Abstract

Public transportation has become a basic need of the community in mobilizing. For every transportation process, passengers are required to have a ticket as proof of travel documents. Passengers and carriers are bound by the existence of a contract of carriage, which is a contract of carriage that gives birth to a legal relationship and gives rise to rights and obligations. This research aims to determine the civil liability of PT KAI Commuter Indonesia is based on an operational disruption event that caused an accident that occurred while transporting passengers. This study uses a normative juridical research method that is descriptive with a qualitative approach. The type of data used is primary data obtained from laws and regulations and secondary data sources obtained from literature materials. The data collection method uses literature studies and direct interviews as supporting data in processing data to produce conclusions regarding legal protection for consumers in legal events in the form of operational disruptions to the EMU Jabodetabek Commuter Line. The results of the study show that passengers and carriers have the right and obligation to get safety guarantees, as well as PT KAI Commuter Indonesia is responsible for losses suffered by passengers in the form of ticket refunds and compensation for accident victims, whether they are dead, disabled, or injured. The compensation paid by PT KAI Commuter Indonesia is a premium paid by passengers managed by the insurance company, namely PT Jasa Raharja. However, in practice, it is still unclear in the laws and regulations and also the scope in the agreement with the insurance company.

Abstract

The rapid growth of financial technology, particularly peer-to-peer (P2P) lending, has introduced electronic standard-form agreements that often place consumers in a weaker bargaining position. Shopee Pinjam (SPinjam), an unsecured digital loan service provided through cooperation with a licensed fintech lender, applies a standard electronic contract that raises concerns regarding contractual fairness and consumer protection. This study examines the legal validity of the SPinjam standard agreement based on Article 1320 of the Indonesian Civil Code and analyzes the extent of legal protection afforded to consumers under Indonesian consumer protection law. This research employs a normative legal method using statutory and conceptual approaches. Legal materials consist of primary sources in the form of legislation, supported by secondary and tertiary legal materials, which are analyzed qualitatively through descriptive-analytical techniques. The findings indicate that the SPinjam standard agreement formally fulfills the legal requirements of a valid contract under Article 1320 of the Civil Code. However, substantively, several contractual clauses demonstrate an imbalance of rights and obligations, potentially disadvantaging consumers and conflicting with the principles of fairness and consumer protection as stipulated in the Consumer Protection Act. Therefore, although legally valid in form, the agreement requires substantive adjustment to ensure equitable legal protection for consumers in fintech lending practices.

Abstract

PurposeThe aim of this research is to analyze the urgency of establishing the LPPDP in strengthening personal data protection laws in Indonesia through a comparison of laws and practices in Hong Kong and Singapore and to determine the opportunities and challenges of establishing the LPPDP in Indonesia. MethodologyThe research uses normative legal research methods with a statutory approach, a conceptual approach and a comparative approach. ResultThe results show that the existence of an independent LPPDP will strengthen the personal data protection law effectively and comply the adequate level of protection with other developed countries. Thus, the President must immediately establish LPPDP regarding the minimum requirements for the DPA's establishment in international practice. ContributionLaw Number 27 of 2022 concerning Personal Data Protection (UU PDP) has directly mandated the establishment of a data protection authority which determined by the President. The LPPDP has projected to become an authority that acts as a supervisor and law enforcer for personal data protection in Indonesia, the LPPDP must be able to perform its functions, duties, and authorities independently. LimitationHowever, instead of achieving this noble goal, there are several recommendations that can be applied in establishing the formation of LPPDP, whether in the form single supervisory authority or ministry based-models.
