Abstract

Factors that cause Indonesia to be selected as a transit country for refugees and asylum seekers, among them are first, Indonesia has a vast marine territory of long coastline, but is not supported by strict rule of law. Secondly, Indonesia's position is very weak in addressing the problem  of asylum seekers and refugees from other countries because it has no national regulations that specifically address the issue. Third, the lack of facilities and infrastructure in handling refugees and asylum seekers. Fourth, the presence of  UNHCR  in  Jakarta  became  a  refugee  attraction.  Fifth,  the  culture  or culture of Indonesia, known for its hospitality, gives the impression that Indonesians can easily accept the arrival and whereabouts of refugees. The setting up of asylum seekers and refugees should be  placed in immigration legislation because the issue of asylum seekers and refugees is a foreigner's (immigration status) problem, which touches on international aspects. The handling of refugees, immigrants and asylum seekers faces several obstacles in the process of handling them: First, Internal Constraints; A) the absence of standard standards in legislation regarding the handling of illegal immigrants. b) The legal vacuum that comprehensively regulates asylum seekers and refugees in Indonesian positive law, weakens coordination among agencies in the field. c) Lack of immigration quarantine facilities to accommodate asylum seekers and refugees, d) Limited regular funds. Second, External Constraints. a) Local Government objected to the additional burden of the arrival of troubled foreigners. b) The often sharp distinction between regional culture and the culture of displaced potential foreigners brings about social conflict. c) Arise of social jealousy of the refugees received free humanitarian assistance in the form of shelter and living expenses, while local residents live in a state of deprivation. Residents do not realize that the aid is not from the government, but from UNHCR and or IOM. D) Often the assimilation between asylum-seeker men and refugees with local women, precisely leaves the child's burden. -the children who turn up when repatriation or resettlement are not brought along.

Abstract

This journal focuses on the problem of finding the relationship between the role of the Headman of Village and the Village Consultative Body (BPD) in drafting Village Regulations (Perdes). The journal research method used is the normative method. The results of the study carried out are the relationship between the authority of the Village Head and the Village Consultative Body (BPD). . As for the process of drafting and forming Aursati Village regulations in the preparation of village regulations carried out by the Village Consultative Body (BPD) with the Aursati Village Head, the drafting process uses the correct mechanism and all stages are passed well

Abstract

Hampir setiap tahun kebakaran lahan dan hutan terjadi di beberapa wilayah Indonesia. Selama penegakan hukum kebakaran hutan masih menggunakan pendekatan postivistik, maka keadilan yang didambakan akan semakin absurt dirasakan oleh masyarakat. Pendekatan paradigma profetik menurut penulis dapat memecahkan kebuntuan itu. Paradigma profetik dalam penegakan hukum dimulai dengan pembinaan penegak hukum melalui kecerdasan spiritual yang ditawarkan oleh Danah Zohar dan Ian Marshall. Pendekatan yang mereka gunakan adalah dengan mengenalkan berpikir spiritual (spiritual tinking). Melalui kecerdasan spiritual (spiritual quition), akan diperoleh kecerdasan yang paling sempurna (ultime intelegent) sehingga dapat menerabas garis-garis formalisme (existing rule) menuju trasedental yang mendekati kebenaran yang hakiki (the ultimate truth). Pembinaan hakim dengan pendekatan SQ sesuai dengan amanat tugas seorang hakim yang menjatuhkan keputusan berdasarkan “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”. Tugas yang dijalankan seorang hakim adalah tugas spiritual dengan mengatasnamakan Tuhan dan Keadilan

Abstract

Undang-undang Partai Politik mengamanatkan perlunya pendidikan politik dengan memperhatikan keadilan dan kesetaraan gender dalam partai politik yang ditujukan untuk meningkatkan kesadaran akan hak dan kewajiban, meningkatkan kemandirian dan kedewasaan dalam kehidupan berbangsa dan bernegara. Kenyataanya partai-partai politik belum dikelola secara demokratis dan belum terinstitusionalisasi sehingga menjadi beban bagi sistem demokrasi dan tata kelola pemerintahan yang baik. Oleh sebab itu perlu dihidupkan lagi peran organisasi sayap partai. Dengan dilakukannya penataan pengaturan organisasi sayap partai sebagai upaya penguatan kaderisasi dan fungsi rekrutmen serta pelembagaan partai politik yang muaranya menjadikan demokrasi di negara ini berjalan sebagaimana mestinya.

Abstract

The application of the principles and doctrine of meaningful participation is currently considered not to meet the needs of society. This is indicated by the dissatisfaction of several parties who are trying to submit a Judicial Review through a judicial review. The purpose of this article is to find out the application of the principles and concepts of Legislative Formation and meaningful participation in the Formation of Legislation. This research uses a normative juridical research type, with three approaches used, a statutory approach, a conceptual approach and a case approach. The results of this research show that the formation of good laws and regulations must fulfill concepts that are in accordance with the concept of the Pancasila rule of law. The principle of openness is the basis for ensuring legal protection for all levels of society, as well as the community having the opportunity to contribute to the formation of legal regulations. In essence, community participation (meaningful participation) can be understood as input or suggestions for the formation of laws.

Abstract

Party Wing Organizations play a strategic role in supporting political parties to strengthen their reach to various levels of society, especially in the process of gathering support, advocacy and interest mediation. However, the legal arrangements that bind these organizations are still being debated, especially in terms of whether they should be subject to the same regulations as general social organizations or obtain special status under the legal umbrella of political parties. This research uses normative juridical methods, with statutory, historical and conceptual approaches. Arrangements regarding Party Wing Organizations still have challenges that require further attention. One of the ideal concepts proposed is that the position and role of party wing organizations should be explained in more detail in the revision of the Political Party Law. This is important to provide clarity regarding the rights and obligations of wing organizations as well as their operational boundaries so that they do not overlap with the role of their parent political parties and play an active role in mainstreaming gender equality and social inclusion in politics. Party wing organizations are legal entities, so as legal subjects they can be sued in the criminal, civil and administrative realms. This recognition is important to clarify the legal status of party wing organizations and prevent a legal vacuum if a dispute or legal violation occurs involving the organization.
