Abstract

This research aims to analyze forms of personal data protection on social media and the implementation of personal data protection on social media. The problem raised was related to the increasing number of cases of personal data leakage on social media. The research method used is this research is a type of field research and the author uses a legal approach and a syar'i normative approach. The data sources used in this research are primary data and secondary data. The data collection methods used by researchers to conduct this research are observation, interviews and documentation. The results of this research are forms of personal data protection on social media in the form of personal data processors, personal data controllers, and personal data subjects who are not only people but also companies/legal entities. Implementing personal data protection, the Ministry of Communications and Information Technology (Kominfo) has a system called the Indonesia Data Protection System (IDPS). IDPS is a system that is able to minimize cyber crime, especially the misuse of personal data and information. The implementation of this system works directly with the social media application manager in this case (META).

Abstract

The results of the study revealed that the degree of election of marriage dispensation in the jurisdiction of the Religious High Court of Palu was motivated by several factors, namely the pregnancy occurrence, parents' concerns, economic, matchmaking, and culture when  was about to get married and still under-age so it had to firstly apply for dispensation of marriage to the religious court in accordance with Act No. 1 of 1974, Article 7 Paragraph (1) and (2) Concerning Marriage jo Compilation of Islamic Law Article 15 Paragraphs (1) and (2). The application of marriage dispensation was submitted to the court, then will be on trial and judge’s consideration in granting marriage dispensation which was not bound by the single positive law yet it was a consideration of justice, legal sociology and benefits that emphasized the implementation of maslahah principle as well.

Abstract

Artikel ini membahas tentang “Hibah sebagai Alternatif Pembagian Harta pada Masyarakat Suku Pattae (Telaah atas Hukum Islam).” Jenis penelitian ini merupakan penelitian lapangan (field reseach) dengan jenis penelitian kualitatif deskriptif. Yaitu suatu jenis penelitian yang dimaksudkan untuk mengelola data yang terkumpul melalui wawancara terstruktur. Pendekatan analisis yang digunakan adalah descriptif analisis (analisis deskriptif). Sementara pendekatan penelitiannya adalah teologis normatif, yaitu suatu pendekatan yang mencoba memaparkan pemahaman dari sudut pandang hukum Islam untuk menjelaskan persoalan hibah orang tua sebagai alternatif pembagian harta. Hasil penelitian menunjukkan bahwa konsep hibah yang berlaku pada masyarakat suku Pattae dilakukan dengan cara berimbang, yaitu membagi rata tanah milik orang tua kepada seluruh anak yang ada melalui musyawara antara orang tua dan anak, baik ia anak laki-laki maupun anak perempuan. Namun perlu dicatat, bahwa harta milik orang tua yang telah diberikan kepada anak sewaktu-waktu bisa ditarik kembali oleh orang tua apabila terjadi sesuatu yang tidak diinginkan. Implikasi Penelitian; Keseimbangan antara hak dan kewajiban akan selalu hadir dari setiap keputusan yang bijaksana dan arif, tidak terkecuali dalam masalah pembagian harta. Al-Qur’an sebelum diturunkan di tanah Arab hak seorang perempuan dalam mendapatkan harta tidak dimungkinkan karena posisi dan derajat yang bangsa Arab anggap tidak ada nilainya. Namun setelah ke-Islam telah datang, maka hak seorang perempuan mulai tumbuh selayaknya hak seorang laki-laki pada umumnya. Islam tidak melihat hak seseorang dari sisi subjeknya tetapi melihat dari sisi kebutuhan dan tanggungjawabnya, maka setiap hak seorang laki-laki atau perempuan dalam mendapatkan harta haruslah berbanding lurus dengan kebutuhan dan tanggungjawab yang ia emban demi suatu keseimbangan dalam kehidupan yang lebih tentram.

Abstract

Tulisan ini menguraikan tentang eksistensi hukum waris adat dalam masyarakat muslim di Kota Gorontalo. Jenis penelitian ini adalah penelitian lapangan bercorak deskriptif kualitatif, dianalisis dengan alur pikir prosedur deduktif yang bersumber dari data primer dan data sekunder dengan menggunakan beberapa pendekatan, yaitu: pendekatan syar’i, yuridis, antropologis, sosiologis, historis, dan filosofis. Hasil penelitian ini menunjukkan bahwa hukum waris adat yang eksis dalam masyarakat muslim di Kota Gorontalo pada awalnya berasal dari nilai-nilai budaya masyarakat setempat. Namun dengan masuknya Islam dan menjadi agama seluruh masyarakat Gorontalo, hukum waris adat tersebut berubah menjadi Islami yang ditandai dengan hidupnya hukum Islam tercermin pada pelaksanaan hukum dalam masyarakat pada saat itu selalu mengacu pada tiga prinsip hukum adat Gorontalo, yaitu: (1) adati hula-hula’a to syara’a (hukum adat bertumpuk pada hukum syarak); (2) adati hula-hula’a to syara’a, syara’a hula-hula’a to adati (hukum adat bertumpuk pada hukum syarak dan hukum syarak bertumpuk pada hukum adat); (3) adati hula-hula’a to syara’a, syara’a hula-hula’a to Kitabi (hukum adat bertumpuk hukum syarak dan hukum syarak bertumpuk pada al-Qur’an dan hadis Nabi saw). Tiga macam prinsip ini merupakan pijakan masyarakat Gorontalo dalam menyelesaikan persoalan hukum, tetapi kemudian hal ini berubah disebabkan kebijakan politik hukum Belanda dengan teori hukumnya (teori resceptie in complexu dan teori receptie), berhasil mengeluarkan hukum adat dari pengaruh hukum Islam yang hingga sekarang masih dirasakan. Inilah sebabnya munculnya praktik pewarisan yang tidak sejalan dengan prinsip hukum Islam dalam masyarakat.

Abstract

This paper elaborates on the Papuan People's Assembly Electing Non-Muslim Leaders in Non-Muslim Majority Areas in the Perspective of Mashid Syari'ah in Jayapura City, Papua Province. The results of this study indicate that the Papuan People's Council (MRP) elects leaders in non-Muslim majority areas in the perspective of maqasid syari'ah in Papua, in its role in the process of organizing the selection of prospective leaders in Papua, has taken away the rights of citizens in general. it is decided by the competent authority of the Papuan People's Assembly (MRP) following what has been decided by formal institutions, such as the General Election Commission (KPU) and traditional institutions that have been given authority according to law. In the provisions of Law No. 21 of 2001 on Papua Special Autonomy, there is no room or space for immigrants. As for the recruitment process for prospective leaders such as Governors and Deputy Governors based on Law No. 21 of 2001 The basic matters that constitute the contents of this Law include the arrangement of authority between the Government and the Provincial Government of Papua and the application of this authority in Papua Province which is carried out with specificity. This law places indigenous Papuans and the population of Papua in general as the main subjects. The existence of the Government, Provincial Government, Regency / City Government, as well as the apparatus under them, are all directed at providing the best service and empowering the people.

Abstract

This research discusses the Supreme Court's policy of increasing the knowledge of Religious Justice judges through the sharia economic judge certification program. This type of research is descriptive qualitative, a type of research to understand the phenomenon of what the research subject experiences in an exceptional natural context. The natural phenomenon referred to is how there is a relationship between PERMA Number 5 of 2016 concerning Sharia Economic Judge Certification and the Supreme Court's policy in increasing the knowledge of Religious Court judges in the field of Sharia economics, the implementation of certification activities, and the results obtained by judges after participating in the certification program, which is then given meaning. This research location focus of the researcher is the office of the Supreme Court of the Republic of Indonesia, which is domiciled in the Special Capital Region (DKI) Jakarta and Bogor Regency, West Java Province. With a methodological approach, namely case studies, normative approaches, human resources (HR), and sharia economic law approaches—data collection techniques with observation, interviews, and documentation. In addition, this research also uses library research through primary and secondary data—the technique of in-depth data analysis by reducing data, presenting data, and drawing conclusions. The results showed that the Religious Court, the Supreme Court, had done so much that it issued several regulations to support this authority. One of the policies produced was the issuance of Supreme Court Regulation (PERMA) Number 5 of 2016 concerning the Certification of Sharia Economic Judges. With the PERMA issuance, many Religious Court judges have been certified in Sharia Economics after participating in the Sharia Economic Judge Certification Training.

Abstract

IntroductionThe rapid expansion of cryptocurrency has generated significant debate within Islamic economic discourse. Bitcoin, as the first decentralized digital currency, offers technological advantages such as transparency, efficiency, and global accessibility. However, it also raises concerns regarding price volatility, speculative trading behavior, and the absence of intrinsic value. These issues have prompted Islamic scholars and regulatory institutions to evaluate cryptocurrency from the perspective of Islamic law and financial ethics. In Indonesia, the Indonesian Ulema Council issued a religious ruling declaring Bitcoin impermissible due to elements of uncertainty, speculation, and potential economic harm. This ruling has stimulated ongoing discussion about the compatibility of cryptocurrency innovation with Islamic economic principles.ObjectivesThis study aims to critically analyze the religious ruling on Bitcoin issued by the Indonesian Ulema Council by examining its legal reasoning, its relationship with Islamic economic principles, and its implications for the governance of digital financial innovation. The research also seeks to explore whether cryptocurrency can be accommodated within an Islamic economic framework under certain regulatory and ethical conditions.MethodThe study employs a qualitative research design using a transdisciplinary analytical approach that integrates perspectives from Islamic jurisprudence, Islamic economics, financial regulation, and digital financial technology. Data were collected through documentation of religious rulings, regulatory policies, and scholarly literature related to cryptocurrency and Islamic finance. The data were analyzed through thematic and comparative analysis to identify the legal reasoning underlying the prohibition of Bitcoin and to evaluate alternative scholarly interpretations regarding the status of digital assets in Islamic economics.ResultsThe findings indicate that the prohibition of Bitcoin is primarily based on concerns about excessive uncertainty, speculative trading behavior, and potential economic harm associated with cryptocurrency markets. Nevertheless, the analysis also reveals that cryptocurrency may be considered permissible when these elements are mitigated through transparent governance, regulatory oversight, and the development of asset-backed digital financial instruments.ImplicationsThe study highlights the importance of developing regulatory and institutional frameworks that reconcile financial innovation with Islamic ethical principles. Such frameworks can provide clearer guidance for Muslim investors while supporting responsible digital financial development.Originality or NoveltyThis research contributes to the growing literature on cryptocurrency in Islamic economics by offering a critical analysis of religious rulings within the broader context of digital financial transformation and regulatory governance.

Abstract

This study examines the effectiveness of legal protection for women victims of domestic violence after divorce and formulates strategies to strengthen substantive justice. Using an empirical juridical approach, the research employed statutory, case, and conceptual analyses. Primary data were collected through interviews with religious court judges, court clerks, advocates, and victims of domestic violence, supported by courtroom observations, while secondary data were derived from legislation, court decisions, Badilag documents, and relevant literature. The findings reveal that legal protection remains ineffective due to weak implementation structures, limited victim-centered perspectives among legal officials, and persistent legal cultures that treat domestic violence as a private matter. The study further finds that religious courts have not fully integrated gender-sensitive and recovery-oriented approaches into post-divorce dispute resolution. To address these challenges, the research proposes strengthening victim-oriented regulations, improving judicial capacity through gender justice training, expanding access to legal aid services, and promoting women’s socio-economic empowerment after divorce. The study concludes that substantive justice for women victims of domestic violence requires an integrative legal framework that combines responsive legal norms, effective judicial practices, and broader social transformation to ensure comprehensive protection, recovery, and access to justice.

Abstract

Penelitian ini dilatarbelakangi oleh kebutuhan mendesak untuk menata kawasan kumuh di Desa Cikoang serta amanat undang‑undang yang menuntut kepastian hukum. Penelitian ini bertujuan untuk menganalisis implementasi Perda Takalar Nomor 3 Tahun 2023 tentang pencegahan dan peningkatan kualitas permukiman kumuh dalam perspektif siyasah syar’iyyah. Penelitian ini menggunakan metode lapangan dengan pendekatan kualitatif, melalui metode normatif syar’i dan empiris. Data diperoleh dari wawancara dengan masyarakat, aparat desa, dan tokoh agama, serta observasi langsung di lapangan yang dipadukan dengan literatur berupa buku, jurnal, dan dokumen kebijakan. Analisis dilakukan melalui reduksi data, penyajian data, dan penarikan kesimpulan dengan uji kredibilitas triangulasi. Hasil penelitian menunjukkan bahwa perda telah memberikan dampak nyata berupa program bedah rumah, pembangunan jamban sehat, perbaikan saluran drainase, pembangunan jalan tani, serta kerja bakti rutin yang melibatkan masyarakat. Nilai filosofisnya tercermin dalam kebersihan sebagai bagian dari iman, serta prinsip ta’awun (tolong‑menolong) dan syura (musyawarah) dalam pelaksanaan program. Namun, efektivitas kebijakan masih terhambat oleh keterbatasan anggaran, lemahnya pendataan penerima manfaat, dan minimnya infrastruktur pendukung, sehingga prinsip keadilan distribusi belum sepenuhnya terwujud. Dalam perspektif siyasah syar’iyyah, perda ini selaras dengan prinsip maslahah, keadilan, dan maqasid al‑shari’ah, tetapi memerlukan penguatan verifikasi partisipatif, transparansi distribusi, serta konsistensi pelaksanaan. Implikasinya, diperlukan kerja sama antara pemerintah daerah dan masyarakat agar kebijakan berjalan lebih adil, berkelanjutan, dan sesuai dengan nilai‑nilai Islam

Abstract

The implementation of marriage administration digitization through the Marriage Management Information System (SIMKAH) is part of efforts to reform marriage registration governance to ensure data accuracy and integrity. However, the effectiveness of SIMKAH cannot be assessed solely from a technical-administrative perspective, but must also be analyzed within the normative framework of Islamic law. This study aims to examine the implementation of SIMKAH in preventing marriage data manipulation at the Gantarangkeke Subdistrict KUA in Bantaeng Regency using the maslaḥah perspective as the basis for analysis. The focus of the research is on ensuring the security and protection of marriage data, the impact of SIMKAH implementation on preventing data manipulation, and the operational mechanisms of SIMKAH in realizing the principle of maslahah. This study uses a qualitative method with theological, sociological, and syar'i approaches. Data were obtained through observation, in-depth interviews, and documentation, then analyzed descriptively-analytically with an emphasis on the relationship between empirical practices and normative principles of Islamic law. The results of the study show that SIMKAH provides an integrated system-based recording mechanism, automatic data validation, tiered access control, and audit trails that enable continuous administrative supervision, thereby significantly limiting the opportunities for manipulation of marriage data. The implementation of this system has had an impact on increasing the transparency, accountability, and reliability of marriage data at the KUA level. From a maslahah perspective, SIMKAH functions as an instrument for protecting the public interest (ḥifẓ al-maṣlaḥah al-‘āmmah) by preventing mafsadah in the form of data falsification and ensuring legal certainty for all parties. The novelty of this research lies in the integration of the analysis of the marriage administration information system with the maslahah framework in Islamic law. This research has implications for strengthening the policy of digitizing religious services and developing fair, accountable, and maslahah-oriented marriage registration governance.
