Abstract

In Islam, neighborly manners are highly recommended, because neighborly harmony is one of the main pillars in building a harmonious and prosperous society. In fact, the Prophet SAW also made this as one of the signs of one's faith. But on the other hand, it is not uncommon to find neighbors who make noise at night and often make other neighbors around them feel uncomfortable and disturbed. In addition to violating neighborly manners, it also violates positive law in Indonesia. The Criminal Code is one of the positive laws that regulates neighborly life, which discusses the rights and obligations of neighbors and the actions of neighbors that violate the law. The discussion that will be discussed in this research, namely regarding the noise of neighbors seen in the perspective of one of the hadiths and articles in the Criminal Code. This is intended so that ordinary people are not ignorant of the importance of neighborly manners and introduce the applicable law related to the issue so that the community can maintain harmony in neighboring. Normative juridical is the method of approach that researchers use to examine this research with secondary materials available laws, books, and journals.

Abstract

Fan writing according to the Copyright Law is included in adaptation works referring to Article 40 Paragraph (1) of the Copyright Law as one of the protected works. The lack of legal rules regarding adaptation works in particular has led to the rampant commercialization of fan-written works whose legality and licensing rules are not in accordance with the rules. Referring to Article 9 of the Copyright Law, a person who obtains economic rights for publishing and adapting works must have obtained permission from the creator or copyright holder. Both the publisher and the author bear the consequences in this case of not obtaining permission and have taken exclusive rights, which consist of economic rights and moral rights bound to the original creation. The consideration between permissible and haram in the creation of this work depends on whether the publishing and commercialization of the written work causes profit or harm to the original character. It can be said to be permissible if the work does not get the permission of the original character but is also not published and not commercialized, so that the author does not get any benefit. Meanwhile, it can be said to be haram, according to Abu Dhar's Hadith on the Prohibition of Doing Harm, if publishing and reproducing a work is an act of exceeding the limit because it has taken the owner's rights without permission. Therefore, it can be considered haram because it is tantamount to seizing other people's property.

Abstract

This study analyzes the HR perspective. At-Tirmidhi regarding cohabitation in the context of Article 412 paragraph (1) of the Criminal Code in Indonesia. By using a qualitative approach, this research highlights the Islamic perspective on relationships between men and women outside of marriage and its relevance to positive law. The research results show the importance of maintaining moral norms in relationships, but there are differences between Islamic law and positive law in enforcing living together. This study provides insight into religious perspectives on social phenomena and their impact on law and social policy. This also provides a basis for understanding the dynamic relationship between religious values and positive law in dealing with social problems.

Abstract

This study aims to analyze the division of inheritance rights based on the Hadiths of Bukhari and Muslim and the Articles of the Civil Code; how the division of inheritance rights is viewed in the perspective of the Hadiths of Bukhari and whether it is in accordance with the provisions of the Civil Code. The research method used is document analysis, collecting data from Islamic law and civil law literature and comparing the two. The results show that the division of inheritance rights in the Hadiths of Bukhari emphasizes the principles of equality and justice for heirs, while the Civil Code regulates the division of inheritance rights based on lineage and the number of heirs. So, the division of inheritance rights in the Hadiths of Bukhari emphasizes the principles of equality and justice, while the Civil Code regulates the division of inheritance rights based on lineage and the number of heirs, thus indicating a difference in approach in determining inheritance in the context of Islamic law and civil law in Indonesia.

Abstract

This study aims to discuss the spread of hoaxes from an Islamic perspective, focusing on the teachings of Hadith. The methodology involves a qualitative approach through the study of religious texts, specifically Hadith, to understand the moral implications of hoaxes. The study also explores the significance of raising public awareness about hoaxes and their potential consequences on society. The findings suggest that hoaxes are considered a form of deception and are strongly discouraged in Islamic teachings. The study concludes by emphasizing the importance of adhering to Islamic communication ethics in dealing with hoaxes, such as verifying information before sharing it and being cautious about the impact of one's words.

Abstract

This research is motivated by the fact that the concept of human rights, as defined in Article 6 of the Universal Declaration of Human Rights (UDHR), is relevant to the values contained in the Qur'an. This research aims to analyse the relationship between Article 6 of the UDHR, which guarantees the right to legal recognition, and the principles contained in the Qur'an. This research adopts a normative legal approach and a descriptive method of analysis. Data were collected using literature review techniques by reviewing legal documents, Qur'anic commentaries and related literature. In addition, the data was analysed using qualitative data analysis techniques. The findings of this study show that there is conceptual harmony between Article 6 of the UDHR and the teachings of the Qur'an in upholding the right to recognition as a legal subject. The findings of this study imply the need for synergy between international law and religious values in order to strengthen respect for universal human rights.

Abstract

The punishment of flogging for those who drink alcohol is a form of implementing hudud law in Islam, which is determined based on the Qur’an and Hadith. Alcohol, as anything that intoxicates, is forbidden because it damages the mind, of the main objectives of the maqashid al-syari’ah. The hadith of Ibn Umar states that”Everything that intoxicates is alcohol, and every alcohol is forbidden.” The companions, including Umar bin Khattab and Ali bin Abi Thalib, agreed to set a punishment of 80 lashes. In Indonesia, especially in Aceh, the implementation of this punishment is regulated in the Qanun Jinayat through Article175 KUHP which regulates the technicalities and procedures for its implementation. The punishment of flogging is determined based on the Qur’an and Hadith under the auspices of the law with the aim of providing a deterrent effect for the suspect and social learning for the entire community. This study aims to analyze the normative and legal basis of the punishment for drinking alcohol based on the hadith and local regulations. This punishment is not only repressive, but also educative and preventive, in maintaining morals and community social order.

Abstract

The crime of defamation in the digital era has become an increasingly complex phenomenon along with the rapid development of information technology. This study aims to analyze the problem of criminal defamation from the perspective of Hadith At-Tirmidzi Number 1894 and Article 27A of the ITE Law. The main focus of the study is on the dynamics of criminal defamation in the context of information and media ethics, the role of hoax news that contributes to the rampant criminal defamation cases, and legal analysis related to both sources. The method used in this study is a qualitative approach with normative analysis of Islamic legal doctrine and positive legal provisions. The results of the study show that Hadith At-Tirmidzi Number 1894 emphasizes the importance of honesty and prohibits lying as part of moral ethics in Islam. Meanwhile, Article 27A of the ITE Law acts as a legal instrument to address criminal defamation violations in the digital realm. A comparison of these two sources shows that although Islamic law and positive law have similarities in maintaining individual honor, the resolution mechanisms are different. Therefore, this study recommends preventive measures such as increasing digital literacy and legal education to reduce the risk of defamation and increase public awareness of the ethics of communicating in cyberspace

Abstract

The phenomenon of online gambling has become a serious concern in Indonesia, as it provides very easy access for all groups, including teenagers and underage children, to engage in gambling practices. This study aims to examine and analyze the punishment for online gambling offenders from two perspectives: Indonesian positive law and Islamic law. Under national law, Article 303 of the Indonesian Criminal Code (KUHP) regulates criminal sanctions for gambling in any form, including digital formats. Meanwhile, Islamic law strictly prohibits all forms of gambling due to elements of speculation (gharar), one-sided loss, and its contradiction with moral values. This study uses a qualitative approach through literature review by analyzing legal sources such as the Criminal Code, legislation, hadiths, as well as fiqh and tafsir literature. The results show that both Islamic law and national law share common ground in prohibiting gambling and imposing sanctions, although they differ in their methods of implementation. Firm law enforcement and preventive measures are necessary to protect society, especially the younger generation, from the harmful impacts of online gambling.

Abstract

This study examines the relationship between the hadith of H.R. Tirmidzi No. 1232 concerning the prohibition of selling goods that are not yet owned with Article 4 Paragraph (1) of Law No. 21/2008 concerning the intermediary function of Islamic banking in Indonesia. With a descriptive-analytical approach with a juridical-normative method, this study reveals significant gaps in the implementation of regulations. While the hadith provides theological guidelines that require actual ownership before the contract, the fragmented regulatory framework results in inconsistent interpretations by the Sharia Supervisory Board in various institutions. Analysis of SINTA indexed journals shows that many Islamic banking products still contain elements of gharar (uncertainty), especially in murabahah contracts with installment payments. This study identifies three main issues: the limited explicit regulation in the DSN-MUI fatwa regarding hybrid contracts, structural challenges in Indonesia's decentralized regulatory approach compared to Malaysia's centralized model, and the gap between theoretical discourse and practical implementation. To strengthen the synergy between religious principles and regulatory mandates, this study recommends harmonization of the regulatory framework, implementation of intensive training for supervisory boards on the contextual background of related hadiths, and development of integrated compliance audits to assess product consistency with hadith guidance and legal requirements.
