Abstract

LPG gas is a primary necessity for the community because it is more practical and efficient than firewood or kerosene. High demand has triggered illegal practices by some businesses, namely transferring subsidized gas cylinders to non-subsidized cylinders using tools that do not meet standards. This action risks causing explosions and losses for consumers. This study aims to analyze the forms of legal protection for consumers, the legal implications for business actors, and efforts to resolve disputes resulting from the distribution of LPG gas that does not comply with company operational standards. The research method used is normative juridical with a statute approach and a conceptual approach. The results of the study show that Legal protection for consumers against the distribution of LPG that is non-compliant with standard operating procedures is implemented through both internal and external mechanisms. Internally, protection is realized through agreements between consumers and business actors to safeguard consumer rights; conversely, external protection is provided by the State through the Consumer Protection Law, which guarantees security, safety, comfort, and legal certainty. This protective framework is further reinforced by the role of the National Consumer Protection Agency (BPKN), which is empowered to supervise and take enforcement action against business actors in violation of the law.. Business actors can be subject to criminal, administrative, and civil sanctions in accordance with Consumer Protection Law, the Oil and Gas Law, and the ESDM Ministerial Regulation. Meanwhile, consumer dispute resolution can be pursued through litigation in court or non-litigation through the BPSK. Consistent law enforcement and strict distribution supervision are necessary to provide legal certainty, safety, and optimal protection for LPG consumers in Indonesia.

Abstract

The Mandalika Special Economic Zone (SEZ) is currently a leading destination not only in Lombok but also in Indonesia. The presence of the Mandalika Circuit as a MotoGP race venue, along with the beauty of the coastal landscape and other tourism potential, makes Mandalika a Super Priority Destination. The Mandalika SEZ is located in three river basins, namely Tebelo Ngolang and Balak. Behind the splendor of the Mandalika Circuit and other supporting infrastructure lies a series of flood data that hit the area, including the floods of January 30, 2021, and December 23, 2022. Based on these events, a study is needed to map the flood risk in the three watersheds and the Mandalika SEZ. This flood risk map can later serve as a basis for formulating policies and anticipatory measures for future flooding. The required data includes rainfall data, land use maps, topographic maps, land use maps, slope maps, and geological/soil type data. The data were then analyzed using a Geographic Information System (GIS) and then overlaid using the ArcGIS software program. Based on the overlay results and weighting of the supporting factors for flooding, flood vulnerability at the study location can be determined. The results showed that the Tebelo Watershed is divided into 3 categories, namely a moderately vulnerable area of 270.32 ha, a vulnerable area of 479.89 ha and a very vulnerable area in the downstream area of 85.44 ha. The Ngolang Watershed is divided into two categories dominated by a vulnerable area of 930.97 ha and a moderately vulnerable area of 568.68 ha. Meanwhile, the Balak Watershed is divided into two categories, namely a vulnerable area of 1,418.59 ha and a moderately vulnerable area of 1,243.53 ha

Abstract

Transparansi penggunaan keuangan didalam pemerintahan desa meupakan salah satau faktor utama penentu kesuksesan dalam pembangunan desa. Akan tetapi, dengan adanya dana desa juga dapat menimbulkan permasalahan yang baru dalam pengelolaannya. Berdasarkan pengamatan awal yang dilakukan penulis bahwa terdapat beberapa masalah yang terjadi di Desa Cendana Hitam yang pertama adalah mengenai prioritas anggaran dana desa yang masih kurang maksimal dilaksanakan, kemudian yang kedua terkait publikasi anggaran dana desa. Penelitian ini bertujuan untuk mengetahui bagaimana pengelolaan dana desa serta bagaimana transparansi pengelolaan dana desa di Desa Cendana Hitam Kecamatan Tomoni Timur Kabupaten Luwu Timur. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian deskriptif, dengan teknik pengumpulan data melalaui observasi, wawanncara, dan dokumentasi. Adapaun hasil penelitian ini menunjukan bahwa pengelolaan dana desa yang dilakukan oleh Pemerintah Desa Cendana Hitam sudah dilakukan berdasarkan Permendagri Nomor 113 Tahun 2014, dimana pengelolaan dana desa meliputi, tahap perencanaan, pelaksanaan serta pertanggungjawaban sudah dilakukan dengan baik. Kemudian, pemerintah desa belum menerapkan prinsip tranparansi secara 100% namun, transparansi baru dilakukan 50% dimana belum semua masyarakat dilibatkan dalam proses perencanaan pembangunan sampai dengan serah terima hasil pembangunan dimana hanya masyarakat tertentu atau orang-orang yang berkepenting saja yang dilibatkan oleh pemerintah desa. Oleh karena itu, dalam meningkatkan transparansi pengelolaan dana desa maka sebaiknya pemerintah desa menyediakan informasi yang dapat dengan mudah diakses oleh masyarakat desa serta melibatkan masyarakat dalam setiap proses penggunaan dana desa. Transparency in the use of finance in village government is one of the main factors determining success in village development. However, the existence of village funds can also create new problems in their management. Based on initial observations made by the author, there are several problems that occur in Cendana Hitam Village, the first is regarding village fund budget priorities which are still not implemented optimally, then the second is related to the publication of the village fund budget. This research aims to find out how village funds are managed and how transparent the management of village funds is in Cendana Hitam Village, East Tomoni District, East Luwu Regency. This research uses a qualitative approach with a descriptive research type, with data collection techniques through observation, interviews and documentation. The results of this research show that the management of village funds carried out by the Cendana Hitam Village Government has been carried out based on Permendagri Number 113 of 2014, where the management of village funds includes the planning, implementation and accountability stages have been carried out well. Then, the village government has not implemented the principle of transparency 100% however, transparency has only been 50% where not all communities have been involved in the development planning process up to the handover of development results where only certain communities or people with interests have been involved by the village government. Therefore, to increase the transparency of village fund management, the village government should provide information that can be easily accessed by village communities and involve the community in every process of using village funds.

Abstract

Meninting Dam, constructed in 2019 in West Lombok Regency, is a newly built reservoir that is vulnerable to sedimentation caused by land erosion in its upstream catchment area. This study aims to estimate the erosion rate, sedimentation rate, and predicted service life of the Meninting Dam as a basis for early sediment management planning. Erosion was calculated using the Modified Universal Soil Loss Equation (MUSLE), while sedimentation was estimated using the Sediment Delivery Ratio (SDR) based on the Boyce (1975) method, integrated with spatial analysis using QGIS. The results show that the erosion rate in the Meninting Dam catchment area reaches 884,467.83 tons/year, producing a sedimentation rate of 40,526.39 m³/year and an estimated dam service life of approximately 45 years. These findings indicate that erosion-induced sedimentation poses a significant long-term risk to the storage capacity of the Meninting Dam and highlight the importance of early erosion control and sediment management strategies for newly constructed reservoirs.
