Abstract

As social beings, humans cannot be separated from each other to fulfill their daily needs. One of the relationships between one human being and another is manifested by an agreement. The agreement process is generally referred to as aqad or contract. Many parties who enter into contracts do not understand the rights and obligations they must fulfill, so even though they use the Islamic legal agreement system, the values in this concept have not been fully implemented. This paper discusses the classification of aqad in sharia economic transactions, which is analyzed using the opinions of the mazhab scholars. This paper aims to explain the classification of aqad in sharia economic law. The research method used in this research is library research. In this case, the writer obtains literary sources through literature such as books, journals, and encyclopedias related to the theme being studied. This research is oriented towards discussing the urgency or importance of aqad in Islamic economic law. The data in the research are presented in a descriptive narrative way. The analysis technique used is the data analysis technique introduced by Miles and Huberman, namely data reduction, data presentation, and concluding. The results showed that aqad is an agreement in an agreement between two parties. In general, the classification is divided into two aqad/agreements, namely aqad tabarru’ and aqad tijarah.

Abstract

The understanding of the ju'alah contract in Islam has been a focal point of debate and analysis in fiqh literature. Ju'alah, as a form of promise to provide compensation for tasks or work performed, holds significant implications in Sharia finance practices, including Bank Wakaf Mikro. From the perspective of scholars, there are various views regarding the legal principles and implications of the ju'alah contract, often reflecting differences among schools of thought. This diversity of opinions raises questions regarding the pillars, conditions, and legal implications of ju'alah transactions. The objective of this study is to delve deeper into scholars' comprehension of the ju'alah contract, its distinctions from the ijarah contract, and its application in Bank Wakaf Mikro in Indonesia. In this study, a qualitative approach is utilized, employing a descriptive-analytical method, where data is obtained through library research methods. The research findings indicate that the arguments presented by the Maliki and Syafi'i scholars regarding ju'alah appear to be stronger due to being grounded on more solid reasoning, both in terms of evidence and societal needs. Furthermore, in analyzing the practices of Bank Wakaf Mikro, conformity with the principles of the ju'alah contract is found, both in terms of its pillars and conditions. Among the various scholars' opinions on the ju'alah contract, it is evident that the Syafi'i scholars' views are more aligned with the practices carried out by Bank Wakaf Mikro support programs.

The Qiyas method in the formation of fatwas of the National Sharia Board-Indonesian Ulema Council aims to provide legal solutions to contemporary Sharia economic problems that have no precedent in classical Islamic legal texts. Abstract

Down payment is called urbun in Fiqh studies. There are differences of opinion regarding the legal status of the use of the down payment or urbun. This research is a type of qualitative literature research with descriptive analysis method. Data sources come from written literature, such as books, books, scientific articles, and others related to the subject of research. The Hanafi and Shafi'i Madzhab tend not to allow it because it is considered to contain elements of uncertainty and potential injustice, while the Maliki and Hanbali Madzhab tend to allow this practice on condition that there is a clear agreement, which later became the basis for the issuance of DSN-MUI Fatwa No. 13/DSN-MUI/2000 concerning Down Payment in Murabahah.
