Abstract

This study examines the social dynamics of public road use using Max Weber's social action perspective. The regulation in Article 274 of Law Number 1 of 2023 is the main focus because it regulates the holding of parties or crowds on public roads without permission. This study uses a qualitative method based on library research, by reviewing legal and sociological literature to understand public behavior in public spaces. The results show that public road use is not only influenced by formal rules, but also by subjective meanings reflected in Weber's four types of social action: instrumental rational, value rational, affective, and traditional. Public roads are often used beyond their intended function, such as for private events or parties, which can disrupt road function, cause congestion, and even accidents. Legal regulations exist to regulate these dynamics, but their effectiveness depends on public social awareness. This study emphasizes that regulating public road use requires both a legal and sociological approach to create order, safety, and harmony in public spaces.

Abstract

The development of digital technology has had a significant impact on the patterns and structure of the modern workforce. Conventional work systems that rely on physical presence in the office are now shifting towards flexible, digitally-based work patterns, such as freelance or the gig economy. This study aims to analyze the transformation of the workforce in the digital era, the driving factors behind the shift from office workers to freelance workers, and to examine this phenomenon through the theory of social change. The method used is descriptive qualitative research with a literature study approach. The results of the study indicate that technological changes, time flexibility, and the need for work autonomy are the main factors driving this shift. Based on the theory of social change, this phenomenon represents a form of societal adaptation to technological advancements and the demands of globalization. The government is expected to develop digital employment policies to ensure the welfare of freelance workers.Thus, the transformation of the world of work in the digital era is not merely a technical change, but also reflects a shift in the social paradigm in understanding productivity, careers, and well-being. The government and relevant institutions are expected to be able to formulate inclusive, adaptive, and sustainable digital labor policies so that the welfare and social protection of freelance workers can be ensured fairly and equitably.

Abstract

This paper aims to present an analysis of bullying that occurs in adolescents using the perspective of symbolic interactionism. The perspective focuses on social interaction, process, and meaning construction. This paper also discusses the complexity of bullying issues sociologically. The definition of bullying eventually becomes dynamic and is influenced by the process of observers in seeing the social interactions that occur. The factor of bullying becomes a crucial variable to fully understand the occurrence of bullying in adolescents. This paper uses qualitative research with a phenomenological approach with purposive sampling technique.

Abstract

Compliance with traffic laws is a key indicator in ensuring order and safety on the roads. Traffic violations continue to occur in various regions, including Aceh Tenggara, particularly among Generation Z. This generation is characterized as dynamic, critical of authority, and highly influenced by social media in shaping their perceptions and behaviors. This phenomenon indicates that repressive law enforcement approaches are no longer fully effective without the support of social legitimacy toward authorities and law enforcement actions. This study aims to analyze the influence of perceived police legitimacy on traffic law compliance among Generation Z. Police legitimacy is understood as the public’s trust in the authority of law enforcement officers to uphold the law fairly, with integrity, and transparently. This research employs a qualitative approach grounded in the social constructivism paradigm of Peter Berger and Thomas Luckmann to understand how social reality is constructed through interactions between individuals and authoritative institutions. The findings show that perceptions of police legitimacy significantly influence compliance levels. Thus, the study affirms that social legitimacy cannot be built solely through formal authority and sanctions, but also through humanistic communication, equitable services, and the presence of officers who embody moral exemplarity within society.

Abstract

Asset confiscation serves as an instrument of social control to eliminate unlawfully obtained profits while simultaneously redressing institutional losses. However, in practice, significant discrepancies often arise between prosecutors' demands and judges' decisions. In a number of decisions, prosecutors consider that the evidence linking assets to the crime has not been met and therefore demand that the assets be returned to the defendant, while judges use judicial discretion to confiscate and return the assets to the victim, based on considerations not fully revealed in the formal evidentiary process. Conversely, there are also cases where prosecutors demand confiscation of assets because they are considered the proceeds or means of a crime, but judges decide differently, rejecting the confiscation because they consider that there is insufficient evidence or a strong causal relationship between the assets and the crime charged. Through a sociology of law approach and jurisprudential analysis, this study finds that this discrepancy is a manifestation of a conflict of authority between two centers of authority in the criminal justice system. Abstract

The rapid development of information technology has transformed conventional buying and selling transactions into e-commerce platforms. This shift has not only changed business models but has also fundamentally reshaped the legal relationship between consumers and business actors. This study aims to analyze the impact of technological development on the legal relationships between parties in e-commerce transactions by employing a sociology of law approach, particularly Eugen Ehrlich’s Living Law theory. The study uses a juridical-sociological method to observe how norms that emerge and evolve within the e-commerce ecosystem such as Terms of Service (ToS), rating and review mechanisms, and the platform’s internal dispute resolution systems function as a form of “living law.” Ehrlich’s theory is applied to examine the gap between state law such as the Consumer Protection Act and the Electronic Information and Transactions Act (ITE Law) and the actual practices and norms adhered to by the e-commerce community. The findings of this research are expected to demonstrate that the living law created by platforms (platform governance) often has a more direct and effective influence in regulating behavior, building trust, and resolving disputes than state positive law.

Abstract

The waste problem is an increasingly complex environmental issue as human activities and needs increase. Although there is a legal basis governing waste management, such as Law Number 18 of 2008 and Medan City Regional Regulation Number 6 of 2015, its implementation remains ineffective. This is evidenced by the continued prevalence of violations such as indiscriminate waste disposal, which causes environmental pollution, declining public health, and ecosystem damage. This study uses a normative juridical method to analyze the application of the law, the effectiveness of sanctions, and obstacles to enforcing regulations related to waste disposal in Medan City. Based on the study, low public awareness, weak supervision, and inconsistency in law enforcement are the main factors hindering the success of waste management. Preventive and repressive efforts need to be strengthened through education, firm supervision, and the implementation of effective sanctions in accordance with the concept of Living Law. Thus, collaboration between the government and the community is key to realizing a clean, healthy, and sustainable environment.

Abstract

This study aims to analyze the sociological implications of law concerning the application of road closure permits, utilizing the theory of law as a tool of social engineering as proposed by Roscoe Pound. While road closures are sometimes necessary for construction or specific events, they often result in significant social impacts. Through a sociological legal approach, this research examines how the law can be effectively used to balance public and individual interests in the context of road closures. Case studies are conducted to understand how this theory is applied in practice and its impact on society.

Abstract

This study aims to analyze legal protection for the rights of female workers in Indonesia through the perspective of Max Weber's Social Conflict Theory, which emphasizes the dimensions of class, status, and power. Normatively, various laws and regulations have provided a basis for protection, but their implementation still faces structural obstacles. This normative-sociological juridical research uses a conceptual and legislative approach with qualitative analysis of secondary data in the form of regulations and case studies. The results show that employment relations are still dominated by power imbalances between capital owners and female workers, which are reinforced by a patriarchal culture. In the class dimension, employers often avoid compliance costs, making female workers vulnerable to economic exploitation. In the status dimension, patriarchal norms weaken legal protection against discrimination, harassment, and maternity rights. Violations of maternity rights, wage and promotion discrimination, and high levels of sexual harassment reflect social conflicts resulting from economic domination and status, so that formal legal protection has not been substantively realized. This study concludes that the weak protection of female workers is not only due to legal implementation, but also to structural power imbalances.

Abstract

Online Gender-Based Violence is a form of cybercrime that has significantly increased in Indonesia and presents complex challenges for the national legal system. This issue is not only related to regulatory and law-enforcement aspects but also to social constructs influenced by cultural norms and patriarchal gender relations. In this context, a socio-legal study is needed to understand how social processes shape the meanings of “crime” and “victim” in OGBV cases and how these meanings affect criminalization and legal handling. This research aims to analyze the social construction of cybercrime, particularly OGBV, through the perspective of Berger and Luckmann’s social constructivism theory. The study employs a qualitative approach with a sociological-juridical method through legal document analysis and media discourse studies. The analysis examines how interactions among society, the media, and legal institutions influence the interpretation of perpetrators and victims within the context of gender-based digital violence. The findings show that the criminalization of OGBV perpetrators is not solely based on juridical aspects but is also a product of social constructions shaped by patriarchal values and gender bias. Responses to victims still face obstacles such as victim blaming and the low gender sensitivity of law-enforcement officers. In conclusion, law serves a dual function as both a product and an instrument of social construction. Therefore, gender-sensitive legal policies grounded in a constructivist perspective are needed to achieve substantive justice for OGBV victims.
