Abstract

This study explores the multidimensional dynamics of the prohibition of polyandry, a marital practice where a woman has more than one husband. Methodologically, the research is grounded in a qualitative approach, drawing on a diverse range of literature, including books, journals, and websites, which are analyzed descriptively and analytically based on the theory of Maslahah. The study aims to provide a deeper understanding and analysis of the dynamics surrounding the prohibition of polyandry and its relevance to the concept of Maslahah. The exploration reveals that the prohibition of polyandry is influenced by social, legal, cultural, economic, and health dimensions. From a social perspective, polyandry disrupts patriarchal structures and complicates issues of lineage and inheritance. Legally, the practice challenges administrative regulations and civil status, reflecting dominant religious and moral norms that support monogamy or controlled polygamy. Economically, while polyandry may address financial constraints in specific settings, it generally reduces economic efficiency and household financial management in the broader societal context. In terms of health, the practice poses risks related to sexual and reproductive health, potentially increasing the spread of sexually transmitted diseases and complicating reproductive management. Additionally, through the lens of Maslahah in Islamic law, the prohibition of polyandry is considered an effort to protect the public welfare, minimize harm (mudharat), and enhance social and familial stability. It indicates that the prohibition policy is not only a manifestation of traditional or religious values but also the result of pragmatic and comprehensive consideration of its long-term impacts on the structure and function of society. Overall, the study provides a critical explanation of how the concept of Maslahah justifies the prohibition, ultimately aiming to preserve societal order and overall well-being.

Abstract

This study conducts an in-depth analysis of the representation of justice systems and the duality of law enforcement as depicted in the popular manga and anime series "One Piece" by Eiichiro Oda. Employing a literature review with Siyasah Syar'iyah theory as the theoretical framework, this research explores how concepts within Siyasah Syar'iyah can be applied to understand the complex justice system presented in this fictional world. The research is divided into two main sections: firstly, examining the representation of the justice system in "One Piece," where law is applied across various characters and situations, highlighting conflicts and compromises between personal morality and the prevailing law. Secondly, the study integrates the perspective of Siyasah Syar'iyah to analyze how these principles are applicable in the context of law and justice within the narrative. The findings indicate that, although "One Piece" is a work of fiction, its representation of the justice system and the duality of law enforcement reflects relevant justice issues in actual society. The Navy and the World Government in "One Piece" often implement actions that are absolute and monolithic, demonstrating a tendency to disregard fair legal processes and human rights. This practice conflicts with the principles of Siyasah Syar'iyah, which emphasize justice, transparency, and accountability. The study also highlights how power and social status can influence the interpretation and application of justice, as represented by Tenryuubito and Yonko, showing disparities in social and legal justice. Therefore, "One Piece" not only entertains but also provides a platform for critical discussions on justice and law enforcement, enabling reflection on real-world justice practices. This research adds a new dimension to the study of law and justice by integrating the principles of Siyasah Syar'iyah. It enriches the literature on interdisciplinary analysis between law, pop culture, and Islamic studies.

Abstract

This study explores the phenomenon of "lookism" or appearance-based discrimination, which divides individuals into two primary groups: those regarded as attractive or "good looking" and those viewed as less attractive or "bad looking." It reveals that individuals perceived to meet the standards of being good-looking gain social and economic advantages through the "halo effect," wherein their appearance positively influences assessments of their professional and moral capabilities. In contrast, those perceived as less attractive or bad-looking encounter substantial disadvantages, including discrimination in job recruitment and promotion, as well as in social and institutional interactions. Utilizing a literature review with a qualitative research approach and an analytical framework based on Erving Goffman's Stigma Theory, this research demonstrates that physical appearance acts as a discrediting stigma, significantly impacting individuals' social identity and opportunities. The analysis emphasizes the integration of stigma into institutional structures and social practices, resulting in hidden yet systematic discrimination. Furthermore, the study explicates how the media and entertainment industries, through their portrayal of unrealistic beauty standards, reinforce societal beauty stereotypes. This influence on public perceptions heightens social pressure to conform to narrow beauty standards. From a sociological perspective, the unequal distribution of "beauty capital" creates persistent inequalities that affect not only economic opportunities but also political representation and power. This research underscores the need for social interventions and policies that reduce stigma and broaden the definition of beauty, which are crucial for dismantling power structures that perpetuate appearance-based discrimination and for fostering a more inclusive and equitable society. Through an informed and data-driven approach, this study provides essential insights into how social norms and values can be reformed to minimize "lookism" bias and enhance appreciation for human character diversity and complexity.

Abstract

This study explores the concept of "household moderation" as a strategy to overcome the dynamics and challenges of family life. This research adopts a literature-based qualitative research type to analyze the concept of household moderation. By integrating Murray Bowen's Family Systems theory and Maqashid Shariah principles, this research shows that household moderation, through practices such as prudent financiafl planning, equitable division of tasks, effective time management, education, and physical and mental health, can create a strong foundation for a harmonious and supportive family life. This research emphasizes the importance of effective communication, cooperation and flexibility in dealing with daily challenges and adapting to changes in family life. Based on an analysis of Murray Bowen's Family Systems theory, home moderation offers insights into how self-differentiation, avoidance of negative triangulation and stabilization of the family emotional system can support healthy family functioning. In addition, marital moderation also contributes to protecting the five aspects of essential well-being according to Maqashid Shariah: religion, soul, intellect, offspring and property. However, this study also recognizes the need to explore further the application of household moderation in highly diverse family contexts to enhance the relevance and applicability of this concept in a pluralistic society.

Abstract

This study aims to analyze the multidimensional impact of erectile dysfunction on family harmony using Murray Bowen's family systems theory and the theory of maslahah within the context of Islamic law. A harmonious family is ideal for any family unit, where each member feels happy, safe, and comfortable. However, achieving such harmony is not without challenges, one of which is erectile dysfunction, which can exert significant pressure on family relationships. Erectile dysfunction affects not only the physiological aspect of the sufferer but also has psychological and social repercussions, such as feelings of shame, loss of self-confidence, and severe stress that can lead to tension within relationships. This research employs a literature review method with descriptive-analytic analysis techniques. Primary data sources include books, journals, and relevant websites. Bowen's family systems theory is utilized to understand how erectile dysfunction can influence family dynamics, including concepts such as self-differentiation, triangulation, and family projection processes, and the theory of maslahah aids in finding holistic solutions to the impact of erectile dysfunction by emphasizing individual and family well-being in psychological, social, and health aspects. The findings indicate that erectile dysfunction exacerbates family dynamics by increasing emotional stress, altering power patterns, and causing negative projection and triangulation in relationships. From the perspective of maslahah, erectile dysfunction disrupts the well-being of individuals and families, necessitating a holistic approach that includes medical treatment and emotional support, as well as reducing social stigma. Therapeutic strategies that enhance self-differentiation, manage triangulation, and foster open communication between partners are crucial for maintaining family harmony. The integration of comprehensive medical care and support from family and the community is expected to help sufferers cope better with this condition and maintain harmony.

Abstract

This research delves deeply into the issue of law enforcement in Indonesia, focusing on the contribution of Rosdalina Bukido's thoughts. This research utilizes a qualitative research method based on literature studies by analyzing Rosdalina Bukido's works related to efforts to maximize law enforcement in Indonesia and applying Roscoe Pound's Sociological Jurisprudence theory. The results highlight the urgency of effective and just law enforcement in nation-building. Bukido emphasizes the role of judges as justice carriers, detailing the gap between theoretical law and daily practices. Internal and external factors influencing law enforcement are discussed, emphasizing consistency in legal principles, professionalism of law enforcers, and public perception of the law. Analysis of Bukido's ideas from the Sociological Jurisprudence perspective highlights the dynamic relationship between law and society. Her contributions include deep understanding of how law must be responsive to its social context and fulfill societal needs and aspirations. Hence, there are important contributions in Rosdalina Bukido's thinking in understanding and implementing law enforcement in Indonesia. The application of Sociological Jurisprudence provides a broader view of how law operates within society. The implications include the necessity of consistency in legal principles, professionalism of law enforcers, and changes in public perception to create a more just and effective legal system.

Abstract

This research investigates the "Bales nae" tradition within the Sasak community in Lombok, Indonesia. Bales nae is an essential post-wedding ritual where the groom's family visits the bride's family following the merariq ceremonies. This tradition aims to strengthen family bonds, foster mutual respect, and preserve cultural heritage. Using a socio-legal approach and theories from Émile Durkheim and Maqashid Sharia, this qualitative study explores the reasons why the Sasak community maintains this tradition. Data were collected through observation and interviews with 12 key informants, including community members, traditional leaders, and families who have practised Bales nae. The research findings reveal that Bales nae functions to introduce and strengthen relationships among extended families, enhance social cohesion, and preserve cultural heritage. Durkheim's functionalism theory highlights the role of Bales nae in social stability and solidarity, while Maqashid Sharia emphasizes its contribution to preserving religion, life, intellect, lineage, and property. This tradition, with its rich symbolic meaning, underscores the importance of maintaining cultural practices amid modern influences. The study concludes that Bales nae is crucial for reinforcing family and social structures, reflecting the profound significance of traditional rituals within the Sasak community.

Abstract

This study aims to analyze the impact of the paylater system on the dynamics of digital transactions in Indonesia and to examine its legal status from the perspective of contemporary Islamic commercial jurisprudence (fiqh al-mu’āmalāt). Employing a qualitative research design grounded in library research, this study draws upon academic literature, official financial institution reports, and relevant Islamic legal sources. The findings reveal that the paylater system has transformed consumer behavior in Indonesia—from prudence-based spending to a consumption pattern driven by instant credit access. While it contributes to financial inclusion, particularly for populations underserved by formal financial institutions, the system also poses significant risks of consumer debt, especially among youth with low financial literacy. From the perspective of fiqh al-mu’āmalāt, paylater schemes are categorized under deferred payment sales contracts (al-bay’u bi thaman ājil), which are permissible provided that contractual conditions are met. However, in digital practice, these schemes often involve elements of gharar (uncertainty) due to the lack of clear information and the potential for riba (usury) stemming from unauthorized interest and penalty mechanisms. Furthermore, the hybrid nature of these contracts—combining elements of loans, sales, and services—introduces additional legal complexities. Therefore, the paylater system must be restructured in accordance with the principles of justice, transparency, and consumer protection, aligning with the objectives of Islamic law (maqāṣid al-sharī’ah). These findings underscore the urgency of implementing sharia-compliant oversight in digital financial services and enhancing consumer literacy as a necessary adaptation of Islamic jurisprudence to the evolving digital economy.

Abstract

This study aims to identify the stages of transformation in inheritance distribution practices among the Sasak Muslim community in Rensing Bat Village, East Lombok, and to explain the process of change through William Fielding Ogburn’s theory of social change. Drawing on field research with a qualitative approach supported by in depth interviews, the findings indicate a gradual shift from a patriarchal customary system towards a distribution pattern that aligns more closely with the principles of afraid. This transformation unfolds in four stages, beginning with the dominance of men as the primary heirs, the emergence of a justice based awareness that opens space for women, a transition towards a bilateral system, and the use of hibachi as a culturally accepted mechanism of value adjustment that simultaneously preserves family harmony. Osborn’s analysis shows that this change follows the stages of invention, accumulation, diffusion and adjustment, reflecting a bottom up process of social transformation arising from collective moral consciousness rather than from external structural pressure. The findings affirm that legal reform does not always need to be institutional or imposed from above, but may develop through the gradual internalization of Islamic values within local culture. This study offers a novel contribution by providing an empirical account of how such internalization occurs organically within the customary system, demonstrating that changes in inheritance practices may evolve through value negotiation at the community level.

Abstract

This study is motivated by the emergence of early marriage practices among Rohingya Muslim refugees in Aceh, which are often normatively framed either as cultural traditions or legal violations, without sufficient attention to the structural conditions that shape them. Accordingly, this article aims to analyse the factors driving this practice and to examine how early marriage is rationalised within conditions of prolonged displacement. Employing a qualitative, fieldwork-based approach, the study was conducted at the Mina Raya refugee camp in September and December 2024 through direct observation and in-depth interviews with seven informants in order to capture the everyday dynamics of life under conditions of uncertainty. Drawing on Anthony Giddens’ structuration theory, the analysis focuses on the relationship between structural constraints and refugee agency. The findings indicate that early marriage is shaped by three interrelated conditions: insecurity within the camp environment, the perceived need to protect girls from harassment or violence, and the absence of viable alternatives such as formal protection mechanisms and access to education. Within this context, marriage is understood by families as the most immediate and rational means of securing safety and stability. The article argues that early marriage constitutes a form of bounded agency—a survival strategy enacted within a severely constrained field of choice shaped by legal invisibility, prolonged displacement, patriarchal norms, and unresolved trauma. These findings contribute to scholarship on Islamic law and socio-legal studies, while underscoring the need for clearer legal frameworks, stronger protection mechanisms, and expanded access to education for refugee women and girls. [Studi ini berangkat dari munculnya praktik perkawinan dini di kalangan pengungsi Muslim Rohingya di Aceh, yang sering kali dipahami secara normatif sebagai tradisi budaya atau pelanggaran hukum tanpa mempertimbangkan kondisi struktural yang melatarbelakanginya. Oleh karena itu, artikel ini bertujuan untuk menganalisis faktor-faktor yang mendorong praktik tersebut serta memahami bagaimana perkawinan dini dirasionalisasi dalam kondisi pengungsian yang berkepanjangan. Penelitian ini menggunakan pendekatan kualitatif berbasis kerja lapangan yang dilakukan di kamp pengungsian Mina Raya pada September dan Desember 2024 melalui observasi langsung dan wawancara mendalam terhadap tujuh informan, guna menangkap dinamika kehidupan sehari-hari dalam situasi ketidakpastian. Dengan menggunakan teori strukturasi Anthony Giddens, analisis difokuskan pada hubungan antara keterbatasan struktural dan agensi pengungsi. Hasil penelitian menunjukkan bahwa perkawinan dini dibentuk oleh tiga kondisi yang saling berkaitan, yaitu ketidakamanan di dalam kamp, kebutuhan untuk melindungi anak perempuan dari pelecehan atau kekerasan, serta ketiadaan alternatif yang memadai seperti perlindungan formal dan akses terhadap pendidikan. Dalam konteks ini, perkawinan dipahami oleh keluarga sebagai cara paling cepat dan rasional untuk memperoleh keamanan dan stabilitas. Artikel ini berargumen bahwa perkawinan dini merupakan bentuk bounded agency, yaitu strategi bertahan hidup yang dijalankan dalam ruang pilihan yang sangat terbatas akibat invisibilitas hukum, pengungsian berkepanjangan, norma patriarkal, dan trauma yang belum terselesaikan. Temuan ini berkontribusi pada kajian hukum Islam dan studi sosio-legal, serta menegaskan pentingnya penguatan kerangka hukum, mekanisme perlindungan, dan perluasan akses pendidikan bagi perempuan dan anak pengungsi.]
