Abstract

This article explores the concept of intentional murder as addressed in both Islamic law and Indonesian positive law, focusing on the Hadith narrated by Abu Dawud and An-Nasa’i (Bulughul Maram No. 1191) and Article 338 of the Indonesian Penal Code (KUHP). The study examines how intentional murder is viewed and punished in Islam, where the family of the victim has the right to choose between seeking qishash (retaliatory punishment) or accepting diyat (compensation), emphasizing the values of justice, forgiveness, and social harmony. In contrast, the Indonesian Penal Code stipulates a fixed punishment, i.e., imprisonment for up to 15 years, without providing a mechanism for the victim's family to pardon the offender. The article further highlights the differences in these two legal frameworks, underscoring the broader implications of justice and societal peace. Both systems, despite their differences, aim to protect the sanctity of life and ensure that justice is served, while fostering a more just and orderly society. This comparative analysis sheds light on the moral and legal complexities surrounding intentional murder and the varying ways in which justice is pursued in both Islamic and secular legal traditions.

Abstract

Pawning has become a financial instrument that is widely used by the public as a solution to get fast funds with goods as collateral. This article aims to examine the practice of pawning from a positive legal perspective in Indonesia, especially in the Civil Code, and compare it with the principles of pawning in Islam contained in the hadith. This research uses a normative and comparative juridical approach method with a focus on articles 1150-1160 of the Civil Code and authentic hadith narrated by Al-Tirmidhi. From the results of the analysis, both legal sources show harmony in the principles of pawning, with hadith as a moral and ethical guide, while the Civil Code provides a detailed legal framework regarding the rights and obligations of the parties involved. The harmony between these two sources of law confirms that the practice of pawning can function in harmony with sharia principles and applicable law. Therefore, it is important for parties involved in pawn transactions to understand and comply with the established rules, as well as uphold ethical and moral values in every transaction. It is hoped that this research can become a reference for practitioners, government and related institutions in maintaining integrity and fairness in pawn practices.

Abstract

This study aims to discuss the phenomenon of cohabitation (kumpul kebo) in the perspective of the Hadith Narrated by Bukhari and Muslim and its relevance in articles 411 and 412 of the Criminal Code. This study uses a descriptive analysis method with a normative legal approach through laws and regulations and the Hadith Book of Sahih al-Bukhari, and literature related to the research topic. The data collection technique uses a literature study with its analysis technique using qualitative data analysis, to understand the moral implications of adultery and to understand the sanctions for adultery in the context of cohabitation. This study also provides an understanding and education about the negative impacts of relationships without a legal marriage. The research findings show that cohabitation is considered a form of adultery that is detrimental to both parties, both from a religious and legal perspective. This study concludes by emphasizing the importance of a legal marriage relationship according to religion and the state and staying away from adultery.

Abstract

Articles 33-34 of Law Number 1 of 1974 concerning Marriage state that the husband is obliged to provide for the family while the wife must help with household affairs. However, many wives have careers outside the home, so the intended article is not implemented properly, eventually leading to marital disputes that end in divorce. Against the background of this problem, four questions were asked, namely (1) what are the factors that cause divorce in career families in the decision of the Religious Court in the Bandung Religious High Court; (2) how does the panel of judges consider in deciding a career family divorce in the religious court of the Bandung PTA area; (3) how to implement Articles 33-34 of the Marriage Law based on the Decision of the Religious Court in the Bandung PTA Region among career families; and (4) how is the development of the concept of a harmonious family in the career family related to the implementation of articles 33-34 in Law Number 1 of 1974 on Marriage? The usefulness of this research is academically to develop family law studies, while practically adding new insights and findings in divorce issues that are useful for society educational.

Abstract

This research examines the sanctions against premeditated murder within the framework of Indonesia's positive law and Islamic law. The study focuses on analyzing Article 340 of the Indonesian Criminal Code and Hadith Sahih al-Bukhari No. 6878 as primary sources. The method employed is descriptive-analytical with a normative juridical approach, using literature review and qualitative analysis. The findings reveal that both legal systems regard premeditated murder as a serious violation of the right to life. The imposed sanctions aim not only to punish but also to protect social stability and uphold human dignity. The maqāṣid al-sharī‘ah approach, particularly the principle of protecting life, serves as a fundamental basis for these sanctions. This study recommends the integration of substantive justice values and the protection of the right to life in the future development of the national criminal law system.

Abstract

This research is motivated by the many problems in the use of Fintec in economic transaction activities in contrast to what is in the policy on the use of sharia fintech services in Indonesia. The purpose of this study is to ensure that existing policies can provide maximum protection for consumers, especially in relation to the sharia principles underlying fintech operations. This study examines the applicable regulations, such as Fatwa DSN-MUI and OJK regulations, as well as the implementation practices of Islamic fintech in providing consumer protection. The results show that although consumer protection policies are adequate, challenges remain in terms of information transparency, dispute resolution, and effective supervision. This study suggests the need for clearer regulations and stricter supervision mechanisms to improve consumer protection in the Islamic fintech sector in Indonesia

Abstract

Zakat is one of the pillars of Islam that must be carried out by Muslims who have met certain requirements. Zakat management is very important so that its distribution is right on target and can realize social justice. In the authentic hadith narrated by Imam Bukhari and Muslim, zakat is managed by amil who is responsible for distributing it to eight groups of recipients. In Indonesia, zakat management is also regulated in Law No. 23 of 2011. Articles 1, 2, and 5 of the law explain the definition of zakat, management principles, and authorized institutions. This article examines the conformity between the principles of zakat management in the hadith and the law, and how the two can support each other for effective zakat management in accordance with sharia.

Abstract

The role of fathers in children's lives cannot actually be underestimated. Unfortunately, there are still many children in Indonesia who grow up without the presence or maximum role of a father. This phenomenon is known as fatherlessness. Either because the father is not there (due to divorce or death), or because the father is there but does not carry out his role well. In fact, according to Islamic teachings and legal regulations in Indonesia, fathers have a big responsibility to provide for their children, both materially, with love and attention. Through this study, it is discussed how Islam provides strong warnings for negligent fathers, even calling it a major sin. The Prophet's hadith also emphasizes a lot about a father's responsibility towards his family. Not only that, Indonesian law also has clear regulations regarding sanctions for fathers who abandon their children, including criminal threats. In essence, fathers are not only breadwinners, but also important figures in children's growth and development. If this role is ignored, the impact could be big for the child, family, and even the future of the father himself. The state and society must care more about this, so that Indonesian children can grow up healthy, complete and happy.

Abstract

The prohibition of committing injustice (zulm) is a fundamental principle in Islamic teachings that emphasizes justice as the foundation of social life. In various hadiths of the Prophet Muhammad (peace be upon him), injustice is strongly condemned as a violation of both divine rights and human rights. This article aims to discuss in depth the prohibition of zulm and explore its deeper implications in both criminal and civil law. Injustice is not only seen as an individual sin, but also as a breach of social justice and public order. Therefore, the command to avoid zulm, as conveyed in hadiths, goes beyond theological and moral dimensions, extending into concrete and applicable legal principles. Through a normative and juridical approach, this study seeks to demonstrate that the prohibition of injustice can serve as a foundation for developing a fair legal system that upholds individual rights. In the context of criminal law, acts of injustice often manifest as crimes requiring firm punishment to maintain social order. Meanwhile, in civil law, injustice appears in forms such as unlawful acts, breaches of contract, or violations of property rights, which demand compensation or restitution. This reflects the importance of integrating Islamic values in building a civilized and justice-oriented legal system.

Abstract

The policy of granting Mining Business Licenses (IUP) to universities under Article 51A of the Minerba Bill raises legal, ethical, and sustainability concerns. This study applies a qualitative approach through literature review to examine the provision from the perspectives of Indonesian law and Islamic teachings. The findings reveal that allowing universities to manage mining permits risks diminishing their academic role, compromising scholarly independence, and fostering potential conflicts of interest. From the standpoint of positive law, this policy contradicts the precautionary principle, social justice, and educational objectives enshrined in the 1945 Constitution, the Higher Education Law, and the Environmental Protection Law. In Islamic thought, irresponsible exploitation of natural resources is classified as fasād (corruption), strictly prohibited, as reflected in Hadith No. 479 narrated by Bukhari. The study concludes by rejecting the provision and recommends repositioning universities as guardians of sustainability values rather than participants in extractive industries.
