Abstract

Parole is one form of integration rights for inmates that allows them to serve the remainder of their prison sentence outside the correctional facility under certain conditions. Narcotics inmates applying for parole have increased in the last 3 (three) years at Class IIA Correctional Facility Padang, even though narcotics crimes are categorized as extraordinary crimes that should receive special attention in both sentencing and correctional processes. This raises concerns that it may weaken efforts to combat narcotics. Integration rights such as parole should be granted with great caution and selectivity. However, this policy tends to become routine without considering its impact on the legal system as a whole. This situation raises concerns about the loose implementation of the parole policy which may blur the essence of the rehabilitation process and weaken the national strategy in combating narcotics. In accordance with Government Regulation Number 99 of 2012 concerning the Requirements and Procedures for the Implementation of the Rights of Correctional Inmates, narcotics inmates can only be granted parole if they meet special requirements, including a willingness to cooperate in uncovering narcotics crime networks. This paper examines two problem formulations, namely: 1) how is the mechanism for parole for narcotics abuse inmates at Class IIA Correctional Facility Padang, 2) can all narcotics inmates be granted parole. To answer these issues, this study uses an empirical juridical approach resulting in the following conclusions: 1) referring to the provisions of the prevailing laws and regulations, namely Law Number 22 of 2022 concerning Corrections and Regulation of the Minister of Law and Human Rights Number 43 of 2021 concerning the Requirements and Procedures for the Granting of Remission, Assimilation, Family Visit Leave, and Parole. The procedure begins with the submission by the concerned inmate, followed by verification and assessment by the correctional officers and the Correctional Observer Team (TPP); 2) all narcotics inmates can be granted parole, namely those who are genuinely active and well-behaved during the rehabilitation process, while those who violate the rules, receive sanctions, and have their parole postponed for 9 (nine) months.

Abstract

Indonesia is one of the countries that adheres to a state system based on law, both in the exercise of government power and based on law. Civil Servant Investigators (PPNS) are certain officials or one of the state apparatus or state institutions who are given special authority by law to carry out investigations into criminal acts where in carrying out their duties and responsibilities they are under the Coordination and Supervision of Police Investigators (Korwas PPNS). The position of the Immigration PPNS is very important because matters relating to immigration are closely related to the sovereignty of the Indonesian state. Immigration PPNS investigators not only have to comply with Law No. 6 of 2011 concerning Immigration but also have to comply with the rules contained in Law no. 8 of 1981 concerning criminal procedural law and must also obey and obey other legal regulations in Indonesia. The discussions in this research are 1) the regulations and principles of criminal law enforcement implemented by Immigration PPNS related to supervision theory; and 2) the position of PPNS Immigration in enforcing criminal law against illegal immigrants. This research uses normative juridical with a case approach using secondary data in the form of related laws, books, journals, legal dictionaries and other related documents so that it can be concluded that the regulations and principles of Immigration PPNS are related to the theory of supervision. This has a huge responsibility and is very important for Indonesia's sovereignty because this can threaten the justice of Indonesian society and has the potential to cause social jealousy if illegal immigrants who enter Indonesian territory are not prosecuted and are not dealt with firmly. A real example in the field is the commotion that occurred in the community due to Rohingya refugees who were not dealt with firmly and seemed to be left to their own devices.

Abstract

Indonesia, which is in the era of globalization, is characterized by the era of Information and Communication Technology (ICT) which introduces the virtual world (cyberspace, virtual world) via the internet network, communication with paperless electronic media. Indonesian society has entered the virtual world which is abstract, universal, independent of the conditions of place and time through the media, and in today's developments, Notaries have also experienced technological advances as developments in society in carrying out their duties and functions as public officials, one of which is Electronic signature in Cyber Notary. In the provisions of Article 15 paragraph (3) of Law Number 2 of 2014, it is stated that other authorities regulated in statutory regulations include: authority to certify transactions carried out electronically (cyber notary), make deeds of waqf pledges and airplane mortgages, However, this provision is in conflict with Article 16 paragraph (1) letter m of Law Number 2 of 2014 which states that a Notary is obliged to read the deed in front of an audience in the presence of 2 (two) witnesses. Meanwhile, the cyber notary's position here is not directly in front of the Notary but through electronic means such as teleconference or video call, as well as Article 5 paragraph (4) in Law Number 11 of 2008, namely the provisions regarding electronic information and/or electronic documents which states that letters and documents which according to the law must be made in the form of a notarial deed or deeds made by deed-making officials must be made in written form, thereby giving rise to legal issues. The problem formulation includes 1). How to review the law regarding electronic signatures in notarial deeds based on Law Number 11 of 2008 concerning Electronic Information and Transactions and Law Number 2 of 2014 regarding amendments to Law Number 30 of 2004 concerning the Position of Notaries ; 2). What are the legal consequences of applying digital signatures in notarial deeds? To answer this question, a normative juridical approach is used, namely an approach through literature study by examining legislation related to the problem formulation. And based on the results of this research, it is concluded that certification of transactions using a cyber notary remains valid in accordance with Article 15 paragraph (3) of Law Number 2 of 2014 which gives notaries the authority to certify transactions using a cyber notary while still paying attention to the following elements. elements of an authentic deed in Law Number 2 of 2014 and Article 1868 of the Civil Code which are the authenticity of the deed, the authority to make the deed as well as reading and signing using a cyber notary in the notary's work area and the deed remains valid as long as the form of the deed complies with the provisions of Article 38 Law Number 2 of 2014 and article 1868 of the Civil Code and the Utilization of Internet Protocol addresses (IP addresses) serve as references for datagrams so that they can arrive and be received on the intended device in order to avoid abuse of authority outside the Notary's area of office.

Abstract

The existence of prostitutes is undeniably growing in Padang city. There are many factors that lead a person to become a prostitute. Starting from economic demands, low levels of education, parental support, peer influence, domestic failure, and so on. Prostitution or prostitution is not considered a legitimate or legal occupation, but there are also those who continue to do it. The development of the times can change all forms of human activity, one of which is the existence of prostitutes in the city of Padang, no longer done by hanging out but with an online system using one of the applications, namely the michat application. The michat application is one of the instant messaging applications used on various cellphones. This application was originally created to help users communicate with friends and family. However, many people, especially in Indonesia, one of which is in the city of Padang, misuse this michat application as a means of online prostitution. Some of the cases that have been listed, online prostitution also occurs in the city of Padang which upholds religious values, namely adat basandi syarak, syarak basandi kitabullah. So it is necessary to conduct an in-depth study of the criminal act of online prostitution related to Commercial Sex Workers (PSK). Based on this description, the problems that the authors discuss in this thesis are (1) How is the law enforcement of online prostitution crimes against prostitutes in the Padang Police jurisdiction (2) What are the obstacles and challenges faced by the police in handling prostitution cases involving prostitutes. The method used in this research is qualitative with an empirical juridical approach. The conclusion that the author can get from the research is that law enforcement carried out by the Padang Police regarding online prostitution crimes against prostitutes is preventive and repressive. The obstacles and challenges of the police in handling cases involving prostitutes are network constraints, limited resources, changes in perpetrator tactics, the existence of perpetrators who are difficult to track, the development of digital platforms, lack of concrete evidence, and low reports.

Abstract

Globalization has led to an increase in interaction between countries, which in turn has led to an increase in the flow of people leaving and entering a country. According to Minister of Law and Human Rights Regulation No. 44 of 2015, increased international mobility requires stricter supervision of foreigners entering Indonesian territory. Immigration has an important role in regulating and supervising foreigners entering a country in accordance with Law Number 6 Year 2011 on Immigration. Article 2 of the law states that the supervision of foreigners aims to protect national interests. The limitations of the problems in this paper are 1) Policies implemented by Indonesia against foreigners entering the Indonesian Territory; 2) The system of supervision of foreigners that has been implemented by the Indonesian government; and 3) Application of Immigration Administrative Measures against foreigners in the Indonesian Territory. The method used is normative law by analyzing primary legal materials such as Law No. 6 of 2011, as well as secondary legal materials so that conclusions are obtained; 1) The entry of foreigners into Indonesia must be in accordance with selective policies, which include entry, stay, and exit from the territory of Indonesia 2) Immigration conducts surveillance to reduce the possibility of misuse of applicable laws and regulations and take action against foreigners who violate the rules in order to maintain the immigration function. 3) Immigration acts as a law enforcer, and guardian of the development of supervision to reduce the possibility of abuse of applicable laws and regulations and take action against foreigners who violate the rules in order to maintain the immigration function.

Abstract

Drug abuse cases involving public figures, including artists and officials, have become a media spotlight, highlighting that the drug problem transcends social and economic boundaries. When individuals who are supposed to be role models for society are involved in drug abuse, it underscores the urgency for more effective prevention and law enforcement measures. Combating drug trafficking is a top priority in maintaining public safety and order. A notable case is that of Teddy Minahasa, which highlights the crucial role of the police in tackling drug networks. This paper examines: 1) Legal Regulations Regarding Law Enforcement by the Police Against Police Officers Who Break the Law; 2) Law Enforcement Against Police Officers Involved in Drug Trafficking (Case Study of Teddy Minahasa's Methamphetamine Distribution). To address these issues, a normative juridical research method is used, yielding the following results: 1) Legal Regulations Regarding Law Enforcement by the Police Against Police Officers Who Break the Law, namely Articles 34-35 of Law Number 2 of 2002 concerning the Police and Articles 5, 6, and 9 of Government Regulation Number 2 of 2003 concerning the Discipline of Police Members, as well as the Criminal Code (KUHP). Oversight mechanisms are carried out both internally by the Inspectorate of General Supervision (Itwasum) and the Division of Profession and Security (Divpropam), and externally by the National Police Commission (Kompolnas), which plays an important role in enforcing discipline and ethics. Police officers involved in criminal acts are processed through general courts without any special legal immunity. Despite challenges such as strong corps culture and corruption practices, reforms continue to improve the system and increase transparency and accountability in law enforcement; 2) Law Enforcement Against Police Officers Involved in Drug Trafficking (Case Study of Teddy Minahasa's Methamphetamine Distribution), demonstrating the vital role of the police in combating destructive drug networks. Such cases not only threaten social security but also undermine the integrity of the police institution. The police must play an important role in identifying, investigating, and dismantling drug syndicates by utilizing technology and inter-agency cooperation. With public support and joint commitment, law enforcement against drug cases can become more effective, ensuring public safety and upholding the rule of law in Indonesia.

Abstract

Waste is a big problem that needs more attention. According to the Ministry of Environment and Forestry, the total amount of waste in Indonesia is 187.2 million tons per year. Padang City as the capital of West Sumatra province also produces large amounts of waste. The accumulation of waste in Padang City in 2021 is around 233,385.96 tons per year. Padang City produces a total of 643.76 tons of waste per day in 2022. Most of this waste, around 62.80% is food waste. Apart from that, waste components such as glass (2.40%), plastic (12.40%), leaves/wood (6.84%), metal (0.19%), paper (5.70%), rubber (1 .50%), textiles (3.30%), and other waste (4.87%) related regulations regarding waste management in Padang City, namely PERDA Number 21 of 2012. However, in reality the waste problem never ends, in fact waste production continues to increase. The problem formulation is: 1) legal regulations related to waste management in Padang City; and 2) legal policies regarding waste management in Padang City. To answer this problem, a normative juridical type of research is used. So it can be concluded that 1) legal regulations related to waste management in Padang City, namely Padang City Regional Regulation Number 21 of 2012 which regulates waste management, West Sumatra Province Regional Regulation Number 8 of 2018 regulates Regional Waste Management, Republic of Indonesia Government Regulation Number 27 of 2020 concerning Specific Waste Management 2) the direction of legal policy regarding waste management in Padang City is by improving waste transportation services such as making transportation more efficient from residential areas to waste disposal sites because one of the problems related is the efficiency of waste logistics. This is believed to be due to the TPS function not being optimal at one location in the area, so it also has an impact on the current traffic system.

Abstract

Kota Padang menghadapi tantangan dalam pengelolaan sampah yang semakin menumpuk setiap harinya.  Bank Sampah hadir sebagai solusi inovatif, mendorong partisipasi masyarakat melalui pemilahan, pengumpulan, dan penimbangan sampah bernilai ekonomis. Berbagai regulasi mendukung Bank Sampah, seperti UU No. 18/2008, Permen LHK No. 14/2021, dan Perwal Kota Padang No. 24/2014. Mekanisme Bank Sampah meliputi pemilahan, pengumpulan, penimbangan, penyimpanan/pengolahan, dan edukasi. Manfaatnya antara lain meningkatkan kesadaran masyarakat, mendorong partisipasi, mengurangi sampah di TPA, meningkatkan nilai ekonomi sampah, menciptakan lapangan kerja, memperbaiki kualitas lingkungan hidup, dan meningkatkan kesehatan masyarakat. Penerapan regulasi dan komitmen semua pihak menjadi kunci keberhasilan. Bank Sampah diharapkan menjadi model pengelolaan sampah yang efektif dan berkelanjutan, menuju lingkungan yang lebih bersih, sehat, dan ramah lingkungan. Rumusan Masalah yaitu :1) Bagaimanakah regulasi terkait pengelolaan sampah melalui bank sampah di Kota Padang; dan 2) Apa manfaat sosial pengelolaan sampah di Kota Padang yang dilakukan melalui bank sampah. Untuk menjawab permasalahan tersebut digunakan jenis penelitian Yuridis Normative. Sehingga dapat disimpulkan bahwa  regulasi terkait pengelolaan sampah di Kota Padang diatur dalam Peraturan Daerah Kota Padang Nomor 21 Tahun 2012 tentang Pengelolaan Sampah untuk meningkatkan kesadaran masyarakat akan pentingnya pengelolaan sampah demi terwujudnya Kota Padang yang bersih dan sehat. pengelolaan sampah  dengan bank sampah di Kota Padang sudah ada diatur dalam Perwako Nomor 24 Tahun 2014 Tentang Gerakan Padang Bersih-Padang Sehat. Manfaat sosial pengelolaan sampah melalui bank sampah di Kota Padang Adanya program bank sampah memungkinkan sampah dapat dikelola secara efektif dan efisien.

Abstract

Global warming and climate change are the biggest challenges of this century that affect human survival throughout the world. Scientific facts show that human activities, especially the burning of fossil fuels, have significantly increased the concentration of greenhouse gases in the atmosphere, causing an increase in global temperatures and extreme weather changes. The impacts of climate change are not only limited to the physical environment, such as melting ice, rising sea levels and extreme weather events, but also include social, economic, health and food security aspects. At the legislative level, many countries have adopted international regulations and agreements, such as the Paris Agreement of 2015, that limit global temperature rise to below 2 degrees Celsius. However, implementation and efforts to achieve this goal are still hotly debated among participating countries. At the societal level, climate change is causing changes in human migration patterns, increasing conflicts over natural resources and threats to global food security. These changes also impact human health through increased risks of vector-borne diseases related to climate change and the psychological impact of more frequent natural disasters. This research problem formulation includes a detailed analysis of how global warming will affect human survival from various social and economic points of view. The focus of this issue is the direct and indirect impacts of global warming on humanity, with an emphasis on empirical research and analysis of current data. The research method used is normative juridical, research that focuses on applicable legal norms or rules, and the data used is secondary. The results of the analysis show that international legal regulations related to global warming and climate change have become the main focus in efforts to mitigate negative impacts on human survival. Global warming, caused by increased emissions of greenhouse gases such as CO2, CH4, N2O, and CFCs, threatens the existence of small islands and coastal areas in Indonesia and causes sea levels to rise. Indonesia, through active participation in the Conference of the Parties (COP), has demonstrated its commitment to global efforts in addressing climate change, although challenges such as inconsistent implementation of the Kyoto Protocol and the inability to force developed countries to take responsibility for their emissions, remain has become a big problem. Efforts to mitigate and adapt to climate change at the national level, including through the National and Regional Action Plan on Greenhouse Gas Emissions (RAN/RAD GRK) as well as the Village Fund program, show proactive steps but are still faced with the challenge of coordination between institutions and resource limitations. The role of local communities and NGOs is very important in supporting the success of this policy. Overall, to achieve the goals of effective emission reduction and adaptation, synergy is needed between a stronger international legal framework, comprehensive national policies, and active participation from society and non-governmental organizations. Only with this holistic and collaborative approach can we ensure the survival of humans and the environment in the future faced with the increasingly complex challenges of climate change.

Abstract

In Padang City, there are many traffic violations committed by children under the age of 17 who use motorized vehicles. From the data in 2022, 3098 cases of traffic violations occurred due to children, even though it is regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation which says that to drive a motorcycle you must have a driver's license and be 17 years old. Based on this, this research aims to find out: a) What are the factors that cause traffic violations by children: b) How is the role of the Padang City Police in preventing traffic violations against minors: c) What are the obstacles faced by the Padang Police in preventing traffic violations by minors. This research was conducted in the Padang City area. To answer the above questions, the research method used is a qualitative method with a Juridical Sosilogis approach (socio legal research), namely an approach to the problem by looking at legal norms and occurring in the field found, using primary data as the main data, namely by conducting interviews and secondary data in the form of literature studies and conclusions obtained, namely: a) The factors that cause children to commit violations are in the form of social factors, educational factors and family or parental factors, because their souls are still unstable and carelessness in driving, lack of knowledge about traffic signs: b) The role of the traffic police here is to prevent in two ways, namely preventive and repressive, namely by conducting counseling to schools to introduce traffic ethics early on and by reprimanding children or adolescents who violate. Legal regulation of traffic violations against motorists who commit violations, the traffic police will take action or impose sanctions on violators in accordance with the Articles violated in Law Number 22 of 2009: c) The obstacles faced by the police in this study are in the form of internal and external factors, internal factors originating from within the police themselves and external factors originating from outside, namely from the community itself.
