Abstract

Within the realm of religious education and the national educational framework, Diniyah Takmiliyah (DT) stands as a pivotal cornerstone in the nation’s development, preparing future generations with a robust grounding in religious knowledge, profound insight, life skills, and virtuous character, all rooted in a deep understanding of Islamic teachings. Diniyah Takmiliyah Al-Wahdah in Bandung city is not only a prominent exemplar within the city but also within the wider context of West Java and Indonesia. This research endeavors to delve into the Implementation of the Curriculum Management System within the Diniyah Takmiliyah Education at Al-Wahdah Bandung city. Employing a qualitative research approach, this study aims to shed light on the practical application of the curriculum management system in Diniyah Takmiliyah Al-Wahdah Bandung city. Qualitative research, characterized by its inductive nature, primarily seeks to depict and explore. The research methodology entails field research, involving direct data collection in the field. The research subjects, serving as primary data sources, encompass all individuals contributing information necessary for comprehensive data collection. These individuals consist of the Diniyah Head, Teachers, and students, selected through purposive sampling, with the sampling technique employing a snowball sample. The research findings reveal that Diniyah Takmiliyah Al-Wahdah Bandung city stands as a distinguished and paradigmatic institution within Bandung city. In its practical implementation, the institution amalgamates the Diniyah Takmiliyah curriculum with the Islamic Religious Education curriculum of Elementary Schools or Madrasah Ibtidaiyah, seamlessly integrating them within the framework of the curriculum at Diniyah Takmiliyah Al-Wahdah Bandung city

Abstract

This research discusses mixed marriage which is very controversial in society, even though most religions have prohibited the practice of mixed marriage. In Decree No. 454/Pdt.P/2018/PNSKt. The judge allowed the marriage of someone of a different religion, even though the Marriage Law clearly does not regulate and returns to the laws of each religion. HKI (Compilation of Islamic Law) prohibits the practice of interfaith marriage as stated in Article 40 letter c. This study aims to analyze the judge's considerations in granting or rejecting interfaith marriages with the applicable laws in the marriage law and KHI (Compilation of Islamic Law). The research method used is qualitative (library research) with a normative legal approach as an analytical tool to describe existing problems and gain insight. The results of this study indicate that the determination of interfaith marriages in Decision No. 454/pdt.p/2018, it is only the subjectivity of judges in interpreting Article 2 (1) of the Marriage Law and legalizing interfaith marriages which are in stark contrast to the Compilation of Islamic Law which has been in force in the Religious Courts in Indonesia.

Abstract

House sale and purchase transactions in the context of sharia have become a major concern in the development of Islamic economic models that are based on the principles of justice, equality, and compliance with Islamic law. One of the contracts proposed to fulfill these principles is the Musyarakah Mutanaqisah Agreement. This study aims to analyze the application of the Musyarakah Mutanaqisah Agreement on home ownership loans in aster village Islamic housing where the implementation of credit is carried out through a Bank mechanism in this case Bank Syariah Indonesia (BSI). The research method used is a qualitative approach with a case study approach. Data were obtained through interviews with related parties, analysis of transaction-related documents, and review of related literature. The results showed that the implementation of the Musyarakah Mutanaqisah contract in BSI Griya Hasanah financing has two contracts in it (hybrid contract). The first is that banks and customers cooperate (syirkah / musyarakah) to buy an asset, so the musyarakah contract in BSI Griya Hasanah financing is only limited to cooperation in the ownership of an asset. The second is ijarah. The asset that becomes the object of financing is leased (ijarah) to the customer with a rental payment which is assumed to be a profit that will be divided between the bank and the customer according to a predetermined ratio. The profit sharing obtained by the bank will be considered as profit for the bank. Meanwhile, the profit sharing received by the customer is diverted to buy the bank's hishah portion. Not only is there more than one contract, in this BSI Griya Hasanah financing scheme there are also two agreement contracts. The first agreement contract contains the Musyarakah Mutanaqisah contract itself, and the second agreement contract contains ijarah.

Abstract

This study aims to investigate the effect of digital zakat on poverty alleviation in the digital era. In the context of growing digitalization, digital zakat becomes an attractive alternative in the collection and distribution of zakat to help those in need. The research method involves searching and analyzing published literature, including scholarly articles, research reports, and books related to digital zakat and poverty alleviation. The data collected will be analyzed qualitatively by identifying key themes that emerge in the relevant literature. These themes will be used to compile research findings that will provide in-depth insights into the influence of digital zakat in alleviating poverty in the digital era. The results of this study show that digital zakat has significant potential in alleviating poverty in the digital era. One of the main advantages of digital zakat is the ease of access and transparency in the collection and distribution of zakat. Through digital platforms, individuals can easily collect and transfer their zakat directly to needy recipients. This reduces the cost and time involved in the traditional process of zakat collection and distribution. In addition, digital zakat also enables a more inclusive approach in alleviating poverty, with more individuals able to participate in giving zakat. This research contributes to the understanding of the effect of digital zakat on poverty alleviation in the digital era. The findings and recommendations from this research can serve as a guideline for zakat institutions, government, and other related organizations in designing and implementing effective digital zakat. It is hoped that this research can encourage further development and wider application of digital zakat for poverty alleviation in the future.

Abstract

This research discusses the concept of the As-Salam contract in online buying and selling transactions at the Chagiya shop. The As-Salam contract is a form of contract in Islam that has an important role in maintaining the principles of justice and ethics in business. This research aims to analyze the application of the As-Salam contract in the context of online buying and selling at the Chagiya shop, as well as its impact on transaction actors and consumers. Qualitative method with descriptive analysis, this research uses a field approach (Field Research) by making direct observations of the activities carried out by the company. While the data collection techniques in this study used interviews with sellers and buyers at Chagiya Stores and library documentation (Library Research), after the data was collected, data analysis was carried out with several stages, namely data reduction, data presentation and drawing conclusions from what was obtained in this study. The conclusion obtained from this research is that buying and selling with the online system carried out by Toko Chagiya is included in the as-salam system using a written contract via the internet where the as-salam contract can be carried out by the two contract actors who are not in one assembly (place) then applied through pictures of products and types through the Instagram site. Both (contract actors) are brought together on one network site. The Online as-Salam System at Toko Chagiya is concluded that as-salam with an online system is permitted, because it fulfills the pillars and conditions of salam sale and purchase that have been determined by Shara' and fulfills the rules that apply in a transaction. This is reinforced by the opinions of Chagiya Shop buyers regarding the sale of their products, 95% say that the online service is satisfactory, the goods in the picture match the reality, and if there is a mistake from the store, the store is responsible. In addition, in practice, the author concludes that the contract carried out by Toko Chagiya is in accordance with the provisions of Fatwa DSN-MUI No.05/DSN-MUI/IV/2000. Where this online buying and selling does not contain elements that can damage it, such as usury, injustice, fraud and the like.

Abstract

Artikel ini membahas terkait dengan metode penafsiran yang digunakan oleh Hakim dalam memutus perkawinan beda agama. Undang-undang No. 19 Tahun 2019 tentang perubahan atas Undang-undang No.1 Tahun 1974 tentang perkawinan, perkawinan beda agama tidak diatur secara eksplisit sedangkan dalam Kompilasi Hukum Islam melarang praktek perkawinan beda agama, sehingga terjadi disharmonisasi hukum, dan penetapan perkawinan beda agama menjadi subjektifitas Hakim dalam menetapkan perkawinan beda agama. Penelitian ini bertujuan untuk mengetahui metode penafsiran apa yang digunakan oleh Hakim. Metode penelitian yang digunakan adalah penelitian kualitatif (library research) dengan pendekatan hukum normatif. Hasil penelitian menunjukan bahwa penetapan no. 959/Pdt.P/2020/PN Bdg perkawinan beda agama yang dikabulkan menggunakan penafsiran letterlijk. Hakim yang menolak dalam penetapan no. 71/Pdt.P/2017/PN Bla menggunakan pendekatan penafsiran holistic.

Abstract

Pembaharuan hukum keluarga dalam putusan pengadilan agama merupakan fenomena yang terjadi dalam sistem peradilan keluarga di berbagai negara. Penelitian ini bertujuan untuk menganalisis perkembangan terkini dalam pembaruan hukum keluarga dan dampaknya terhadap putusan pengadilan agama. Melalui metode pendekatan penelitian hukum normatif, penelitian ini mengkaji berbagai aspek perubahan hukum keluarga yang telah terjadi dalam beberapa tahun terakhir dan bagaimana hal tersebut mempengaruhi proses pengadilan agama. Penelitian ini mengidentifikasi beberapa isu utama yang menjadi fokus dalam pembaruan hukum keluarga. Pertama, pengakuan terhadap hak-hak individu dan kesetaraan gender dalam konteks pernikahan dan perceraian. Perkembangan hukum keluarga menunjukkan adanya peningkatan kesadaran akan perlunya perlindungan terhadap hak-hak individu yang terlibat dalam proses peradilan keluarga, termasuk hak-hak perempuan. Ini tercermin dalam putusan pengadilan agama yang semakin memperhatikan prinsip-prinsip kesetaraan gender dan keadilan dalam penyelesaian perkara keluarga. Kedua, penyesuaian hukum keluarga dengan perkembangan sosial dan budaya. Masyarakat yang terus berubah membutuhkan regulasi hukum yang mampu menanggapi kebutuhan dan tuntutan baru dalam konteks keluarga. Oleh karena itu, pembaruan hukum keluarga berupaya mengakomodasi perubahan sosial dan budaya, seperti pengakuan terhadap pernikahan sejenis, perlindungan hak anak dalam kasus perceraian, dan pengaturan hak-hak keluarga dalam konteks keluarga maju. Ketiga, penggunaan teknologi dan digitalisasi dalam proses pengadilan agama. Perkembangan teknologi informasi dan komunikasi telah mengubah cara kita berinteraksi dan mempengaruhi berbagai aspek kehidupan termasuk sistem peradilan keluarga. Pembaruan hukum keluarga harus mampu mengikuti perkembangan teknologi untuk meningkatkan efisiensi dan transparansi dalam proses pengadilan agama. Hasil Penelitian menunjukkan pembaruan hukum keluarga juga mempengaruhi putusan pengadilan agama. Pengadilan agama harus mampu mengadaptasi perubahan hukum keluarga dan memastikan bahwa putusan yang dihasilkan sejalan dengan prinsip-prinsip hukum yang baru. Hal ini membutuhkan pemahaman yang mendalam tentang pembaruan hukum keluarga dan kemampuan untuk menerapkannya secara konsisten dalam praktik pengadilan.

Abstract

Child marriage remains a crucial issue in Indonesia and Malaysia even though both countries have laws restricting it. This study aims to analyze the dynamics of child marriage in the perspective of legal anthropology, focusing on the interaction between local traditions and Islamic legal regulations. Through a qualitative approach and literature study, this study found that the root of the problem of child marriage lies not only in economic and educational factors, but also in the strong influence of old-fashioned social, cultural, and religious norms that are often dialectic with formal law. In Indonesia, the existence of Law No. 16 of 2019 has not been fully effective due to the high number of marriage dispensation applications and the strong practice of elopement such as merariq. In Malaysia, state autonomy in Islamic family law creates regulatory variations and complexities in handling child marriage. This study concludes that a holistic approach through strengthening the role of religious courts, economic empowerment, inclusive education, and campaigns involving religious and customary leaders are key in breaking the chain of child marriage.

Abstract

Child marriage is still a serious problem in Indonesia, including Cirebon Regency which records hundreds of marriage dispensation applications every year. This practice has a negative impact on children's rights, educational continuation, reproductive health, and the quality of human resources to deal with the demographic bonus. This Community Service activity aims to improve legal knowledge and reproductive health, change attitudes towards child marriage, and encourage the formation of an Anti-Child Marriage Village Forum in Ciwaringin District. The program will be carried out in July-September 2025 by involving 45 participants (teenagers, parents, community leaders, village cadres) through a participatory and collaborative approach. The stages include initial observation, training and workshops, project-based campaigns, village forum formation, and evaluation. Data were collected by pre-post questionnaires, observations, in-depth interviews, and photo/video documentation. The results of the evaluation showed a significant increase in legal knowledge (54.3 → 82.7), knowledge of reproductive health (48.5 → 79.1), and attitudes in support of child marriage postponement (61.2 → 83.9). The participation rate reached >90%, with the active involvement of PKK teenagers and mothers in the production of posters, leaflets, digital content, and the establishment of village forums through the Village Head Decree. This activity concluded that community-based reproductive health and legal education is effective in improving community knowledge and attitudes and triggering local leadership for child marriage prevention advocacy, although real behavioral change requires sustained cross-sectoral interventions.

Abstract

The adoption of children from extramarital relationships is a complex legal issue because it involves legal, social, and religious dimensions at the same time. This study aims to analyze the comparison of the regulation of adoption of children out of wedlock in Islamic law and positive law in Indonesia, especially related to the legal status of children, civil relations, and the implications of their rights. This research uses a normative-juridical approach with a comparative legal method, through an examination of laws and regulations, court decisions, fatwas, as well as relevant Islamic law and national law literature. The results of the study show that in Indonesia's positive law, children out of wedlock can obtain a civil relationship with their biological father as long as it is scientifically proven and determined through legal mechanisms, but does not automatically obtain inheritance rights from adoptive parents except through grants or mandatory wills. Meanwhile, Islamic law views the adoption of children in the form of kafālah, which emphasizes the parenting aspect without changing the child's nasab, inheritance rights, and marital status. The difference in principle between the two legal systems poses normative challenges in the practice of child protection, so an integrative approach is needed that is able to ensure the best interests of children without ignoring Islamic sharia values. This research contributes by offering a conceptual framework for harmonization between Islamic law and national law in the regulation of out-of-wedlock child adoption based on the protection of children's rights.
