Abstract

Penelitian ini bertujuan untuk mengkaji secara menyeluruh mengenai relevansi konsep hukum Islam Kaidah Al-Yaqīnu Lā Yuzālu bi al-Syakk dengan Asas Kepastian Hukum dalam hukum nasional serta untuk mengetahui bagaimana implementasinya dalam kehidupan hukum terutama dalam Yurisprudensi atau putusan pengadilan. Metode pendekatan yang digunakan dalam penelitian ini yaitu pendekatan kualitatif-deskriptif dan pendekatan induktif melalui analisis isi (content analysis) dengan jenis penelitian kepustakaan. Hasil dari penelitian ini menjelaskan antara konsep Kaidah Al-Yaqīnu Lā Yuzālu bi al-Syakk dengan Asas Kepastian Hukum menunjukkan banyak kesamaan: keduanya berfokus pada penetapan hukum yang kuat, menghindari spekulasi, dan menuntut pembuktian yang kuat yang berguna dalam praktik hukum positif Indonesia, bukan hanya dalam teori fiqh. Relevansi Kaidah Al-Yaqīnu Lā Yuzālu bi al-Syakk dengan Asas Kepastian Hukum dalam kehidupan hukum dibuktikan dengan Putusan Mahkamah Agung Nomor 42 PK/Pid/2006 yang mengkonfirmasi bahwa saat adanya keraguan dalam pengambilan keputusan, Hakim harus berpegang pada keyakinan hukum yang kuat. Relevansi tersebut menunjukan bahwa prinsip-prinsip hukum islam dapat bekerja sama dengan hukum nasional dalam upaya menegakkan hukum untuk tercapainya keadilan substansif serta kepastian hukum.

Abstract

The Joint New Student Admission System (PPDB Bersama) was introduced by Jakarta's Provincial Education Office to expand equitable access to quality education for economically vulnerable students through government-private school collaboration. Despite its equity goals, implementation faces administrative, technical, and organizational challenges. This qualitative case study analyzes policy implementation at three private senior high schools in West Jakarta using Edward III's framework: communication, resources, disposition, and bureaucratic structure. Data were collected through interviews, focus group discussions, and document analysis involving principals, staff, teachers, and students. Findings reveal that communication remains inconsistent due to fragmented policy dissemination and limited parental understanding; human and technological resources are adequate but constrained by verification procedures and system instability; implementers demonstrate strong commitment to supporting vulnerable students, though the no-transfer policy creates unintended disciplinary issues; and bureaucratic procedures follow official guidelines but are hindered by rigid quotas and limited school-level autonomy. The study concludes that while PPDB Bersama enhances educational equity, its effectiveness requires strengthened socialization, improved cross-agency coordination, flexible resource allocation, and adaptive bureaucratic mechanisms. Strategic recommendations are proposed to optimize policy performance and reinforce private schools' role in achieving equitable and inclusive education in Jakarta.

Abstract

The Independent Curriculum was designed as a strategic response to create flexible learning to optimize students' interests and talents. However, its implementation at the elementary school level still faces various complex obstacles that prevent students from maximizing their potential. This study aims to analyze the challenges of implementing this curriculum through a qualitative approach using a literature review method, which examines secondary data from various scientific literature and relevant documents. The research findings outline three fundamental obstacles. First, the limited availability of resources and technology-based learning media, which reduces the effectiveness of the knowledge transfer process. Second, the imbalance in school readiness, including disparities in facilities between urban and remote areas, and variations in teacher competency in adapting new pedagogical methods. Third, the lack of parental support and understanding of this educational paradigm, which leads to a lack of synergy between the learning environment at school and at home. Based on this analysis, it is concluded that the success of the Independent Curriculum does not depend solely on regulations but rather requires integrative collaboration between the government, schools, and parents to create a conducive educational ecosystem for the realization of independent and creative student profiles. ABSTRAKKurikulum Merdeka dirancang sebagai respons strategis untuk menciptakan pembelajaran yang fleksibel guna mengoptimalkan minat dan bakat peserta didik. Kendati demikian, implementasinya di tingkat sekolah dasar masih dihadapkan pada berbagai hambatan kompleks yang menghalangi penguatan potensi siswa secara maksimal. Penelitian ini bertujuan untuk menganalisis problematika penerapan kurikulum tersebut melalui pendekatan kualitatif dengan metode studi kepustakaan, yang mengkaji data sekunder dari berbagai literatur ilmiah dan dokumen relevan. Temuan penelitian menguraikan tiga kendala fundamental. Pertama, keterbatasan ketersediaan sumber daya dan media pembelajaran berbasis teknologi yang mengurangi efektivitas proses transfer ilmu. Kedua, ketimpangan kesiapan sekolah yang mencakup disparitas fasilitas antara wilayah perkotaan dan daerah terpencil, serta variasi kompetensi guru dalam mengadaptasi metode pedagogik baru. Ketiga, minimnya dukungan dan pemahaman orang tua terhadap paradigma pendidikan ini, yang menyebabkan kurangnya sinergi antara lingkungan belajar di sekolah dan di rumah. Berdasarkan analisis tersebut, disimpulkan bahwa keberhasilan Kurikulum Merdeka tidak hanya bergantung pada regulasi, melainkan menuntut kolaborasi integratif antara pemerintah, sekolah, dan wali murid untuk menciptakan ekosistem pendidikan yang kondusif demi terwujudnya profil pelajar yang mandiri dan kreatif.

Abstract

This community service research aims to optimize the role of local leaders and the Village Head in strengthening community-based tourism education in Malaus Village. The initiative responds to the limited tourism literacy among residents and the lack of effective coordination within local leadership in developing the village dam as both an educational and recreational site. Using a descriptive qualitative approach, data were collected through participatory observation, in-depth interviews, and documentation involving the village head, RT/RW leaders, fish-cage managers, youth groups, and community members as key informants. The findings reveal that local leaders act as social facilitators who successfully mobilize community participation, while the Village Head provides policy legitimacy and structured direction for tourism development. Student involvement serves as a catalyst that enhances practical educational activities, including site cleaning, environmental arrangement, and digital content training for local youth. The results indicate that the success of tourism education is strongly influenced by active local leadership, community social capital, and synergy among village stakeholders.
