Abstract

Penelitian ini menyelidiki fenomena perilaku cerewet pada istri dalam konteks rumah tangga, mengidentifikasi penyebabnya, dan mengeksplorasi strategi untuk mengelola dinamika tersebut demi mencapai keharmonisan dalam hubungan. Perilaku cerewet dipahami sebagai kebutuhan berkomunikasi dan diakui, sering kali muncul dari ketidakpuasan dalam dinamika hubungan, perbedaan kepribadian, serta tekanan kehidupan sehari-hari. Menggunakan studi kepustakaan dengan jenis penelitian kualitatif dan analisis deskriptif-analitik berdasarkan teori sistem keluarga Minuchin. Hasil penelitian menunjukkan bahwa, perilaku cerewet pada istri dalam rumah tangga bisa dimengerti melalui faktor-faktor seperti ketidakpuasan dalam hubungan, perbedaan kepribadian, gaya komunikasi, dan tekanan sehari-hari. Seringkali, kecerewetan merupakan cara untuk menegaskan diri dan mengekspresikan ketidakpuasan. Mengatasi hal tersebut membutuhkan empati dan komunikasi efektif, termasuk mendengarkan aktif, memahami emosi yang mendasarinya, serta menetapkan waktu untuk dialog. Selain itu, pengembangan hobi bersama, penggunaan humor, dan introspeksi diri mendukung dinamika hubungan yang sehat. Berdasarkan analisis teori Salvador Minuchin tentang penyesuaian diri dalam keluarga memberikan penekanan pada batasan, subsistem, dan fleksibilitas yang jika diterapkan, dapat mengurangi kecerewetan dan meningkatkan harmoni keluarga. Komitmen bersama untuk mendukung dan memahami satu sama lain serta adaptasi dinamika keluarga merupakan kunci untuk memperkuat hubungan dan menciptakan keharmonisan.

Abstract

The socio-economic challenges faced by vulnerable groups in Gombe State, Nigeria, underscore the need for sustainable interventions to alleviate poverty and dependency. This study examines the utilization of Zakat and Waqf as Islamic socio-economic tools to empower vulnerable populations and promote economic independence. Employing a mixed-method approach, it integrates qualitative interviews with stakeholders in Zakat and Waqf management and quantitative data on poverty and dependency rates. Findings reveal that structured and transparent administration of Zakat and Waqf can significantly enhance access to education, healthcare, and sustainable livelihoods, reducing dependency. However, challenges such as limited awareness, poor institutional frameworks, and inadequate regulatory support hinder optimal implementation. This study recommends policy reforms, institutional capacity-building, and enhanced community engagement to maximize the impact of these Islamic instruments. The research contributes to ongoing discussions on leveraging Islamic social finance to foster socio-economic equity and justice.

Abstract

This study analyzes Masnun Tahir’s thoughts on Nationalist fiqh as a solution to the challenges of pluralism, intolerance, and radicalism in Indonesia. Masnun Tahir proposes a paradigm of Nationalist fiqh that integrates Islamic values with the multicultural context of Indonesian nationhood. The study employs Jurgen Habermas’s Critical Hermeneutics theory as an analytical framework to explore the transformative dimensions of this thought, encompassing interfaith dialogue, education, and the strategic role of religious scholars (ulama) in fostering social harmony. Using a library research methodology and textual analysis, this research examines Masnun Tahir’s works and the relevance of his ideas in the social context. The findings indicate that Masnun Tahir’s Nationalist fiqh offers a comprehensive approach that balances Islamic teachings with national values, positioning pluralism as a strength to enhance unity. This paradigm encourages the application of contextual Islamic law that respects local values and aligns with societal needs. Interfaith dialogue emerges as a central pillar of this paradigm, functioning as a tool to strengthen social integration and minimize conflicts arising from differences in belief. Education based on Nationalist fiqh is also identified as a key element in shaping a tolerant and patriotic generation. The analysis reveals that the paradigm of Nationalist fiqh is not merely normative but also transformative, providing practical solutions to the challenges of intolerance and radicalism. However, its implementation faces obstacles, including social resistance and the need for cross-sectoral support. With inclusive and sustainable strategies, Nationalist fiqh holds significant potential as an instrument for inclusive social transformation in Indonesia. This study contributes to the enrichment of theoretical discourse and offers a new perspective on bridging religion and nationhood in the Indonesian context.

Abstract

The purpose of writing this article is to discuss mixed marriages that occur in Indonesia because the practice of mixed marriages is something that cannot be denied, both interfaith marriages and nationalities. Then, using a library study through data collection in its preparation using various journals and books that still have relevance to the object of discussion in the preparation of this article is the type of study that will be used. Furthermore, the data used in this study is a qualitative approach with a descriptive-analytic nature of research. The results of this study state that mixed marriages are a necessity if both partners have the same harmony and commitment in building the ark of domestic life. Then, mixed marriage is also a lifestyle if both partners want a different partner from the surrounding community which is the main attraction, or even a need to fulfil a lifestyle for the perpetrators.

Abstract

This study explores the hidden challenges faced by parents in educating children in the modern era, referred to as “invisible enemies”, focusing on digital technology, individualism, academic pressure, peer influence and consumerist culture. It develops adaptive and responsive strategies to address these hidden challenges as a guide for parents. Employing a literature study with a qualitative-exploratory-descriptive approach, this research analyses the risks of the modern era in child education using Ulrich Beck's risk society theory framework. The findings reveal that parents face various hidden risks, such as exposure to inappropriate digital content, social pressures that undermine collective values, and challenges in balancing child protection with fostering independence. These align with the risk society theory, characterized by the risks arising from technological advancements and social changes, which are not only physical but also psychosocial. In this context, parents act as risk mitigation agents. Their role encompasses not only protecting children from the negative impacts of these risks but also equipping them with adaptive skills, instilling collective values, providing support for emotional balance and interests and fostering independence. This study contributes scientifically to the development of parenting strategies that are more responsive to the challenges of the modern era. It also offers practical guidance for parents, educators, and policymakers to create a resilient, ethical generation capable of navigating future socio-technological dynamics. Abstract

This article discusses the tradition of ngorek at the nyongkolan ceremony in the traditional Sasak Tanak Awu marriage. The ngorek tradition is a tradition which is done in the afternoon when the nyongkolan event is taking place. At the time of the event, the groomsmen perform the tradition of chopping or stabbing one of his own limbs with a sharp weapon such as swords, kris and so on, so that sometimes these activities cause injuries to their limbs. The main focus of the study of this article is why the Sasak Tanak Awu people still practice the tradition of ngorek by using the concept of reasons for the emergence of legal practice in society which was initiated by Satjipto Raharjo, this paper finds that the factors of the Tanak Awu Village community in carrying out the Ngorek tradition are, first, to show off invulnerability, second, attracts girls and third, keeps tradition. [Artikel ini membahas mengenai tradisi ngorek pada upacara nyongkolan dalam perkawinan adat Sasak Tanak Awu. Tradisi ngorek adalah sebuah tradisi di mana dilakukan pada sore hari ketika acara nyongkolan sedang berlangsung. Pada saat acara tersebut, laki-laki pengiring pengantin melakukan tradisi ngorek dengan cara membacok atau menusuk salah satu anggota badannya sendiri dengan keras menggunakan senjata tajam seperti pedang, keris dan lain sebagainya, sehingga terkadang kegiatan tersebut menyebabkan terjadinya lukaluka pada anggota badan merekaf. Fokus utama kajian artikel ini adalah mengapa masyarakat Sasak Tanak Awu masih melakukan tradisi ngorek dengan menggunakan konsep alasan munculnya praktek hukum dalam masyarakat yang digagas oleh Satjipto Raharjo, tulisan ini menemukan bahwa faktor-faktor masyarakat Tanak Awu melakukan tradisi ngorek adalah, pertama, untuk memamerkan ilmu kebalnya. Abstract

This article discusses the low success rate of mediation at the Bantul Religious Court in 2018-2020: a study of the analysis of the role of mediators at the Bantul Religious Court. The focus of this study is to analyze the reasons or factors for the low success of mediation by mediators at the Bantul Religious Court by utilizing the concept of legal sociology whose scalpel uses the theory of legal effectiveness, legal culture and conflict resolution. The results of this study indicate that the effectiveness of the successful role of the mediator is influenced by seven factors namely First, the parties are determined to divorce, Second, the degree of difficulty of the case. Third, the level of public awareness. Fourth, the mediation time is too short. Fifth, Mediation is only a formality. Sixth, the good faith of the parties. Seventh, the ability of the mediator. [Artikel ini membahas mengenai rendahnya tingkat keberhasilan mediasi di Pengadilan Agama Bantul tahun 2018-2020: studi terhadap analisis peran mediator di Pengadilan Agama Bantul. Fakus dari kajian ini ialah menganalisa alasan atau faktor rendahnya keberhasilan mediasi oleh mediator di Pengadilan Agama Bantul dengan memanfaatkan konsep sosiologi hukum yang pisau bedahnya menggunakan teori efektivitas hukum, budaya hukum dan resolusi konflik. Hasil penelitian ini menunjukkan bahwa efektifitas keberhasilan peran mediator dipengaruhi oleh tujuh faktor yakni Pertama, Para pihak sudah bersikukuh untuk bercerai, Kedua, Tingkat kesulitan kasus. Abstract

This article aims to detail the development of the method of finding sources of Islamic law concerning the perspectives of the scholars of the madhhab al-arba'ah, and explore its advantages and disadvantages based on the findings gathered. The research adopts a literature-based approach, a research method that relies on literature as the main source of information. Primary data sources are obtained from classical works, books, journals, and other related references related to the method of finding sources of Islamic law, especially in the perspective of the ulama mazhab al-arba'ah. Researchers use a qualitative approach with analytical descriptive methods to analyse primary data. The results show that the schools of Islamic law, such as Hanafi, Maliki, Shafi'i, and Hambali, show differences in the method of legal discovery and its implementation. Each school has distinctive characteristics based on its origin's sociocultural and political context. The thoughts of the leading figures in developing the science of usul fiqh, such as Abu Hanifah, Imam Malik, Imam Shafi'i, and Imam Ahmad, reflect the differences in ijtihad and law-making methods in these schools. Thus, this article provides an overview of the complexity and diversity of legal discovery methods in the Islamic context, illustrates the evolution of legal thought over time, and highlights the different approaches among the schools of Islamic law.

Abstract

Higher education in Indonesia plays a pivotal role in preparing a generation ready for the professional world. The curriculum of the Master's Program in Sharia Science at UIN Sunan Kalijaga Yogyakarta is integral to this mission. However, this research identifies gaps in the curriculum that do not fully align with alumni needs and job market demands. A field study involving 104 alumni from September 2018 to August 2022 was conducted using a descriptive-analytical method with an empirical approach. Data was collected via a survey sent to alumni and analyzed using Ralph W. Tyler's theory and James A. Banks' multicultural education theory. Findings reveal that courses like Fiqh Studies, Sharia Science, and Islamic Family Law in Indonesia were highly valued and should be further developed. Conversely, courses such as Falak Science and Arabic Text Reading were seen as less relevant and suggested for removal. Additionally, the replacement of the final project with journal publication was criticized. The analysis suggests that the curriculum should evolve to better reflect societal diversity and complexity. The proposed changes emphasize developing relevant courses and revising or eliminating those deemed less beneficial. These recommendations aim to ensure that the Sharia Science Master's Program remains responsive, inclusive, and capable of producing graduates who can compete in the global era.

Abstract

As an Islamic country, Islamic family law reform in Malaysia is experiencing various dynamics. This article aims to examine the genealogy, reform, and products of Islamic family law in the field of marriage (munakahat) in Malaysia. The authors find that Malaysia’s Islamic law reform is divided into three periods using literature research. In the Malay period, Islamic values were generally embedded in the law in Malaysia. During the British colonial period, English law had dominated and was used as common law, which was absorbed in various legislation and jurisprudence in Malaysia. It was only after independence that efforts to reform and codify Islamic family law began, marked by the stipulation of the jurisdiction of the federal territorial government and the territorial government into thirteen states. The codification of family law began with establishing a committee to amend Islamic law and be guided by other Islamic countries. The authors find four areas of marriage that have been reformed in Malaysia, namely the age limit for marriage, marriage registration, polygamy, and divorce. Among the four areas of marriage law, the authors find slight differences in regulations on the technical and material grounds in each state in Malaysia.
