Islam gives freedom to people to choose their religions in accordance with their will and faith as stated in the Qur’an,2:256. For practitioners, the meaning of religious conversion is closely related to personal dimension that they feel; conversion as the shifting from something bad into the good one, the shifting from one religion into another, the shifting from inappropriate side into the appropriate side, and the appropriateness of long process of finding the God. For the religious elite, religious conversion is one dimension of religious freedom, which is closely related to the esoteric dimension experienced and perceived by the practitioners. Besides, pragmatic-practical motive in the form of marriage and promotion cannot be avoided in conversion case. In wider context, conversion can be understood as one of positive influence of inter-religious relationship in plurality context. However, it can be also a negative influence when the conversion is not based on strong belief in the new religion. Otherwise, the conversion is based on contemporary interest of the practitioners which is pragmatic and practical. The phenomenon of religious conversion mostly becomes destructive potential for the building of religious harmony, as in the religious community have triumphalistic ideology.

Josep Schacht adalah seorang tokoh orientalis yang memiliki concern pada kajian hadis dan hukum Islam. Schacht memperkenalkan teori projecting back, common link dan argumentum e silentio. Ketiga teori tersebut bertujuan untuk menguji autentisitas dan orisinalitas hadis, namun lebih condong melemahkannya secara paradigmatik. Tiga teori yang digagas Schacht tersebut mendapatkan respon pro dan kontra. Sebagian sarjana membantah keras teori Schacht yang mengatakan bahwa semua hadis tidak otentik berasal dari Nabi. Diantara bantahan tersbut datang dari seorang pakar hadis modern, Muhammad Musthafa Azami. Artikel ini mendiskusikan ketiga teori yang digagas Schacht beserta bantahan Azami terhadapnya. Penelitian ini menggunakan pendekatan deskriptif dan analisis konten. Hasil penelitian menunjukkan ketiga teori yang digagas oleh Josep Schacht tersebut terdapat sejumlah kecacatan hingga tidak ilmiah di mata Musthafa Azami dan melalui penelitian dengan pendekatan historis-filologis, Azami mampu membuktikan otentisitas hadis. Dengan demikian, meskipun pengkajian ilmiah kerap kali digaungkan sebagai aktifitas yang objektif, nyatannya sangat sulit ditemukan tanpa unsur keberpihakan dari seorang peneliti.

Abstrak Penelitian ini bertujuan untuk mengeksplorasi konsep kafa’ah dalam hadis tentang kriteria memilih pasangan dan implikasinya dalam legislasi hukum Islam di Indonesia. Penelitian ini bersifat kualitatif yang mendasarkan dirinya pada studi pustaka (library research) dengan pendekatan sosiologi hukum sebagai pisau bedah analisisnya. Hasil dari penelitian ini menunjukkan bahwa Kontinyuitas blue print pesan hadis tentang kafa’ah yang menempatkan agama sebagai skala prioritas dalam memilih calon pasangan terbukti telah mewarnai dan turut mempengaruhi legislasi hukum Islam, tak terkecuali di Indonesia. Kalam Insya’ pada redaksi matannya merupakan bukti bahwa Nabi SAW mencoba mengaktualisasikan nilai-nilai hukum Islam baik secara formil maupun materiil sesuai kedudukannya sebagai pemegang otoritas ketuhanan (al-Syari’ Majaziy) dan kenegaraan sekaligus. Pada masa selanjutnya, posisi pemegang otoritas ini diwakili oleh penguasa/pemerintah (di Indonesia terdiri atas lembaga legislatif, eksekutif dan yudikatif), termasuk dalam hal ini adalah pasal 61 Kompilasi Hukum Islam tentang pencegahan pernikahan karena tidak sekufu’ dalam hal agama. Pada gilirannya, aspek keterpengaruhan ini membawa beberapa implikasi yakni : 1) terjadinya pergeseran paradigma hukum perkawinan dari diyani menuju qadha’i; 2) Materi hukum bercorak semi otonom dan melahirkan implementasi hukum yang semi responsif; 3) Pergeseran etika dari solipsistik ke etika universal.

Gender adalah seperangkat sikap, peran, tanggung jawab, fungsi, hak, dan perilaku yang melekat pada diri laki-laki dan perempuan akibat bentukan budaya atau lingkungan masyarakat tempat manusia itu tumbuh dan dibesarkan. Penelitian ini membahas hadits hadits berkaitan dengan kesetaraan gender, yaitu hadits berkaitan dengan penciptaan dan kepemimpinan perempuan. Hadits tentang pnciptaan perempuan secara tekstual menyatakan bahwa perempuan tercipta dari tulang rusuk laki-laki, sedangkan kelompok feminisme menilai hadits tersebut sebagai hadits yang dhoif dan melalui metode penafsiran lain menyatakan bahwa laki-laki dan perempuan tecipta dari satu hal yang sama. Hadis-hadis tentang kepemimpinan wanita memunculkan dua gagasan, yakni gagasan dari kelompok tekstualis dan kontekstualis. Kelompok tekstualis secara jelas melarang wanita menjadi sosok pemimpin sebagaimana teks hadis yang diriwayatkan oleh sahabat Abi Bakrah. Sementara, kelompok kontekstualis secara sudut pandang memberikan kebebasan kepada seorang wanita untuk memimpin di wilayah publik sekalipun. Tentu berbeda dengan kelompok tekstualis yang hanya memandang wanita dalam bentuknya secara fisik bukan kapabilitasnya sebagai makhluk Allah yang sama derajatnya dengan laki-laki.

This empirical-ethnographic research delves into the burgeoning landscape of social media discussions, particularly focusing on the YouTube channel @FaqihAbdulKodir. Amidst the plethora of content, this channel stands out for its unique exploration of ḥadīth through the lens of qirā’ah mubādalah, attracting a substantial audience and gaining recognition among academics and gender activists. Employing reception theory analysis, this study seeks to synthesize insights from @FaqihAbdulKodir’s exploration of ḥadīth concerning livelihood. The research sheds light on the reception of the prophet’s teachings, unraveling the intricate process of knowledge transmission. The findings reveal a spectrum of internalisations, rooted in the understanding of reciprocity. The research concludes with three distinct types of reception. First, an exegesis reception manifests as a trending interpretation style of living ḥadīth. Second, an aesthetic reception highlights the beauty of Islamic teachings, fostering equality before God, particularly in matters of livelihood. Third, a functional reception emerges, emphasizing mutuality in family income as a cornerstone for household harmony. This study not only contributes to the academic discourse on ḥadīth but also offers insights into the multifaceted impacts of @FaqihAbdulKodir’s channel on individuals’ perceptions and practices in their daily lives.

This article explores aspects of gender equality in the context of divorce, with a study focus on the hadith that discuss divorce actions taken by women. This study aims to explore a deeper understanding of the Islamic view of divorce initiated by women and its impact on gender equality in society. By detailing the various relevant hadiths, the study analyzes the context, law, and wisdom behind the ruling. The results of this study show that women can terminate their marriage by filing a khul' (sue for divorce) before a religious court. With this, it is hoped that every married couple has the awareness to carry out their duties and treat their spouses well, so that the harmony and integrity of the household can be maintained.

The injustice of women is still rampant today. People often use religious teachings to perpetuate patriarchal systems. The purpose of this study is to examine the concept of women's justice in Islam from the perspective of Asghar Ali Engineer. This research uses qualitative methods with a library research approach, namely research conducted by reading the concept of equality of women used in the book "The Right of Women in Islam", data collection techniques in this study are carried out by reading, understanding, and examining parts of the book that are relevant to the theme of discussion, then content analysis is carried out to obtain a clear understanding of the information or data obtained. The result of this study is the concept of women's justice in Islam perspective Aghar Ali Engineer can be seen in his thoughts which are summarized on several themes, namely: Asghar criticism of women's justice, women's leadership, women's testimony, inheritance of women, women in marriage, and women and divorce. From these themes have shown about the various criticisms made by Asghar in order to defend women's justice, it can be understood that Asghar rejects various legal foundations that normatively degrade women.

Abstract: Along with the development of the times, some individuals perform sex reassignment surgery because they feel that their current body is not following their psyche. Individuals who perform sex reassignment surgery are called transsexuals. In Indonesia, after performing a sex change operation, you can apply to the District Court to get a change of identity on your residence card. When they have officially changed their gender and identity, the question that will be asked is whether the rights they will get will be the same as the rest of the general public. One of the rights of each individual is to carry out marriage, which is a marriage between a man and a woman. However, in Indonesia, there are no regulations regarding marriages carried out by transsexuals. So there is a need for a study of transsexual marriage, which would be appropriate if viewed from the perspective of natural rights theory. The purpose of this study is to describe transsexual marriage from the perspective of natural rights theory. This type of research is normative legal research using a conceptual approach. Based on the analysis carried out, it can be seen that marriages performed by transsexuals are not legal according to religion and the state because they violate the boundaries and rules that have been set by the state.Keywords: Marriage; Transsexual; Natural Rights.Abstrak: Seiring dengan perkembangan masa terdapat beberapa individu yang melakukan operasi pergantian kelamin karena merasa tubuh yang dimilikinya sekarang tidak sesuai dengan kejiwaannya. Individu yang melakukan operasi pergantian kelamin disebut dengan transeksual. Di Indonesia sendiri, setelah melakukan operasi pergantian kelamin maka dapat mengajukan ke Pengadilan Negeri untuk mendapatkan perubahan identitas pada kartu kependudukannya. Ketika secara resmi telah berubah kelamin serta identitasnya, maka yang akan menjadi pertanyaan adalah terkait hak-hak yang akan didapatkannya apakah akan dipersamakan dengan masyarakat umum lainnya. Salah satu hak setiap individu adalah melaksanakan perkawinan, yang mana perkawinan tersebut antara laki-laki dengan perempuan. Namun di Indonesia tidak ada aturan terkait perkawinan yang dilakukan oleh transeksual. Sehingga perlu adanya kajian tentang perkawinan transeksual, yang mana akan tepat jika ditinjau dari perspektif teori hak kodrati. Tujuan dari penelitian ini adalah untuk mendeskripsikan perkawinan transeksual yang ditinjau dari perspektif teori hak kodrati. Jenis penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan konseptual. Berdasarkan analisa yang dilakukan dapat diketahui bahwa perkawinan yang dilakukan oleh transeksual tidak sah menurut agama dan negara karena melanggar batasan-batasan dan aturan yang telah ditetapkan oleh negara.Kata Kunci: Perkawinan; Transeksual; Hak Kodrati.

This research explores the phenomenon of ta'lim and salawat through Majlis Maulid wa al-Ta'lim Riyad al-Jannah as an embodiment of the concept of living hadith which functions to emulate the da'wah of the Prophet PBUH. Observation, interviews, and documentation were carried out in the ta'lim assembly, while condensation analysis, data presentation, and triangulation techniques were used for data validation. The results of the study reveal several main points: 1) The concept of prophetic character formation is based on the Qur'an, hadith, culture, and liberation-transcendent humanist values; 2) Salawat hadith is the basis for worshippers to salawat as a form of prayer for blessings and peace of life; 3) The implementation of prophetic character formation is carried out through three paths: the formation of an understanding of prophetic values, the habituation of prophetic values through culture, and the development of discipline; 4) The implications of the formation of prophetic character result in individual transformation (personal change) and social (active in religious, environmental, and community activities). This transformation also has an impact on the taklim council as a universal holistic education base.

Radicalism is a doctrine to someone who is closely related to the jihad phenomenon identified with negative actions. Every so often our societies are confronted with terrorist violence because of radicalization. Therefore, this research wants to focus on the role of the family in preventing radicalism and how can social interaction in the environment affect the entry of radicalism towards children. This research used library research based on the type of current research approach. The findings show that the role of education by family units has a great contribution to the deradicalization process, through the important role of education that can be directly exemplified by the family. In addition to the social interaction channels, interaction in social groups with children and other family members, especially in the context of interaction through the internet, also needs to be considered.
