Abstract

This study aims to examine the Islamic perspective on the process of electing leaders, focusing on the hadith narrated by Al-Bukhari that warns of the dangers of entrusting authority to those who are not qualified. Using a descriptive-analytical method with a normative juridical approach, this research analyzes primary sources such as the hadiths in Sahih Al-Bukhari and relevant statutory regulations, supported by secondary sources from related scholarly literature. The findings reveal that leadership in Islam is a great trust (amanah) that demands strict fulfillment of Shari'ah criteria, including justice, trustworthiness, knowledge, and honesty. Entrusting leadership to incompetent individuals may lead to widespread social and political collapse, as indicated by the Prophet Muhammad (peace be upon him) in his hadith. Furthermore, the community’s negligence in electing suitable leaders is considered a collective sin that significantly affects societal stability. Therefore, Muslims must exercise greater vigilance, critical thinking, and responsibility in choosing their leaders to maintain social order in line with the principles of shura and Islamic values.

Abstract

This study is motivated by the increasing relevance of religious moderation in the context of Indonesia’s diverse religious and cultural landscape. The need to understand and apply religious values in a moderate and inclusive manner is crucial for maintaining social harmony and preventing religiously motivated conflicts. This research aims to analyze the contributions of Syaikh Mahfudz at-Tarmasi's thoughts on contextualizing hadith, particularly in supporting the principles of religious moderation, and to explore their relevance to the Nusantara society. The study employs a normative approach with descriptive-analytical methods. Data were collected through a literature review of Syaikh Mahfudz's works and other relevant supporting literature. The data were then analyzed qualitatively to identify key themes that promote religious moderation. The findings reveal that Syaikh Mahfudz at-Tarmasi utilized a methodology of sanad and matan criticism in interpreting hadiths. He not only scrutinized the textual authenticity but also considered the social and cultural contexts, resulting in a moderate understanding of Islam that aligns with the pluralistic nature of Indonesian society. The study's findings underscore the necessity of strengthening moderate Islamic preaching based on the values of rahmatan lil ‘alamin to enhance interfaith tolerance and counter extremism. This research is expected to contribute significantly to the enrichment of hadith studies in Indonesia and to offer practical guidance for implementing peaceful and inclusive Islamic teachings within a multicultural society.

Abstract

This research is motivated by the fact that the understanding of Hadith in Indonesia still faces various challenges, especially related to the application of the right methodology in the modern context. This research aims to analyze Muhammad Syuhudi Ismail's thinking in the methodology of understanding hadith, especially the textual-contextual approach he developed, as well as his contribution to the development of Hadith studies in Indonesia. This study applies a qualitative approach with historical-analytical methods, where data is obtained through literature study techniques on Syuhudi Ismail's main works. Then, the data was analyzed using qualitative data analysis techniques. The results of this study show that Syuhudi Ismail has succeeded in developing a comprehensive methodology for understanding Hadith by integrating textual and contextual aspects in a balanced manner. The findings of this study imply the need for a more holistic approach in the study of hadith in Indonesia, which not only prioritizes textual aspects, but also pays attention to the social, cultural, and historical context in the application of Hadith in contemporary society.

Abstract

Background: The Dewan Hisbah serves as a fatwa and research institution responsible for ensuring that the understanding of Hadith aligns with Sharia principles and can be applied contextually in the lives of Muslims. Purpose of the Study: To understand the methodology of Hadith study implemented by Dewan Hisbah of Persatuan Islam in assessing the authenticity and relevance of Hadith as a basis for issuing fatwas, and to explore the contribution of Dewan Hisbah's application of Hadith study methodology to the development of understanding and implementation of Islamic teachings among Muslims. Methods: The research titled Application of the Hadith Study Methodology of Dewan Hisbah of Persatuan Islam employs a literature review as the primary approach. Literature collection was conducted using two main platforms, PubMed and Google Scholar, with keywords such as "application of methodology," "Hadith Dewan Hisbah," and "Persatuan Islam." Results: The application of the Hadith study methodology by Dewan Hisbah has bridged the gap between the tradition of Islamic scholarship and the needs of the Muslim community in the modern social context. Conclusions: This role not only maintains the relevance of Islamic teachings but also fosters the creation of a civilized society based on universal and inclusive Sharia values.

Abstract

The book Adab Al-'Alim wa Al-Muta'allim by KH. M. Hasyim Asy'ari is one of the important works in the tradition of Islamic education, especially in the context of Islamic boarding schools in Indonesia. This book discusses the ethics and manners of an alim (scholar) and student in the teaching and learning process. One of the important aspects in this book is the method of understanding the hadith presented by KH. Hasyim Asy'ari. Hasyim Asy'ari emphasized the importance of a comprehensive approach in understanding hadith, which includes several main methods, namely the Ijtihad approach, the muqaranah approach between verses and hadiths, the bayan approach through the atsar of companions, the qaul of salafus salih scholars, and verses to help understand the meaning. Through this book, KH. Hasyim Ash'ari shows that understanding hadith requires not only mastery of linguistics, but also extensive knowledge of the social context, and principles of Islamic law. This book is an important reference in teaching hadith in Islamic boarding schools and other Islamic religious institutions in Indonesia.

Abstract

The volatile global economy necessitates ethical investment frameworks, where Islamic finance offers a unique values-based model. However, a significant gap persists in the literature: the rigorous application of Hadith criticism to authenticate and contextualize the prophetic traditions underpinning Islamic investment ethics. This study addresses this by critically examining key hadith concerning Islamic ethical standards like riba, gharar, and maysir, and principles of justice. This research aims to demonstrate how critically authenticated hadith can be effectively applied in modern Islamic financial products and policies, fostering greater transparency and ethical integrity. Employing a qualitative library research approach with content and historical-critical analysis, we apply hadith criticism methodologies—including jarh wa ta'dil, sanad analysis, matn criticism, and ilal al-hadith—to selected texts from canonical collections. The findings of this study indicate that the majority of the key hadiths analyzed are classified as either sahih or at least hasan, thereby providing a strong and authoritative normative foundation for the formulation of Islamic investment ethical standards and enabling their practical application in the modern Islamic finance industry. The main contribution of this research lies in integrating the tradition of Hadith scholarship with the practice of Islamic economic ethics, a connection that has thus far been underexplored in academic literature. Ultimately, this study proposes a methodologically sound framework of Islamic investment ethics, bridging traditional Hadith studies with contemporary finance to promote a more resilient and ethical global financial system.

Abstract

This study critically analyzes the epistemological foundations of hadith criticism, examining the paradigmatic conflict between the textualist Ahl al-Hadith and the rationalist Ahl al-Ra’yi/Kalam traditions. This topic is vital as it addresses the core tension between tradition and reason in Islamic thought, a debate that remains highly relevant in contemporary contexts, especially regarding hadith’s authenticity and its compatibility with modern knowledge. The research uses a qualitative, library-based comparative analysis to scrutinize the methodologies of both traditions, focusing on their respective primary sources of authority, criticism criteria, and validity standards. The research findings indicate that both paradigms possess complementary strengths and weaknesses: the textual paradigm excels in historical authenticity but lacks rational coherence, while the rational paradigm emphasizes theological consistency and universal Islamic values yet tends toward subjectivity. Both represent distinct but mutually corrective approaches to understanding prophetic truth. This study's key contribution is a proposal for a comprehensive critical epistemology that integrates the historical rigor of sanad criticism with the rational scrutiny of matn. This hybrid framework offers a balanced and accountable approach to hadith criticism, bridging the historical gap and ensuring its continued relevance for modern scholarship and believers.

Abstract

This study aims to explore moral values within the local Kutai tradition, specifically through a Hadith study examining the Erau Tradition in Kutai Kartanegara, East Kalimantan. The Erau tradition, as part of local culture, embodies values of character and ethics that align with Islamic teachings, particularly regarding solidarity, equality, and respect. This research employs a library research method with a descriptive qualitative approach, gathering data from various scientific articles, journals, and other literary sources. The findings reveal strong Islamic moral values within the practice of the Erau Tradition, such as religiosity, social ethics, and mutual respect. These results indicate that local traditions can serve as a medium to reinforce Islamic values, particularly in moral education and character development. Thus, this study is expected to provide deeper insights into the relationship between local culture and Islamic values and to enrich local wisdom-based educational approaches.

Abstract

Due to parental divorce, children become victims and require the husband as the father to pay for the child's living expenses until they are independent. However, the amount of living expenses is not regulated by law and there are no legal sanctions if the father violates the decision. This often harms the mother and child who have custody. This study aims to analyze: (1) Considerations of the Religious Court in determining the child's living expenses after divorce; (2) Implications of the Religious Court Decision regarding the child's living expenses; (3) Legal efforts of the wife against the ex-husband who does not comply with the decision; (4) Clarity and justice of the law in decisions regarding the child's living expenses. The theories used include the theory of legal benefit from Imam Al-Ghazali and the theory of legal principles from Gustav Radbruch. This study is qualitative with a descriptive analysis method, using data from the contents of the Religious Court decision. Data were obtained through observation, interviews, documentation, and content analysis. The results of the study show: (1) Variation in the amount of the child's living expenses; (2) Many violations of the father's actions in fulfilling the cost obligations; (3) Legal efforts taken by the wife; (4) The decision must regulate more property guarantees to facilitate the implementation of the child's living expenses. Legal development is needed regarding clauses in decisions and statutory regulations.

Abstract

A justice collaborator are suspect, defendants or convicts but work together with law enforcement officials to provide information in uncovering criminal acts that have occurred. The aim of the research is to analyze the legal protection of justice collaborators in terms of Law 31/2014. This study uses normative legal research methods with qualitative data. The results of the study show that (1) Legal protection for justice collaborators in terms of Law Number 31 of 2014 explained in article 5 that law enforcement officials have the obligation to provide protection and assistance to justice collaborator from legal entities so that they feel safe from threats which will come. (2) Legal protection for justice collaborators in terms of five basic principles or commonly called Maqashid Asy-Syariah which can be concluded that Islam highly upholds the protection of human rights, which in this case is legal protection for justice collaborators who have important services in helping officials Law enforcers uncover a crime.
