Abstract

Data protection in the healthcare sector is a crucial aspect in the digital era, given the increasing volume and complexity of data. This article explores existing data protection policies and practices, such as the General Data Protection Regulation (GDPR) and the Health Insurance Portability and Accountability Act (HIPAA), which provide a framework for regulating patient data privacy and security. Although policies are in place, significant challenges remain, particularly with growing cyber threats and sometimes outdated technology. Various practices have been implemented to address these challenges, including the use of encryption, blockchain technology, and improved security systems. Education and training for health workers and collaboration between stakeholders are also important elements in ensuring effective data protection. Going forward, a multidimensional approach that includes policy, technology, and human awareness is needed to ensure the security of patient data, reduce risk, and improve the quality of health services.

Abstract

Cases of theft of company assets by unscrupulous employees are a criminal offense. Theft of company assets with entry permit facilities causes losses for the company, not only loss of assets, but also other legal consequences in the form of administrative sanctions from the government for the loss of goods with entry permit facilities. This research aims to understand the legal consequences for companies that are victims of criminal acts committed by unscrupulous employees considering that the goods stolen are imported goods with import duties exemption facilities which are the company's responsibility to the government authority that provides these facilities (for example: the Investment Coordinating Board and Directorate General of Customs and Excise). Next, examine whether administrative sanctions for the loss of company assets with import duty facilities fulfill the principles of justice for companies that are victims of theft by unscrupulous employees. This research is a Normative Juridical research with a legal approach and the concept of examining laws, research results and books to find legal theories, principles and views in the process of obtaining answers which are the main subject of this research.

Abstract

Freedom of opinion in Indonesia, constitutionally guaranteed as a human right, faces challenges in the digital era due to the ambiguous enforcement of the ITE Law, which initially targeted cybercrimes but expanded to regulate online speech, risking democratic expression. This study analyzes the ITE Law’s evolution (2008–2024) to assess its impact on freedom of expression in digital democracy, focusing on legal shifts and enforcement practices. Using normative juridical research, the study examines secondary legal materials through qualitative analysis, including legislation, court decisions, and scholarly works. The 2024 revisions reduce penalties and limit complaints to directly affected individuals, aiming to curb repression. However, ambiguities persist in defamation provisions, and enforcement biases threaten free speech. The study underscores the need for clearer legal standards, digital literacy programs, and alternative dispute mechanisms to align the ITE Law with democratic principles. Future research should explore comparative models and the law’s societal impact post-revision.

Abstract

The legal political system greatly influences the Indonesian state to become a state based on law, thus requiring the involvement of community components in the process of formulating laws. This is so, because the legal political system will have a vital role in making the law. This is because the direction of the Indonesian state in the application as a state of law uses the concept of Continental European Civil Law, where written law is a very important part of the formation process, and is used as the basis for the implementation of governance. In order to ensure the implementation of legal protection for all people, as well as justice in treatment, and guarantee protection of citizens' rights, it is necessary to establish concrete guidelines in planning and drafting laws. This is intended to be the basis for regulating the process of law-making, starting from the beginning until the time when the law is enacted or applied in regulating the life of the state society. Thus, by creating concrete guidelines and guidelines, each law-making process can be carried out in a definite, consistent, and standardised manner.

Abstract

Digitalisation in the healthcare sector is bringing about a major transformation in the way healthcare communication is conducted, especially regarding the management of patient data and the protection of medical rights. This study uses the literature method. The research findings found that current legal regulations are still not fully responsive to the rapid development of technology, so a more comprehensive policy update is needed. Emphasis is placed on the need for harmonisation between health technology innovation and ethical and legal principles to maintain the security of medical information. This article offers solutions to improve legal protection in health communication, with the aim of creating a digital health system that is safe, reliable, and effective for the community.

Abstract

This study explores the ethical and legal dilemmas in the delivery of health information on digital platforms, focusing on three main aspects: transparency, misinformation, and legal liability. In the digital age, quick and easy access to health information should help people make better decisions. However, a lack of transparency and the spread of misinformation can be detrimental to public health. This study emphasises the importance of transparency in information delivery to build public trust, while identifying misinformation as a serious threat to public health. The study also discusses the legal responsibility that information providers and digital platforms have to ensure the information provided is valid, accurate and based on scientific evidence. With a combination of strict regulations and strict law enforcement, it is hoped that a safer and more reliable information environment can be created for the public.

Abstract

Technology-based health communication has experienced rapid development in the era of digital transformation, especially through the implementation of telemedicine. This development accelerates access to healthcare services, improves efficiency in diagnosis and treatment, and enables remote interaction between patients and medical personnel. However, advances in health technology also present significant regulatory challenges. Legal regulations are crucial to ensure that telemedicine services operate in accordance with professional ethics and applicable laws, and provide adequate protection for sensitive patient data. Data protection is an important aspect that must be strictly maintained to prevent the risk of leakage and misuse of health information. Effective telemedicine implementation requires close collaboration between the government, healthcare providers, and technology industry players. With strong legal regulations, safe technology implementation, and public education, an inclusive, efficient, and reliable digital healthcare ecosystem can be created.

Abstract

This research discusses health communication law within the framework of the pandemic crisis with a focus on public information policy, government accountability, and implications for the protection of public rights. Transparent and accurate communication is a key element in delivering health information to the public to prevent misinformation and increase public awareness of pandemic mitigation measures. Government accountability in managing health communication policies also plays a major role in building public trust and ensuring effective policy implementation. In addition, this study highlights the importance of protecting people's rights, especially access to correct information and guaranteeing individual privacy, especially regarding health data. This study emphasises that health communication law should be a strategic instrument to balance crisis management with the protection of human rights and public communication ethics.

Abstract

The legal portrait of health communication is an important study that highlights aspects of responsible health information delivery, protection of patient rights, and the role of the media in public education. The delivery of health information must be based on strict ethical and legal standards, so that the public gets accurate and reliable data. In addition, the law also serves to protect patients by ensuring the confidentiality of health information and guaranteeing correct and transparent information. The media, as the main means of information dissemination in the digital era, plays a crucial role in improving public health literacy and preventing the spread of hoaxes that can be misleading. With a synergistic interaction between information providers, legal regulations, and the media, effective health communication can be achieved, benefiting the welfare of society at large.

Abstract

This study aims to analyse the monitoring mechanism of the Corruption Eradication Commission's (KPK) wiretapping authority from a human rights perspective. The research method used is normative juridical with a literature study approach, which examines various laws and regulations, court decisions, and relevant legal literature. The results showed that the tapping supervision mechanism by the KPK Supervisory Board still has various weaknesses, such as potential conflicts of interest, risk of information leakage, and unclear standard procedures. In addition, administrative supervision has not been able to fully guarantee the protection of privacy and human rights. Therefore, it is necessary to optimise a more proportional supervision model, through regulatory reform, strengthening independent external supervision, and utilising technology to increase transparency and accountability. This effort is expected to create a balance between the effectiveness of corruption eradication and the protection of human rights in Indonesia.
