Abstract

Chemical castration is a punishment against pedophiles, who have committed acts of crime that are considered an extraordinary crime. Pedophiles have ruined the future of children, with tremendous psychological and environmental impacts. This paper aims to uncover the problems of fiqh in Indonesia concerning chemical castration which has the aim of providing a deterrent effect for rape perpetrators of children. The data collection method in this study uses the literature study. There are differences in the views of legal experts with doctors. Legal experts decide on penalties for pedophiles with Law Number. 17 of 2016 concerning the Second Amendment to Law Number. 23 of 2002 concerning Protection of Children, while the Indonesian Doctors Association states reject chemical castration punishment, following the Code of Ethics as stated in the rules of the Medical Code of Ethics Assembly (MKEK) Number. 1 of 2016 concerning Chemical Castration. Fiqh experts disagree over the castration penalty for chemistry. There is no castration punishment in the fiqh, because the Prophet Muhammad forbade castration, as opposed to Islamic principles. Some fiqh experts agree that chemical castration punishment includes ta'zīr, which is a sentence handed over entirely to the legitimate government. Thus, although the castration chemical punishment has been determined, in its implementation there are problems because there are still rejections and problems according to the fiqh expert

Abstract

developing science in North Sumatra, then researchers will look at the role of educational institutions in the development of Islam in North Sumatra. And then the researcher wants to know the influence of Ulama in calling Social changes that occur in the people of North Sumatra. The method used in this research is descriptive qualitative research, which aims to understand social problems, events, the role of interaction and community groups. The qualitative approach is used by focusing on the social conditions surrounding the existence of the Ulama who lived in his day, which became the basis in compiling the historical events of the ulama network in the development of Islam in North Sumatra in the XX century. The results of this study are First, the scientific network among fellow North Sumatra scholars is very good, it shows from the shape of the education system. This can be seen in the connection with his teachers in the Middle East. Secondly, the role of Isl?mic boarding schools Musthafawiyah and Maktab Islamiyah is very important, including as a producer of scholars in North Sumatra and a center for the study and development of Islamic Law studies in the midst of society. Third, the Ulema continue to maintain Islamic treasures as a source of answering all problems of social change. As the second answer emphasizes, one of the central roles of the pesantren is to become a center for the study of Isl?mic law studies. Keywords: ulama network, Sumatera, development, the 20th century

Abstract

Abstract: The development of Islamic boarding schools and madrasas in Indonesia cannot be separated from the political education policy of the government that is currently in power. Through a literature study, this study intends to reveal how the form of education politics carried out by the government towards these two institutions. The theoretical debate on education politics during the Old Order begins the explanation of this study. Then, the debate during the New Order is discussed, and the debate related to the Reformation era is discussed after that. This study illustrates that despite the politicization of Islamic boarding schools and madrasas, these indigenous Indonesian educational institutions must be preserved and their development should be considered. Furthermore, Islamic boarding schools and madrasas are important indicators for the progress of the religion and the nation. By looking at the realities of advanced education today, Islamic boarding schools and madrasas are a reflection of the superiority of scientific, intellectual, and cultural achievements. The government as a policymaker should provide full political support so that Islamic boarding schools and madrasas can compete at the world level.الملخص: لا يمكن فصل تطوير المدارس الداخلية الإسلامية والمدارس الدينية في إندونيسيا عن سياسة التعليم السياسي للحكومة التي تتولى السلطة حاليًا. تهدف هذه الدراسة ، من خلال دراسة أدبية ، إلى الكشف عن شكل السياسة التربوية التي تنفذها الحكومة تجاه هاتين المؤسستين. سيبدأ النقاش النظري حول سياسات التعليم في عهد النظام القديم في شرح هذه الدراسة ، ثم يتبعها في عهد النظام الجديد ، وينتهي خلال فترة الإصلاح. توضح هذه الدراسة أنه على الرغم من تسييس المدارس الداخلية الإسلامية والمدارس الدينية ، يجب الحفاظ على هذه المؤسسات التعليمية الإندونيسية الأصلية والنظر في تطويرها. علاوة على ذلك ، فإن المدارس الداخلية الإسلامية هي مؤشرات مهمة لتقدم الدين والأمة. بالنظر إلى واقع التعليم المتقدم حاليًا ، فإن المدارس الداخلية الإسلامية والمدارس الإسلامية هي انعكاس لتفوق الإنجازات العلمية والفكرية والثقافية. يجب على الحكومة كصانع للسياسة أن تقدم الدعم السياسي الكامل حتى تتمكن المدارس الداخلية الإسلامية والمدارس الإسلامية من المنافسة على المستوى العالمي.Abstrak: Perkembangan Pesantren dan madrasah di Indonesia tidak dapat dipisahkan dari kebijakan politik pendidikan pemerintah yang sedang berkuasa. Melalui studi literatur, kajian ini hendak mengungkap bagaimana bentuk politik pendidikan yang dijalankan oleh pemerintah terhadap kedua lembaga tersebut. Perdebatan teoritis politik pendidikan pada masa Orde Lama akan mengawali penjelasan kajian ini, kemudian disusul pada masa Orde Baru, dan diakhiri pada masa Reformasi. Kajian ini memberikan gambaran bahwa sekalipun terjadi politisasi terhadap pesantren dan madrasah, akan tetapi lembaga pendidikan asli Indonesia ini harus tetap dilestarikan dan diperhatikan perkembangannya. Selanjutnya, pesantren dan madrasah merupakan salah satu indikator penting untuk kemajuan agama dan bangsa. Dengan melihat realitas pendidikan yang sudah maju saat ini, pesantren dan madrasah adalah cerminan dari keunggulan capaian keilmuan, intelektual dan kultural. Pemerintah sebagai pemangku kebijakans udah sepatutnya memberikan dukungan penuh secara politik agar pesantren dan madrasah bisa bersaing di tingkat dunia.

Abstract: ‘Umar Ibn al-Kaththâb and Islamic Polity: An experimentation of Application of Islamic Law in Local Context. Abstract

Background: Postpartum birth control is one of the family planning programs that still have low coverage. Midwives have a big role in increasing postpartum family planning coverage. Postpartum mothers will often contact the midwife so that the midwife can advise the postpartum mother to use postpartum birth control. The aim of this study is to evaluate the role of midwives and postpartum mothers in the use of postpartum family planning in the Asahan regency Methods: This study used a cross-sectional design, the location study was Asahan regency, and the population was 81 postpartum mothers in Asahan Regency. The researcher used purposive sampling with the criteria of giving birth in the last one month and having more than two children. The instrument used was a questionnaire. This research will conduct cross-tabulation distribution. Results: The results of the cross-tabulation showed that 24 birth control users at the midwife's clinic gave birth at a midwife clinic, 18 people gave birth at a midwife clinic (22.2%), and 21 people had postnatal health checks (25, 9%), received advice on using postpartum family planning as many as 15 people (18.5%) and received family planning counselling after delivery as many as 14 people (17.3%). This study indicated that postpartum family planning was carried out in the midwife clinic as many as 18 people (22.2%) and in the hospital or public health centres as many as nine people (11.1%). Conclusion: Postpartum mothers who do postpartum health checks to midwives are more likely to use postpartum family planning than postpartum mothers who do not undergo postpartum health checks. Postpartum mothers who advised to use postpartum family planning from a midwife will have a greater risk of using postpartum FP than postpartum mothers who do not receive postpartum FP.

Abstract

The high level of competition in various business fields today demands the management of the company to improve the excellence of the products it has, in competition in the business world the company is required to find a special strategy to create Competitive advantage so that it can put its company in the position of market leader and always ahead so that always be the choice of consumers. Online digital collections such as E-Book and You Tube that are widely available on the internet make the world of book publishing increasingly competitive as well as the implementation of improper strategies can give a bad impact to publishing companies, there are persons that markets products that are not original (pirated books) are troubling the publishing world. For that, it is necessary to find out the Marketing strategy conducted by book publishers in Medan, to know what are the obstacles in implementing Marketing strategy conducted by book publishers in Medan City and finally to The effort to overcome the obstacles in implementing the Marketing strategy conducted by the publisher in Medan City. This article is with a qualitative descriptive approach by using SWOT analysis. The results of the research from SWOT analysis are S-O strategy with aggressive, i.e. (S2, O2) a book made from quality paper materials and quality content makes the library demand increase annually. (S1, O1) Direct selling that is done by campus company can increase profit and big profit due to higher education market. (S3, O3, O2) The company is working with a national bookstore that is likely to have a wide network and distributed on a national scale as well as many growing library requests annually.

Abstract

In carrying out the operational activities of organizations, both private and government, it is inseparable from spending a certain amount of money for the costs incurred. Costs incurred as a form of support for the smooth implementation of activities. In companies, the activities carried out are oriented towards generating profit, in contrast to government institutions where the activities are carried out for the welfare of the people. To finance the activities carried out, it is necessary to make efforts to acquire financial sources in order to provide a willingness to fund to cover the costs incurred. This study aims to determine the procedure for submitting the use of APBD and how to apply the procedure for accountability for the use of APBD funds in the Gerindra faction. The analytical method used in this study is a descriptive method in which each data collected is analyzed and then conclusions are drawn and the type of research used is descriptive qualitative. The results obtained are that the procedures that have been carried out are running well according to the provisions of the Minister of Home Affairs No. 77 of 2020 concerning technical guidelines for regional financial management. However, the use of funds for activities still prioritizes personal and staff money.

Abstract

This research aims to understand the Islamic boarding school-based economic development programs issued by the Regional Office of the Ministry of Religious Affairs of North Sumatera Province. The resources owned by Islamic boarding schools can be developed as facilities in the practice of Islamic Economics activities. The method used in this research is a qualitative method with a descriptive approach. The data used is primary data, namely the results of direct observations in internship activities for one month in the Islamic Religious Education Field Office of the Ministry of Religious Affairs of North Sumatera Province, and secondary data used are scientific journal articles, documents, and other related and relevant sources. As for the results obtained from this research, the economic development program based on boarding school in the Regional Office of the Ministry of Religious Affair of North Sumatera Province is basically the same as the program of the Ministry of Religion of the Republic of Indonesia, namely by issuing a mapping and profiling program for 100 Economic Islamic Boarding Schools. Specifically, the programs issued include: the Pesantrenpreneur program, the Santripreneur Movement, 100 BUM-Pes (Islamic Boarding Schools Owned Enterprises), launching the Islamic Boarding School Community Economic Hub activities, Communities of Practice, as well as replicating or developing up to 1,500 Islamic boarding schools. The aim of this program will be able to bring out Islamic boarding schools that are independent in various aspects. The development of the Islamic boarding school-based economy is expected to advance the economic level of the Islamic boarding school itself and the surrounding community, and also can advance and make the Islamic boarding school as the center for Islamic Economics practice.

Abstract

Background: Pictorial health warning on cigarette packs has been implemented since 2014, but smokers in Indonesia increase every years. Pictorial health warning on cigarette packs must be continuously evaluated regarding its effectiveness in reducing smoking behavior in Indonesia. Regulated about Regulations of pictorial health warning on cigarettes packs are expected to make smokers to quit smoking and regulations that have been in effect since 2014 should have been evaluated to see pictorial health warning on cigarettes packs that can change the behavior of smokers or prospective smokers in adolescents. This study aims to describe perceptions of pictorial health warning on cigarette packs and smoking behavior and intention to quits smoking of undergraduate student of state Islamic University of North Sumatra. Methodology: This research was conducted to students of the Islamic University of North Sumatra as many as 215 students. The study was conducted in March 2019 using a structured questionnaire that had been prepared. The data in this study will be presented in the form of frequency distributions and then the results are presented in the table. Results: The results of this study indicate that the respondents felt not fear with pictorial health warning on cigarette packs as many as 165 people (76.7%). For the smoking behavior of students it was found that as many as 147 people (68.4%) stated that they had not smoking and respondents who stated smokers as many as 68 people (31.6%), wanted to stop smoking after seeing picture health warning on cigarette packaging as many as 28 people (41.2%). Respondents who said they would continue smoking even though they had seen pictorial health warning on cigarette packs as many as 40 people (58.8%). Conclusion: The majority of students undergraduates of the North Sumatra State Islamic University (UIN SU) were not afraid when they saw pictorial health warning on cigarette packs and students undergraduates have smoking behaviour. Those who smoke said they wanted to stop smoking after seeing pictorial health warning on cigarette packs especially when looking at ppictorial health warning on cigarette packs related to smoking resulting in lung cancer.

Abstract

Abstrak The Qur'an, as a direction and guide for humans, requires Muslims to understand the verses of the Qur'an. The Qur'an has set rules for humans in seeking sustenance, one of which is by way of muamalah or trading (buying and selling). Trading should not be done with the will of vanity. Allah forbids humans to eat other people's property and harming others in a vanity way. Trading or buying and selling are required to be based on an-taradin' or the willingness between the two parties. This study aims to analyse the concept of 'an-taradin in online buying and selling, which refers to the interpretation of Al-Munir by Wahbah az-Zuhaili. This is a qualitative study. The data were analysed using a literature study. According to Shari'a rules, the results showed that 'An-taradin or mutual consent in Surah An-Nisa' verse 29 is the willingness between the two parties. Mutual willingness must be following the limits of sharia. Online buying and selling transactions are required to have open ethics and trust in the transaction to avoid the detrimental of both parties. Honesty and benefit can be the basic principles in conducting online buying and selling transactions.
