Abstract

Prinsip due process of law dalam hukum acara pidana Indonesia menuntut agar setiap proses hukum dijalankan sesuai standar negara hukum yang menjunjung keadilan dan perlindungan hak individu. Prinsip ini menekankan pentingnya perlakuan adil terhadap tersangka, termasuk hak untuk menyampaikan pendapat dan didampingi penasihat hukum. Penelitian ini membahas penerapan prinsip tersebut dalam penetapan tersangka yang tidak didahului pemeriksaan, berdasarkan Putusan Nomor 10/Pid.Pra/2024/PN Bdg. Metode yang digunakan adalah metode hukum normatif dengan pendekatan studi undang-undang dan analisis putusan pengadilan. Hasil penelitian menunjukkan bahwa penyidik tidak menjalankan kewajibannya sesuai prinsip due process karena tidak memberikan kesempatan kepada pemohon untuk menjelaskan kronologi peristiwa. Hakim dalam putusannya mengabulkan permohonan praperadilan, menyatakan penetapan tersangka tidak sah, memerintahkan penghentian penyidikan, dan memulihkan hak-hak pemohon. Studi ini menegaskan bahwa cacat prosedural dalam penetapan tersangka merupakan pelanggaran serius terhadap due process of law yang seharusnya disertai pertanggungjawaban etik, administratif, perdata, hingga pidana bagi penyidik yang melanggarnya.

Abstract

Abstract: This research examines the inconsistency in the application of the concept of participation (medeplegen) based on legal regulations in Indonesia. Indonesia as a state of law (rechtsstaat) requires consistency in the application of legal norms, including criminal law. However, in practice, there are often inconsistencies in the application of participation regulations as stipulated in Article 55 of the Criminal Code (KUHP) in conjunction with Article 20 of the National Criminal Code (KUHP Nasional) of 2023. This study uses normative legal research methods with statutory and case approaches. The results of the research indicate that first, the juridical provisions regarding the concept of participation in the criminal law system include several forms: pleger (person who commits), doen pleger (person who causes another to commit), medepleger (person who participates in committing), and uitlokker (person who incites). Second, the inconsistency in applying the concept of participation occurs due to differences in interpretation between law enforcers, lack of clear guidelines in distinguishing forms of participation, and the transition period between the old Criminal Code and the National Criminal Code of 2023. This research recommends the need for technical guidelines from the Supreme Court and intensive socialization regarding the implementation of participation provisions in the new national criminal law. Keywords: Participation, Medeplegen, Criminal Law, Inconsistency, National Criminal Code Abstrak: Penelitian ini mengkaji inkonsistensi penerapan konsep penyertaan (medeplegen) berdasarkan peraturan hukum di Indonesia. Indonesia sebagai negara hukum (rechtsstaat) menghendaki konsistensi dalam penerapan norma hukum, termasuk hukum pidana. Namun dalam praktiknya, seringkali terjadi inkonsistensi dalam penerapan regulasi penyertaan sebagaimana diatur dalam Pasal 55 Kitab Undang-Undang Hukum Pidana (KUHP) juncto Pasal 20 KUHP Nasional Tahun 2023. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pertama, ketentuan yuridis konsep penyertaan dalam sistem hukum pidana mencakup beberapa bentuk: pleger (orang yang melakukan), doen pleger (orang yang menyuruh melakukan), medepleger (orang yang turut serta melakukan), dan uitlokker (orang yang menganjurkan). Kedua, inkonsistensi penerapan konsep penyertaan terjadi karena perbedaan penafsiran antaraparat penegak hukum, tidak adanya pedoman yang jelas dalam membedakan bentuk-bentuk penyertaan, serta masa transisi antara KUHP lama dengan KUHP Nasional 2023. Penelitian ini merekomendasikan perlunya pedoman teknis dari Mahkamah Agung dan sosialisasi intensif mengenai implementasi ketentuan penyertaan dalam hukum pidana nasional yang baru. Abstract

 Indonesia has rules for law enforcement to the community. There are various kinds of rules/laws with various motives for criminal acts committed. Among other things, the crime of theft. This research aims to find out the judge's considerations in the application of the law and to find out how the criminal sentence is imposed in the decision. This type of research is normative legal research, using conceptual, legislative, and case approach methods. The results of the study found that in imposing the severity of the sentence that will be imposed by the previous judge, the judge first considers the aggravating matters and those that mitigate the defendant when it is related to the facts that have been revealed in the trial, and the judge uses 2 (two) forms of consideration, juridical and non-juridical. In the decision, the judge sentenced the criminal offense to imprisonment for 10 (ten) months each. So that according to the compiler, in applying an article or law, judges pay more attention to the consequences of the actions of the perpetrators of criminal acts, in order to create a verdict that is as fair as possible for both the defendant, the victim and the community

Abstract

Criminal law enforcement in Indonesia is not only faced with technical and structural obstacles, but also with serious threats from within the system itself, especially through the practice  of obstruction of justice carried out by law enforcement officials. Actions such as destruction of evidence, intimidation of witnesses, manipulation of information, and interference with the investigation process have been proven to occur in a number of major cases, one of which is in the case of the murder of Brigadier J. The purpose of this study is to juridically analyze the concept  of obstruction of justice, evaluate its regulation in Indonesia's positive criminal law, and examine the criminal liability of law enforcement officials involved in act. This research uses normative legal research methods with a legislative approach, and is analyzed qualitatively descriptively through literature studies and case studies. The results of the study show that although the term obstruction of justice has not been explicitly regulated in the Criminal Code, the substance of the act has been reflected in various general and special criminal provisions such as Articles 221, 231, 233 of the Criminal Code and Article 21 of the Corruption Law. However, scattered and multi-interpreted arrangements lead to weak law enforcement effectiveness against perpetrators, especially if they come from law enforcement institutions.

Abstract

This study examines the criminal provisions applied to corruption cases involving the former Head of the National Land Agency (BPN) of Toba Regency in issuing a Land Ownership Certificate (SHM) No. 221. Corruption is categorised as an extraordinary crime due to its violation of social and economic rights. However, based on Articles 2 and 3 of Law No. 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law No. 20 of 2001, the defendant was not proven to have committed any unlawful act, and no state financial loss was found. The judicial analysis also confirms that Ministerial Regulation No. 28 of 2015 and Ministerial Decree No. 1695 of 2022 only regulate sectoral technical criteria and do not classify the land as state property. The Supreme Court's cassation ruling on October 4, 2023, rejected the Public Prosecutor's appeal and upheld the acquittal. This study highlights the importance of precise legal interpretations in corruption cases to avoid judicial errors.
