Abstract

Kekerasan Dalam Rumah Tangga (KDRT) terhadap anak merupakan fenomena sosial yang banyak terjadi hampir di seluruh bagian wilayah negara Indonesia. Penelitian ini bertujuan untuk mendeskripsikan penyebab anak mendapatkan perlakuan KDRT, macam-macam bentuk KDRT-nya, dampaknya dan juga upaya perlindungannya yang dilakukan oleh Lembaga Perlindungan Anak Jawa Barat (LPA Jabar). Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan dan hasil wawancara. Data yang dikumpulkan melalui dua tahap, yaitu analisis dokumen terkait, seperti buku, artikel jurnal, nomenklatur undang-undang, dan lainnya, kemudian baru mengumpulkan data hasil wawancara. Hasi penelitian mengidentifikasi bahwa penyebab KDRT pada anak beragam macamnya seperti anak masih lemah, takut ancaman, kurang bergaul, dan korban perceraian. Bentuk KDRT-nya bisa berupa kekerasn fisik, psikis, seksusal dan penelantaran. Dampaknya anak menjadi trauma, murung, gelisah, kurang nafsu makan, sakit bahkan meninggal dunia. Adapun upaya perlindungan yang dilakukan LPA Jawa Barat terhadap anak korban KDRT yaitu dengan melakukan sosialisasi, monitoring, mengarahkan, mendampingi, membantu dan bekerja sam dengan lembaga-lembaga atau dinas sosial.

Abstract

Corruption is an extraordinary crime that has negative impacts on various aspects of life, including the economy, public trust, and government stability. Efforts to combat corruption in Indonesia have been carried out through various policies and regulations, including Law Number 31 of 1999 jo. Law Number 20 of 2001 on the Eradication of Corruption. One important instrument in supporting the eradication of corruption is the involvement of the public in reporting corrupt acts through a whistleblowing mechanism. This research aims to analyze the implementation of legal protection for whistleblowers in Indonesia based on Law Number 31 of 2014 on the Protection of Witnesses and Victims, particularly in providing protection for whistleblowers. In addition, the study examines the implementation of whistleblower protection policies and improving the effectiveness of legal protection for whistleblowers in corruption cases. This research uses a normative juridical method with a statute approach to analyze regulations that govern protection for whistleblowers, especially Law Number 31 of 2014, as well as policies implemented by Lembaga Perlindungan Saksi dan Korban (LPSK) and other law enforcement agencies. Data analysis is conducted using a qualitative analysis method. Based on the research findings, it is concluded that legal protection for whistleblowers still faces various challenges in its implementation. Normatively, legal protection for whistleblowers is regulated under Law Number 31 of 2014, but policy reforms are needed to strengthen the role of LPSK in providing more comprehensive protection for whistleblowers. With a more effective legal protection system, it is hoped that whistleblowers will be able to play a larger role in the fight against corruption, thereby promoting the creation of a more transparent, accountable, and integral legal system in Indonesia.

Abstract

Domestic violence remains a pressing issue, with approximately 70% of cases resolved through penal mediation in recent years. In West Java Province alone, nearly 3,000 cases of domestic violence have been recorded, highlighting the urgency of effective resolution mechanisms. Penal mediation has emerged as an alternative approach, yet its alignment with Islamic legal principles remains underexplored. Islamic law strictly prohibits acts of violence, as it is a religion that upholds human dignity and peace. This study aims to examine the principles of Islamic law in the application of penal mediation to domestic violence cases and to identify the challenges faced in its implementation from both general and Islamic perspectives. Employing an empirical juridical method, this research gathers qualitative data through interviews, field observations, and literature reviews. The findings reveal a strong correlation between Islamic legal principles and penal mediation, with Surah An-Nisa verse 35 serving as a foundational reference for mediation efforts. However, the study also uncovers normative challenges, including inconsistencies in regulatory frameworks and misinterpretations of Islamic law regarding reconciliation and peace. The novelty of this research lies in its integration of Islamic legal principles with contemporary penal mediation practices, providing a unique perspective on addressing domestic violence. By bridging legal theory and religious doctrine, this study contributes to the development of more culturally and ethically grounded mediation practices, offering valuable insights for policymakers, legal practitioners, and religious scholars.

Abstract

Along with the development of increasingly modern globalization, the authority and existence of customary institutions for dispute resolution began to be questioned, especially now that some people tend to resolve their disputes through formal institutions such as state courts and the police. This article examines the legal politics of the existence of customary courts in civil procedure law. The research approach is normative juridic and is analyzed through qualitative juridic, which studies data based on legal aspects. The study's findings indicate that legal discrepancies regarding customary justice in the law of civil events remain. However, there is a history of cooperation between the state and the village courts as regulated in Article 86 letter A, article 103, paragraphs (2) and (3). article 120 letter a and article 135 letter a HIR (KUH Perdata Hindia Belanda). Since the entry into force of Emergency Law No. 1 of 1951, these articles have been abrogated, except for Article 135 letter a HIR. The practical implications of the political study of customary law include adopting a common law recognizing the right to justice for indigenous peoples in Indonesia.

Abstract

Penelitian ini menilai efektivitas kegiatan penyuluhan pendidikan inklusif mengenai kesadaran hak asasi manusia (HAM) pada anggota OSIS SMP Negeri 1 Nagreg. Intervensi yang dilaksanakan pada 7 November 2025 ini menggabungkan tes pre-post melalui Quizziz (n = 29), pemberian materi interaktif, serta Forum Group Discussion (FGD) dengan mitra lokal Senyum Anak Nusantara (SAN). Dengan desain single-group pretest-posttest, peserta mengerjakan 10 soal Quizziz sebelum dan sesudah sesi pemberian materi, FGD digunakan untuk menangkap pemahaman kontekstual dan respons praktis terhadap kasus perundungan. Hasil menunjukkan peningkatan pengetahuan yang signifikan dengan total jawaban benar meningkat dari 145/290 (50%) pada pre-test menjadi 276/290 (95%) pada post-tes. Sebagian besar butir mengalami peningkatan yang signifikan, meskipun pada dua butir yang berkaitan dengan aspek psikologis (butir 8-9) masih menunjukkan kurangnya pemahaman. Temuan ini menunjukkan bahwa penyuluhan tersebut efektif meningkatkan pengetahuan teknis dan kesadaran situasional, sekaligus menyoroti perlunya tindak lanjut yang berfokus pada pengenalan psikologis dan respons empatik. Rekomendasi praktis mencakup modul role-play singkat, bagan alur pelaporan satu halaman, struktur dukungan teman sebaya, serta integrasi materi HAM ke dalam pembelajaran PPKn.

Abstract

Constitutionally, freedom of religion and belief has been guaranteed in Constitution. The right to embrace religion and belief in God Almighty. However, local believers often experience discrimination against their civil rights, especially the rights of women. This research will examine how the position of women followers of the Sunda Wiwitan belief and all the problems in maintaining their rights. The approach method used in this research is normative juridical through legal principles, legal systematics, and conducted on norms and principles contained in secondary data, which are scattered in primary, secondary, and tertiary legal materials. The Constitutional Court Decision No. 97/2016 has provided new hope for the indigenous faith community, for women, as an integral part of the Sunda Wiwitan community. Women's challenges and difficulties in facing various forms of discrimination to obtain civil rights, such as birth certificates and marriage certificates, are bureaucratic obscurity and lack of understanding of women's rights that often prevent access to public services, which they should receive. In addition, social stigma and negative community views towards traditional beliefs further exacerbate the nuances of this condition. The presence of local women leaders of Sunda Wiwitan, signifies a courageous effort to fight for the rights of indigenous peoples and advocate for more inclusive change. Their efforts show that women in the Sunda Wiwitan community not only play a role as cultural preservationists, but also as agents of change who fight for justice and equality.

Abstract

Digital technology has opened up many job opportunities around the world, including opportunities to work abroad. High salary offers are one of the factors driving Indonesians' interest in working abroad. However, this situation is often exploited by irresponsible parties to commit fraud using victims' information, which ultimately leads to human trafficking crimes. The number of online fraud victims among Indonesian migrant workers abroad increased from 15 cases in 2020 to 7,027 cases in 2025, with 4,300 cases occurring in Cambodia. This highlights the weakness of state protection for its citizens in the digital age. This paper focuses on analyzing the modus operandi of online scams targeting Indonesian migrant workers, the efforts undertaken by the Indonesian government, and the enforcement of laws in Cambodia against illegal activities. This research employs a normative legal and descriptive qualitative approach. From the discussion, it is known that the modus operandi of online scams targeting Indonesian citizens involves facilitating the recruitment process, forging data and documents, visa abuse and travel manipulation, as well as abuse of foreign legal jurisdiction. Efforts to address and prevent labor exploitation through online scams involve all levels, including international cooperation, the role of the government, and public awareness. Furthermore, the weakness of law enforcement and economic interests has created a dependency on illegal activities that not only threaten the internal stability of Cambodia but also harm Indonesia socially, economically, and legally.

Abstract

The Economic Analysis of Law (EAL) theory proposed by Richard A. Posner holds significant relevance in the regulation of Islamic banking, particularly in assessing the effectiveness and efficiency of regulations to achieve economic objectives. EAL emphasizes the importance of flexible and responsive regulations to market needs, as well as the integration of Sharia principles without hindering innovation. In the context of Islamic banking, regulations must adhere to Sharia principles such as the prohibition of riba and fairness in risk-sharing, while also promoting financial efficiency and stability. This study aims to analyze how EAL can assist in designing regulations that maximize economic benefits while ensuring social justice, in line with maqashid sharia. Using a qualitative and normative-analytical approach, this research compares the concepts of EAL with the principles of Islamic banking and identifies the challenges in aligning efficiency and justice in regulatory practice. The findings of this study suggest that the application of the Economic Analysis of Law (EAL) theory in the regulation of Islamic banking is crucial for achieving a balance between economic efficiency and social justice. While EAL focuses on optimizing resources for maximum economic benefit, in the context of Islamic banking, regulations must still consider Sharia principles such as the prohibition of riba and distributive justice. The main challenge lies in the need for regulations that are flexible and responsive to market dynamics, so they can integrate Islamic moral values with the need for efficiency. Therefore, well-designed regulations can support the sustainable and stable growth of Islamic banking, while meeting societal needs in accordance with maqashid sharia.

Abstract

This research is motivated by the phenomenon of the polemic faced by the press against the Police, which is related to the lack of certainty in resolving cases in the press even though there is an MoU made between the Press Council and the Police. This research aims to find a problem that has existed between the Police and the Press Council such as the MoU (Police and Press Council) which then questioned its significance such as its legal strength in resolving press cases. Then provide the best advice in resolving press cases by the police of the Republic of Indonesia. The research method used is normative juridical, with a statute approach. The results obtained from this research show that the MoU between the Press Council and the Police has the same legal force as agreements in general. Then the settlement of cases in the Police can be resolved one of them using the restorative justice method by using police discretion as an effort to keep press people from feeling criminalized and maintaining the image of the police.

Abstract

Article 142 of the New Criminal Procedure Code introduces the right to remain silent, yet it conflicts with Article 235, which continues to recognize defendant statements as valid evidence. This normative discrepancy creates legal uncertainty regarding the protection of suspects' and defendants' rights during the evidentiary process in Indonesia's judicial system. The aim of this research is to examine the existence of Defendant Statements in Indonesia's New Criminal Procedure Code in light of the Right to Remain Silent principle. The research adopts a normative legal method supported by a comparative approach in the United States of America and the Netherlands. It analyzes statutory provisions and compares them with legal systems that firmly uphold the privilege against self-incrimination. The findings demonstrate a clear contradiction between Article 142, which guarantees the Right to Remain Silent, and Article 235, which still recognizes Defendant Statements as valid evidence. This inconsistency creates legal uncertainty and undermines the effective protection of suspects’ and defendants’ rights during the evidentiary process from a critical perspective, suggesting that New Criminal Procedure Code has not fully embraced the principle of due process. It also creates the potential for abuse of power, particularly in practices that pressure defendants into providing statements. This study, therefore, proposes harmonising Articles 142 and 235 to ensure coherence between human rights principles and evidentiary mechanisms. The study contributes to this by offering a doctrinal and comparative framework to reinforce the implementation of the non-self-incrimination principle within Indonesia's criminal justice system.
