Abstract

Crime is a common problem in society and can be committed by anyone, both the perpetrator and the victim. Criminal policy used in tackling crime in Indonesia consists of two methods, namely preventive and repressive. In its implementation, it involves crime prevention investigators, police investigators, and civil servants (PPNS). However, the problem is the overlap between police investigators and PPNS because both have different authorities in conducting investigations. One of the well-known PPNS in Indonesia is the Road Traffic and Transport PPNS. In handling traffic and transport criminal offences, the investigation is carried out by two investigation agencies in accordance with Article 259 paragraph 1 of Law 22/2009 on traffic and transport. In the implementation of crime policy, it is important to coordinate activities between police and PPNS investigators to avoid overlapping authority. The role of the community in preventing crime by reporting suspicious activities to the authorities is also very important. In this way, it is hoped that the public can prevent crime by reporting suspicious activities to the authorities.

Abstract

Crime victims often find themselves in a consistently disadvantaged position, suffering physically, psychologically, and materially due to the crimes they endure. Unfortunately, the state's attention to victims lacks the intensity given to criminals, with a predominant focus on the legal position and human rights of offenders. Striking a balance between justice for perpetrators and protection for victims is essential. Presently, victims are predominantly considered supplementary to the sufferer, serving as witnesses solely to establish the guilt of the perpetrator. This research uses legal normative methods and employs a descriptive-analytical approach to explore victim guarantees in the Indonesian criminal justice system. The study scrutinizes statutory regulations, emphasizing the role of victimology in safeguarding crime victims. Historically, victim protection primarily centered on the right to compensation. However, Law Number 13 of 2006 concerning Witness and Victim Protection, in conjunction with Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Witness and Victim Protection, significantly expanded victims' rights. Despite this progress, the integration of victim rights into the criminal justice system remains incomplete. The Indonesian criminal justice system must prioritize and safeguard victims' interests, acknowledging the crucial role of victimology in advocating for the rights of those harmed by perpetrators.

Abstract

Ideally, the validity of Testimonium de Auditu evidence in cases of sexual violence should provide stronger legal protection for victims, given that sexual violence often occurs in closed situations without direct witnesses. However, in reality, Testimonium de Auditu has long been considered to have insufficient evidentiary strength in Indonesian criminal law, leading to its frequent disregard in law enforcement processes. This research focuses on how regulatory changes in Indonesia have accommodated and strengthened the validity of Testimonium de Auditu in the context of sexual violence crimes. This study aims to analyze the renewal of the validity of Testimonium de Auditu evidence in sexual violence crimes based on the perspective of Indonesian legislation. The research is classified as a qualitative literature study, utilizing a normative legal approach. The findings indicate that the reforms outlined in the Indonesian Criminal Code (KUHP), Constitutional Court Decision Number 65/PUU-VIII/2010, and Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS) have strengthened the position of Testimonium de Auditu as valid evidence in cases of sexual violence. These reforms allow Testimonium de Auditu to be recognized and more adaptive within the criminal justice system, particularly in addressing the challenges of proving sexual violence, which often lacks direct witnesses.

Abstract

Suntik mati merupakan tindakan euthanasia aktif yang dalam perkembangannya diartikan sebagai pengakhiran kehidupan karena belas kasihan (Mercy Killing). Suntik mati (mercy killing) merupakan perbuatan melanggar hukum sebagaimana diatur dalam Pasal 344 KUHP dan bertentangan dengan tujuan dilakukannya pengobatan untuk menyembuhkan jiwa pasien. Kenyataannya, dokter sering berhadapan dengan kasus permintaan suntik mati, disitulah tuntutan etika, moral, dan hukum dibutuhkan. Rumusan masalah dalam tesis ini yaitu: Bagaimana pengaturan suntik mati (mercy killing) ditinjau dari aspek Hukum Pidana Indonesia; Bagaimana pertanggungjawaban pidana Dokter pada pasien ditinjau dari aspek Hukum Pidana Indonesia; Bagaimana perdebatan terhadap penerapan suntik mati (mercy killing) di Indonesia. Metode yang digunakan dalam penulisan tesis ini adalah metode penelitian yuridis normatif, yaitu metode yang mengacu pada norma hukum yang dilakukan dengan studi pustaka. Penelitian ini bersifat deskriptif. Metode analisa data yang digunakan adalah deskriptif kualitatif. Pengaturan suntik mati (mercy killing) ditinjau dari aspek Hukum Pidana Indonesia dapat dilihat dalam Pasal 344 KUHP dan Pasal 461 UU No.1 Tahun 2023 dianggap paling mendekati, meskipun kedua pasal tidak menyebut istilah euthanasia secara konkret. Istilah euthanasia aktif disebut dalam penjelasan Pasal 461 UU No.1 Tahun 2023. Pertanggungjawaban pidana Dokter ditinjau dari Hukum Pidana Indonesia, dokter yang terbukti bersalah memberikan suntikan mematikan kepada pasien, dapat berupa hukuman penjara. Perdebatan yang terjadi terhadap penerapan mercy killing di Indonesia ialah golongan setuju beralasan bahwa tindakan tersebut merupakan hak asasi yang dimiliki setiap manusia untuk menentukan hidupnya termasuk hak untuk mati yang sejajar dengan hak untuk hidup; dan golongan kontra beralasan bahwa tindakan mercy killing hakekatnya merupakan bunuh diri yang dilarang berbagai agama dan dianggap suatu pembunuhan yang merupakan perbuatan melanggar hukum.

Abstract

Criminal acts of terrorism are generally committed by men, but there is an interesting fact that these acts of terrorism are not only committed by adult men but also involve women and children in them. This is a new mode or strategy carried out by the perpetrators of terrorism in order to trick the security forces. The formulation of the problem in this thesis research is the first, namely what is the policy for punishing children who are involved in criminal acts of terrorism, second, what is the policy for punishing woman who are involved in criminal acts of terrorism, and the third, how are efforts to prevent terrorism crimes involving women and children in the future? will be reviewed based on statutory regulations. The research used is normative legal research supported by empirical juridical data by conducting interviews with North Sumatra Regional Police. The nature of this research is a descriptive analysis with a statutory approach (state approach) and an analytical approach (analytical approach) using qualitative methods to draw deductive conclusions. The results of the study show that firstly, the criminal policy for terrorism crimes involving children is that children who commit acts of terrorism cannot be subject to specific minimum criminal sanctions in Articles 6, 8 to 13 and 15 of Law Number 5 of 2018 while capital punishment or life imprisonment Life also cannot be enforced but replaced with a maximum imprisonment of 10 years. Second, the criminal policy against terrorism crimes involving women has been regulated in Law Number 5 of 2018, but nothing regulates non-penal policies against women who are involved in criminal acts of terrorism. Then the third, efforts to prevent terrorism crimes involving women and children in the future are reviewed based on laws and regulations, namely by preparing National Preparedness, Counter-Radicalization, and Deradicalization. Conclusions and suggestions can be seen that first, in the absence of laws governing the criminalization of children as terrorist actors, it is necessary to form a related regulation. Second, in the absence of anything that regulates women's non-penal policies against criminal acts of terrorism, it is necessary to establish a special regulation regarding this matter. Third, by preparing National Preparedness, Counter-Radicalization, and Deradicalization, synergy is needed between law enforcement officials, the government, the community, the private sector and other parties

Abstract

Children are basically the buds, potential, and future generations of the nation's aspirations. In the juvenile justice system, a child in conflict with the law is a child who is aged 12 years or older but has not yet reached 18 years of age and is suspected of committing a crime. It is not uncommon to find children committing a crime; fundamentally, there are so many different forms of crimes that can be committed by children, one of which is gambling crime.Research uses the type of normative juridical research through an empirical approach. In this research, it employs the statutory approach (statute approach) and the case approach (case approach). The data sources used are secondary data, consisting of primary, secondary, and tertiary legal materials. Data collection is conducted through library research and interviews, which are then processed and analyzed using qualitative analysis methods.Sanctioning minors involves two dimensions: Diversi and Restorative Justice as stipulated in Articles 1 paragraph 6 and 7 of Law No. 11 Year 2012 concerning the Juvenile Justice System. Factors underlying juvenile gambling offenses include internal factors such as religious factors and factors of curiosity or desire to try, and external factors such as economic factors, environmental factors, and family factors. The judge's consideration in imposing sanctions on juvenile gambling offenders must be based on the principle of the best interests of the child as mandated in Law No. 11 Year 2012 concerning the Juvenile Justice System. From a criminological perspective, it is important to prevent minors from being labeled as gambling offenders, which can affect their life development.

Abstract

Mining of minerals without a permit is a mining activity that has a big impact, especially on the environment and the State administrative system. This study explores aspects of unlawful acts in cases of unlicensed mining that can be detrimental to the State and have an impact on the environment, focusing on the Bingai River Watershed, Langkat Regency. This research aims to reduce, overcome, and analyze the interpretation of unlawful acts and implement material law against excavated mining actors in the Bingai River Basin. This research uses an empirical juridical approach with descriptive-analytical methods. Data was obtained from case studies at the Langkat District Environmental Service, Sei Bingai District SDA and Environment and other related legal materials, as well as in-depth legal literature regarding mining without permits and law enforcement. The results of this research show that criminal law enforcement against perpetrators of C-quarry mining in the Bingai river basin faces complex challenges, including interpreting unlawful acts, applying clear legal principles, and efforts to prevent unauthorized C-quarry mining activities in the Bingai river basin. . This research contributes to an understanding of the legal dynamics in enforcing criminal law against perpetrators of the criminal act of excavated mining in the Bingai river basin, as well as providing a basis for improving the law enforcement system and efforts to overcome the criminal act of excavated mining in the Bingai river basin.

Abstract

Disparitas putusan hakim terhadap tindak pidana narkotika sering terjadi. Oleh karena itu tujuan dari penelitian ini untuk menganalisis formulasi disparitas pidana di Indonesia, faktor penyebab terjadinya disparitas putusan hakim terhadap pelaku tindak pidana narkotika menurut Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman dan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, serta menganalisis apa sebenarnya yang dipertimbangkan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana narkotika dalam Putusan Nomor 599/Pid.Sus/2018;1234/Pid.Sus/2018/PTMdn; 332/K/Pid.Sus/2019; 943/Pid.Sus/2019/PN. Rap; Nomor 841/Pid.Sus/2020/PN.Rap. Metode penelitian menggunakan metode penelitian hukum yuridis normatif yaitu mengacu pada norma-norma hukum. Penelitian ini bersifat deskriptif analitis. Data yang digunakan adalah data sekunder. terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data adalah library research (penelitian kepustakaan). Analisis data adalah kualitatif.. Hasil Penelitian menunjukkan formulasi disparitas pidana bahwa Hakim bebas untuk menjatuhkan putusan sebagaimana diatur dalam Pasal 3 UU Kekuasanaan Kehakiman. Faktor yang menjadi terjadinya disparitas pidana adalah berasal dari internal (dalam diri hakim) dan dari eksternal (luar diri hakim). Pertimbangan hakim dalam memutus perkara adalah pertimbangan yuridis dan non yuridis. Kata kunci: Disparitas Pidana, Narkotika, Putusan Hakim. Abstract The disparity of judges' decisions on narcotics crimes often occurs. Therefore, the purpose of this study is to analyze the formulation of criminal disparity in Indonesia, the factors causing the disparity of judges' decisions against narcotics criminals according to Law Number 48 of 2009 concerning Judicial Power and Law Number 35 of 2009 concerning Narcotics, as well as analyzing what exactly did the judge consider in imposing a sentence against narcotics criminals in Decision Number 599/Pid.Sus/2018; 1234/Pid.Sus/2018/PTMdn; 332/K/Pid.Sus/2019; 943/Pid.Sus/2019/PN. Rap; Number 841/Pid.Sus/2020/PN.Rap. The research method uses a normative juridical legal research method, which refers to legal norms. This research is descriptive analytical. The data used is secondary data. consists of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection technique is library research (library research). The data analysis is qualitative. The results of the study show the formulation of criminal disparity that judges are free to make decisions as stipulated in Article 3 of the Law on Judicial Power. Factors that cause criminal disparity are internal (within the judge) and external (outside the judge). The judge's considerations in deciding cases are juridical and non-juridical considerations. Abstract

Survei Nasional Penyalahgunaan Narkoba 2021 menunjukkan ganja sebagai narkotika yang paling sering disalahgunakan, mencapai 41,4%. Meskipun upaya pemusnahan ladang ganja dilakukan dalam rencana aksi pemberantasan, keberadaan ladang-ladang yang belum terungkap masih mungkin di Provinsi Sumatera Utara. Oleh karena itu, permasalahan ladang ganja memerlukan perhatian serius, khususnya terkait kebijakan hukum pidana oleh BNN Provinsi Sumatera Utara. Penelitian ini menggunakan metode hukum yuridis normatif yang deskriptif analitis dengan pengumpulan data dari bahan hukum primer, sekunder, dan tersier melalui wawancara, serta dianalisis secara kualitatif. Hasil penelitian ditemukan bahwa meskipun kebijakan hukum pidana dalam pemberantasan penyalahgunaan narkotika dilaksanakan oleh eksekutif, perlu dicatat bahwa beberapa delik tindak pidana narkotika yang diatur dalam Undang-Undang Nomor 35 Tahun 2009 tidak diatur lagi dalam Undang-Undang Nomor 1 Tahun 2023 tentang KUHP. BNN Provinsi Sumatera Utara telah melakukan pemusnahan ladang ganja pada tahun 2022 di empat titik Pegunungan Tor Sihite Kabupaten Mandailing Natal.

Abstract

Sexual violence in Indonesia is an increasingly urgent case, with 431,471 cases recorded in 2020, including 3,602 cases in the public domain. Sexual violence is defined as a physical or non-physical sexual act by someone who has power over the victim, without the victim's consent. Its forms include harassment, exploitation, forced contraception, abortion, rape, marriage, prostitution, slavery, and sexual torture. This thesis discusses the legal formulation of the crime of sexual violence, legal protection for victims, and an analysis of the Medan District Court's decision regarding cases of sexual violence. Using normative legal research methods, this study examines existing regulations, including the Criminal Code, Law No. 23/2004 concerning Domestic Violence, the Bill on the Elimination of Sexual Violence, Law No. 39/1999 concerning Human Rights, the Universal Declaration of Human Rights, and Law No. 13/2006 concerning Protection of Witnesses and Victims, which regulate criminal acts and protection of victims of sexual violence.
