Abstract

Program bimbingan belajar privat dalam meningkatkan pemahaman hukum fikih peserta didik merupakan bentuk pengabdian masyarakat yang dilaksanakan di pondok pesantren. Kegiatan ini bertujuan untuk memberikan pendampingan belajar secara intensif melalui metode privat dengan pendekatan personal agar peserta didik mampu memahami materi fikih secara lebih mendalam dan aplikatif. Setiap kelompok kecil peserta dibimbing oleh seorang guru privat dalam ruang belajar khusus yang kondusif. Hasil kegiatan menunjukkan adanya peningkatan signifikan dalam pemahaman peserta terhadap konsep-konsep dasar fikih serta perubahan positif dalam sikap kedisiplinan dan keterlibatan belajar. Kegiatan ini tidak hanya berdampak pada aspek kognitif, tetapi juga pada pembentukan karakter dan budaya belajar yang positif. Program ini direkomendasikan untuk dilanjutkan dan dikembangkan sebagai model pembelajaran alternatif di lingkungan pendidikan pesantren guna memperkuat kualitas pendidikan keagamaan yang lebih efektif dan berkelanjutan.

Abstract

The divorce phenomenon that occurs in society is a husband who assigns his wife the authority to file for divorce, giving up his right to file for divorce himself. Moving past these issues, the author is interested in learning more about the legality of a divorce from a husband to his wife based on the legal foundation of fiqh al-syafi’iyyah. The writers’ method of inquiry is descriptive qualitative research with a normative perspective. The study’s findings indicated that the legality of divorce on a wife according to fiqh scholars al-syafi’īyyah is valid and the fall of divorce is because there is a need (hajat) and this opinion is a strong opinion to practice. This is different from the case of a husband delegating his wife’s divorce to another woman. There is a difference in the opinion of scholars, some fiqh al-Syafi’iyyah scholars say it is legal, some others argue that it is illegal on the grounds that there is no intention and women also cannot accept representation.

Abstract

The position of children as legal subjects will certainly become a problem that needs to be studied in more depth. Children who physically and psychologically still need care and guidance in order to achieve perfect growth, precisely when dealing with the law will certainly experience psychological and even physical changes in a bad direction. In the case of children as legal subjects, there is a difference between Islamic law and positive law in Indonesia because of the different objectives of establishing and enforcing the law itself. To examine this problem, qualitative research methods are used with a normative juridical approach. The data collection technique was carried out using the documentation method, in which data was collected from fiqh literature and laws related to juvenile crimes, then analyzed using the content analysis method. The results of the study show that children according to Islamic law are not subject to criminal punishment because punishment in Islam is imposed on people who are mature (adults), have good sense and criminal acts are not carried out by force. However, in Islam if a child performs jarimah, a ta'zir punishment will be imposed as guidance and teaching for the child. Meanwhile, according to positive laws in Indonesia, the punishment system is different from adults.

Abstract

Kekerasan seksual seperti pemerkosaan merupak salah satu bentuk kejaharan seksual yang harus dilakukan upaya pencegahannya dengan memberlakukan sanksi yang dapat memberikan efek jera terhadap pelaku dan mencegah terjadinya hal serupa pada orang yang lain. KUHP Pasal 285 merupakan salah satu peraturan yang mengatur secara khusus berkaitan dengan kekerasan seksual, namun hal tersebut belum bisa memberikan dampak yang siknifikan terhadap pencegahan kejahatan pemerkosaan. Berdasarkan realitas tersebut harus dilakukan upaya perancangan perubahan terhadap KUHP dengan mengakomodir hukum Islam (fiqh) dan Qanun Jinayat Aceh. Secara fiqh kejahatan pemerkosaan dalam satu sisi dikategorikan ke dalam zina sehingga dikenakan hukuman hudud, namun disisi lain bisa dikategorikan ke dalam hirabah sehingga bisa dikenakan hukuman yang lebih berat lagi dari hudud. Sementara Qanun Jinayat Aceh menerapkan hukuman ta’zir berupa cambuk atau denda dalam bentuk emas murni. Secara fiqh atau qanun sangat memberikan efek jera terhadap pelaku dan dapat mencegah untuk terulang kembali kejahatan serupa tersebut.

Abstract

This study examine the transformation of the concept of justice in Islamic criminal law as a contribution to the reform of national criminal law. The assess the extent to which the principles of justice in Islamic criminal law, such as proportional justice, victim protection, and the principle of public benefit (maslahah), have been incorporated into the new national criminal law system, particularly within the 2023 Indonesian Penal Code (KUHP). This research employs a doctrinal method through literature analysis, drawing on national legislation, jurisprudence, and both classical and contemporary Islamic legal thought. The findings reveal that although several Islamic legal principles are beginning to be accommodated, such as the application of restorative justice, a more humane sentencing approach, and the acknowledgment of local values, this integration remains partial and does not yet fully reflect the comprehensive framework of Islamic justice. Therefore, transforming the national criminal law system through the values of Islamic legal principles is a strategic step toward building a justice system that is more responsive, substantively fair, and aligned with the Indonesian national identity.

Abstract

This study originates from the absence of a functional theory that systematically explains the legal status of joint marital property within the framework of Islamic law. Previous studies have predominantly focused on normative aspects such as shirkah (partnership), maintenance (nafaqah), and hibah (gifts), without conceptualizing joint property as an instrument for protecting the reciprocal rights of spouses. This theoretical gap raises critical questions regarding how Islamic jurisprudence can respond to the demands of modern legal systems that emphasize legal certainty, economic justice, and mutual protection within marriage. Accordingly, this research aims to formulate a Functional Theory of Joint Marital Property from an Islamic perspective through the integration of classical fiqh principles, social functionalist theory, and the local wisdom of the Indonesian archipelago (Nusantara). The study employs a library-based research method with normative analysis, utilizing approaches from usul al-fiqh, legal hermeneutics, and social systems theory. This multidimensional approach enables the identification of principles of reciprocity, public interest (maslahah), and rights protection embedded in classical fiqh texts, as well as their relevance to the Indonesian legal system. The findings indicate that joint marital property serves three primary functions: a protective function safeguarding the rights of both spouses; a stabilizing function ensuring the continuity and resilience of the household; and an integrative function that harmonizes Islamic jurisprudence with the requirements of modern legal frameworks. This functional theory of joint marital property constitutes a novel contribution to the development of Islamic family law in Indonesia and may serve as a foundational framework for regulatory reform, the formulation of jurisprudential guidelines, and the strengthening of rights-based protection mechanisms within marriage.
