North Ternate City. This type of research is qualitative with a juridical, sociological, and pedagogical approach. Data sources are primary/secondary data while data collection is observation, interviews, documentation, and reference searches. Data analysis techniques use data categorization, data reduction, grouping, data preparation, data interpretation, data verification, and concluding. The results of the research are that sirri marriage does not contradict the concept of maslahah murlahan itself, so in this case the essence of sirri marriage is based on maslahah murlah which brings harm, but sirri marriage is not recorded so it can contain many fasids

Abstract

This study aims to find out how the results of calculating the Qibla direction of the mosque and the accuracy of the Qibla direction of the mosque using the Qibla Tracker, Qibla Arc, and Google Earth instruments. The type of research used is field research which is descriptive qualitative in nature. This study uses an astronomical and syar'i approach. Source of data in this study from primary data and secondary data. Data processing techniques and data analysis in the form of data reduction, data presentation, inference, and verification as well as the final conclusion. The results of the study found that 5 out of the 13 mosques in this study still had an inaccurate Qibla or did not face the true Qibla. Qibla tracker and protractor methods get the same results as the google earth method. The implication of this research is that it is hoped that the local government, especially the KUA, will re-verify the Qibla direction of the mosque in order to correct the deviation that has occurred. In addition, it is necessary to socialize the accuracy of the Qibla direction to the community and provide a basic understanding to the community regarding the importance of the Qibla direction in carrying out worship, as well as the instruments used in determining the Qibla direction. Abstract

The submission of dowry in the form of land (Sompa Tanah), as practiced by the Bugis community in Bone, reflects the flexibility of local mechanisms in addressing real-world challenges based on the ideal values of tradition. This study is important in the broader discourse on dowry, which often highlights cultural legitimacy in perpetuating violence and the subordination of women. The provision of Sompa Tanah in Bugis society serves as a cultural, legal, and religious mechanism to establish legal certainty regarding rights and obligations in marital relations. This descriptive qualitative research draws on observation and interview data, which are then analyzed contextually to understand their relevance to social management within the community. The findings indicate that Sompa Tanah functions as a legal mechanism that not only regulates rights and obligations in marriage but also provides legal certainty within the marital bond. The legal security afforded to women serves as a safeguard for their rights as wives and mothers within a patriarchal society. As a legal mechanism, Sompa Tanah ensures social order and gains customary and cultural legitimacy, which strengthens the position of women in the Bugis social structure. Additionally, marriage, as a social bond, carries the risk of divorce, which is also legally acknowledged. Consequently, this paper recommends further comparative studies to explore the practice of Sompa Tanah across different regions to gain more comprehensive and in-depth knowledge.

Abstract

Religious and spiritual knowledge are among the areas of education that must be given full attention by families for their children. Religious knowledge is very meaningful in awakening the instinctive spiritual strength and willingness that exists in children through religious guidance and the practice of religious teachings which are of course adapted to their level and age, so that it can help to gain basic religious knowledge which has implications for the child's awareness of running. religious teachings properly and correctly. The Koran explains about orphans in various ways, including religion, faith, property, inheritance, spoils of war, marriage, and so on. This shows that the problem of orphans in the Koran is not only a sosial and humanitarian problem, but is also related to religious and faith issues which will have an impact in the afterlife. Therefore, the problem of orphans in Islam is a very important matter, so it requires serious attention and handling from people who are caring and adequate. Allah commands those who believe and are pious to pay attention to, look after, assist, aid and protect orphans in the ways He has determined.

Abstract

This research aims to determine the benefits according to Najmuddin al-Tufi and the distribution of daughters' inheritance in terms of the concept of benefits. The research method used is descriptive analysis, the data is processed using content analysis. The results of this study show several important points. First: that the benefits according to al-Tufi are different from those understood by the majority of ulama, al-Tufi believes that the benefits are as follows: Benefits and mafsaadat can be assessed on the basis of reason alone, Maslahat is an argument that stands alone and is separate from the syarak text, the scope of benefit is muamalah and custom and benefit are the strongest Islamic arguments. Second: Based on this view, there is nothing wrong with dividing a daughter's inheritance 1:1 as long as there are benefits, even though it is contrary to the Islamic law.

Abstract

The aim of this research is to discuss the protection of women's rights in the MUI Fatwa in the field of Munâkaḥat from a Maşlaḥah perspective. This research is qualitative research with the type of library research. The data collection method used in this research is literature study. The research results show that there is Maşlaḥah obtained regarding the protection of women's rights in the MUI fatwa in the field of Munâkaḥat. The MUI or Indonesian Ulema Council, the main Islamic administrative body in Indonesia, considers such relations to be legally dangerous because they are considered to violate public regulations. The MUI generally underlines the importance of complying with Islamic norms and state regulations, which is legally dangerous because it is considered to violate public regulations requiring official registration.
