Perlindungan hukum masyarakat hukum adat atas hutan adat merupakan kewajiban pemerintah yang harus dipenuhi sebagaimana yang diatur dalam Pasal 18B UUD 1945. Fokus permasalahan yang dibahas dalam penelitian ini adalah bagaimana prinsip-prinsip pengaturan Hutan Adat berdasarkan Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 dan Bagaimana peran pemerintah daerah dalam mewujudkan Perlindungan Hukum Masyarakat Hukum Adat pasca Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011.Hasil penelitian menunjukan bahwa Prinsip-Prinsip Pengaturan Hutan Adat dalam Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 adalah: a) Hutan adat terpisah dari Hutan Negara; b) Hutan adat merupakan hutan hak; c) Definisi Hutan adat adalah hutan yang berada dalam wilayah masyarakat hukum adat, dan; d) hutan adat merupakan hak yang dimiliki oleh masyarakat hukum adat. Sedangkan peran pemerintah daerah dalam mewujudkan perlindungan hukum masyarakat hukum adat atas hutan adat pasca Putusan Mahkamah Konstitusi No. 35/PUU-IX/2011 adalah dengan menerbitkan surat keputusan kepala daerah tentang pengakuan, perlindungan masyarakat hukum adat dan wilayahnya termasuk didalamnya hutan adat

The implementation of government leadership based on culture is one solution to overcome the leadership crisis in Indonesia. This type of research uses this type of empirical legal research by pin pointing the research site in Baubau city. The data sources used are primary data and secondary data. Data collection techniques using interviews and literature studies. The results showed that the implementation in the system of government and daily life is an effective and appropriate step, moreover Buton is an area that has a history of sultanate that has long lived with local cultural values, namely Pomaa Masiaka means always living caring for each other and loving each other, Popia-Piara means always living to care for each other. Pomae-Maeka means always glorifying each other, Poangka-Angkataka means mutual respect, and Pobinci-Binciki Kuli pinching each other's skin is an allusion to painful deeds. While Polima is able to be a solution to improve various aspects of life in society because complex cultural values are able to answer the problems that occur now such as corruption, collusion, nepotism, violence, and social problems such as lazy to know the surrounding environment, not mutual respect, and other problems. With the implementation of polima the government and the community will understand each other and understand the role of each will create a safe, peaceful, and prosperous life.

The contract or agreement is rapidly growing at this time as the consequence logical from the development cooperation business people business. Many business cooperation carried out by businessmen in the form of a contract or written agreement. The purpose of this research is to know and understand the legal analysis against the risks that arise in the agreement as well as to know the form of resolving disputes outside of the courts in the perspective of positive law and Islamic law. The type of research used in this study are normative legal research which in the use of research analysis Techniques used are qualitative techniques for which information unearthed through in-depth interviews and information search through the library, either from legislation, documents relating to the writing of this thesis so that what is in question in the study answered with a maximum. Results of the study showed that a cooperation agreement with Sejahtera Corporateand Adil Makmur potentially cause conflict so that it appears in the dispute between the parties resulting from any such agreement surfaced that there are risks such as risks language, the risk of disputes. To resolve this issue then there needs to be a model of dispute resolution that is ADR in particular using arbitration institutions while the Model dispute resolution outside of court according to ACT No. 30 of 1999 are mediation, arbitration, consilition, which chosen by the parties in accordance with applicable LAW while according to customary law, the dispute could be resolved through private, family, head of the indigenous organizational institution.

Pengiriman TKI ke luar negeri memang dapat memberikan manfaat ekonomi yang relatif besar tidak hanya bagi TKI itu sendiri dan keluarganya tetapi juga bagi negara tersebut, karena Negara tersebut menganggap pengiriman TKI ke luar negeri merupakan jawaban atas tidak adanya negara dalam menyediakan lapangan kerja. Penelitian yang digunakan dalam penelitian ini adalah dengan menggunajan jenis penelitian hukum normatif yang digunakan untuk menyusun penelitian. Review hasil penelitian menunjukkan bahwa Undang-Undang Hukum Politik Nomor 39 Tahun 2004 tentang perlindungan dan pembangunan Tenaga Kerja Indonesia di luar negeri ada 4 (empat) yaitu 1) Memberdayakan dan mendayagunakan tenaga kerja secara optimal dan manusia; 2) Menciptakan pemerataan peluang kerja dan penyediaan tenaga kerja sesuai dengan pembangunan nasional dan kebutuhan kabupaten; 3) memberikan perlindungan kepada pekerja dalam menciptakan kesejahteraan; dan 4) kesejahteraan buruh dan keluarganya sementara Faktor hukum politik implementasi hukum memengaruhi hukum Nomor 39 Tahun 2004 tentang perlindungan dan pembangunan Tenaga Kerja Indonesia di luar Negri terkait dengan perlindungan hukum di luar negeri memiliki TKI 2 (dua) yaitu 1) Struktur ( Ketenagakerjaan Dewan, b. Menjadi Keluhan minimal yang disediakan oleh Penguasa di luar negeri untuk TKI) dan 2) Substansi.

Penelitian ini bertujuan untuk mengkaji kapabilitas modal sosial Aisyiyah kota baubau, mengingat kepercayaan (trust) masyarakat kepada gerakan organisasi ini secara umum cenderung meningkat dengan sejumlah perkembangan amal usaha Muhammadiyah Kota Baubau. Penelitian ini mengkategorikan bahwa modal sosial intern lebih kuat ketimbang modal sosial ekstern organisasi, hal ini memberikan deskripsi bahwa Aisyiyah Kota Baubau mampu mengelola kader dan amal usaha sebagai bentuk upaya pengembangan organisasi, hanya saja masih belum optimal dalam membangung network terhadap stakeholder dan pemerintah daerah. Disisi lain, Aisyiyah Kota Baubau dalam perkembangannya turut dipengaruhi dengan kondisi sosial budaya masyarakat buton yang sedikit banyak memiliki jarak secara ideologis dengan muhammadiyah.

Kepemilikan tanah di indonesia ditandai dengan bukti kepemilikan tanah berupa sertifikan tanah yang diperoleh melalui proses pendaftaran tanah. Adanya pendaftaran tanah merupakan jaminan kepastian hukum yang diberikan oleh Negara kepada warga Negara terhadap kepemilikan tanah di Indonesia. Penelitian ini bertujuan untuk menganalisis hak-hak penguasaan tanah dalam kerangka UUPA selain itu penelitian ini memfokuskan pada pelaksanaan transparansi penetapan penerimaan Negara bukan pajak yang diterapkan pada pihak tertentu serta menganalisis penerapan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah di masyarakat khususnya di Desa Sribatara, Kecamatan Lasalimu, Kabupaten Buton. Metode Penelitian yang digunakan dalam penelitian ini adalah menggunkan jenis penelitian hukum normative dimana data yang diolah adalah data sekunder yakni bahan hukum primer dan bahan hukum sekunder dengan memanfaatkan tekhnik ceramah dan diskusi dalam mengolah datanya dan kemudian dianalisis berdasarkan ketenruan peraturan perundang-undangan. Hasil Penelitian menunjukan bahwa pelaksanaan pendaftaran tanah di Desa Sribatara, Kecamatan Lasalimu, Kabupaten Buton masih dijumpai berbagai hambatan baik hambatan yang berasal dari masyarakat, aparat pemerintah bahkan substansi dari pelaksana aturan dari Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Sejatinya keberadaan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah harus berpegang teguh pada prinsip-prinsip hukum dari UU No. 5 Tahun 1960 tentang Peraturan Dasar Pokok Agraria. Untuk lebih mengoptimalkan penerapan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah di masyarakat perlu didukung oleh sejumlah kementrian bukan hanya Kementrian Agraria Tata Ruang namun juga kementrian terkait seperti kementrian kehutanan dan lingkungan hidup, kementrian keuangan demi memaksimalkan proses percepata legalisasi sertifikasi tanah.

Tujuan penelitian menganalisis efektifitas pengadilan agama dalam menyelesaikan sengketa ekonomi syariah. Metode penulisan yang digunakan adalah metode penulisan normatif dengan pendekatan peraturan perundang-undangan dan pendekan analitis. Hasil penelitian ini menunjukkan bahwa Peradilan agama belum memiliki hukum acaranya sendiri padahal banyak perkara yang menjadi kewenangan dari peradilan agama memiliki karakter tersendiri yang sifatnya spesifik dan berbeda dengan perkara pada perdata umum. Kemampuan hakim pada peradilan agama yang paling banyak disorot sejak diberikannya kewenangan pada peradilan agama untuk menyelesaikan sengketa ekonomi syariah. Sehingga diperlukan perbaikan dari segi penguatan sistem dan peningkatan kemampuan hakim. The research objective is to analyze the effectiveness of religious courts in resolving Islamic economic disputes. The writing method used is the normative writing method with the statutory approach and analytical short. The results of this study indicate that the religious courts do not yet have their own procedural law, even though many cases that are under the authority of the religious courts have their own characteristics which are specific and different from cases in general civil. The capacity of judges in the religious courts has been highlighted the most since the granting of authority to the religious courts to resolve sharia economic disputes. So it is necessary to improve in terms of strengthening the system and increasing the capacity of judges.

Sumba Island holds a lot of local wisdom. One of the local wisdom is Piti Maranggangu. Piti Maranggangu is a catch / take in meetings that often occur in public places or public places, such as in traditional markets, places of customs activities (traditional parties), on the street, at home and even planted. The purpose of this study was to find out and understand Piti Maranggangu from the point of view of Customary Law and Law No. 1 of 1974 on marriage. The type of research used is socio-legal research with a research location in Sumba Island, East Nusa Tenggara. The results showed that Piti Mara interfered with a review of the principles of customary law that piti maranggangu practices are recognized in the sumba island community and is a form of honest exogamous mating mating system. Referred to as honest exogamy because the edited woman has been positioned as a surrogate in the clan. While Piti Maranggangu in the perspective of Law No. 1 of 1974 can be concluded that there are 2 (two) conditions violated in the marriage process, namely substantive conditions that there is no consent from the bride, then the age of the edited bride is underage (under 19 years). As a result of violating these substantive conditions, Piti Maranggangu can legally be void by law.

The role of the Community Development Unit (Binmas) of the Bone Bolango Police is very important. Its existence can be one of the efforts to prevent crime through community-based prevention efforts. The type of research used is empirical legal research. The results show that the role of the Community Development Unit (Binmas) of the Bone Bolango Police is being played with an emphasis on improving the efficiency and technical capabilities of the police, but it still has shortcomings because even though the handling or resolution of problems that occur in the community is only a matter of violations, minor crimes need to be improved. The inhibiting factors are first in terms of the quantity of the number of personnel; second, the supporting facilities or facilities are still minimal; and thirdly, the lack of legal awareness of the community participating in counseling or socialization activities.

The 1945 Constitution does contain the idea of political democracy and at the same time economic democracy. That is, in the highest power holder in our country is the people, both in the political and economic fields. All political and economic resources are controlled by sovereign people. However, in a democratic system built certainly not all of them are directly controlled by the people. The purpose of this research is to formulate the concept of populist economic law based on economic law in Indonesia and to understand the legal comparison between Islamic economic system and conventional economic system in the development of economic law in Indonesia. This research is normative legal research that is conducted by researching and studying the laws and regulations. The research approach used in this study is 2 (two) namely statute approach and conceptual approach. The results showed that the Concept of Economic Law Based on Populist Economy in Indonesia was built through 4 (four) principles of economic law, namely legal justice, legal certainty of benefits and affordable rules so as to realize the main goal of economic law, namely creating economic growth, balanced equality and welfare while the Comparison of Law Between Islamic economic system and conventional economic system in economic law development in Indonesia is Islamic economy based on sharia principles while conventional economy based on human will.
