Abstract

This paper discusses the analysis of the biography of Muhammad bin Ishaq bin Yasar (Ibnu Ishaq) in the context of Jarh wa Ta'dil, a branch of hadith studies that evaluates the quality of hadith transmitters. Ibnu Ishaq is known as an influential Islamic historian, but his role as a hadith narrator has often been criticized by scholars. This study covers a brief biography of Ibnu Ishaq, the criticisms (jarh) against him, and the defenses (ta'dil) he received. Criticisms of Ibnu Ishaq include allegations of tadlis (concealing transmitters), weaknesses in the chain of narration (sanad), and negative views from scholars such as Yahya bin Ma'in and Imam Ahmad bin Hanbal. Nonetheless, Ibnu Ishaq's significant contributions to Islamic history are recognized by several prominent scholars. The paper concludes that a deep understanding of the context and methods of Ibnu Ishaq's transmission is necessary to appreciate his contributions without neglecting the fundamental principles of hadith studies.

Abstract

This research aims to analyse the protection of citizenship status in Indonesian national law as part of human rights, with a focus on the implementation of Article 15(2) of the Universal Declaration of Human Rights (UDHR), which prohibits arbitrary deprivation of citizenship. The method used is a normative approach by analysing the laws and regulations governing citizenship in Indonesia and comparing them with the international principles in the UDHR. The results show that although Indonesia has regulated citizenship as a protected right, there are challenges in the implementation of these protections, such as administrative problems of citizenship, dual citizenship, and non-transparent loss of citizenship. The contribution of this research is to provide insight into the importance of protecting citizenship as a human right in the context of national and international law, and to suggest reforms to the administration of citizenship in order to guarantee this right more effectively.

Abstract

This research is motivated by the fact that legal protection of the right of every individual to have citizenship is one of the fundamental aspects regulated in international law and Islamic law. This research aims to analyze the perspective of Islamic law and Article 15 Paragraph (1) of the Universal Declaration of Human Rights which states that everyone has the right to nationality. This research applies a normative juridical approach with descriptive analysis method. Data were collected through document studies and relevant literature using purposive sampling techniques. Furthermore, the data was analyzed using qualitative data analysis techniques. The results of this study show that Islamic law and Article 15 Paragraph (1) of the Universal Declaration of Human Rights have harmony in guaranteeing the right of every individual to have citizenship as a form of protection of human dignity. The findings of this study imply the need to harmonize national regulations with the principles of Islamic law and international law to ensure that the right to citizenship can be effectively guaranteed.

Abstract

This study explores the Islamic legal perspectives on online trading of defective goods, considering hadiths, laws, and comparisons with positive law, in the context of the increasing electronic commerce in the modern world. Findings highlight the seller's obligation to transparency and responsibility for defective goods, as well as the rights of buyers, providing a basis for practical recommendations including enhancing information transparency, forming policy based on Sharia principles, educating business operators and consumers, developing dispute resolution mechanisms in accordance with Islamic law, and implementing technology to improve transparency and compliance. Thus, it is hoped that consumer protection in the context of online trading can be enhanced in line with the moral and ethical principles of Islam, which in turn will support the sustainable development of electronic commerce

Abstract

Land is something that is very important for human life. From the land humans come from, on the land humans live and into the land humans will return. Ownership, control, use and utilization of land need to be regulated in such a way in national agrarian law. In particular, land rights also need to be regulated in the agrarian law. In this context, the teachings and laws in Islam as the largest religion in Indonesia also influence the conception and policies regarding land rights. In this case, the teachings contained in the verses of the Quran and the hadith of the Prophet Muhammad SAW as a source of Islamic law become the theological and philosophical basis of the substance of land rights regulated in the constitution and other laws and regulations in Indonesia.

Abstract

In the digital era filled with social media, the spread of negative content has become a phenomenon threatening the integrity and security of the digital environment. This paper outlines the impact and challenges of disseminating negative content and reviews efforts to address it from the perspectives of Islamic law and positive law, emphasizing the importance of the hadith of Prophet Muhammad (peace be upon him) stating, "Verily, among the signs of a person's goodness in Islam is that he leaves what does not concern him" (Narrated by Tirmidhi). From the perspective of Islamic law, Muslims are invited to live their digital lives with integrity, morality, and awareness of their moral responsibilities. Principles such as selectivity in content consumption, guarding the purity of the heart, and spreading goodness serve as the foundation for Muslims in using social media. Meanwhile, positive law provides a framework for regulating the use of social media, including addressing the spread of negative content. Through strict regulations and effective law enforcement, it is hoped that a safe and positive online environment can be created for all users. Thus, addressing the phenomenon of negative content dissemination on social media requires a holistic approach that combines religious values, moral principles, and legal regulations, with the hadith of Prophet Muhammad serving as the main pillar in leading a dignified and beneficial digital life for all individuals.

Abstract

This research aims to analyze cases of theft based on Article 362 of the Criminal Code and Hadith Bukhari no. 6285. The research method used is qualitative with case studies. Data was collected through literature studies and analysis of court decisions related to theft cases. The research results show that Article 362 of the Criminal Code and Hadith Bukhari no. 6285 has similarities and differences in defining and regulating the crime of theft. The similarities lie in the elements of theft, namely taking something that does not belong to you with the intention of possessing it. The difference lies in the sanctions given, where the Criminal Code provides for imprisonment, while Hadith Bukhari no. 6285 sanctions caning. It can be concluded from this research that Article 362 of the Criminal Code and Hadith Bukhari no. 6285 are two different sources of law in regulating the crime of theft. Even though they have similarities and differences, these two sources of law have the same goal, namely to protect property rights and uphold justice.

Abstract

Child protection in Indonesia is not fully optimal, so bullying occurs in all age groups, especially children. Knowing legal protection by comparing H.R. Muslim No. 4650 and Article 76A of Law No. 35 of 2014 concerning Child Protection. The author takes a qualitative approach with a normative analysis of Islamic legal doctrines and positive legal provisions. The results of the study show that the prohibitions listed in Muslim Hadith No. 4650 and Law Number 35 of 2014 concerning Child Protection are a strong basis in efforts to protect every child which emphasizes the importance of maintaining dignity and rights among others. Despite the differences in the types of punishments imposed, both still aim to stop the occurrence of bullying in the future as one of the efforts to realize child protection.

Abstract

This research examines critical study techniques of hadith collections, focusing on the methods of sanad and matan criticism to assess the authenticity of hadith. Hadith criticism is an academic effort to evaluate the quality of the transmission and the textual content of hadith, ensuring its originality as a source of Islamic teachings after the Qur'an. The approach includes sanad criticism to assess the chain of transmission and the credibility of the narrators, and matan criticism, which evaluates the consistency of the hadith text with the Qur'an and other Islamic principles. This study also analyzes the criticism methods used in major hadith collections like Sahih Bukhari and Sahih Muslim, and explores textual and contextual approaches in understanding hadith. Contemporary challenges in hadith criticism, such as hadith fabrication and the relevance of hadith application in modern contexts, are discussed along with potential solutions. Through appropriate hadith criticism, the teachings of Prophet Muhammad can be authentically understood and relevantly applied in the lives of Muslims. A holistic approach positions hadith criticism as a crucial tool for preserving the purity of Islamic teachings and providing relevant guidance for Muslims across generations.
