Abstract

Bahwa kesamaan kedudukan hukum bagi setiap warga Negara telah dilindungi oleh konstitusi sebagai wujud perlindungan hak asasi manusia dalam memenuhi rasa keadilan hukum. Jaminan kesamaan dihadapan hukum tersebut harus dijunjung tinggi tampa kecuali sebagaimana dimanahkan dalam Pasal 27 ayat (1) UUD 1945, hal ini sejalan dengan doktrin Hukum yang menyatakan bahwa keadilan harus dapat diakses oleh semua warga negara tanpa terkecuali (justice for all/accessible to all)”. Namun akses hukum dan keadilan belum sepenuhnya menyentuh lapisan masyarakat tidak mampu, olehnya itu dipandang perlu ada sarana untuk dapat menfasilitasi layanan bantuan hukum cuma-cuma/ gratis bagi masyarakat tidak mampu. Melalui kegiatan penyuluhan hukum dengan tujuan meningkatkan pemahaman dan pengetahuan hukum masyarakat terkait pemberian Bantuan Hukum Bagi Masyarakat Tidak Mampu yang diselenggarakan oleh Pemerintah dengan menggunakan metode tatap muka langsung, agar masyarakat dapat mengetahui tata cara memperoleh layanan bantuan hukum gratis sehingga mewujudkan perubahan sosial yang berkedilan.

Abstract

This study aims to identify and analyze the hamlet land pawn agreement practice and its impact on the economic level of indigenous peoples in Negeri Piliana, Central Maluku Regency. The method used is sociological juridical research which emphasizes research aimed at obtaining legal knowledge empirically by going directly to the object. The chosen research location was Negeri Piliana, Tehoru District, Central Maluku Regency. The research was conducted using primary and secondary data. The sample selection method used a purposive sampling method. The results of this study indicate that the pawn sales transaction practice in Negeri Piliana, Tehoru District, Central Maluku Regency, has a different concept from the concept according to customary law in general. The pawn sales practice, in this case, is an agreement to give a hamlet (land that has been planted with certain long-lived crops such as coconut, cloves, nutmeg or cocoa) to obtain an amount of money with a mutually agreed repayment period as long as the pawn giver can cover the amount owed along with interest. So that if it is not agreed upon, it can cause the pawn giver as the owner to lose access to the pawned object for an unlimited time, which can impact the economic level of the surrounding community.

Abstract

Political parties are an important aspect that determines the quality of holding good general elections, because political parties are the first door for candidates for government administration. Find out what are the requirements for political parties to become participants in the General Election (PEMILU) and how to carry out factual verification of political parties. The statutory and analytical approach through literature studies related to the factual verification of political parties participating in general elections. There are parties that were previously declared ineligible, then later after taking legal or administrative measures they were passed, meaning that there was implementation that was not optimal or error in the field.

Abstract

The concepts of positivism and utilitarian schools show differences in regulating or interpreting society and individual rights. The purpose of this research is to find the views of the pure law school and the utilitarian law school in reconstructing indigenous peoples. This research uses normative legal research. In its study, this research uses several approaches, namely the statutory approach and the concept approach. The results showed that John Austin's pure legal school places the construction of indigenous peoples in the standard norms contained in Article 18 B paragraph (2) of the 1945 Constitution. This flow limits the interpretation of the construction of indigenous peoples. Meanwhile, according to the utilitarian legal school of Jeremy Bentham, the view of Article 18 B paragraph (2) of the 1945 Constitution as the basis for the construction of indigenous peoples shifts by interpreting the existence of indigenous peoples is not only seen as law an sich, but the legal regulation of legal communities is seen in 3 (three) aspects, namely a) indigenous peoples are seen in the position of legal reality; b) Customary law becomes a translation of the legal provisions referred to in Article 18 B paragraph (2) of the 1945 Constitution; c) Recognition and protection of the law of indigenous peoples are constructed in the aspect of legal reality. Thus, the utilitarian school of law opens a new approach in the construction of indigenous peoples that is not only reviewed from the norms an sich in statutory regulations but the existence of utilitarian schools of law can be used to open more lively legal spaces in constructing recognition and protection of the rights of indigenous peoples as subjects of law.

Abstract

The process of child adoption is not done widely based on The Traditional Law of Minangkabau because most of the adopted children are still their relative. The legal status of adopted child in the foster family can be obtained through the court where the status is the same with biological child or foster child, while the legal status of adopted child in the adopted relative can be gained through the tribe recognition or determination of Minangkabau Tradition namely as “kamanakan di bawah lutuik” (the closest nephew/niece). The purpose of this paper was to find out how was Islamic law intervention towards the law of Minangkabau tradition especially in child adoption. This research employed Field Research with the main data came from primary data obtained from informants in the field and the secondary data obtained from the materials related to the research. The data collection was carried out through interview, reading, and grouping in accordance with the theme being discussed, then were analyzed by using descriptive theory, inductive theory, and presented them in the form of paper. The results of this research state that in Islam and Minangkabau tradition basically forbid someone to adopt other people’s child by cutting the family ties with the child’s parents, then move it to the foster parents because it can cause chaos in the inheritance system either according to the traditional law or according to Islamic Law.

Abstract

Suku Bajo merupakan suku yang hidup bebas mengembara di lautan luas sehingga sering dikenal sebagai pengembara laut (Sea Nomads). Salah satu kearifan yang dimiliki oleh Masyarakat Suku Bajo adalah adanya pemukiman diatas laut yang telah ditinggali secara turun temurun. Penelitian ini bertujuan untuk mengidentifikasi pengaturan hak bermukim Masyarakat Suku Bajo dan mendesign konsep perlindungan hukum hak bermukim Masyarakat Suku Bajo. Jenis penelitian dalam penelitian ini adalah penelitian hukum normatif yang menggunakan beberapa pendekatan hukum yakni, pendekatan peraturan perundang-undangan, pendekatan konsep dan pendekatan sejarah. Sumber bahan hukum yang digunakan adalah bahan hukum primer yang kemudian analisis secara preskriptif untuk mendapatkan hasil bahan hukum yakni norma hukum mengenai pengaturan hak bermukim Masyarakat Suku Bajo. Hasil penelitian menunjukan bahwa hak dasar bagi pemenuhan hak asasi manusia merupakan budaya Masyarakat Suku Bajo. konsep perlindungan Masyarakat Suku Bajo harus memenuhi prinsip nondiskriminasi, dan bersifat progresif, selain itu dalam penerapannya harus melibatkan langsung Masyarakat Suku Bajo. Bentuk perlindungan hukum yang dapat diberikan adalah pemberian hak berupa sertifikat hak atas tanah dan/atau bangunan yang ditinggali oleh Masyarakat Suku Bajo secara turun temurun. Pemberian sertipikat tersebut merupakan bentuk perlindungan negara terhadap Masyarakat Suku Bajo dengan memberikan kepastian hukum terhadap tempat bermukimnya.

Abstract

Customary land rights are the highest form of land ownership under customary law, encompassing all land within a specific customary legal jurisdiction, jointly held by members of the indigenous community. The purpose of this research is to find a model for registering communal land in the land registration system and to determine the legal status of communal land in the land registration system. The research methodology used in this study is normative legal research, employing various approaches such as statutory approach and conceptual approach. The legal sources used include primary legal materials, secondary legal materials, and tertiary legal materials. The research findings indicate that the registration of communal land in the land registration system, both de facto and de jure, has been recognized and protected through two regulations that acknowledge the existence of communal land, namely Ministerial Regulation No. 10 of 2016 and the Complete Systematic Land Registration (PTSL) program. Essentially, communal land controlled by indigenous communities will be acknowledged through a decree issued by the regent/mayor/governor for the registered communal land at the local National Land Agency (BPN) office. However, the legal status of communal land in the Land Registration System shows that communal land is not included in the rights to land as regulated in Government Regulation No. 24 of 1997 concerning land registration. Therefore, a revision of the land registration regulation is necessary to ensure the legal certainty of communal land controlled by indigenous communities

Abstract

The Sidokare Village-Owned Enterprise (BUMDes), which was founded in 2019, has succeeded in cooperating with village PKK women who are active members and operational in 2022. During the operation, the Sidokare BUMDes did not escape several obstacles. Through the PAR (Participatory Action Research) approach with the initial mapping stages, tansek, priority ranking, historical tracing, Venn diagrams, flowcharts, problem tree analysis, and hope tree analysis. So that the problem is obtained, namely, the failure of product marketing in BUMDes. This is due to the low knowledge of BUMDes executors, namely PKK women, in managing products in terms of quality and marketing. So that the product is not in demand by the village community. As a result of these problems, it is difficult to determine the selling price, it is difficult to attract buyers, the product manufacturing process is not optimal, and product marketing cannot be comprehensive in the community sector. This service program aims to help PKK women in improving the quality and marketing of soap products, as well as help the economy of the Sidokare BUMDes. The results of the training and mentoring program for PKK women in Sidokare Village are making BUMDes administrators and PKK women enthusiastic about producing and exploring activities to produce 100 dish soaps and 60 laundry soaps. The soap products are marketed to shops and the people of Sidokare. So that the product can be recognized and purchased easily by the people of Sidokare.

Abstract

This scientific article aims to explore the role of local wisdom in strengthening law enforcement and preventing crime in Buton community. By employing a research methodology adhering to academic standards, the study identifies the forms of local wisdom and its implications for crime prevention. The research findings highlight the significance of cultural festivals, particularly the "pesta kampung" tradition, which embodies values such as communal harmony, compassion, and mutual cooperation. These values contribute to raising legal awareness and fostering a sense of responsibility among the community. The results underscore the potential of local wisdom approaches as effective tools for crime prevention. The implications of this study can inform policymakers, legal practitioners, and researchers worldwide, shedding light on the importance of incorporating local cultural practices into legal frameworks to promote law-abiding behaviors and enhance community well-being. Highlights: Local wisdom plays a vital role in preventing crime through community engagement. Cultural festivals serve as platforms to reinforce law enforcement values and promote legal awareness. Incorporating local wisdom into crime prevention strategies can enhance community well-being and foster a sense of responsibility among individuals.
