Abstract

This paper's legal review will discuss how to understand the Russian invasion in 2022 from the point of view between self-defense and disobedience to international law. To discuss the above theme, we conducted a series of data source searches on some scientific publications, global politics, international law, and the mass media that seriously discuss the racial conflict with Ukraine. This study uses a phenomenological approach, which is trying to understand international events, complete with the questions of this study. We found information and supporting data by searching on the Google engine or electronically and continued with data analysis with an in-depth evaluation and concluding relevant to the topic of discussion. So, based on the evidence from international reports, we can conclude that international law history on Russia's attack on Ukraine in 2022 is a violation of international law. However, when viewed from a country's defense, its existence, and openness to foreign powers in a neighboring country. Russia, then this is a threat to the safety of secrets in the future.

Abstract

The mandatory Polymerase Chain Reaction (PCR) testing continues to be an interesting issue for many people. So the legality of the polymerase chain reaction test for local airline passengers is interesting for us to study. The data for this study were derived from secondary data from various journals and related literature readings that we obtained electronically. Then we explore as deeply as possible to understand the question and purpose of this study. So we also conducted a study through the evaluation system and data coding to draw valid conclusions and have high reliability. Sources of publication data include international and national journals. Based on the discussion of the findings, we can summarize that the regulatory status of mandatory testing for prospective passengers often changes, both in terms of price and legality, and other conditions. So along with this study, we report that there are still changes and the legal status of mandatory testing or not for prospective domestic passengers. It is hoped that this study will be helpful in the development of legal studies and business legality of PCR in Indonesia.

Abstract

This study discussed the duties and roles of the legal apparatus, especially the Police, in handling criminal cases and courts against perpetrators of criminal acts. We manage this study with a phenomenological approach that we design in a qualitative study and rely on secondary data, namely data in the form of scientific evidence that has been published in several literature sources, books, and scientific papers of academic work that were released between 2010 and 2022. As for the mechanism of our study, we carried out extensive data coding techniques, thorough evaluations, and data interpretation to obtain findings that would answer the problems and hypotheses of this study with the principles of high validity and reliability. From the results of the study and discussion of the findings, we can conclude, among other things, that the duties of the Police are based on Article 13 of Law no. 2 of 2002 that the Police are law enforcement, citizen protection, and community service. Meanwhile, the understanding of jurisdiction is an authority possessed by the Police in forcing citizens to obey the criminal Law to uphold justice for the power and authority of state law towards citizens and other aspects. Thus, these findings are intended to be an additional important input for understanding legal and Police studies in future studies.

Abstract

Many things happened after the collapse of the New Order government in Indonesia. Reform necessitated a change in the constitution so that, in the end, the direction of national development also changed. Where previously it was the Outlines of State Policy, now it is formulated in law through the National Development Planning System. This study aims to find out and analyze the implementation of development by the central and regional governments according to Law Number 25 of 2004 concerning the National Development Planning System. The normative research method analyzes law, legal principles, legal rules, legal systems, and various juridical concepts. The data needed in this writing is secondary data as the main data and primary data as supporting data—legal materials, namely data obtained from literature studies, archives, and library materials. The study results show that the SPPN Law is even more appropriate and follows the constitutional mandate. This law is consistent as a reference for planning. Then it accommodates guidelines for regularly planning, compiling, establishing and evaluating long and medium-term development policies. Furthermore, the basis for implementing development planning is determined by legal products that are formally regulated and stipulated by hierarchical laws and regulations.

Abstract

There have been many sharp criticisms regarding law enforcement by law enforcement officials where small cases that could be resolved through peaceful efforts ended up in court. In 2020, the Attorney General issued Prosecutor Regulation Number 15 of 2020 concerning termination of prosecution. It is necessary to pay attention to the legal certainty aspect of the regulation when it is implemented. This study aims to analyze the aspect of legal certainty in the Prosecutor's Regulation Number 15 of 2020 concerning termination of prosecution based on restorative justice. Study this law uses a normative juridical approach Statutory Approach, the "statuta approach", and Conceptual Approach, the "conceptual approach". The results of the study concluded thatThe aspect of legal certainty lies in the guidelines that have been made by determining and limiting the requirements and implementation of termination of prosecution based on restorative justice. Service Regulation Number 15 of 2020 was made to support law enforcement with legal certainty, where restorative justice is given a clear, firm and comprehensive legal basis.
