Abstract

Abstract This study aims to investigate the development of mental resilience in children from broken homes. Particular focus is given to efforts to build their mental resilience in the face of the stress, instability and emotional challenges of such family dynamics. This study employs qualitative research through desk research to integrate two primary theoretical frameworks: Maqashid Sharia and Bronfenbrenner's Ecological Systems Theory. The results show that building children's mental resilience requires a holistic approach involving a safe and supportive environment, mental health education, therapy, and community and school involvement. Education and training for parents and caregivers are also essential to correct behaviours that can negatively impact children's mental health. Through the lens of Maqashid Sharia and Bronfenbrenner's Systems Ecology theory, this research offers new insights into a comprehensive approach to supporting children from broken homes, demonstrating the importance of inter-systems cooperation to support children's long-term mental well-being and resilience.

Abstract

This study aims to examine the role of the ulama in modern politics in Indonesia, focusing on the dynamics from rebellion to diplomacy. The research also analyzes the role of ulama using the political elite theories of Vilfredo Pareto and Gaetano Mosca to provide a new perspective on the power and influence of ulama in Indonesian politics. The methodology used is a literature review with a qualitative research approach, utilizing primary data from authoritative books, journals, and online sources. The results show that the ulama has a significant role in various aspects of Indonesian politics. In the early post-independence period, ulama such as Kyai Haji Hasyim Asy'ari played a role in mass mobilization against colonialists, while ulama like Abdurrahman Wahid (Gus Dur) used diplomatic strategies to maintain their influence despite efforts by the government to depoliticize religion. After the reform era, ulama gained a more significant space in politics, both through Islamic-based political parties and in their roles as advisors and mediators. The study also reveals that the ulama plays a crucial role in shaping public policies that reflect Islamic values. Fatwas issued by the Indonesian Ulama Council (MUI) often influence government policies in various fields, such as Sharia economics. Furthermore, ulama is involved in political education for the public, advocacy for marginalized groups, and participation in interfaith dialogue at international forums. Analysis based on Pareto and Mosca's political elite theories indicates that ulama is part of the elite holding moral and spiritual power and functions as advisors and mediators in practical politics. The process of elite circulation and the importance of religious organizations in maintaining their power highlight how the ulama continuously adapts and functions within the dynamic political power structure in Indonesia. With their long history of contribution and adaptation, ulama in Indonesia is poised to continue being a significant pillar in shaping the nation's political and social future.

Abstract

This research aims to analyze the weak public criticism of the practice of nepotism in Indonesia through the Elite Theory perspective developed by Vilfredo Pareto and Gaetano Mosca. Nepotism, which is defined as giving important posts or positions to relatives or close friends without considering competence, has become an integral part of the Indonesian political system. This study uses descriptive qualitative research to explore the factors that influence people's attitudes towards nepotism and the interactions between these factors. Data sources were obtained through library research which included literature, articles and previous research. The research results show that the normalization of nepotism in Indonesia is strengthened by a paternalistic political culture, low community political participation, and economic dependence on political elites. The dominance of organized elites, as explained by Pareto and Mosca, plays a central role in weakening society's critical voice. Pareto emphasized that elites use nepotism to maintain power and hinder the circulation of new, more competent elites, while Mosca pointed out that elites manipulate public opinion and maintain the status quo through control over important resources and institutions. This condition results in apathy and the inability of society to form an effective opposition to the ruling elite. This research concludes that the weak public criticism of nepotism is a consequence of the dominance of elites who use their power to maintain control and avoid criticism. To overcome this problem, reforms are needed in the political and cultural system in Indonesia, including increasing transparency, strengthening anti-corruption institutions, as well as more inclusive and participatory political education. These findings provide a significant contribution to understanding the dynamics of power and social behavior in Indonesia and offer practical recommendations for strengthening the critical role of society in dealing with nepotism practices.

Abstract

The legal age of marriage in Indonesia has become a compelling issue and has been extensively studied by scholars. Although the national law stipulates that the legal age of marriage must be 19 years for both males and females, inpractice, some loopholes can be exploited, specifically through marriage dispensation. This article aims to elucidate the disparity between "law in the book" and "law in action." Using a literature review with a normative approach and employing Herbert Lionel Adolphus Hart's theory of legal expression as an analytical framework, this study finds that significant reforms have occurred in Indonesia's marriage law, as promulgated through Law No. 16 of 2019, whichraised the minimum legal age of marriage to 19 years for both males and females. This reform aims to reduce cases of early marriage, support gender equality, and improve the quality of life in line with international human rights standards. It is dubbed the "Front-Faced Law." On the other hand, Indonesia maintains flexibility in its legal system by allowing marriage dispensations, which provide exceptions to this rule under certain circumstances, referred to as the "Back-Faced Law." Itcreates a duality or "Two-Faced" nature in the legal system, reflecting a legal expression that balances the desire for progressive reform with the recognition of the need for fair and flexible policies in addressing the complexities of social realities.

Abstract

The Industrial Revolution 5.0 changed the paradigm of human interaction with technology, which emphasises the synergy between artificial intelligence and unique human capabilities to create more humane and sustainable innovations. In the context of Islamic family law, the Industrial Revolution 5.0 brings new challenges and opportunities that require thoughtful understanding to ensure its relevance and benefits for Muslims. This research compares the evolution of Islamic family law before and during the Industrial Revolution 5.0 era through a literature study-based comparative approach with a qualitative research type. The research shows that, before the revolution, Islamic family law had established a solid moral and social foundation, regulating marriage, divorce, inheritance and family responsibilities with an emphasis on social justice and the protection of individual rights. When the Islamic family law entered the revolutionary era, significant changes were encountered in communication, employment, family economy, and education. Although new technology has brought opportunities to strengthen faith and religious practice, it has also raised issues such as privacy and psychological impact. Islamic family law is required to integrate traditional values with technological innovations, maintain education and understanding of rights and obligations within the family, and maintain a balance between material and spiritual progress. With judicious adaptation, Islamic family law can ensure harmonious and prosperous families in this new era.

Abstract

This research highlights the view of Islamic family law on the rejection of the marriage contract of LGBT couples as a marriage, which is seen through the lens of Maslahah theory. Through a literature study using qualitative research based on the scalpel of Maslahah theory, The research underlines that marriage in Islam is not only an agreement between two individuals but also an institution governed by certain conditions and pillars, including the existence of male and female parties who are permitted according to Sharia, as well as the existence of a guardian, dowry, and fair witnesses. In the context of LGBT couples, the marriage contract does not fulfil these conditions, so it cannot be considered a marriage contract in Islamic family law. In addition, the rejection is analysed through Maslahah theory, which emphasises the importance of maintaining the integrity of the family structure, moral values and spiritual goals in society. The refusal is interpreted as an attempt to preserve the general welfare by maintaining social harmony and adherence to Islamic principles. It shows that the rejection of marriage contracts for LGBT couples is not discriminatory but rather the result of a deep understanding of the concept of marriage in Islam, with the aim of achieving broader welfare and protecting the institution of the family as the basic social and spiritual unit. This research confirms that Islamic law is a dynamic and adaptive system seeking to promote justice and welfare in accordance with religious principles and the needs of society. Thus, the rejection of marriage contracts for LGBT couples in Islamic family law can be understood as part of an effort to maintain the harmony of society without abandoning the underlying religious principles.

Abstract

This research examines the phenomenon of legal pluralism in the context of plural societies, where ethnic, religious and cultural diversity pose challenges and opportunities in the application of diverse legal systems, including customary law, religious law and national law. Therefore, this study aims to identify and understand the interaction between these legal systems, identify the challenges that arise, and explore harmonisation strategies to support social integration and justice. The methodology used is descriptive-analytic qualitative research based on desk research to understand the dynamics of legal pluralism and use Maslahah theory as an analytical lens. The results showed that the challenges faced by pluralistic societies towards the growing legal pluralism are the birth of conflicts between norms, access to justice, and the need for legal reform. The efforts needed to achieve harmonisation of legal pluralism are by conducting dialogue between stakeholders, inclusive legal education, and adaptation to social change. The Maslahah analytical framework provides an essential perspective in evaluating harmonisation efforts, with a focus on creating social welfare and preventing harm. This research contributes to the legal literature by providing insights into how plural societies can overcome the challenges of legal pluralism and create a legal system that is fair, inclusive and responsive to the diversity of society.

Abstract

The convergence of customary norms with Islamic legal norms gives rise to a new legal entity, including philosophical meanings. However, it is often seen as problematic and potentially conflicting with Islamic legal principles. This article seeks to explore the symbolic meanings and reasons for the persistence of the kebon odeq in the marriage customs of the Sasak community in Pengadang Village, Central Lombok. Utilizing an anthropological approach with symbolic anthropology theory popularized by Victor Turner and conducting in-depth interviews with five key informants, this article reveals that within the kebon odeq, the Sasak community in Pengadang assigns significant symbolic meanings to various elements. The components of kebon odeq enhance a sense of unity and cultural values as a form of respect for ancestral customs. Symbolically, it emphasizes the correlation of its symbolic meaning with cultural values, marriage, and social aspects of society. In Islamic law, this tradition holds symbolic meanings related to the values of Islamic marriage, especially commitment and maintaining sustainability. The intersection of philosophical meanings between custom and Islamic law is a significant motivation for the extent to which kebon odeq is preserved and developed by the Sasak Muslim community.

Abstract

This study examines the tradition of fidyah payments—compensation for missed prayers (ṣalāt) on behalf of the deceased—within the Sasak Muslim community in Central Lombok, Indonesia. Although this practice diverges from the mainstream Shāfiʿī school of law (madhhab), which the community primarily follows, it endures as a deeply ingrained tradition. Based on fieldwork and interviews with tuan gurus (local religious leaders) and deceased family members, the research finds that fidyah is commonly paid using rice, money, or gold from the deceased’s estate, distributed as alms to the poor. The community views fidyah as a means of atoning for missed prayers, offering peace to the family. Tuan gurus legitimize this practice by citing specific Islamic juristic opinions, particularly those of Imām al-Subkī and Imām Abū Ḥanīfah. Over generations, the Sasak community has internalized fidyah as a communal obligation, with non-compliance regarded as a family dishonor. This study demonstrates how tuan gurus’ teachings shape and institutionalize religious practices, transforming them into essential cultural traditions.

Abstract

Artikel ini membahas tentang produk-produk hukum keluarga Islam di Turki dengan fokus utama kajian artikel ini adalah bagaimana sejarah dan perkembangan hukum keluarga di Turki dan apa saja produk dari pembaharuan hukum keluarga di Turki menggunakan studi kepustakaan.Tulisan ini menemukan bahwa perkembangan pembaharuan hukum keluarga di Turki yang dimulai dari al‐Majallâh (1876), The Ottoman Law of Family Right (1917), Peraturan Sipil Turki (The Turkish Civil Code of 1926) merupakan sebuah respon atas pengaruh dan perubahan kondisi sosial, politik, dan ekonomi yang tidak stabil apalagi pada masa tersebut masyarakat Turki masih mengalami kondisi krisis identitas. Kemudian produk dari pembaharuan hukum keluarga di Turki dibagi kedalam dua cakupan yakni munakahat dan mawaris, di mana bagian dari munakahat itu sendiri meliputi, khitbah, batas usia minimal menikah, larangan dalam perkawinan, poligami, walimah, pembatalan perkawinan, perkawinan yang tidak disahkan, perceraian, kompensasi dalam perceraian, Sedangkan dalam mawaris meliputi, wasiat dan jumlah pembagian antara laki-laki dan perempuan yang setara.
