Abstract

Basic Education as a leading pioneer in Strengthening Muslim Character has a relationship with character education. The implementation of Strengthening Character Education is carried out with the principle of school-based management which is the responsibility of school principals and teachers, as the fulfillment of the workload of teachers and school principals (Article 6 paragraph 3,4,5 PP 87/2017). According to President Joko Widodo's directive, character education at the basic education level gets a larger portion than education that teaches knowledge, for Elementary Schools by 70% while for Junior High Schools by 60%. The point of this research is management of strengthening characters education in elementary schools are includes planning, implementation and evaluation. The research method is descriptive qualitative through observation, documentation and interview.The result of this research obtained depiction that the first,the reinforcement of character education students have been implemented well through the preparation of goals, strategy and policy mapping and procedure mapping and program improvement using RPP and syllabus design; second, the implementation of character education runs well through activities of religious activities, nationalism cultivation, social care and environmental awareness; third, evaluation of the strengthening of character education management students through supervision activities on the implementation of activities by carrying out reflections, analysis and follow-up plans.

Abstract

The development of information technology has given rise to new forms of crime, one of which is online gambling, characterized by its cross-border nature, anonymity, and digital system-based operations. However, the criminal punishment of such offenses in Indonesia still relies on Article 303 of the Indonesian Criminal Code (KUHP), which was originally designed to regulate conventional gambling. This condition creates juridical problems because the application of outdated legal norms to online gambling is often carried out through analogical interpretation, which potentially contradicts the principle of legality (nullum crimen sine lege). This study aims to analyze the current criminal punishment framework for online gambling offenses and examine the urgency of reformulating criminal law policy regarding online gambling in Indonesia. The research employs a normative juridical method using statutory, conceptual, and case study approaches to relevant court decisions. The legal materials consist of primary legal sources in the form of legislation and secondary legal sources such as legal literature, journals, and expert doctrines. The analysis is conducted qualitatively and descriptively by examining the compatibility of existing legal norms with the development of digital crimes. The results of the study indicate that Article 303 of the Criminal Code is no longer capable of addressing the complexity of online gambling, particularly in terms of offense formulation, legal subjects, and operational mechanisms of digital crime. The existing criminal sanctions are also considered disproportionate to the socio-economic impacts caused, such as money laundering, public financial losses, and increasing derivative crimes. Therefore, the reformulation of criminal law policy has become an urgent necessity through the establishment of specific legal norms explicitly regulating the definition of online gambling, forms of conduct, criminal liability, and proportional sanctions. Thus, the national criminal law system can become more responsive, effective, and capable of providing legal certainty in addressing the development of digital crime. Abstract

Drug abuse in Indonesia continues to generate complex legal and public health problems due to the inconsistency between punitive narcotics law enforcement and recovery-oriented rehabilitation policies. Although Law Number 35 of 2009 concerning Narcotics recognizes rehabilitation through Articles 54, 103, and 127, the implementation of these provisions remains ineffective because the law simultaneously criminalizes narcotics users while providing facultative rehabilitation measures. The phrase “may” in Article 103 creates excessive judicial discretion, resulting in sentencing disparities, inconsistent rehabilitation practices, and the continued dominance of imprisonment for narcotics users. This condition reflects a normative conflict between punitive criminalization under the Narcotics Law and the rehabilitative measures paradigm introduced by Law Number 1 of 2023 concerning the Indonesian National Criminal Code. This study aims to analyze the doctrinal weaknesses of rehabilitation regulation for narcotics users and formulate an integrated rehabilitation model within the national criminal law system. This research employs normative legal research using statutory, conceptual, and case approaches through qualitative legal analysis of legislation, court decisions, and criminal law doctrines. The study finds that the primary weakness of the current rehabilitation policy lies in the ambiguity of legal subject classification, the absence of standardized assessment mechanisms, and the facultative nature of rehabilitation norms. This study proposes a reformulation model in the form of mandatory conditional rehabilitation for narcotics users and addicts proven to consume narcotics for personal use and not involved in trafficking networks. The reformulation should systematically integrate rehabilitation provisions in the Narcotics Law with rehabilitative measures under Articles 103 and 105 of the Indonesian National Criminal Code to establish a more proportional, health-based, and restorative criminal justice system. This model contributes to contemporary Indonesian criminal law reform by strengthening therapeutic jurisprudence and public health criminal policy approaches in narcotics law enforcement.

Abstract

Tindak pidana korupsi merupakan kejahatan luar biasa yang menimbulkan kerugian negara secara masif. Sistem pemulihan aset di Indonesia yang masih bergantung pada mekanisme conviction-based forfeiture dinilai tidak memadai dalam menghadapi kompleksitas kejahatan ekonomi modern, sebagaimana tercermin dalam kasus Harvey Moeis di mana uang pengganti yang ditetapkan hanya 0,14 persen dari total kerugian negara. Penelitian ini bertujuan mengkaji politik hukum pidana Indonesia dalam kerangka RUU Perampasan Aset dan membandingkannya dengan sistem Non-Conviction Based (NCB) Asset Forfeiture di Amerika Serikat. Metode yang digunakan adalah yuridis normatif dengan pendekatan perbandingan hukum dan penarikan kesimpulan secara deduktif. Hasil penelitian menunjukkan bahwa Indonesia menghadapi tiga kelemahan struktural, yakni kekosongan substansi hukum, fragmentasi kewenangan kelembagaan, dan budaya hukum yang berorientasi pada pemidanaan badan. Dibandingkan dengan Amerika Serikat yang telah menerapkan mekanisme civil forfeiture melalui gugatan in rem berdasarkan Civil Asset Forfeiture Reform Act (CAFRA) 2000, Indonesia masih tertinggal dalam efektivitas pemulihan aset. Penelitian ini merekomendasikan pengesahan RUU Perampasan Aset dengan adopsi mekanisme NCB model hybrid, penguatan kapasitas kelembagaan KPK, PPATK, dan Kejaksaan Agung, serta pengembangan mekanisme Mutual Legal Assistance yang lebih proaktif.

Abstract

Abstract: This study examines the application of the double track system and the anti-SLAPP principle in Indonesian criminal law, with a focus on Decision Number 374/Pid.Sus/2024/PT SMG. The research addresses two questions: how the double track system operates in cases involving environmental defenders, and to what extent the anti-SLAPP principle influences judicial reasoning. A normative juridical approach is employed using statutory, conceptual, and case-based analysis of relevant legal instruments, doctrines, and court decisions. The findings show that the court may acknowledge the formal fulfillment of criminal elements while refraining from imposing punishment when the act is closely linked to environmental advocacy and public interest. The integration of the double-track system and the anti-SLAPP principle supports a more proportional and context-sensitive approach to criminal adjudication. The case analysis also reveals limitations, including the absence of clear procedural standards and the risk of inconsistent application across similar cases. Additionally, the protection of environmental defenders is not absolute and must be balanced with the rights of affected individuals. This study proposes a more structured integration of both principles to strengthen legal certainty, ensure proportionality, and support the protection of environmental defenders within a balanced framework of criminal justice. Studi ini meneliti penerapan sistem jalur ganda dan prinsip anti-SLAPP dalam hukum pidana Indonesia, dengan fokus pada Keputusan Nomor 374/Pid.Sus/2024/PT ​​SMG. Penelitian ini membahas dua pertanyaan: bagaimana sistem jalur ganda beroperasi dalam kasus-kasus yang melibatkan pembela lingkungan, dan sejauh mana prinsip anti-SLAPP memengaruhi penalaran yudisial. Pendekatan yuridis normatif digunakan dengan menggunakan analisis hukum, konseptual, dan berbasis kasus dari instrumen hukum, doktrin, dan keputusan pengadilan yang relevan. Temuan menunjukkan bahwa pengadilan dapat mengakui pemenuhan formal unsur-unsur pidana sambil menahan diri dari menjatuhkan hukuman ketika tindakan tersebut terkait erat dengan advokasi lingkungan dan kepentingan umum. Integrasi sistem jalur ganda dan prinsip anti-SLAPP mendukung pendekatan yang lebih proporsional dan peka konteks terhadap peradilan pidana. Analisis kasus juga mengungkapkan keterbatasan, termasuk tidak adanya standar prosedural yang jelas dan risiko penerapan yang tidak konsisten di berbagai kasus serupa. Selain itu, perlindungan pembela lingkungan tidak bersifat mutlak dan harus diseimbangkan dengan hak-hak individu yang terdampak. Studi ini mengusulkan integrasi yang lebih terstruktur dari kedua prinsip tersebut untuk memperkuat kepastian hukum, memastikan proporsionalitas, dan mendukung perlindungan para pembela lingkungan dalam kerangka peradilan pidana yang seimbang.            Keywords: Environmental Defender; Double Track System; Anti-SLAPP; Criminal Sanction; Judicial Decision.

Abstract

As the provisions of Article 183 of the Criminal Procedure Code, the system or theory of proof embraced in Indonesia is a negative evidentiary system of law which, in the case of proof, is based on the evidences established in the law which may provide the judge's confidence. Based on the above matter, the existence of Decision Number 777 / Pid.b / 2016 / PN Jakarta Pusat is important to be studied in the judgment. The judge gives the verdict by using circumstantial evidence proof theory. The case was decided entirely using indirect evidence because there was no eye witness or other direct evidence that could prove the indictment. The discussion was conducted using qualitative approach with normative juridical method. Circumstantial evidence is new among practitioners, legal arguments from experts are needed to sharpen the analysis. The juridical review of the use of circumstantial evidence is divided into two categories that are recognized by the KUHAP and which are not recognized. Circumstantial evidence can be a solution for judges in verifying cases that are considered difficult. In a law-based State, the use of circumstantial evidence theory requires the regulation of valid evidence in accordance with the current development of cases.

Abstract

The rise ofhuman trafficking casesinIndonesia, raisesits own concerns. Various cases ofhuman trafficking is happening right now based on reports in the mass media and electronic media as well as some research show human trafficking especially in women and children need serious attention. Trafficking of women and children that occurred in Indonesia usually for prostitution, pornography, begging and domestic servants. This studyaims to determine the factors that cause the occurrence of women and children trafficking and find difficulties in handling cases of trafficking in women and children. This research was conducted with the juridical sociological analytical descriptive. Primary data and secondary data collected through free guided interview techniques, library research and documentation. Determination ofthe respondents conducted bypuporsive sampling. Data that has been collected analyzed qualitatively.The study concluded that: (a) the factors that influencehuman trafficking especiallyof women and children in general because of poverty, lack of education, lack of information andare in thesocio-cultural conditions that are less favorable for their development. (b) Constraints in the handling ofcases ofhuman trafficking apart due to lack ofknowledge ofthe law enforcement in implementing UU No.21 Year2007 on Pemberantasan Tindak Pidana Perdagangan Orang is also due tothe lack ofcross-sectoral coordinationin the handling ofthe case.
