Abstract

This article investigates violations of women’s rights stemming from the practice of kawin magrib, a form of forced marriage, within the Sasak Muslim community in Lombok, Indonesia. Despite its inherently gender-discriminatory nature, the kawin magrib tradition remains a fundamental aspect of Sasak Muslims’ identity and societal structure. Employing a socio-legal approach and conducting in-depth interviews with nine key informants, this study delves into the persistent reasons behind this tradition and its repercussions on women’s rights. The authors found that the primary objective of kawin magrib is to uphold the moral standards of the younger generation within religious norms. However, the profound adverse effects on women cannot be disregarded. This article highlights the severe psychological trauma endured by women due to this customary law and the potential for men to exploit this tradition deceptively, marrying women without genuine consent. Based on these findings, the article underscores the urgent necessity of reforming this practice, with a strong focus on safeguarding women’s rights and promoting gender equality.

Abstract

Interfaith marriages remain a controversial subject among scholars in Indonesia. Despite the legal prohibition, the practice of interfaith marriage continues to persist. This article analyses various legal norms, decisions of the state courts and the Indonesian Constitutional Court related to interfaith marriages, revealing disparities between legal norms and practical implementation. Employing a normative approach through a literature review, this research finds that the state legislation strictly prohibits interfaith marriage. Paradoxically, couples navigate a legal workaround, exploiting a loophole in Population Administration Law No. 23 of 2006 to formalise their marriages. They submit applications to the district court, and the court’s decisions serve as the basis for recording their union. Some couples also employ an alternative strategy by marrying abroad and subsequently registering their unions upon returning to Indonesia. The article argues that the state’s legal expression in regulating the practice of interfaith marriages in Indonesia manifests ‘double face’. This study holds significant implications, particularly in enhancing policy comprehension, providing profound insights into the legal dynamics of interfaith marriages in Indonesia, and assessing its impact on citizens’ religious freedom. [Perkawinan beda agama di Indonesia masih menjadi isu kontroversial di kalangan para sarjana. Meskipun hukum negara telah melarangnya, praktik perkawinan beda agama masih terus berjalan hingga saat ini. Artikel ini menganalisis sejumlah hukum negara, putusan Pengadilan Negeri, dan putusan Mahkamah Konstitusi terkait perkawinan beda agama di Indonesia, mengungkap disparitas antara aturan hukum dan praktik. Menggunakan penelitian kepustakaan dengan pendekatan normatif, penelitian ini menemukan bahwa hukum negara telah mengatur secara ketat perkawinan beda agama dengan melarangnya. Namun, para pasangan beda agama memanfaatkan celah hukum dalam Undang-Undang No. 23 Tahun 2006 tentang Administrasi Kependudukan untuk mencatatkan perkawinan mereka. Mereka mengajukan permohonan ke pengadilan negeri dan ketetapannya digunakan sebagai dasar untuk mencatatkan perkawinan mereka. Sebagian dari mereka juga memanfaat “pintu belakang” dengan menikah di luar Indonesia dan kembali untuk mencatatkan administrasi perkawinan mereka. Dengan demikian, tulisan ini berpendapat bahwa ekspresi hukum negara dalam mengatur praktik perkawinan beda agama di Indonesia mencerminkan “dua wajah”. Abstract

The phenomenon of Rohingya refugees in Aceh, Indonesia, presents complex challenges in refugee management, particularly amid regulatory limitations and evolving social dynamics. Based on this context, this study aims to elucidate the dominant role of Islamic law understanding in Aceh in addressing the Rohingya refugee issue, employing Michael Mann's theory of power networks as an analytical framework. This research employs a qualitative, descriptive-analytical approach involving in-depth interviews with 15 informants, including UNHCR staff, activists, local communities, and refugees. Secondary data were obtained from literature and policies on refugee management in Indonesia. The findings indicate that the Acehnese community's understanding of Islamic law, as reflected in ukhuwah Islamiyah and local values such as peumulia jamee, serves as a key factor in accepting refugees. The principle of ukhuwah Islamiyah, rooted in the Qur'an, Hadith and the objectives of Sharia (Maqāṣid al-Sharīʿah), provides the moral and legal foundation for supporting international solidarity. However, challenges arise in social tensions, negative media coverage, and suboptimal implementation of Presidential Regulation No. 125 of 2016 concerning the Handling of Refugees from Abroad. From the perspective of power network theory, this study finds that the ideological network based on Islamic legal values dominates community solidarity. Meanwhile, economic, political, and military networks struggle to balance resource distribution and harmonising local and international policies. The scientific contribution of this research lies in its discovery that Islamic and local values dominate other power networks in refugee management in Aceh. The study recommends the formulation of a qanun on refugee management that aligns with local values as a model for similar contexts in other regions

Abstract

This research focuses on the October 2023 conflict between Israel and Hamas, analyzing violations of international law committed by both parties under the 1949 Geneva Conventions. Using a qualitative document-based approach, the study investigates actions taken by Israel and Hamas during the first ten days of the conflict. It examines the jus ad bellum and jus in bello violations, such as Hamas's unprovoked attacks on Israeli civilians and Israel's disproportionate retaliatory strikes in Gaza. Both parties violated the Geneva Conventions: Hamas breached Article 51 by launching attacks without declaring war and targeting civilians. In contrast, Israel's retaliations violated the principle of proportionality by causing excessive civilian harm. Israel's blockade of Gaza also violated humanitarian law, as it denied civilians access to essential goods. The research identifies legal obligations under international law, noting that while Israel is a state party to the Geneva Conventions, Hamas, as a non-state actor, is bound by customary international law. The study concludes that both sides committed war crimes, requiring legal accountability through international mechanisms. The findings contribute to ongoing discussions about the challenges of enforcing international law in asymmetrical conflicts involving state and non-state actors.KEYWORDS: International law, Justice of war, Israel-Palestine dispute, Use of force.

Abstract

In this paper, the researcher analyses and explains polygamy as a form of domestic violence from the perspective of positive Indonesian law and how it critiques Law No. 1 of 1974 on Marriage by examining Law No. 23 of 2004 on the Elimination of Domestic Violence in Indonesia. Using a literature review, this study found that polygamy carried out without fulfilling the conditions stipulated in the marriage law and Islamic Law Compilation (KHI) can be a form of domestic violence. This is because polygamy committed without the first wife's consent and without regard to the family's welfare can cause injustice and imbalance in the husband-wife relationship and damage the family concerned. Polygamy cases, if associated with Law No. 23 of 2004 concerning the elimination of domestic violence, are a form of psychological violence that can be criminalised and charged with Domestic Violence Law No. 23 of 2004, specifically Article five, which states that "every person is prohibited from committing acts of domestic violence against persons within the scope of their household, whether committed directly or indirectly, to cause pain or misery or suffer physically, sexually, psychologically, and or domestic neglect, including domestic neglect". The criminal penalty can be imprisonment of up to three years or a fine of up to 9 million rupiahs. Suppose the psychological attack causes illness or prevents the victim from doing their job to the extent that their daily activities are disrupted. In that case, they can face imprisonment of up to four months or a fine of three million rupiahs.

Abstract

This paper discusses the implementation of Islamic family law in Indonesia's marriage law regarding the right to choose a partner for women with the main problem explaining how the interrelationships of the values ​​of Islamic family law are absorbed in Indonesian laws. Utilizing a literature study whose primary data sources come from books, journals and statutes, this research finds that Indonesia, as a country known for its Muslim majority and having many ethnicities and cultures, also adopts the principles of equality in Islam implemented in Marriage Law No. 1 of 1974 is included in the realm of choosing a mate for women. As stipulated in UUP No. 1 of 1974 concerning the conditions for marriage regulated in Article 6 Paragraph 1, namely that there must be the consent of the bride, meaning that the woman is willing to be married by a man who wants to marry her without any coercion. What is contained in Article 6 Paragraph 1 UUP No. 1 of 1974 is in line with the mission of Islam, namely the principle of equality for women. This aims to build a happy and eternal household and of course in line with human rights.

Abstract

This research examines the representation of feminism and women's empowerment in "One Piece," specifically on Amazon Lily Island, as depicted in episodes 408 to 421 of the anime series. This study employs a literature review and a qualitative research approach with a descriptive-analytical method to investigate how Amazon Lily Island, as a matriarchal society, embodies feminist values through the independence, strength, and solidarity of its women. Unlike previous studies focusing on feminist characters in films and television series, this research emphasizes the distinctiveness of Amazon Lily Island in the "One Piece" narrative, reflecting key themes such as gender, power, and matriarchy. The findings reveal that the island's female characters, especially Queen Boa Hancock, epitomize strong and autonomous female archetypes yet grapple with the paradox of power and vulnerability. This study enriches the literature on feminism in media, particularly in anime, and discusses how the Amazon Lily Island narrative contributes to a broader understanding of women's empowerment and the challenges they encounter in a patriarchal society.

Abstract

The resurgence of Maqāṣid al-Sharī’ah discourse in contemporary Islamic studies is often positioned as a flexible bridge between divine values and the aspirations of modernity. It is hailed as an ethical framework capable of harmonizing Islamic legal tradition with the principles of social justice, human rights, and democracy. However, behind this euphoria lies a critical issue concerning how Maqāṣid is produced, claimed, and disseminated as a discourse imbued with various interests. This study aims to deconstruct the discourse of Maqāṣid in recent Islamic scholarship by tracing its shift from a normative analytical tool to an ideological instrument that often blurs the line between interpretation and political legitimization. This research was conducted through a literature study employing a descriptive-analytical-exploratory qualitative approach, utilizing Norman Fairclough’s Critical Discourse Analysis (CDA) as the analytical framework. The findings reveal that Maqāṣid is utilized not only to interpret Islamic law but also to reframe social reality through normative narratives that appear universal yet carry specific ideological underpinnings. In academic practice, it has evolved into an epistemic commodity that affirms liberal agendas without necessarily adhering to the rigorous methodologies of Islamic scholarship. In the political sphere, it functions as a rhetorical ornament of the nation-state to gain ethical legitimacy for policies that may not reflect the substantive values of Sharī’ah. Through the lens of CDA, this study positions Maqāṣid not merely as an interpretive tool but as a discursive practice that reflects power relations in the production of contemporary Islamic knowledge. Thus, this research offers not only a critique of the Maqāṣid euphoria but also calls for the restoration of a more reflective, open, and historically conscious discursive space in the development of an honest and resilient Islamic epistemology.

Abstract

Modern life often requires family members to live apart due to work or educational obligations, presenting challenges for effective parenting. This study examines strategies to optimize child-rearing in the context of physical separation by integrating Maslow’s hierarchy of needs with the principles of Maqāṣid Syarīʿah. Using a qualitative, descriptive-analytical approach, the study draws on a range of scholarly sources, including journals and books. The findings demonstrate that children’s essential needs—physiological, safety, love, esteem, and self-actualization—can still be met through consistent, technology-mediated communication, such as video calls and messaging. The involvement of extended family or caregivers also plays a critical role in supporting children’s daily needs. Maslow’s framework emphasizes structured emotional support, while Maqāṣid Syarīʿah highlights the preservation of religion, life, intellect, lineage, and property. Together, these frameworks offer a comprehensive model for distant parenting. The study concludes that effective parenting across distances is achievable through intentional collaboration, the appropriate use of digital tools, and alignment with both psychological and spiritual development goals.

Abstract

This study investigates how the concept of nafaqah is interpreted and applied in Muslim societies and how women's financial rights have been recognized and protected within the framework of Islamic law. The study utilizes the library research method as one of the main approaches to collecting relevant data and information from various perspectives and viewpoints. The analysis shows that although the concept of nafaqah is regulated in Islamic teachings, its implementation often does not reflect the principles of gender equality and economic justice. In addition, women's right to financial support is also an integral part of creating gender equality in society. These rights include women's inheritance rights, property ownership, and equal access to economic opportunities. As such, there is a need for concrete measures to strengthen the protection of women's financial rights in Muslim societies. This includes legal reforms recognizing women's economic rights equally, raising public awareness about the importance of gender equality in nafaqah, and promoting harmonization between the concept of nafaqah and women's economic rights.
