Abstract

Increasing the legal responsibility of hospitals in the management of drugs and medical devices is a strategic step in improving the quality of health services and protecting patient rights. Hospitals have an obligation to ensure that all drugs and medical devices used meet the standards of safety, effectiveness, and compliance with applicable regulations. Good governance includes distribution supervision, stock management, and usage control, which serve to minimise risks to patients. In addition, improper management can potentially lead to legal consequences in the form of sanctions or prosecution. Overall, strengthening the legal responsibility of hospitals is an important element in creating a safer, more efficient and reliable healthcare system in accordance with regulatory standards and medical ethics.

Abstract

Complaints and legal dispute resolution mechanisms between medical personnel and patients are important processes in safeguarding patients' rights while ensuring that medical personnel carry out their profession with applicable standards. Complaints are usually made by patients or families to the relevant institutions, where the process may involve mediation as an initial attempt at resolution. If mediation is unsuccessful, the dispute may proceed through formal legal channels or alternative mechanisms such as arbitration. Settlements are based on evidence, medical documentation, and expert opinion to ensure fair decisions. This mechanism is designed to create transparency, accountability, and legal protection that helps build trust between patients and medical personnel and maintain the quality of healthcare services.

Abstract

Dispute resolution in the health sector often involves complex and emotional processes. This study examines the development of restorative policies as an alternative to health dispute resolution using a comparative approach. Restorative policies, which focus on dialogue, mediation and consensus-based resolution, enable peaceful dispute resolution and maintain good relations between patients, health workers and healthcare institutions. This study revealed that the implementation of restorative policies can reduce emotional tension, accelerate resolution, and minimise stigma. Strong policy support, including training of professional mediators and strengthening health sector regulations, is required for the successful implementation of restorative methods. The main recommendation is the integration of restorative policies into a more humane and inclusive health dispute resolution system, providing satisfactory outcomes for all parties involved.

Abstract

The phenomenon of homelessness and begging in public places remains a complex social problem and has an impact on public disclosure and legal norms. The main problem in this study is how the criminal law against homelessness and begging in public places, and how the calculation of its provisions in the old Criminal Code and the new Criminal Code based on Law Number 1 of 2023. This study uses a normative juridical method with a regulatory-statutory approach and literature study. In the old Criminal Code, the act of begging is regulated in Article 504 which threatens imprisonment for anyone who begs in public. Meanwhile, the new Criminal Code regulates similar acts in Article 425 which no longer uses the term "begging" explicitly, but regulates the prohibition against the repeated exploitation of certain activities in public places that disturb the community. The results of the study show that despite substantial continuity, the new Criminal Code tends to use a more humanistic approach and emphasizes social rehabilitation. Law enforcement against homelessness and begging still faces various obstacles such as low public reporting, limited supervision by officials, and minimal rehabilitation facilities. Therefore, the main conclusion of this study is that a repressive approach alone is insufficiently effective. An integrated legal strategy is needed, combining penal and non-penal approaches, with the active involvement of the government, the community, and social institutions.

Abstract

The Constitutional Court's decision No. 112/PUU-XX/2022, which changed the term of office for the leadership of the Corruption Eradication Commission (KPK) from four years to five years, has sparked controversy in the realm of Indonesian constitutional law. The Constitutional Court, which is supposed to act as a negative legislator, is considered to have exceeded the limits of its authority by establishing new norms in its decision. This research aims to analyze whether the action is a form of deviation of the Constitutional Court's authority referring to the 1945 Constitution and Law Number 24 of 2003 concerning the Constitutional Court. This research uses a normative juridical method with a descriptive-analytical approach through a literature study of regulations, scientific journals, and other legal sources. The research findings indicate that the Constitutional Court not only declared Article 34 paragraph (1) of the KPK Law contrary to the 1945 Constitution, but also stipulated a direct change in the term of office to five years, including for the current KPK leadership. This action is considered a form of judicial activism that deviates from the principle of separation of powers and the principle of non-retroactivity of law. In conclusion, the Constitutional Court's decision creates legal uncertainty, opens space for politicization of the judiciary, and sets a negative precedent in Indonesia's constitutional system. Therefore, it is necessary to reaffirm the limits of the authority of the Constitutional Court in order to remain within the framework of constitutional law that upholds the principle of checks and balances at all times.

Abstract

The tax system in Indonesia adheres to the principle of “Self Assessment,” whereby taxpayers' calculations of their tax withholding, payment, and reporting obligations are considered accurate until a Tax Audit Order is issued by the Directorate General of Taxes of the Ministry of Finance of the Republic of Indonesia. Furthermore, tax treatment in Indonesia must reflect fairness for every person (taxpayer) as mandated by Article 28D paragraph (1) of the 1945 Constitution, and the hierarchy of laws and regulations below it must not conflict with the 1945 Constitution. This is expected to create legal certainty and a business-friendly environment, ultimately improving the welfare of Indonesian citizens through increased state revenue from the tax sector for national development and fostering a healthy business climate. The researcher will conduct a case study on the differences in VAT treatment of input tax credits for taxpayers who are still in the pre-production phase and taxpayers who are already in production, using a normative legal approach in the research. The objective of this research is to examine the application of VAT treatment by minimizing “gray areas” and “multiple interpretations” of a provision in legislation, thereby creating legal certainty that is fair and just. It is hoped that the results of this study will create conditions where tax regulations do not conflict with higher-level regulations, thereby avoiding harm to taxpayers.

Abstract

The legal relation in insurance law, both in theory and in practice, has undergone changes following the Constitutional Court Decision Number 83/PUU-XXII/2024, which conditionally declared Article 251 of the Indonesian Commercial Code (KUHD) unconstitutional. The aforementioned decision has had significant implications, not only in practical terms for the insurance business practices in Indonesia but also indirectly by altering the foundational concept of contractual obligations as recognized within the Indonesian legal system. The existence of undeclared pre-existing conditions, which has long served as the basis for the annulment of health insurance contract, can no longer be used by insurance companies as grounds to terminate their coverage relationship with policyholders. This normative legal research will elaborate on the implications of the enforceability of Article 251 of the Commercial Code following the Constitutional Court Decision Number 83/PUU-XXII/2024. In practice, the Constitutional Court Decision Number 83/PUU-XXII/2024 has had a positive impact on the protection of health insurance policyholders' rights. However, it also gives rise to legal inconsistencies when confronted with the concept of contractual law as recognized in the Indonesian legal system.

Abstract

The development of deepfake technology powered by artificial intelligence has brought significant changes to the digital communication landscape and the perception of truth. Deepfakes enable the creation of highly realistic, yet entirely fake, visual and audio content, blurring the line between fact and fabrication. This study uses a literature review method to analyze the ethical and social implications of the deepfake phenomenon, particularly regarding the future of truth. The results show that deepfakes pose serious challenges in the form of privacy violations, the spread of disinformation, a decline in public trust, and the potential for social polarization and threats to democracy. On the other hand, this technology also offers innovative opportunities in the fields of entertainment, education, and health if used responsibly. Therefore, adaptive regulations, the development of detection technologies, and increased digital literacy are needed to minimize the risks and maximize the benefits of deepfakes for society.

Abstract

Elections as a process of changing national leadership are reflected in the 2024 presidential general election which will elect the president for the next five years. In the 2024 presidential election there will be guarantees and protection for human rights, including political rights, especially the right to vote and be elected through a process of political contestation. But in practice, there are many violations of politics, especially people's right to vote. This research aims to see to what extent the legal rules in the 2024 presidential election guarantee and protect citizens' voting rights in accordance with the constitution in the Pancasila country. This research method is literature study. The results of the research are that there are several legal regulations that protect citizens' voting rights, including Article 27 paragraph (1) of the 1945 Constitution, Article 28D paragraph (1) of the 1945 Constitution, Article 28I paragraph (2) of the 1945 Constitution, Constitutional Court Decision Number: 011-017/ PUU-I/2003, Constitutional Court Decision Number: 102/PUU-VII/2009, article 43 of Law Number 39 of 1999 concerning Human Rights (HAM) and Law Number 7 of 2017 concerning General Elections. The conclusion of the research is that existing legal regulations seek to guarantee and provide protection to citizens so that they can channel their voting rights properly as a form of channeling citizens' political rights and citizens' rights in providing strong legitimacy to the president and vice president of the Republic of Indonesia 2024-2024.
