Abstract

Introduction: The Indonesian Criminal Justice System does not recognize concepts related to restoration, such as restorative justice, alternative conflict resolution, circular punishment, or ishlah. The idea of restoration is generally not recognized by the Criminal Procedure Code (KUHAP), which is based on the concept of legality.Purposes of the Research:  To study and discuss the actual existence of the function and impact of the concept of restoration (restorative justice, alternative dispute resolution, circular punishment, and circular punishment or Ishlah) in the development of the Indonesian Criminal Justice System.Methods of the Research: This research uses a normative research methodology with a qualitative approach to investigate the concept of restoration and its consequences for various applicable laws and principles.Results of the Research: The findings of this research show that the concepts of recovery and restoration, such as alternative dispute resolution and punishment, are concepts that prioritize the interests of the parties involved, especially the principles of win-win solutions and recovery. This has been used to resolve criminal cases that meet standards at both the investigation and prosecution levels as one way to resolve criminal cases. The application of these ideas in the Indonesian Criminal Justice System is a deviation from the basic principles of the Criminal Procedure Code, namely the principle of legality which must be observed at all times. It is recommended that methods for implementing restorative ideas be included in the Draft Criminal Procedure Code (RKUHAP). Some examples of this mechanism are alternative dispute resolution, circular punishment, and ishlah. Thus, the concept of restoration can be legally and formally recognized as a principle in the Indonesian Criminal Justice System when put into practice.

Abstract

Introduction:  The practice of child marriage is quite common and is rife in Gorontalo Province. From 2019 to 2021, there were 1,383 data on applicants for child marriage dispensation at the Religious Courts of the Gorontalo Province Regency/City.Purposes of the Research: To complement the shortcomings of previous studies that did not pay attention to legal protection against neglect of children's rights in line with the increasing age of child marriage in terms of the perspective of children's rights.Methods of the Research: This study uses empirical legal research using a statutory approach, a case approach, and a conceptual approach. sources of data using primary and secondary data. Data collection techniques using literature review techniques and interviews Data analysis uses qualitative data analysis, which is analyzed theoretically to obtain prescriptive legal solutions. Results of the Research: The neglect of children's rights in cases of child marriage is more due to the unavailability of legal protection that guarantees the fulfillment of children's human rights and the legitimacy aspect of customs, culture, and traditions regarding social status in society

Abstract

Introduction: This study analyzes the comparison of election criminal law enforcement in Indonesia with the system implemented by the Conseil Constitutionnel in France.Purposes of the Research: Analyze and compare the electoral criminal law enforcement systems in Indonesia and France, highlighting similarities and differences in dispute resolution mechanisms. In addition, this research also focuses on revealing the strengths and weaknesses of each system through juridical and sociological approaches. In this way, it is hoped that insights and recommendations will be born that can strengthen the electoral legal system in Indonesia, especially in the aspects of coordination, transparency, and effectiveness of dispute resolution.Methods of the Research: Descriptive research with literature study and comparative analysis. The results of the study show that Indonesia's electoral system faces problems of coordination between institutions, such as Election Supervisory Board, Electoral Commission, and the courts, which leads to ineffectiveness and transparency in dispute resolution. In contrast, the Conseil Constitutionnel in France has a centralized authority that allows for faster and more efficient settlement of electoral disputes.Results of the Research: The need for reform in the Indonesian electoral legal system, including the establishment of an independent institution that has full authority to handle election disputes. In conclusion, to increase efficiency and transparency, Indonesia needs to adopt a more centralized system and strengthen coordination between relevant institutions, by integrating juridical and sociological approaches in the enforcement of election criminal laws.
