Abstract

One of the forms of transportation often used by the people of West Sumatra (Sumbar) is the PT Bus. XXX, Based on LLAJ Law Number 22 of 2009 and PK Law Number 8 of 1999, currently public transport very often provides minimal services to passengers or takes actions that are considered to cause losses to passengers, both materially and non-materially, Sometimes it can even endanger the lives of consumers. Organizing public bus passenger transportation should provide a sense of security, safety and order, all of which are important parts and are one of the main objectives in organizing transportation. The method used in the research is the research approach that the author uses in this research is sociological juridical. And the type of research used is qualitative-descriptive because it is more appropriate to explain PT.XXX's responsibilities. The conclusion that the author got from this research is the responsibility of PT. XXX regarding accident passengers and passenger comfort has not been fully implemented by PT. XXX. The responsibility given is not only insurance but also justice felt by passengers, which is the most important thing passengers need, namely a sense of security, safety and comfort, especially since this is public transportation used by many people.

Abstract

Community Service Activities that will be carried out by the Lecturer Team of the Dharma Andalas University Law Study Program will be accomplished in the form of law counseling related to Online Loans. This is intended to socialize to the public about legal online loans and vice versa. It is because the illegal online loans are very widespread and disturbing to the public because debt collectors who collect loans terrorize their victims. Law counseling was provided in one of the sub-districts in Padang City due to the large number of complaints from the people who were caught in online loans where the relevant task force received 8,991 complaints related to illegal loan until October 2023, so that the public needed to be given an understanding regarding to loan money, both legal and illegal, and the impacts from the perspective of law. This service is carried out by using a lecture method with laptop and LCD Projector in Padang City, particularly at the house of one of the residents in Unand Housing Complex, Padang Besi Village, Lubuk Kilangan District, Padang City. To measure their understanding, the participants were asked questions in the form of question-and-answer games.

Abstract

The Faculty of Law at Dharma Andalas University will conduct a community service activity in the form of a legal education campaign focusing on "Stop Bullying" to create a bullying-free school environment. This campaign aims to raise awareness about bullying, which is a repetitive aggressive behavior intended to harm or weaken individuals who are physically or mentally weaker. Bullying can occur physically, verbally, socially, or even online. According to data from the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases in schools are on the rise, underscoring the urgency for preventive measures. The campaign will be conducted through lectures using laptops and projectors at several schools in Pesisir Selatan. This program aims to help school communities better understand and take preventive actions against bullying, thereby fostering a safe and conducive learning environment for students.

Abstract

Meningkatnya kejahatan di Indonesia berakibat timbulnya berbagai macam modus dalam terjadinya tindak pidana. Salah satu bentuk tindak pidana yakni tindak pidana pencurian kendaraan bermotor. Dalam penyelesaian perkara pidana sering kali hukum mengedepankan hak-hak tersangka dan terdakwa yang diatur dalam Undang-Undang Nomor 8 Tahun 1981 Pasal 50. Namun pada kenyataannya hak-hak korban terbaikan. Banyak ditemukan korban kejahatan kurang memperoleh perlindungan hukum yang memadai baik perlindungan yang sifatnya imateril maupun materil. Padahal telah ada aturan-aturan yang mengatur tentang perlindungan saksi dan korban, seperti di dalam Undang-Undang Nomor 31 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 13 Tahun 2006 Tentang Perlindungan Saksi dan Korban. Melihat pentingnya peranan saksi dan/atau korban dalam membuat terang suatu perkara pidana maka penting untuk pemberian perlindungan terhadap saksi dan korban tersebut. Jenis pendekatan penelitian yang digunakan yakni yuridis empiris. Adapun kesimpulan yang penulis bisa dari penelitian ini yakni Bentuk perlindungan hukum ada 2 (dua) yaitu perlindungan hukum preventif dan perlindungan hukum represif. Adapun perlindungan hukum yang diberikan Polresta Padang dengan memproses kasus tindak pidana pencurian kendaraan bermotor lebih berfokus pada penegakan hukum terhadap pelaku, efeknya secara tidak langsung memberikan perlindungan hukum terhadap korban. Kendala penyidik ada internal dan eksternal. Upaya yang dilakukan penyidik yaitu upaya preventif dan upaya represif. Dalam kaitannya dengan melindungi hak-hak korban tindak pidana pencurian kendaraan bermotor Polresta Padang telah berupaya dengan baik dalam melindungi hak-hak korban dan memastikan bahwasanya korban mendapatkan akses keadilan. Meskipun demikian, ada masih ada beberapa kasus yang tidak bisa ditangani dan diselesaikan oleh Polresta Padang. Hal ini termasuk hal yang wajar dalam sistem hukum, karena setiap kasus memiliki karakteristik tindak pidana yang berbeda.

Abstract

Kejahatan bukan hanya dilakukan oleh orang dewasa saja tetapi sebagian juga dilakukan oleh anak. Sebagaimana diketahui bahwasanya penyelesaian kasus apa pun terhadap pelanggar hukum yang berusia di bawah 18 tahun akan mempengaruhi perkembangan kepribadian anak, maka menarik untuk melihat lebih jauh permasalahan anak di bawah umur yang terlibat pada kegiatan kriminal. Hak dan martabat anak harus dilindungi ketika mereka dihukum karena perannya dalam melakukan kejahatan. Maka, Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak mengamanatkan alternatif pendekatan saat menangani perkara pidana anak: diversi melalui restorative justice. Penulis menggunakan teori hukum campuran dan metodologi penelitian empiris. Temuan penelitian ini, jika dibandingkan dengan hukum yang digunakan sebagai indikasi, mendukung Teori Penegakan Hukum yang ada saat ini. Penerapan hukum terhadap pelaku remaja mencerminkan keharmonisan ini dengan menjunjung tinggi nilai-nilai seperti keadilan, kejelasan hukum, dan kemaslahatan masyarakat. Mengingat tidak semua kasus anak di bawah umur ditangani oleh unit PPA di Polres Kota Padang, maka unit reserse kriminal yang juga menangani kasus yang melibatkan orang dewasa bertugas melaksanakan diversi bagi anak pelaku pencurian.

Abstract

The Head of Village’s office work of only six years is considered too short, so elected village heads often do not have enough time to complete development plans in their villages. It is hoped that extending the Village Head's term of office to 9 years will increase the effectiveness of development and community welfare. On the other hand, extending the term of office is considered inconsistent with the spirit of democracy and the principles of the rule of law. This research aims to find out the legal regulations related to the position of village head and the urgency of extending the work of village head from a legal perspective and democratic theory. The author utilizes qualitative research methods with a normative juridical approach to explain the questions asked. The development of policies governing the term of office of village heads in Indonesia reflects changes in the structure of the village government. The discourse on increasing the term of office of village heads to nine years raises profound questions about the balance between leadership stability and the essence of democracy in the context of village government in Indonesia. Extending the term of office of village heads is not in line with the spirit of democracy and can open up space for developing oligarchy at the village level. Limiting power and limiting terms of office are the main principles for preventing abuse and maintaining balance in government.

Abstract

The rapid advancement in technology and infomation has transformed human life paradigms, shifting conventional activities into digital realms through various technological devices. However, alongside technological progress, personal data has become increasingly vulnerable to misuse and privacy violations. The protection of personal data is considered a fundamental human right that must be guaranteed and respected. Although the Personal Data Protection Law has been enacted, its implementation faces various challenges such as data theft, fraud, data selling, and leaks managed by the government for public services. Therefore, this research examines how the government manages the protection and utilization of personal data in public services and the participation of the community in personal data protection. To address these questions, the author employs a qualitative writing method with a normative juridical approach. Law Number 27 of 2022 concerning Personal Data Protection provides a robust legal framework to safeguard individual data and ensure legal certainty for data controllers. Satu Data Indonesia plays a role in integrating data to enhance public service efficiency and ensure data security. However, the implementation and improvement of data protection systems are still necessary. Active participation from the government, data controllers, data owners, law enforcement agencies, as well as digital literacy education and regulatory strengthening, are expected to enhance security and public trust in managing personal data in the digital era.

Abstract

Media sosial telah menjadi bagian tak terpisahkan dari kehidupan remaja, termasuk siswa SMP. Meskipun memiliki berbagai manfaat, media sosial juga membawa dampak negatif, seperti penurunan konsentrasi belajar, risiko kecanduan, dan paparan informasi yang tidak sesuai. Penelitian ini bertujuan untuk meningkatkan kesadaran siswa SMP Kartika terhadap dampak media sosial melalui kegiatan sosialisasi yang terstruktur. Metode yang digunakan adalah pendekatan kuantitatif deskriptif dengan melibatkan 100 siswa sebagai sampel. Kegiatan sosialisasi dilakukan melalui ceramah interaktif, diskusi kelompok, dan penyebaran materi edukasi. Hasil penelitian menunjukkan adanya peningkatan pemahaman siswa terhadap dampak media sosial, yang diukur melalui pre-test dan post-test. Rata-rata nilai kesadaran siswa meningkat sebesar 35%. Temuan ini menunjukkan bahwa sosialisasi dapat menjadi strategi efektif dalam meningkatkan kesadaran siswa terkait penggunaan media sosial yang bijak.

Abstract

Air Manis Padang Beach is one of the popular beach attractions in West Sumatra. Apart from enjoying the natural panorama and waves, this beach cannot be separated from the legend of Maling Kundang. This sweet water beach has an unspoiled natural atmosphere. Plastic waste management in the Air Manis beach area aims to increase public awareness regarding the negative impact of plastic waste on the environment and the importance of maintaining beach cleanliness. Plastic waste management is a priority program based on the condition of the most abundant and frequently encountered piles of plastic waste. Therefore, local people and tourists will better understand the negative impact of plastic waste on the environment. And it can encourage a reduction in the amount of plastic waste that is thrown away carelessly, thereby reducing pollution in coastal areas. In this way, the beach will become more beautiful and attractive for tourists, thereby having a positive impact on the local tourism sector. The method used is an educational and participatory approach through socialization, discussions, quizzes activities, giving out door prizes. This research involved 10 respondents consisting of local communities, tourist visitors and tourism business actors. The research results show that this outreach increases public awareness and understanding of the importance of disposing of waste in the right place, as well as Pancasila ethical values such as environmental concern, social responsibility and shared awareness. Abstract

Increasing Pancasila as the basis of the state can be achieved through socialization that emphasizes the values ​​of tolerance and unity among students. This effort aims to prevent brawls between students and build awareness of the importance of maintaining harmony in society. This socialization is focused on increasing students' understanding of Pancasila as the state ideology, as well as instilling the values ​​of mutual respect and cooperation. Implementation methods include seminars, discussions, and involvement of community leaders and educators, as well as the use of social media to reach more students. The expected results of this program are increased student awareness of the importance of Pancasila, a reduction in the number of brawls between students, and the formation of a student community that supports each other and respects differences. With these steps, it is hoped that Pancasila can become stronger as the basis of the state and become a guideline in students' daily lives.
