Abstract

Abstrak Perjanjian jaminan fidusia merupakan salah satu instrumen hukum yang banyak digunakan dalam praktik pembiayaan di Indonesia untuk memberikan kepastian dan perlindungan hukum bagi para pihak, khususnya kreditur dan debitur. Pengaturan mengenai jaminan fidusia diatur dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia, yang memberikan hak preferen serta kekuatan eksekutorial kepada kreditur. Namun, dalam praktiknya, pelaksanaan eksekusi jaminan fidusia sering menimbulkan permasalahan, terutama terkait tindakan sepihak oleh kreditur yang berpotensi merugikan debitur. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi kreditur dan debitur dalam perjanjian jaminan fidusia serta mengkaji implikasi perubahan hukum setelah adanya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, serta menggunakan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi kreditur terletak pada hak preferen dan kekuatan eksekutorial sertifikat jaminan fidusia, sedangkan perlindungan bagi debitur diwujudkan dalam hak atas penggunaan objek jaminan serta perlindungan dari tindakan sewenang-wenang. Putusan Mahkamah Konstitusi telah mengubah mekanisme eksekusi jaminan fidusia dengan menekankan pentingnya kesepakatan wanprestasi dan penyerahan sukarela objek jaminan, sehingga menciptakan keseimbangan perlindungan hukum antara kreditur dan debitur. Dengan demikian, dapat disimpulkan bahwa perlindungan hukum dalam perjanjian jaminan fidusia telah mengalami perkembangan ke arah yang lebih adil, meskipun masih diperlukan penyempurnaan regulasi dan peningkatan pemahaman hukum masyarakat agar implementasinya berjalan efektif. Kata kunci: perlindungan hukum, jaminan fidusia, kreditur, debitur, eksekusi jaminan.   Abstract Fiduciary guarantee agreements are a legal instrument widely used in financing practices in Indonesia to provide legal certainty and protection for parties, particularly creditors and debtors. Fiduciary guarantees are regulated by Law Number 42 of 1999 concerning Fiduciary Guarantees, which grants preferential rights and executorial powers to creditors. However, in practice, the execution of fiduciary guarantees often raises issues, particularly related to unilateral actions by creditors that could potentially harm the debtor. This study aims to analyze the forms of legal protection for creditors and debtors in fiduciary guarantee agreements and examine the implications of legal changes following Constitutional Court Decision Number 18/PUU-XVII/2019. The research method used is normative legal research with a statutory, conceptual, and case-based approach, utilizing primary and secondary legal materials. The results indicate that legal protection for creditors lies in the preferential rights and executorial powers of the fiduciary guarantee certificate, while protection for debtors is realized in the right to use the collateral and protection from arbitrary actions. The Constitutional Court's ruling has transformed the fiduciary guarantee enforcement mechanism by emphasizing the importance of default agreements and voluntary surrender of the collateral, thus creating a balance of legal protection between creditors and debtors. Thus, it can be concluded that legal protection under fiduciary guarantee agreements has evolved towards fairer outcomes, although regulatory refinements and increased public legal understanding are still needed for effective implementation.Keywords: legal protection, fiduciary guarantee, creditors, debtors, guarantee enforcement.

Abstract

This study explores the relationship between national defense capability, defense economics, and economic stability in Indonesia’s development context. Defense and economic development are closely linked and essential for maintaining national sovereignty and prosperity, particularly amid globalization and complex geopolitical dynamics. Using a literature review and meta-analysis, the study examines how defense capability and defense economics interact to influence economic stability and growth. The findings indicate that stronger defense capability supports the defense economy, which in turn contributes to overall economic stability. However, this relationship is not linear and depends on factors such as government policy, R&D investment, domestic industrial capacity, and geopolitical conditions. Technological innovation and defense industry development are also identified as key drivers of growth and resilience to external shocks. The study provides insights for policymakers and industry stakeholders to strengthen synergy between defense and national economic development.

Abstract

Abstract The development of information systems cannot be separated from the rapid progress of information technology and the internet. At present, this has changed the paradigm in busi­ness processes and policy making. Higher education institutions are no exception starting to use internet-based information systems as an alternative in the process of its activities. However, only few research has discussed the effect of online academic systems on student satisfaction. This study aims to analyse the effect of system quality, information quality and online service quality siakad on student satisfaction. Data were obtained by survey method of 255 students of the Indonesian Tourism Academy (AKPINDO) Jakarta with multiple linear regression methods. The results of the study revealed that the quality of academic information systems had no effect on student satisfaction, while information quality and service quality significantly affected student satisfaction. Simultaneously the quality of the system, information and services affect the satisfaction of students.

Abstract

This research aims to determine the process of making banana cake with the substitution of sugar with date juice and to determine the level of people's preference for banana cake with the substitution of date juice. The method used is the experimental method. Researchers used this method to add date juice and reduce granulated sugar. The results of the research show that the process or method for making banana cakes with date juice substitution is the same as making banana cakes in general, the only difference is that there is a date juice substitution in each dough. The test results of respondents' preferences for banana cake with date juice substitution were based on four criteria, namely aroma, color, taste and texture. In terms of aroma and taste, products with 25% substitution are preferred, while in terms of color and texture, products with 70% substitution are preferred. Improving the quality and increasing nutritional value of banana cake, such as increasing vitamins, minerals and fiber, could have positive implications for consumers looking for healthy cakes.

Abstract

The background of this research was carried out because coconut meat has good nutritional content as a source of food nutrition which is important for providing health benefits and providing new innovations from kue lumpur. Kue lumpur is a typical Indonesian snack originating from Sidoarjo, East Java. Kue lumpur is made from the main ingredients, potatoes, flour, sugar, coconut milk and egg to produce the characteristic of a kue lumpur that is smooth and soft. The purpose of this study was to obtain the best ratio of coconut flour substitution to the characteristics of kue lumpur and to find out the level of public liking and acceptance of kue lumpur. This research uses literature study, questionnaire and observation. The results of the research that has been done have the characteristics obtained from kue lumpur with a 20% substitution of coconut flour with aroma scores (3.6), color (3.8), taste (3.86), texture (3.78) and an overall score of 15.04, because it doesn’t use too much coconut flour which has quite coarse particles, so it doesn’t change to much in terms of aroma, color, taste and texture of the kue lumpur.
