Abstract

Indonesia’s insolvency framework is currently suboptimal in accomodating rapid creditor enforcement with preserving viable firms, particularly publicly listed companies where market signaling and minority interests are at stake. This article proposes the adoption of a semi-public restructuring regime that combines private negotiation (pre-packs) with structured judicial oversight similar to scheme procedures, including limited moratorium and cram-down powers. Using a normative juridical method supported by case analysis (including Garuda’s dual-track restructuring) and interviews with supervisory judges, the paper: (1) identifies legal and practical shortcomings of PKPU/Bankruptcy under Law No. 37/2004; (2) compares UK Part 26A, US Chapter 11, and regional moratorium models; and (3) formulates statutory reforms to operationalize semi-public restructuring in Indonesia. The proposal rests on three core pillars: a mandatory insolvency test, a time-bound moratorium to facilitate rescue, and judicially supervised cram-down with strengthened disclosure obligations to safeguard minority creditors.

Abstract

The execution of mortgage rights through auction mechanisms should ideally provide legal protection and certainty for creditors and auction winners acting in good faith. However, in practice, the process of vacating the collateral object after the auction often faces legal and non-legal obstacles that prevent the auction winner from immediately taking physical possession of the object, even though ownership rights have been legally transferred through the auction minutes. This study aims to analyze the legal implications of these obstacles to eviction on the legal certainty of auction winners. The research uses a normative legal method with a legislative approach and a case approach through analysis of the Mortgage Law, SEMA, Minister of Finance Regulations, and court decisions. The results of the study show that the Mortgage Law does not explicitly regulate the mechanism for vacating the object after the auction, thus creating a normative vacuum and differences in interpretation in practice. Meanwhile, SEMA Number 4 of 2014 functions as a policy regulation and does not have substantive binding force. As a result, auction winners often experience delays in physical possession, cost losses, and legal uncertainty. This study concludes that regulatory updates are needed regarding the post-auction eviction mechanism, strengthening the authority of the implementing agency, and harmonizing procedural law so that protection and legal certainty for auction winners acting in good faith can be effectively realized.

Abstract

This study aims to examine the legal position of  covernotes in the provision of bank credit facilities and the urgency of regulating their issuance by Notaries as a measure to prevent abuse. This research is important because the practice of issuing  covernotes is often used as a basis for credit disbursement, even though, legally,  covernotes are not authentic deeds and do not possess the evidentiary power of authentic notarial acts. This condition creates potential risks of misuse by both banks and Notaries, as well as legal uncertainty for all parties involved. The study employs a normative legal research method with a statute approach and case approach. The legal materials utilized include primary, secondary, and tertiary sources, collected through library research. Analysis is conducted qualitatively through interpretation of the processed legal materials. The results indicate that  covernotes function solely as temporary and informative administrative statements, clarifying that the process of credit collateral registration is still underway.  covernotes cannot be regarded as valid collateral evidence; therefore, in the event of default, the bank cannot execute the collateral before the authentic deed is issued. These findings underscore the critical need for clear regulation of  covernotes by Notaries to ensure legal certainty, prevent abuse of authority, and protect the interests of debtors, creditors, and Notaries themselves. With clear regulation,  covernotes can continue to serve as an effective administrative instrument without creating legal risks or conflicts of interest in the credit provision process.

Abstract

Artikel ini membahas permasalahan terkait dengan pembaruan hukum pidana Indonesia berkaitan dengan rechterlijk pardon (permaafan hakim) sebagai salah satu bentuk putusan dalam perkara pidana. Tujuan penelitian ini adalah untuk mengetahui nilai-nilai Pancasila yang diusung dari pengaturan dan penerapan rechterlijk pardon (permaafan hakim). Metode yang digunakan di dalam penulisan artikel ini adalah pendekatan kasus dan pendekatan perundang-undangan. Hasil dari penelitian ini menunjukkan bahwa rechterlijk pardon (permaafan hakim) merupakan perwujudan dari nilai-nilai Pancasila dalam proses penegakan hukum pidana, dan sebagai perwujudan upaya meng-Indonesiakan ketentuan hukum pidana yang selama ini dilandaskan oleh nilai-nilai yang berasal dari bangsa kolinal.

Abstract

The increasing volume of waste generated in urban areas poses significant challenges to environmental sustainability. This study aims to evaluate the effectiveness of a community-based waste management education program implemented in Kebakkramat District. The primary objective is to enhance environmental awareness among residents, thereby fostering responsible waste management practices. A mixed-methods approach was employed, combining quantitative surveys and qualitative interviews to assess community engagement and knowledge retention. Data collected from 200 households indicated a 40% increase in awareness about waste segregation and recycling practices post-implementation. Additionally, qualitative feedback highlighted a shift in community attitudes towards waste management as a shared responsibility. The findings suggest that community involvement is crucial for the success of environmental initiatives. This research contributes to the growing body of evidence supporting education as a vital tool for enhancing environmental awareness and promoting sustainable practices at the community level.

Abstract

Economic and business development in Indonesia heavily relies on the role of financial institutions, especially banking, in providing capital through credit facilities. However, credit distribution also carries the risk of default, necessitating an adequate legal protection system for creditors. This research aims to analyze the legal protection for creditors in credit agreements with mortgage rights as collateral under Indonesian positive law, identify issues hindering its implementation, and formulate solutions to strengthen legal protection to increase creditor confidence. The study employs a normative legal research method with conceptual and statutory approaches, focusing on an in-depth analysis of creditor protection in credit agreements with mortgage rights through examination of legal principles, legal systematics, and relevant legislation. Data collection is conducted through literature study, while data analysis uses a qualitative method with a deductive approach, involving stages of identification, interpretation, consistency analysis, and synthesis to identify legal gaps and formulate recommendations for improving legal protection for creditors. The research results reveal that legal protection for creditors in credit agreements with mortgage rights in Indonesia faces several obstacles, including ineffective execution processes, limited collateral objects, lack of certainty in collateral valuation, limited capacity of registration institutions, and low public legal awareness. To address these issues, proposed solutions include optimizing execution implementation, expanding collateral objects, creating clear valuation guidelines, enhancing the National Land Agency's capacity, providing legal education to the public, improving relevant regulations, increasing inter-agency coordination, and strengthening supervision and law enforcement. The implementation of these measures is expected to increase creditor confidence, improve the investment climate, and promote economic growth while maintaining a balance of interests among all parties.

Abstract

This article examines the effectiveness of intellectual property rights law enforcement in Indonesia by analysing three main elements of the legal system: legal substance, legal structure, and legal culture. The study focuses on the enforcement of intellectual property rights through civil mechanisms, criminal proceedings, and alternative dispute resolution. The analysis shows that the effectiveness of intellectual property enforcement is influenced not only by the adequacy of legal norms, but also by the capacity and coordination of law enforcement institutions, procedural efficiency, and public legal awareness. In civil disputes, parties are encouraged to strengthen contractual clauses that refer disputes to alternative dispute resolution or arbitration mechanisms, as these forums may provide faster, more confidential, cost-efficient, and legally certain outcomes. Meanwhile, in criminal enforcement, challenges remain in the technical capacity of law enforcement officials, inter-institutional coordination, and bureaucratic complexity. Therefore, improving intellectual property law enforcement in Indonesia requires strengthening the competence of law enforcement officers, simplifying enforcement procedures, enhancing institutional collaboration, and increasing public awareness of intellectual property protection. These measures are essential to create a more professional, efficient, and practical enforcement system that supports legal certainty and the protection of innovation.

Abstract

Many companies face the threat of difficulty paying their debts to their creditors. There are many reasons the debtor has not paid off the debt, including being unable to pay off the debt that has been given at all, the debt that has been paid is still insufficient for the debt bill, being late in paying the debt, or paying the debt but not in accordance with what has been agreed. The reconciliation plan in the PKPU contains one of which is the debtor's plan to restructure his debts in accordance with the principle of business continuity, which most often is rescheduling, regulated in Article 265 of Law Number 37 of 2004 concerning Bankruptcy. The parties are free to determine the content of the peace plan, the freedom of the content of this peace plan is known as the principle of freedom of contract. The peace agreement which has been ratified by the court, then the reconciliation has binding legal force for the Debtor and the Creditors.

Abstract

One of the most important aspects of life is education, thinking and human behavior along with the education has been taken. Education is one of the most important efforts for a nation in maintaining its existence. The purpose of this research is study the role of education to the existence  the custom society of Kampung Naga, Tasikmalaya, West Java. This research is a qualitative research with descriptive qualitative method. The data used in the form of qualitative data. Data collection techniques used are observation and literature review. The data analysis techniques using interactive models. The results of research is shown that the important of education role to existence for custom society life of Kampung Naga, Tasikmalaya, West Java. It is shown that the role of education provides more usefulness, but does not change their behavior. There is not only formal education that already exists but also balanced with environmental education in the form of education from family. This education is done so that they can teach the pattern of hereditary behavior that has existed from an early age so that their existence will still survive. They is custom society is not easy along the formal and custom so there are some problems about education. Abstract

This research aims to explore and examine the civil law implications for individuals who are Khuntsa and have changed their identities, with a focus on the perspectives of Islamic Law and Civil Law in Indonesia. The research adopts a normative legal approach with a prescriptive nature, emphasizing the analysis of legislation and case studies. If this process is carried out and followed by a legal application to change their gender identity through the court system, and the judge approves it, there will be legal implications. Additionally, it is essential to consider religious perspectives, especially Islam. To address the issues arising from the civil law implications for Khuntsa individuals who have changed their identities based on court rulings, specific regulations governing their status and position are necessary. This is aimed at ensuring legal certainty in such cases.
