Abstract

The object of discussion in this study is the form of personal data protection and the factors that hinder investigations into criminal acts of misuse of personal data. This research aims to determine the form of protection of people's personal data and the obstacles in the process of investigating misuse of personal data. This research method uses a normative juridical approach because it examines legal aspects and legal rules using literature material. The research specifications use descriptive analysis laws. The research results show that forms of personal data protection in Indonesia exist and are regulated in Law Number 27 of 2022 concerning Personal Data Protection, Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, as well as Government Regulation Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions. The inhibiting factors for the Lampung Regional Police's Ditreskrimsus in carrying out investigations into misuse of personal data include legal instrument factors, apparatus factors, facilities and infrastructure factors, community factors and cultural factors.

Abstract

The aim of this research is to determine the criminal sanctions imposed by fines on perpetrators of the crime of smuggling alcoholic beverages. The method used in this research is a normative legal research method using a statute problem approach. The results of this research are that the forms of sanctions given to perpetrators of the crime of smuggling alcoholic beverages are categorized based on the smuggling carried out in the import and/or export sector. Smuggling carried out in the import sector is subject to sanctions with a minimum imprisonment of 1 (one) year and a maximum imprisonment of 10 (ten) years and a fine of at least IDR 50,000,000.00 (fifty million rupiah) and a maximum of IDR 5,000. 000,000.00 (five billion rupiah), and smuggling in the export sector with a minimum prison sentence of 1 (one) year and a maximum prison sentence of 10 (ten) years and a fine of at least Rp. 50,000,000.00 (fifty million rupiah ) and a maximum of IDR 5,000,000,000.00 (five billion rupiah).

Abstract

Permasalahan pidana mengenal adanya suatu ketimpangan dalam pemberian hukuman pidana yang disebut dengan disparitas. Disparitas pidana merupakan suatu pelaksanaan pidana yang berbeda atau tidak sama bagi pelaku tindak pidana yang melakukan tindak pidana yang sejenis atau serupa. Disparitas pidana akan menjadi permasalahan di kemudian hari apabila dikaitkan dengan pendidikan administrasi. Dimana pelaku akan melakukan perbandingan mengenai tindak pidana yang dapat ditanggung oleh orang lain. Akan terjadi suatu kejadian ketidakadilan mengenai perbedaan pidana yang akan berimplikasi pada stigma negatif oleh narapidana dan masyarakat yang akan memperkuat ketidakadilan peradilan dalam menentukan penjatuhan putusan pidana. Dalam hal ini terdapat banyak aspek yang menyebabkan terjadinya disparitas pidana. Akan terjadi suatu peristiwa ketidakadilan mengenai perbedaan pidana yang akan berimplikasi pada stigma negatif oleh narapidana dan masyarakat yang akan memperkuat ketidakadilan peradilan dalam menentukan penjatuhan putusan pidana. Abstract

Purpose: The purpose of this study is to determine how to expand the meaning of the principle based on the National Criminal Code. Methodology: The method used was a normative juridical approach and an empirical juridical approach with a qualitative research type. Primary and secondary data sources were used. Results: The results of the research show that the laws that exist in society to obtain a form of legal certainty based on the provisions of Pasal 2 Ayat (3) of the National Criminal Code are required to compile the customary laws that exist in each region concerned to be selected and then included in the regulations. Area. This is a form of implementing the expansion of the meaning of the principle of legality into Regional Regulations. Limitations: This study is only related to expanding the meaning of the principle of legality in the National Criminal Code. Contribution: This research is expected to be a reference and contribute to the application of expanding the meaning of the principle of legality in reality.

Abstract

Assault is an intentional act that causes pain or injury to another person's body. So it can be interpreted that abuse is a form of criminal act. Based on the explanation of Article 351 paragraph (1) of the Criminal Code, it is emphasized that abuse that causes the victim to suffer serious injuries is carried out by a person against another person, even against objects, even though a person must be responsible for his actions. Criminal responsibility is intended to determine whether a suspect/defendant is responsible for a crime that occurred or not. What are the inhibiting factors in criminal liability for perpetrators of abuse which resulted in serious injuries to two victims based on Decision Number: 659/Pid.B/2019/PN.Tjk and what is criminal liability for perpetrators of criminal acts of abuse which resulted in serious injuries to two victims? Data analysis uses qualitative data analysis. The inhibiting factors in criminal accountability for perpetrators of abuse which resulted in serious injuries to two victims based on Decision Number: 659/Pid.B/2019/PN.Tjk are the legal factors themselves, law enforcement factors, means and facilities factors, community factors and cultural factors , community factors and law enforcement officers. Criminal liability for the perpetrator of the criminal act of abuse which resulted in serious injuries to two victims in Decision Number: 659/Pid.B/2019/PN.Tjk has met the value of criminal liability in accordance with the provisions of the actus because the defendant has committed an act that is prohibited as stated in it. in the Criminal Code.

Abstract

The promotion of online gambling through social media such as Instagram and WhatsApp is increasingly attracting public interest, even though it violates the law in accordance with Article 27 Paragraph (2) of Law Number 19 of 2016. Case at the Tanjung Karang District Court (Number 892/Pid.Sus/2023/PN .TJK) revealed that online gambling promotion is a criminal offense with the threat of prison sentences and fines. What is the criminal liability of perpetrators who promote online gambling products and what is the basis for the judge's considerations in imposing criminal penalties on perpetrators who promote online gambling products? Data analysis uses qualitative data analysis. The judge's decision is in accordance with applicable law, taking into account legal, sociological and philosophical aspects. In this case the judge placed more emphasis on the sociological and philosophical aspects. Hakim used Mackenzie's theory, emphasizing balance, artistry, intuition, and a scientific approach. Criminal liability must be strictly legally necessary to protect society from the negative impacts of online gambling. The criminal liability contained in decision number 892/Pid.Sus/2023/PN.TJK regarding online gambling promotion involves several defendants. This decision emphasizes the importance of law enforcement in maintaining justice and public security, and shows the appropriate application of the law to punish the promotion of illegal gambling.

Abstract

This research aims to analyze the basis of investigators' considerations in using restorative justice as a resolution mechanism for child sexual abuse cases at the Metro City Police Resort. The research employed normative and empirical juridical approaches. Primary and secondary data were collected through literature reviews and field studies. Data were analyzed qualitatively to draw conclusions aligned with the issues discussed. The findings indicate that the investigators' considerations in resolving child sexual abuse cases are based on juridical, philosophical, and sociological foundations. Juridically, the Metro City Police Resort refers to Article 16 Paragraph (1) of Law No. 2 of 2002 on the Indonesian National Police regarding discretion and Police Regulation No. 8 of 2021 on the Handling of Criminal Acts Based on Restorative Justice. Philosophically, the application of restorative justice in such cases is rooted in the principles of substantive justice and the protection of human rights, particularly for vulnerable child victims. Sociologically, restorative justice in this context considers the circumstances of the perpetrator and the victim, as well as the impact caused by the crime. To ensure the perpetrator fulfills their obligations, the police must monitor the implementation of agreements made during the restorative justice process. This monitoring is crucial to prevent recidivism by the perpetrator and ensure the victim receives ongoing protection and recovery.

Abstract

Purpose: This study aims to analyze the punishment of perpetrators of unlicensed logging based on the trilogy of legal objectives: justice, legal certainty, and expediency. Methodology: The research method used is juridical-normative with a qualitative descriptive approach. This research focuses on analyzing Decision No. 379/Pid.B/LH/2023/PN.Tjk, supported by literature studies and secondary data in the form of laws and regulations. Results: The results showed that the criminalization in the cases studied tended to prioritize aspects of legal certainty, such as the enforcement of formal legal norms. However, aspects of substantive justice, especially for affected communities, have not been fully achieved. Likewise, legal expediency related to efforts to prevent environmental damage still requires strengthening to have a broader impact. Conclusion: This study highlights that the punishment of perpetrators involved in illegal deforestation must align with the three primary goals of law: legal certainty, justice, and utility. Legal certainty requires clear and consistent sanctions to deter illegal activities. Justice demands proportional punishment based on the environmental damage caused, while utility emphasizes the long-term benefits of punishment, such as ecosystem restoration and community welfare. Therefore, applying the trilogical goals of law in sentencing offenders for illegal deforestation can strike a balance between environmental protection, legal enforcement, and ecological recovery. Limitation: This research is limited to analyzing one court decision, so it is not yet able to provide a comprehensive picture of the implementation of the trilogy of legal objectives in similar cases in Indonesia. Contribution: This research contributes to understanding the implementation of the trilogy of legal objectives in the criminalization of environmental crime cases. The findings can serve as a reference for policy makers and legal practitioners to design a more balanced approach to punishment.

Abstract

Sexual violence is an act that is degrading, humiliating, harassing, and/or attacking a person’s body or reproductive function, typically caused by an imbalance of power relations or gender discrimination, which results in psychological and physical suffering. Sexual violence against children is a social problem that requires special attention because this crime involves children in its commission. The Institute for Criminal Justice Reform (ICJR) also emphasizes that intercourse with a child constitutes a criminal offense, even if it is framed as consensual, in order to protect the child’s rights and future. Based on this issue, the author aims to examine efforts to combat sexual violence against children under the guise of sexual consent to find the most effective strategies to reduce this increasingly widespread crime. The research method used is a normative and empirical juridical approach. The data used includes both primary and secondary data. Data collection procedures involve literature study and field research. The data analysis was conducted using qualitative analysis. The results of the study show that efforts to combat sexual crimes include both penal and non-penal measures. Penal efforts involve the government enacting more specific regulations on sexual crimes involving adults and children under the pretense of sexual consent, as well as taking repressive measures as a last resort. Non-penal efforts conducted by relevant institutions include public outreach and education that provides information about such criminal behaviors. The suggestions in this study are: (1) To prevent sexual crimes committed under the guise of sexual consent, it is necessary to involve the community and a supportive environment that is aware of unlawful acts occurring around them, and to collectively protect family and community members from engaging in harmful behavior. (2) The government is expected to establish more specific policies regarding sexual crimes involving adults and children under the pretext of sexual consent.

Abstract

Illegal trafficking of protected wildlife is an activity that is a threat to the survival of wildlife, Illegal trafficking categorized as a crime against wildlife includes: intentionally capturing, storing, possessing, maintaining, transporting and trading protected animals in a living condition. The problem in this thesis is what is the basis for the judge's legal considerations in passing a verdict against the perpetrator of the crime of trafficking in protected wildlife of the Siamang species in Decision Number: 134 / Pid.B / LH / 2023 / Pn Kla? is the judge's decision in imposing the sentence in accordance with substantive justice?, The research method used is normative and empirical juridical, The data used is primary and secondary data, data collection with literature studies and interviews. While data processing through the stages of data examination, data selection, data classification, and data systematization. The data that has been presented in the form of a description, discussed and analyzed descriptively qualitatively, to then draw conclusions. Based on the results of the study, it is known that the consideration of the Judge in Decision Number: 134 / Pid.B / LH / 2023 / Pn Kla in deciding the criminal case of trade in protected wildlife species of siamang, the Judge in Decision Number: 134 / Pid.B / LH / 2023 / Pn Kla related to the criminal act of trade in siamang species of wildlife considered the legal, sociological, and philosophical aspects according to Ahmad Rifai's theory. The legal aspect includes the sufficiency of evidence and the fulfillment of the elements of Article 40 Paragraph 2 in conjunction with Article 21 Paragraph 2 of Law No. 5 of 1990 concerning the Conservation of Natural Resources and Ecosystems. Sociologically, the judge sees the impact of the defendant's actions on society and the environment. From a philosophical perspective, punishment is seen not as revenge, but an effort to educate the defendant not to repeat his actions. Finally, the judge sentenced him to 1 year and 4 months in prison and a fine of Rp25,000,000, subsidiary to 1 month in prison if the fine is not paid. The suggestion is that the government, law enforcement and stakeholders are expected to increase education to the community, especially around national parks/protected forests, not to trade in protected animals. This is important to prevent similar crimes and maintain the existence of protected animals in their habitat.
