Abstract

This thesis is entitled Enforcement of The Law By The Police Against Thugs Who Commit Public Transport Avoidance. Which in writing uses normative research methods, using the and case studies, research that examines the factual implementation or implementation of positive legal provisions in each specific legal event. The formulation of the problem in this research is: (1) What are the law enforcement efforts carried out by the police in dealing with thuggery in Padang City. (2) What are the obstacles faced by the Police in dealing with thuggery in Padang City? From the legal research that has been carried out using the research mentioned above, it can be concluded that, in the first problem formulation, law enforcement efforts have been carried out in a repressive and preventive manner, but in practice law enforcement administrators in the field often experience conflict between legal certainty and justice. This is because the conception of justice is an abstract formulation, while legal certainty is a procedure that has been determined normatively. Meanwhile, the second problem formulation discusses the obstacles faced by the police in dealing with thuggery in Padang City, such as internal obstacles and external obstacles.

Abstract

Correctional Institutions (LAPAS) play a crucial role in Indonesia's correctional system, tasked with rehabilitating Correctional Inmates (WBP) to reintegrate productively into society. However, the issue of overcapacity in LAPAS Class IIB Muara Teweh poses significant challenges in security management and inmate rehabilitation, including the heavy workload of security officers. Based on data, this LAPAS houses 383 inmates, far exceeding its ideal capacity of 175, with a security ratio that is highly imbalanced (ideally 1 officer for every 5 inmates). This increases the risks of conflicts, escapes, and security disturbances. This research examines the role of security officers in managing inmate security, the challenges faced by security officers in performing their duties, and the effectiveness of security personnel in providing protection at LAPAS Class IIB Muara Teweh. The research employs a qualitative method with an Empirical Juridical approach and a case study (Case Approach). The results reveal that security officers play a strategic role in maintaining order and supporting rehabilitation, but their main challenges include a lack of personnel, insufficient facilities, and high workloads. The effectiveness of security is hindered by the imbalanced ratio and limited training. Therefore, efforts are needed to improve the competence of security personnel, increase staffing and facilities, and conduct regular performance evaluations to create a safer and more conducive environment in LAPAS. This study is expected to serve as a reference for future correctional facility management policies in Indonesia

Abstract

The implementation of democracy in Indonesia is a mandate from the provisions of Article 2 paragraph (1) and Article 6A paragraph (1) of the 1945 Constitution of the Republic of Indonesia, where one of the indicators is general elections. However, the implementation of general elections is often overshadowed by the presence of family members of powerful politicians running for general elections and succeeding, including the elections for president, governor, regent, and others. This condition can trigger much debate and concern about democracy, the quality of elections, and political stability in Indonesia. Nevertheless, the right to elect and to be elected are protected rights and their existence is recognized by the constitution. The limitations of the problem in this paper include: 1) Political dynasty in the perspective of democracy; 2) Political dynasty in the perspective of democracy and citizens' rights in elections in Indonesia. This research used a normative juridical approach by using secondary data in the form of literature studies so that the conclusions are obtained that: a) political dynasty is contrary to democratic principles that emphasize transparency, accountability, and fair participation; b) although the regulations have been set up to protect citizens' rights to elect and be elected, the rise of political dynasty shows incompatibility with democratic principles. It is difficult to avoid political dynasty in a democracy, but efforts are needed to maintain balance and avoid abuse of power by the ruling family.

Abstract

The dominance of foreign digital platforms in the application ecosystem within Indonesia poses significant implications for the sovereignty of the Indonesian state; the utilization of such foreign digital technologies results in the inadvertent surrender and delegation of citizen data to foreign entities for monitoring and processing purposes. This phenomenon has elicited concern among legal scholars, as the usage of foreign applications signifies the applicability of the legal frameworks from the countries of origin of these applications. This raises critical questions regarding the sovereignty of the Indonesian state, particularly concerning its ability to exert control over data and cyberspace in the context of global platforms. The methodological approach employed in this investigation is grounded in normative legal research, utilizing a conceptual framework that examines relevant legal statutes. The aggregation and distribution of personal data constitutes an infringement upon individual privacy rights, as the right to privacy inherently encompasses the prerogative to determine the provision of personal information. The strategic policies and initiatives undertaken by the Indonesian government to bolster national digital sovereignty can be realized through several measures: the implementation of comprehensive personal data protection standards to enhance national digital sovereignty, the establishment of an independent authority for personal data protection, the fortification of cybersecurity measures to mitigate data security risks, and the jurisdictional enforcement of cyberspace law towards achieving digital economic sovereignty. There exists a pressing need for extensive regulatory frameworks to safeguard personal data as an integral component of human rights. A balance must be struck in the management of personal data processing, ensuring the protection of rights and fostering awareness among data subjects, thereby facilitating the development of a secure digital economic ecosystem that offers legal certainty for enterprises and enhances consumer confidence. Furthermore, the establishment of equitable international personal data protection regulations is essential to support the advancement of the digital economy through arrangements governing cross-border data flow.

Abstract

Taxation, as a fundamental component of the system of cooperation, serves as a financial resource to underpin governmental financing and expenditure while also acting as an instrument for the regulation of social and economic policies aimed at promoting equitable welfare. The process of tax collection occasionally engenders inequities for taxpayers; consequently, Law 14 of 2002 instituted the Tax Court as an autonomous judicial entity designated for the adjudication of tax-related disputes. Notwithstanding its establishment, the Tax Court encounters significant challenges, notably the dualism of authority wherein the Supreme Court provides technical guidance. At the same time, the Ministry of Finance oversees organizational, administrative, and financial directives. In the Constitutional Court's Decision (MK) Number 26/PUU-XXI/2023, the regulation pertaining to the oversight of the Tax Court was deemed inconsistent with Article 24, paragraphs (1) and (2) of the 1945 Constitution, prompting the Constitutional Court to impose a deadline of December 31, 2026, for the consolidation of the Tax Court's guidance authority under the auspices of the Supreme Court. Consequently, this research endeavours to scrutinize the role and prospective trajectory of the Tax Court alongside the measures necessary to effectuate the transfer of guidance authority in alignment with constitutional mandates. Hence, the author has entitled this study "Measuring the Role and Future of the Tax Court after the Constitutional Court Decision Number 26/PUU-XXI/2023." The questions posed for investigation are: What is the Role and Position of the Tax Court as delineated by the Tax Court Law, and what is the Role and Future of the Tax Court subsequent to the Constitutional Court Decision (Number 26/PUU-XXI/2023)? To address these inquiries, the author employs a qualitative writing methodology complemented by a normative legal perspective.

Abstract

Corruption in Indonesia remains a persistent problem, undermining the government system, economy, and threatening social stability. This study aims to analyze the authority of prosecutors in conducting investigations into corruption crimes based on Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia. The research questions in this study include: 1) How is the authority of the prosecutor's office regulated in investigating corruption crimes under Law Number 16 of 2004; 2) What is the mechanism for investigations conducted by prosecutors; and 3) What obstacles are faced by prosecutors in conducting investigations based on this law. This research uses normative and empirical legal methods. To address these issues, an empirical juridical type of research is employed, utilizing semi-structured interviews and the statute approach. The results show that Law Number 16 of 2004 provides a strong legal foundation for prosecutors to investigate corruption crimes. The authority is further regulated under Law Number 31 of 1999 on the Eradication of Corruption Crimes, as amended by Law Number 20 of 2001. This represents a significant challenge for the prosecutor's office and other law enforcement agencies to address. The role of prosecutors is specified in Article 1 point 1 of Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia, and their duties and functions as investigators of corruption crimes are aligned with the provisions of Article 284 paragraph (2) of the Criminal Procedure Code (KUHAP) and Article 17 of Government Regulation Number 27 of 1983. The existence of various regulations granting investigative authority to other institutions also poses obstacles, leading to overlapping jurisdictions and differing perceptions in carrying out the investigative process. These issues form significant challenges to the authority of prosecutors as investigators of corruption crimes.

Abstract

Abuse of authority which is a right owned by Government Agencies and/or Officials and other state administrators to take decisions and/or actions in administering government. In this case also Abuse of authority is the use of authority by Government Agencies and/or Officials in taking decisions and/or actions in government administration carried out by exceeding authority, mixing up authority, and/or acting arbitrarily as intended in Article 17 and Article 18 of Law Number 30 of 2014 concerning Government Administration. And states the aspect of authority where the problem lies in whether the official who issued the letter has the authority or does not have the authority to issue the letter based on existing regulations. And when issuing decisions, officials should have authority and if they do not have authority, they are prohibited from issuing decisions. Therefore, this statement is also in accordance with the provisions of Article 1 point 22 of Law No.30.

Abstract

Penelitian ini membahas mengenai Asuransi Dalam pasal 1774 KUHPdt dikatakan bahwa asuransi merupakan perjanjian untung-untungan, disamakan dengan perjudian. Sementara bangsa Indonesia yang mayoritas islam, didalam hukum islam atau syariah judi adalah perbuatan yang diharamkan. Terbukti didalam praktek, tertanggung dalam perjanjian asuransi berkewajiban membayar premi dan tertanggung berkewajiban membayar sejumlah uang pertanggungan atau ganti kerugian kepada tertanggung jika terjadi evenement (peristiwa tidak tentu) sebagaimana yang diatur dalam pasal 246 KUHD tersebut. Tertanggung sudah membayar premi tiap bulan sampai habis masa perjanjian asuransi sesuai yang diperjanjikan, namun evenement tidak terjadi, premi yang sudah dibayarkan tidak dikembalikan kepada tertanggung, penanggung mengambil uang premi tersebut tanpa ada pembayaran ganti rugi lagi pada tertanggung dengan alasan evenement tidak terjadi. Hasil penelitian ini diharapkan dapat memberikan sumbangan pemikiran tentang perlindungan hukum terhadap tertanggung atas premi yang sudah dibayarkan. proposal penelitian ini dipergunakan 2 (dua) pendekatan penyelesaian masalah, yakni pendekatan undang-undang (statutory approach) dan pendekatan konseptual (conceptual approach), Pendekatan berdasarkan perundang-undangan (statute approach) tersebut bertujuan untuk menganalisis bentuk maupun substansi peraturan perundang-undangan yang berkaitan dengan asuransi. Selain itu penelitian ini juga memberikan sumbangan tentang konsep asuransi berbasis syariah dalam hukm positif nasional. Disamping itu urgensi penting lainnya adalah : Bagi Pemerintah, diharapkan dapat memberikan pedoman untuk menyusun kebijakan-kebijakan tentang perasuransian dalam rangka memberikan perlindungan hukum terhadap masyarakat selaku tertanggung dalam perjanjian asuransi, sehingga melahirkan konsep nasskah akademik dalam penyusunan rancangan undang-undang asuransi yang sampai saat ini masih mengacu pada KUHD (WvK) yang merupakan produk pemerintah kolonial belanda. Akademisi, memberikan sumbangan pemikiran dan wawasan tentang arti penting perlindungan hukum tertahadap tertanggung atau masyarakat dalam perjanjian asuransi dan konsep asuransi berbasis syariah dalam hukum positif nasional. Bagi Masyarakat, khususnya tertanggung dalam perjanjian asuransi supaya mereka terlindunggi secara hukum islam atau konsep syariah dan dalam rangka mendapatkan kepastian hukum ketika konsep syariah tersebut sudah diatur secara tertulis dalam hukum positif. Kata Kunci : Legal Protection, Investment, Sharia Insurance Abstract: This study discusses the Insurance in article 1774 of the Criminal Code said that insurance is a chancy agreement, equated with gambling. While the Indonesian majority Muslim nation, in Islamic law or sharia gambling, is an act that is forbidden. Proved in practice, the insured in the insurance agreement is obliged to pay premiums and the insured is obliged to pay a sum of sum assured or compensation to the insured if there is an event (an uncertain event) as stipulated in article 246 of the KUHD. The insured has paid the premium every month until the insurance agreement expires as agreed, but the event does not occur, the premium that has been paid is not returned to the insured, the insurer takes the premium without paying compensation to the insured on the grounds that the event does not occur. The results of this study are expected to contribute ideas about legal protection to the insured for premiums that have been paid. This research proposal was used 2 (two) problem solving approaches, namely the statutory approach and the conceptual approach, the statute approach aimed at analyzing the form and substance of legislation related to insurance. In addition, this study also contributed to the concept of sharia-based insurance in national positive law. Besides that, another important urgency is: For the Government, it is expected to provide guidelines for developing insurance policies in order to provide legal protection for the community as insured in the insurance agreement, giving birth to the concept of academic concepts in the drafting of insurance laws to date. still referring to the KUHD (WvK) which is a product of the Dutch colonial government. Academics, contribute ideas and insights about the importance of legal protection against the insured or the community in insurance agreements and sharia-based insurance concepts in national positive law. For the community, especially the insured in the insurance agreement so that they are protected by Islamic law or the concept of sharia and in order to obtain legal certainty when the concept of sharia is regulated in writing in positive law. Abstract

This community service activity was conducted in several senior high schools in Padang with the aim of increasing students’ awareness and understanding of ethical and responsible social media use to prevent cybercrimes such as hoaxes, hate speech, cyberbullying, defamation, and identity theft. The topic was selected due to the growing number of digital violations involving teenagers and the urgent need for digital literacy education. The method used consisted of interactive socialization sessions supported by pre-test and post-test evaluations, discussions, and educational materials related to digital ethics and the Electronic Information and Transactions Law (UU ITE). The results showed a significant improvement in students’ understanding and awareness after the activity. This indicates that educational and participatory approaches are effective in shaping wiser online behavior among students and can serve as a preventive effort against legal problems in the digital environment.

Abstract

This study aims to examine the position of the Corruption Eradication Commission (KPK) after the amendment of Law No. 30 of 2002 through Law No. 19 of 2019. The approach used is juridical-empirical using literature studies. Data were collected by compiling journals on the Corruption Eradication Commission (KPK) and related literature. The results of the study indicate that the Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission through Law Number 19 of 2019 is one of the most controversial legislative changes in the history of legal reform in Indonesia. This change has fundamental implications for the position, institutional character, and level of independence of the Corruption Eradication Commission (KPK) as a state institution specifically established to eradicate corruption. This article aims to comprehensively examine the position of the KPK after the enactment of Law Number 19 of 2019 from the perspective of constitutional law and the principles of the rule of law. The research method used is normative legal research with a statutory, conceptual, and historical approach. The results of the study indicate that the change in the position of the KPK as a state institution within the executive branch of power, the establishment of the Supervisory Board, and the change in the status of KPK employees to State Civil Apparatus (ASN) have shifted the paradigm of KPK independence. Although the changes are claimed to be aimed at strengthening accountability and oversight, in practice they have the potential to weaken the effectiveness of the Corruption Eradication Commission (KPK) as an independent institution in eradicating corruption.
