Abstract

This study examines the protection of the right to privacy from the perspective of Islamic law and Article 12 of the Universal Declaration of Human Rights (UDHR). The right to privacy is a fundamental human right, particularly in the modern era where rapid technological advancement has amplified the risks of data breaches and personal intrusion. The research aims to analyze the Islamic concept of privacy, compare it with international legal standards, and explore their implementation in daily life. Utilizing a qualitative-comparative method, this study reveals both the convergence of values and the divergence in approaches between maqāṣid al-sharīʿah in Islam and the principles of international human rights law. The findings indicate that both legal frameworks uphold privacy as an essential element of human dignity and individual freedom. Islamic law provides spiritual, moral, and legal foundations that align with the intent of Article 12 UDHR, while also emphasizing the social responsibility of respecting others’ privacy. These insights underscore the necessity of cultivating collective awareness of the right to privacy as a means to foster a just, civil, and respectful society.   Abstrak Penelitian ini mengkaji perlindungan hak atas privasi dari perspektif hukum Islam dan Pasal 12 Deklarasi Universal Hak Asasi Manusia (DUHAM). Hak atas privasi merupakan hak asasi manusia yang fundamental, terutama di era modern saat kemajuan teknologi pesat meningkatkan risiko pelanggaran data dan gangguan terhadap kehidupan pribadi. Penelitian ini bertujuan untuk menganalisis konsep privasi dalam Islam, membandingkannya dengan standar hukum internasional, serta mengeksplorasi implementasinya dalam kehidupan sehari-hari. Dengan menggunakan metode kualitatif-komparatif, studi ini mengungkapkan adanya kesesuaian nilai dan perbedaan pendekatan antara maqāṣid al-sharīʿah dalam Islam dan prinsip-prinsip hukum hak asasi manusia internasional. Temuan menunjukkan bahwa kedua kerangka hukum tersebut menempatkan privasi sebagai unsur penting dalam martabat manusia dan kebebasan individu. Hukum Islam memberikan landasan spiritual, moral, dan hukum yang sejalan dengan maksud Pasal 12 DUHAM, sekaligus menekankan tanggung jawab sosial untuk menghormati privasi orang lain. Temuan ini menegaskan pentingnya membangun kesadaran kolektif terhadap hak atas privasi sebagai sarana mewujudkan masyarakat yang adil, beradab, dan saling menghormati

Abstract

This paper examines in detail the Science of jarh wa al-ta'dil as a tool to assess the narrator of hadith in terms of weaknesses (jahr) and also strengths (ta'dil). The research method used is a literature study. The study resulted in that first, jarh wa ta'dil as a step to determine whether the narration of a narrator is acceptable or must be rejected altogether, the requirements and procedures in jarh wa ta'dil, and, the contradictions (khilafiyah) between al-Jarh and al-Ta'dil among scholars.

Abstract

This study aims to examine the meaning of ‘adalah, the levels of ta’dil and its impact on the narration of the hadith brought, and the rules used in ta’dil. The research method used is a qualitative research method by collecting written data sources, both primary data from books and secondary data from online digital based with a library research approach to facilitate the preparation of this article. The results and discussion of this study conclude that the assessment of ‘adalah (justice) includes aspects of faith and morals; there are six levels and six rules in carrying out ta’dil.

Abstract

The phenomenon of slander that occurs among Muslims, the validity and existence of hadiths are tarnished is marked by the existence of Maudhu hadiths which are spread by irresponsible transmitters. To ensure the authenticity of the hadith, there is a need for a means of criticism of the matan and sanad, including the transmitter. So this research attempts to present the history of the development of hadith sanad criticism from the perspective of jarḥ and ta'dīl using a historical approach method. Therefore, this research is part of qualitative research. From this research, a result was obtained; Firstly, that the critical study of hadith has basically been practiced since the lifetime of the Prophet SAW, although aspects of the sanad or personal rāwi (jarḥ and ta'dīl) and this study continued to develop in subsequent periods. Second, in reality, currently the existence of false hadiths continues to spread and develop and even false hadiths appear that have not been studied and researched by previous scholars, so the need for jarḥ and ta'dīl studies to determine the authenticity of hadiths continues at all times and does not become stagnant with changing times.

Abstract

The practice of divorce without going through a formal court process, commonly referred to as informal or unregistered divorce, remains prevalent in Indonesian society despite clear regulations outlined in Law Number 1 of 1974 on Marriage. This paper aims to examine the legal dimensions of such practices and explore the social and psychological impacts, particularly on children. Findings indicate that divorces conducted outside the legal framework not only violate national laws but also often result in disadvantages for vulnerable parties, especially women and children. In Islamic teachings, while divorce is permissible, it is considered the most detested lawful act by Allah and should only be pursued after all efforts at reconciliation have failed. National legal provisions echo this perspective by emphasizing mediation and the principle of justice as primary steps in resolving marital disputes. This alignment reflects a harmony between religious norms and state law. Therefore, public awareness of proper legal procedures for divorce needs to be enhanced to protect individual rights and preserve family stability. Strengthening legal education and premarital counseling are effective preventive strategies in this regard.

Abstract

This article examines the prohibition of gambling from the perspective of the Hadith narrated by Bukhari No. 5787 and its relevance to the practice of online gambling in the digital era. The study employs a qualitative approach with descriptive-analytical methods focusing on the analysis of hadith texts and Indonesian positive law, particularly Article 27 Paragraph (2) of Law No. 11 of 2008 on Electronic Information and Transactions (ITE Law). The findings reveal that online gambling has destructive impacts on individual morality, family resilience, and the economic stability of society. Bukhari’s Hadith strictly forbids all forms of gambling, including invitations to gamble, and offers charity as an alternative act of purification. Although Indonesian positive law regulates online gambling prohibition, challenges remain in its effective enforcement. This article highlights the need for a synergistic approach between religious normative values and state law enforcement to address the phenomenon of online gambling comprehensively.

Abstract

This article aims to analyze the correlation between Article 1 of Law No. 7 of 1984, which ratifies the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), and selected hadiths narrated by Imam Tirmidhi, especially in addressing issues of discrimination and gender injustice. Using a descriptive-analytical method and a normative juridical approach, this study relies on primary data sources such as national legislation and the Jami’ at-Tirmidhi hadith collection, as well as secondary data from relevant Islamic legal and scholarly literature. Data collection was conducted through literature review and analyzed qualitatively. The findings indicate that there are normative foundations and values within the hadiths that can be reinterpreted contextually and in line with maqashid al-shari’ah, supporting the principles of justice and gender equality as mandated in Indonesian positive law.

Abstract

This research aims to determine the prevalence of cases of violence against children based on hadith and law no. 35 of 2014. Violence against children is a serious problem that affects children's welfare and development. This article presents an analysis of violence against children based on the hadith perspective and Law no. 35 of 2014 concerning Child Protection. Through a literature review, this article describes the concept of violence against children according to Islamic teachings as well as the legal perspective regulated in Law no. 35 of 2014. Apart from that, this article also discusses the impact of violence on children and prevention efforts that can be taken from both a religious and legal perspective. It is hoped that this article can provide deeper insight into child protection in the context of violence and provide a basis for efforts to overcome violence against children in society.

Abstract

Interfaith marriage is a complex and sensitive issue in Indonesia, presenting a conflict between positive law and religious values. Article 28 B of the 1945 Constitution guarantees freedom of religion, but its implementation is constrained by unclear regulations and different interpretations. Islamic law, as a source of law, provides a unique view on interfaith marriage, emphasizing individual rights and the principle of justice. To resolve this conflict, a holistic approach that integrates positive law and Islamic law is needed, as well as concrete steps such as the establishment of clear regulations, improvement of public understanding, capacity of legal officials, individual protection systems, interfaith dialogue, interfaith cooperation, and active community participation. Thus, it is expected to create a harmonious, inclusive and equitable marriage environment.

Abstract

In historical literature, there are many hadith scholars from various eras. These hadith scholars have different levels, especially in the science of al-jarh wa at-ta`dil. They can be classified as strict (mutasyaddid), moderate (mu`tadil), or lenient (mutasahhil). Among the scholars considered lenient is Imam Al-Hakim. This can be seen in his book Mustadrak al-Hakim. This paper uses a qualitative method, specifically a pure library research study, focusing on al-Mustadrak 'ala al-Shahihain as primary data, and applying the hadith science approach in analyzing the lenient perspective of Imam Al-Hakim. The result of this research is that the hadith discussed in this paper is considered weak (da'if) because in its chain of narrators (sanad) there are Qatadah bin Du'amah and Hasan al-Basri, both of whom are considered mudallis (obfuscators), and in this chain, neither of them narrated clearly (sarih).
