Abstract

Tujuan dari perkawinan adalah membentuk keluarga yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha esa, namun dewasa ini banyak perkawinan yang tidak berjalan baik sebagaiman tujuan dari perkawinan sehingga banyaknya yang mengajukan gugatan perceraian. Dalam menangani perkara perceraian hakim wajib untuk memberikan ruang kepada para pihak untuk dapat melakukan proses mediasi sepanjang pemeriksaan perkara hal tersebut sesuai dengan Perma No.1 Tahun 2016  Tentang Prosedur Mediasi Di Pengadilan. Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan para pihak dengan di bantu oleh mediator. Mediasi bertujuan untuk menyelesaikan sengketa secara damai yang tepat, efektif dan dapat membuka akses yang lebih luas kepada para pihak untuk memperoleh penyelesaian yang memuaskan serta berkeadilan

Abstract

Pluralisme hukum merupakan karakter fundamental dalam sistem hukum Indonesia yang terbentuk dari sejarah panjang interaksi antara adat, agama, dan negara. Salah satu bidang hukum yang memperlihatkan dinamika pluralisme tersebut adalah hukum kewarisan. Dalam praktik kewarisan di Indonesia, masyarakat tidak hanya tunduk pada satu sistem hukum yang bersifat tunggal dan seragam, melainkan berada dalam persimpangan tiga rezim hukum utama, yaitu hukum adat, hukum Islam, dan hukum nasional. Ketiga sistem hukum ini hidup berdampingan, saling berinteraksi, saling memengaruhi, bahkan tidak jarang saling berkompetisi dalam menentukan mekanisme pembagian harta warisan. Tujuan dari penelitian ini adalah mengkaji serta menganalisis secara komprehensif dinamika pluralisme hukum dalam sistem waris adat di Indonesia dengan menitikberatkan pada dialektika antara hukum adat, hukum Islam, dan hukum nasional. Fokus kajian diarahkan pada bagaimana ketiga sistem hukum tersebut beroperasi dalam praktik, bagaimana konflik dan kompromi hukum terjadi, serta bagaimana peran negara dalam mengelola pluralisme hukum agar tetap menjamin kepastian hukum dan keadilan substantif. Penelitian ini menerapkan metode hukum normatif yang mengadopsi pendekatan terhadap undang-undang serta konsep-konsep yang relevan, historis, dan sosiologis. Hasilnya menunjukkan bahwa pluralisme hukum dalam kewarisan adat tidak selalu bermakna konflik normatif semata, melainkan juga mencerminkan proses adaptasi sosial dan pencarian keadilan kontekstual oleh masyarakat. Namun demikian, lemahnya harmonisasi regulasi, perbedaan penafsiran hakim, serta belum adanya kodifikasi hukum kewarisan nasional yang komprehensif seringkali menimbulkan ketidakpastian hukum. Oleh karena itu, diperlukan pembaruan hukum kewarisan yang responsif terhadap realitas pluralisme hukum dengan menempatkan nilai keadilan, kemanfaatan, dan kepastian hukum secara seimbang.

Abstract

As a tradition that has been practised for a long time, waqf or endowment is clear evidence that Muslims in Indonesia are developing through this worship. However, what if the waqf is in the form of a mosque, Islamic school, and grave (3M’s waqf). It is an unusual thing in the contemporary Islamic tradition, but its existence persists. Meanwhile, 'Urf as one of the legal propositions in establishing Islamic law has known the concept and has been practised for generations in suburban areas where most of the population is Muslim. This tradition is then accommodated in Law Number 41 of 2004 concerning endowment, which contains land endowment and endowment organiser (nazhir). This paper examines the tradition of endowment in Indonesian society to benefit mosques, Islamic schools, and graves. By using the historical and analytical-conceptual approaches, this paper will analyse waqf in these three forms. The results of this study can be taken into consideration by stakeholders in developing strategies for strengthening and empowering 3M's donated land to create benefits for the Indonesian since 3M’s endowment is commonly found in Indonesian society.

Abstract

Until now, palm oil plantations remain the largest contributor to the Indonesian economy, accounting for 75% of exports of plantation products. The area of ​​oil palm plantations has now reached 16.01 million hectares, with 53.57% of it controlled by large private companies. To support the economic growth of Indonesian society as a whole, the government, through the Minister of Agriculture Regulation No. 26 of 2007, has made it mandatory for Palm Oil Plantations to allocate 20% of the total land they manage for the community (Inti-Plasma). Unfortunately, this goal cannot be realized optimally due to unbalanced cooperation. The community must bear the debt for the costs of building the garden along with the interest. This research aims to provide an alternative agreement model other than the existing agreement so that the community or oil palm plantation business actors have a choice of agreement model. The research method used is normative legal research, namely research whose sources come from documents in the form of statutory regulations, court decisions, contracts/agreements, legal theory, and scholars' opinions. The results of this research conclude that the Muzaaroah/Mukhobaroh Agreement and Musaqoh Agreement models are more profitable for the community because they do not use a debt and interest system in their cooperation patterns and provide more certainty and benefits. After all, profit sharing is calculated based on their respective roles and burdens. This research will influence the choice of agreement model used by Plasma farmers in establishing Inti-Plasma partnerships, shifting from a debt-and-interest-based model to one based on profit-and-loss sharing.

Abstract

The concept of the people’s economy developed by Mohammad Hatta is relevant to the principles of Islamic economics, as both emphasize public welfare, justice, social benefit, and the principle of family-based economic organization as fundamental foundations of economic life. This study aims to examine Mohammad Hatta’s thoughts on the people’s economy, particularly the factors underlying its development and the Islamic philosophical values embedded within it. This study employs historical and Islamic philosophical approaches. The historical approach is used to trace the development of Mohammad Hatta’s ideas on the people’s economy by examining his family background, education, Minangkabau traditions, religious life, and the influence of European intellectual traditions. Meanwhile, the Islamic philosophical approach is employed to analyze Islamic values related to welfare, justice, and public benefit based on the principles of Sharia. The findings indicate that, historically, Mohammad Hatta’s concept of the people’s economy was influenced by his family and educational background, Minangkabau traditions, religious values, and the development of European economic thought. From the perspective of Islamic philosophy, the people’s economy is consistent with the principles of welfare, justice, and public benefit oriented toward the interests of society as a whole. Therefore, Mohammad Hatta’s concept of the people’s economy has philosophical relevance to the principles of Islamic economics, particularly in establishing an economic system that promotes justice, public benefit, and the welfare of society.
