Abstract

Competition law aims to promote fair market practices and prevent monopolistic behaviour, while political economy explores the relationship between economic systems and political institutions. Together, these disciplines shape the regulatory frameworks that oversee national markets and economic policies, encouraging competition and tackling issues such as inequality and market inefficiencies. In developing countries, the influence of political economy tends to be more significant than in developed nations, which usually benefit from more stable democratic institutions and stronger legal systems. Among ASEAN member states (AMS), there is notable variation in levels of economic development, policies, political structures, and legal frameworks. Consequently, each AMS’s unique political and legal history has influenced its approach to economic management and competition law, leading to distinct priorities and concerns. These political economy factors similarly impact the process of regional competition law integration among ASEAN countries. This paper explores how political economy shaped the enactment and enforcement of competition law in selected AMS: Malaysia, Vietnam, Thailand, and Indonesia. It analyses the underlying reasons for their specific reservations, exemptions, and priorities within their competition law. Using qualitative legal research and comparative analysis, the study reviews relevant political economy structures, statutes, regulations, and policies in the chosen AMS to assess their significance and influence on competition law administration. The findings indicate that ASEAN’s regional competition law alignment and integration must recognise each AMS’s broader internal political economy, which is vital for developing competitive markets within ASEAN.

Abstract

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.

Abstract

Penelitian ini menganalisis implementasi pengaturan Perseroan Perorangan menurut Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja dalam perkembangan usaha mikro kecil di Kota Medan. Permasalahan dalam penelitian ini, yaitu; Bagaimana pengaturan Perseroan Perorangan menurut Undang-Undang Cipta Kerja khususnya yang berkaitan dengan kategori usaha mikro kecil? Bagaimana praktik pengaturan Perseroan Perorangan menurut Undang-Undang Cipta Kerja dalam kaitannya dengan perkembangan usaha mikro dan kecil di Kota Medan? Apa faktor-faktor yang mempengaruhi tercapai atau tidaknya tujuan pengaturan Perseroan Perorangan menurut Undang-Undang Cipta Kerja dalam kaitannya dengan usaha mikro dan kecil dalam menjalankan kegiatan usahanya di Kota Medan? Penelitian ini menggunakan metode penelitian hukum empiris, bersifat deskriptif analitis. Data bersumber dari data primer yaitu hasil wawancara kepada KEMENKUMHAM Kanwil Sumut, Dinas Koperasi dan UMKM Kota Medan dan pelaku UMK di Kota Medan yang dipilih secara purpossive-sampling. Selanjutnya data yang dikumpulkan dianalisis secara kualitatif dengan penarikan kesimpulan menggunakan penalaran deduktif. Implementasi pengaturan Perseroan Perorangan Menurut Undang-Undang Cipta Kerja terhadap perkembangan UMK secara sekilas terlihat sangat efektif karena proses pendirian Perseroan Perorangan sangat dipermudah, tetapi bila kita kaji kembali maka terlihat pengaturan tersebut belum maksimal. Perbankan takut memberikan kredit kepada Perseroan Perorangan karena sifatnya one tier system. UMK yang melewati omset UMK tidak bisa transfer data untuk naik kelas menjadi PT persekutuan modal, Perseroan Perorangannya harus ”bubar” lalu membentuk PT persekutuan modal dari awal kembali, oleh karena itu pelaksanaan pengaturan Perseroan Perorangan justru tidak mendukung perkembangan UMK “Naik Kelas”.

Abstract

PT PLN (Persero) UIP SUMBAGUT di Kota Medan merupakan Badan Hukum Milik Negara (BUMN) yang mewujudkan salah satu Pasal 33 UUD NKRI 1945 memiliki posisi strategis bagi peningkatan kesejahteraan rakyat dengan tujuan membangun infrastruktur ketenagalistrikan melakukan pengadaan tanah. Tanah yang telah diperoleh wajib dilakukan Pendaftaran Tanah. Pendaftaran Tanah bertujuan untuk memberikan kepastian hak kepada pemilik tanah dengan menerbitkan sertipikat untuk memberi rasa aman kepada pemilik tanah akan haknya pada tanah.  Jenis penelitian hukum normatif (yuridis normatif) atau penelitian hukum pustaka dan didukung dengan studi lapangan. Yuridis normatif yaitu penelitian yang mengacu pada teori-teori, doktrin-doktrin, norma-norma, asas-asas, prinsip-prinsip dan kaidah-kaidah hukum yang terdapat dalam perundang-undangan di Indonesia. Dukungan studi lapangan karena untuk meneliti berbagai aturan hukum undang-undang pokok agraria serta peraturan dibawahnya yang akan dikaitkan dengan pelaksanaan di lapangan dan keterangan-keterangan yang diperoleh dari wawancara kepada pimpinan PT PLN (Persero) UIP SUMBAGUT Di Kota Medan dan kantor pertanahan kota Medan.Hasil penelitian menemukan bahwa kegiatan pendaftaran tanah PT PLN (Persero) berupa Hak Guna Bangunan. Syarat pemberian Sertipikat Hak Guna Bangunan tertuang dalam Peraturan Menteri Agraria Dan Tata Ruang/ Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 18 Tahun 2021 tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah. PT PLN (Persero) UIP SUMBAGUT mengalami Problematika Yuridis dan Problematika Teknis untuk memenuhi persyaratan dokumen bukti perolehan tanah dari masyarakat maupun badan hukum lainnya.

Abstract

Artikel ini menganalisis efektivitas penerapan Peraturan Komisi Pengawas Persaingan Usaha Nomor 1 Tahun 2010 tentang Tata Cara Penanganan Perkara dalam penegakan hukum persaingan usaha di Indonesia. Penelitian ini menggunakan pendekatan yuridis normatif dengan menelaah ketentuan peraturan perundang-undangan serta didukung analisis empiris terhadap Putusan KPPU Nomor 12/KPPU-L/2011. Hasil penelitian menunjukkan bahwa penerapan Peraturan Komisi Nomor 1 Tahun 2010 belum berjalan efektif, yang dipengaruhi oleh ketidakjelasan norma, khususnya terkait perpanjangan waktu penyelidikan, rendahnya ketaatan para pihak dalam proses beracara, serta keterbatasan kewenangan regulatif KPPU. Kondisi tersebut berdampak pada belum optimalnya perwujudan kepastian hukum dan keadilan dalam penanganan perkara persaingan usaha. Oleh karena itu, diperlukan penegasan kerangka hukum acara persaingan usaha melalui penataan kewenangan Komisi dan revisi Undang-Undang Nomor 5 Tahun 1999 guna meningkatkan efektivitas penegakan hukum persaingan usaha di Indonesia.

Abstract

Abstract: The obligation to implement Social and Environmental Responsibility (TJSL) in Indonesia has been regulated by law, but regulations regarding the provision of incentives for companies that implement it have not been comprehensively formulated. This situation raises questions about the effectiveness of TJSL policies in encouraging corporate compliance while increasing the attractiveness of national investment. This study aims to analyze the regulation of TJSL incentives in the Indonesian legal system, assess the urgency of providing incentives from the perspective of legal certainty and ease of doing business, and compare them with policies implemented in Singapore. This study is a normative legal study with legislative, conceptual, and comparative approaches. Primary and secondary legal materials are analyzed qualitatively using the theory of legal certainty, development law theory, and comparative law theory as analytical frameworks. This study shows that the regulation of TJSL incentives in Indonesia is still limited, not systematically integrated with investment and ease of doing business policies, and has not been designed as a strategic instrument to encourage optimal corporate participation. In contrast, Singapore implements a more structured approach through a combination of fiscal and non-fiscal incentives aligned with sustainable development policies and improving the investment climate. Therefore, reformulating CSR incentive policies in Indonesia is necessary to create legal certainty, increase the effectiveness of CSR implementation, and strengthen national competitiveness and investment attractiveness. The formulation of clear, measurable, and integrated incentives will make CSR not only a legal obligation but also a strategic instrument for sustainable economic development. Abstrak: Kewajiban pelaksanaan Tanggung Jawab Sosial dan Lingkungan (TJSL) di Indonesia telah diatur dalam peraturan perundang-undangan, namun pengaturan mengenai pemberian insentif bagi perusahaan yang melaksanakannya belum dirumuskan secara komprehensif. Kondisi ini menimbulkan persoalan mengenai efektivitas kebijakan TJSL dalam mendorong kepatuhan korporasi sekaligus meningkatkan daya tarik investasi nasional. Penelitian ini bertujuan untuk menganalisis pengaturan insentif TJSL dalam sistem hukum Indonesia, menilai urgensi pemberian insentif dalam perspektif kepastian hukum dan kemudahan berusaha, serta membandingkannya dengan kebijakan yang diterapkan di Singapura.Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Bahan hukum primer dan sekunder dianalisis secara kualitatif dengan menggunakan teori kepastian hukum, teori hukum pembangunan, dan teori perbandingan hukum sebagai kerangka analisis. Penelitian ini menunjukkan bahwa pengaturan insentif TJSL di Indonesia masih bersifat terbatas, tidak terintegrasi secara sistematis dengan kebijakan investasi dan kemudahan berusaha, serta belum dirancang sebagai instrumen strategis untuk mendorong partisipasi korporasi secara optimal. Sebaliknya, Singapura menerapkan pendekatan yang lebih terstruktur melalui kombinasi insentif fiskal dan non-fiskal yang selaras dengan kebijakan pembangunan berkelanjutan dan peningkatan iklim investasi. Atas dasar hal tersebut reformulasi kebijakan insentif TJSL di Indonesia diperlukan guna menciptakan kepastian hukum, meningkatkan efektivitas pelaksanaan TJSL, serta memperkuat daya saing dan daya tarik investasi nasional. Perumusan insentif yang jelas, terukur, dan terintegrasi akan menjadikan TJSL tidak hanya sebagai kewajiban hukum, tetapi juga sebagai instrumen strategis pembangunan ekonomi berkelanjutan. Abstract

The Indonesian government has not been optimal in promoting the development of UMKM as a strategy to achieve the SDGs. As a result, the global commitment for people around the world to enjoy a peaceful and prosperous life by 2030 is still difficult to achieve. The main issue in this paper questions the extent of the Indonesian government's efforts in promoting the development of UMKM. Using the normative juridical research method, the research findings show that UMKM play an important role in national economic development, thus they should be the focus of strategies to achieve the SDGs. Indonesia itself has policies and regulations that mandate the development of UMKM. Unfortunately, the implementation of those policies and regulations has not met expectations due to paradigmatic constraints within them. Therefore, it is recommended that the Indonesian government undertake legal reforms in the field of investment to optimize the implementation of existing policies and regulations, particularly in the field of investment, in developing UMKM.

Abstract

The era of globalization has encouraged the influx of foreign investment into Indonesian industries, creating market structures that are vulnerable to anticompetitive practices by multinational corporations. The Sany Group case has become a significant precedent in the enforcement of Indonesian competition law. KPPU Decision Number 18/KPPU- L/2024 represents the first vertical integration case involving a foreign entity and resulted in a substantial administrative fine. This study examines the regulation of vertical integration under Indonesian competition law, the provisions governing dealer agreements with foreign business actors, and the juridical analysis of KPPU Decision Number 18/KPPU- L/2024 concerning the alleged violation of Article 14 of Law Number 5 of 1999 by Sany Group. This research employs a normative juridical method with a descriptive nature, utilizing statutory, conceptual, and case approaches. Data were collected through library research and analyzed qualitatively using a deductive reasoning framework. The findings indicate that, procedurally, the decision has fulfilled the elements required under Article 14. Substantively, however, the essence of Sany Group's violation lies in the abuse of economic dependence arising from asymmetrical bargaining power rather than merely vertical integration. The application of the extraterritoriality principle in this decision faces challenges because Law Number 5 of 1999 does not explicitly regulate the authority of the Business Competition Supervisory Commission (KPPU) in this regard. In practice, Sany Group's conduct more closely corresponds to the provisions of Article 25 concerning the abuse of a dominant position. The inability of Article 25 to adequately address this case stems from its quantitative approach based on market share thresholds. This study recommends revising the implementing guidelines of Article 25 to accommodate the concept of abuse of economic dependence and to clarify the extraterritorial authority of the KPPU.
