Abstract

Kampung sentabeng merupakan salah satu kampung yang menjadi binaan Desa Sikida. Keberadaan Masyarakat sentabeng yang sebagian besar bekerja sebagai petani telah membuka lahan seluas 100 ha. Penguasaan tanah oleh masyarakat Sentabeng sebagai pemegang hak atas tanah ditandai dengan adanya sertifikat hak milik (SHM) yang dimiliki oleh masyarakat dan masyarakat membayar pajak tiap tahunnya. Perlakuan negara terhadap keberadaan masyarakat sentabeng menunjukan hukum tidak berdaya. Tujuan dari penelitian ini adalah 1) Untuk menganalisis, menjelaskan dan memahami pengaturan hukum kepemilikan tanah masyarakat sentabeng yang berada dalam kawasan Perbatasan Indonesia – Malaysia dan 2) Untuk menganalisis, menjelaskan dan memahami hakikat penyelesaian konflik kepemilikan tanah perbatasan masyarakat sentabeng ditinjau dari perspektif Filsafat Ilmu dan Ilmu Hukum. Hasil penelitian menunjukan bahwa 1) Pengaturan Hukum Kepemilikan Tanah Masyarakat Sentabeng yang Berada dalam Kawasan Perbatasan Indonesia – Malaysia adalah dengan memberikan pengakuan hak komunal atas masyarakat sentabeng dan 2) Penyelesaian konflik kepemilikan tanah perbatasan masyarakat Sentabeng ditinjau dari perspektif filsafat ilmu dan ilmu hukum adalah dengan menempuh model penyelesaian konflik berbasis prinsip-prinsip keseimbangan yang mengutamakan musyawarah mufakat yang harus memenuhi keseimbangan hak dan kewajiban antara masyarakat sentabeng dengan pemerintah pusat/pemerintah daerah.

Abstract

Keberadaan Lembaga Bantuan Hukum dalam mewujudkan keadilan yang berpihak pada masyarakat keadilan sangat penting di Negara Indonesia. Salah satu perwujudan itu diwujudkan dalam bentul Pemberian Layanan bantuan hukum yakni Pos Bantuan Hukum di Pengadilan Agama Pasarwajo. Kegiatan ini merupakan bentuk pengabdian kepada masyarakat antara dosen fakultas hukum, Yayasan Lembaga Bantuan Hukum Amanah Peduli Kemanusiaan yang bermitra dengan Pengadilan Agama Pasarwajo dalam pemberian bantuan hukum kepda masyarakat miskin. Pada dasarnya, Posbakum Pengadilan Agama Pasarwajo telah menerapkan dan melaksanakan ketentuan yang ada dalam Perma Nomor 1 Tahun 2014 jo. SOP Pelayanan Pos Bantuan Hukum (POSBAKUM) Pengadilan Agama Pasarwajo No : SOP/AS/02 Tanggal 2 sedangkan peran Posbakum Pengadilan Agama Pasarwajo ada 4 yakni a) Memberikan bantuan hukum secara prodeo menurut UU 16 Tahun 2016 dan Perma No. 1 Tahun 2014; b) Memberikan akses keadilan bagi masyarakat yang kurang mampu terhadap pelayanan pengadilan; c) Melaksanakan asas peradilan yang cepat, murah dan biaya ringan; d) Mewujudkan peradilan yang agung sebagai mitra dari pengadilan agama pasarwajo. Legal Assistance of the Justice Seeking Community through the Legal Aid Postal Service at the Pasarwajo Religious Court The existence of legal aid institutions in realizing justice in favor of the justice community is very important in the State of Indonesia. One of the manifestations is manifested in the form of providing legal aid services, namely the Legal Aid Post at the Pasarwajo Religious Court. This activity is a form of community service between law faculty lecturers and The Amanah Peduli Humanitarian Legal Aid Foundation (YLBH ALIM), in partnership with the Pasarwajo Religious Court, in providing legal assistance to the poor. Basically, the Pasarwajo Religious Court Posbakum has implemented and implemented the provisions contained in Perma Number 1 of 2014 jo. SOP for Legal Aid Postal Services (POSBAKUM) of the Pasarwajo Religious Court No. SOP/AS/02 dated two while the roles of Posbakum for the Pasarwajo Religious Court are 4, namely a) Providing legal assistance on a free basis according to Law 16 of 2016 and Perma No. 1 of 2014; b) Providing access to justice for underprivileged communities to court services; c) Implementing the principle of fast, low-cost and low-cost justice; d) Realizing a great judiciary as a partner of the Pasarwajo.

Abstract

Constitutional Court will be able to provide protection for constitutional rights which will produce institutions that are able to provide answers to reforms. The presence of the Constitutional Court third amendment to the 1945 Constitution of the Republic of Indonesia, which became the basis of Article 24C. The legitimacy of the Constitutional Court in a limited way is formulated, namely: to begin, to investigate legislation that violates the constitution, to adjudicate disputes over the power of state institutions vested with constitutional authority, and to adjudicate the dissolution of political parties and settlement, the four general election disputes. In the modern state administration discourse, it currently requires the Constitutional Court to expand the scope of its authority in relation to Constitutional Complaints or commonly referred to as Constitutional Complaints. The necessity of one of these powers can be seen in the number of state institutions that violate the constitutional rights of citizens through the actions of these institutions. However, the channel for this complaint still does not exist, only that currently exists in providing protection for the right of Constitutional Complaints to be protected through judicial review of the basic constitution as regulated in the constitution.

Abstract

Dalam usaha efisiensi dan menjaga intervensi penyelesaian sengketa Pemilihan Kepala Daera (PILKADA) sebagai sengketa tata usaha Negara yang timbul akibat dikeluarkannya keputusan penyelenggara negara yang merugikan peserta pemilihan (pasangan calon) atau partai politik atau individu dan institusi lain, di dalam proses pilkada. Dianggap perlu peradilan khusus pilkada sebagaimana ketentuan di dalam Undang-Undang PILKADA. Sehingga penyelesaian sengketa tersebut dapat diperiksa dan diputus secara adil oleh lembaga independen, sehingga memberi rasa adil atas terpenuhinya hak masing-masing yang bersengketa. Dalam Penelitian ini, peneliti menggunakan metode normatif dengan pendekatan konseptual.

Abstract

Indigenous institutions in Indonesia are a local wisdom inherited from the ancestors of the Indonesian State. This research is normative legal research, namely legal research conducted by researching and examining statutory regulations, starting from Article 18b paragraph 2 of the 1945 Constitution, 18B paragraph (2), Article 28D paragraph (1), Article 28G paragraph (1), and Article 28I paragraph (3), and the organic regulations under them. The results of the study show that the arrangements for protecting traditional institutions in Indonesia, namely that the State is obliged to protect the natural rights of humans themselves, namely customary law communities, are based on the Decision of the constitutional court no. 35/puu/ix/2012, namely customary rights in both private law and public law. John Locke's theory of protection is related to regulations issued by the State to provide legal protection for rechtgemeschappen, which needs to be studied juridically and sociologically. While the harmonization of customary institutional protection norms in Indonesia, namely by carrying out a legal review (reviewing) of legal regulations against Permendagri with Article 18b, Paragraph 2 of the 1945 Constitution, Article 6 of Law Number 39 of 1999 concerning human rights, Constitutional Court Decision Number 35/puu-ix/2012 Permendagri Number 52 of 2014 concerning the recognition and protection of customary law communities, and Circular Letter Number 3/se/iv/2014 regarding the determination of the existence of customary law communities and ulayat lands.

Abstract

Abstract Bilateral negotiations are the first attempt to solve industrial relations problems. It is interesting to study in detail the urgency of bilateral negotiations to resolve industrial relations disputes and the existence of PKB as the legal basis for implementing bilateral PKB. The research method used by the author is normative legal research, which aims to find legal principles, principles and doctrines to answer legal questions. The results of the study show that bilateral negotiations as an initial effort to resolve industrial relations disputes require a commitment of good faith in the negotiation process, collective bargaining and enforcement of collective bargaining. Prudence and prudence are also required in drafting collective labor agreements so that contract clauses do not cause losses or problems in enforcement. Keywords: Urgency. Abstract

Abstrak Hubungan kerja adalah hubungan antara pengusaha antar buruh berdasarkan perjanjian kerja yang mempunyai unsur pekerjaan, upah dan perintah berdasarkan perjanjian kerja antara pekerja dan pengusaha. Pemutusan Hubungan Kerja (PHK) merupakan suatu hal yang pada beberapa tahun yang lalu merupakan suatu kegiatan yang sangat ditakuti oleh karyawan yang masih aktif bekerja. Permasalahan adalah, bagaimana mekanisme penyelesaian perselisihan hubungan industrial dan bagaimana proses hukum penyelesaian perselisihan hubungan kerja di pengadilan hubungan industrial. Perselisihan hubungan kerja terdiri dari perselisihan hak, perselisihan kepentingan dan perselisihan antar serikat pekerja. Perselisihan hubungan kerja pada dasarnya diselesaikan di Pengadilan Perselisihan Hubungan Industrial (Pengadilan PHI). Sebelum mencapai tahap atau tingkat Pengadilan PHI dapat menempuh tahap-tahap awal atau alternatife yang terdiri dari: 1. Lembaga Bipartit, 2. Mediasi, 3. Konsilsasi, dan 4. Arbitrase. Dengan cara tersebut, pengadilan memutuskan untuk menghukum pengusaha (tergugat), untuk membayar uang pesangon, uang THR 2013 dan uang pengganti hak yang seharusnya diterima oleh penggugat, sesuai ketentuan Pasal 156 Ayat (1) Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Abstract

Family law is part of the legal system that applies in Indonesia, which has developed along with social developments in society. This paper provides an overview of how the development of family law in Indonesia uses a normative approach and describes the development of family law in Indonesia these days. The development of family law in Indonesia is influenced by several factors, ranging from the historical aspect of law to today's social developments. The development of family law develops according to the community's needs for legal certainty and aspects related to family relations, starting from age limits for prospective husbands and prospective wives, child status, and marriage agreements to a marital status that is not administratively registered.

Abstract

Indonesia is a country that has a history of gross human rights violations. However, the case has not been resolved. In addition to settlement through the court, a reconciliation pattern is highly recommended in the settlement of the case in question. But the rules on reconciliation have been canceled by the Constitutional Court. The results of the study concluded that the Settlement of cases of gross human rights violations was resolved with a pattern of reconciliation with the establishment of an independent institution (KKR). Besides that, the pattern of reconciliation can also be done in a family way. Reconciliation arrangements exist in several regions in Indonesia, namely Papua, Aceh and Palu Reconciliation patterns that exist in these rules vary, there are those who use the TRC pattern there are also those who use family reconciliation patterns.
