ABSTRAKKasus kekerasan seksual di era digital semakin meningkat sering dengan majunya perkembangan teknologi. Sayangnya, masih banyak pihak yang menyalahgunakan perkembangan teknologi tersebut hingga pada akhirnya merugikan beberapa pihak dan menyebabkan jatuhnya korban. Kasus kekerasan seksual meningkat di era digital, yang menjadi sumber keprihatinan. Namun demikian, banyak upaya dapat dilakukan. Pencegahan kekerasan seksual dan mengakhiri kekerasan seksual memerlukan tanggung jawab individu dan sosial serta tindakan pemerintah. Pemerintah perlu mengambil langkah dalam mencegah dan merespon kekerasan seksual perempuan. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan pendekatan perundang-undangan yang mencakup kajian terhadap semua peraturan perundang-undangan yang berkaitan dengan masalah hukum yang dihadapi. Hasil dari Penelitian ini menunjukkan bahwasanya terdapat 2 bentuk kekerasan seksual di media sosial, diantaranya seperti kekerasan seksual secara langsung dan kekerasan seksual secara tidak langsung. Untuk kekerasn seksual yang dilakukan secara eksplisit dapat berupa Berbagi gambar atau video porno tanpa persetujuan; Eksploitasi dan pengancaman; Penindasan Seksual; Komentar berbau seksual; Pendekatan untuk memperdaya (cyber grooming): Peretasan (hacking); Konten ilegal (illegal content); Pelanggaran privasi (infringement of privacy); Pencemaran nama baik (online defamation);dan Rekrutmen online (online recruitment). Sedangkan Kekerasan seksual implisit dapat dikomunikasikan secara langsung atau tidak langsung melalui pernyataan yang menghina tentang seksualitas atau lelucon berorientasi seksual, permintaan bantuan seksual dari pelaku, dan kata-kata atau perilaku yang berkonotasi seksual.

It's been almost a year since WHO declared Covid-19 to be a pandemic, this outbreak has infected almost all countries in the world and has affected various sectors. As a rule of law, Indonesia issued various legal products to deal with the impact of the Covid-19 Pandemic, especially from the health and economic sectors. This article will explain what legal products the government has formed to deal with pandemics and discuss the problems of legal products that apply in dealing with pandemics. The research method used in this study is Normative Juridical with a conceptual approach, statutory approach and comparative approach. This research will evaluate the legal products formed by the government because there are problems such as disharmony, in addition to another problem, namely the formation of laws formed by the House of Representatives together with the government which have no connection with the acceleration of the handling of the Covid-19 pandemic and are considered to be negligent. to the sense of crisis. One of the recommendations that can be implemented by the Government is to focus on establishing laws and regulations related to the handling of the Pandemic and evaluating the laws and regulations made in the context of handling the Pandemic in the past year.

Restitution has become a representative of the development of the criminal justice system in Indonesia, with its foundation relying on the eligibility of the rights of crime victims. Such a practice is said to have made the criminal justice system in Indonesia more humane, particularly in terms of human rights. The provision of restitution to victims of criminal acts resulting in death has occurred in Indonesia for the first time. This is based on the presence of severe human rights violations in these criminal acts. This research employs a normative-empirical method, which involves examining the implementation, application, or enforcement of the prevailing laws and regulations in Indonesia in specific legal events within the community. The balance between fulfilling the rights of both the perpetrators and the victims in criminal acts in Indonesia is increasingly pursued over time, one of which is through restitution. Restitution can be one of the efforts made to fulfill victims' rights, including in cases of murder or violence that causes the victim's death. But, it is challenging to determine an appropriate nominal amount for fulfilling restitution for victims. There is a need for a deeper examination and evaluation of the losses suffered by victims of criminal acts who have lost their lives and their right to life. Thus, the provision of restitution as a means of achieving justice for victims will be better fulfilled.

Initially, the marriage process begins with a marriage agreement or what is called a pre-nup. The academic anxiety that can be found is related to the issue of marriage agreements, namely that there is a conflict of norms. This is indicated by the Constitutional Court's decision in its decision confirming that notary officials are given the authority to ratify marriage agreements. Meanwhile, in Law Number 2 of 2014 concerning Amendments to Law no. 30 of 2004 concerning the Position of Notaries, where in this law there are no provisions governing the authority of a notary to ratify marriages made by the parties during the marriage period, so that notary officials do not have a strong legal reason as a basis for making a marriage agreement. The problem formulation in this research is First, What is the Essence of a Marriage Agreement according to Positive Law in Indonesia? Second, what is the form of legal protection for notary officials in Marriage Agreements made after marriage? Third, how can the formulation of a marriage agreement made during the marriage period provide legal certainty? The method used is the normative juridical method. The results of this research are that a marriage agreement was made before and during the marriage. Apart from that, if there is no prior marriage agreement, then the original assets or assets acquired during the marriage do not have permission for those assets (joint assets). Apart from that, the notary is authorized to make an agreement if it must comply with the terms of the validity of the agreement and if it does not comply with the terms of the validity of the agreement it will be canceled by the judge. This can certainly provide legal certainty for notaries.

This article explores the conflict between Land Management Rights (HPL) and Customary Rights and analyzes its implications in the context of Government Regulation (PP) 18/2021 in Indonesia. The analytical focus encompasses the origins of the conflict, its details within the legal framework, and the identification of root issues that trigger field tensions. The research methodology involves legal document analysis, case studies, and interviews with relevant stakeholders. The study also evaluates the impact of the implementation of PP 18/2021 on the conflict and its implications in legal, social, and environmental dimensions. The research findings provide crucial insights for policymakers, stakeholders, and the community, supporting the understanding of the HPL and Customary Rights conflict and seeking sustainable solutions. Critical analysis underscores the necessity for a review of existing regulations to accommodate the traditional rights of local communities, preserve environmental sustainability, and reduce the potential for conflict within a more inclusive legal framework.

Nowadays the world has often labeled as the 4.0 era, humans can reach almost everything at the snap of a finger. The development of information technology has penetrated all lines of life, including the law enforcement. The judiciary system as the main forum for the law enforcement process is also have to adapt, if not to do so, the judiciary system may be deemed as a failed system. The enactment of Supreme Court Regulation Number 1 of 2009 became the sign of electronic litigation era in Indonesia. However, long before that the Supreme Court has already improved the judiciary system electronically, because “judiciary system” not only means the litigation process but other process includes the case administration. Writer in this paper will discuss on what are the improvements that Supreme Court have made on judiciary system and further to analyze normatively on whether such improvement may support the fulfillment of judiciary principle especially the principle of fast, simple and low-cost proceeding, or otherwise whether such improvement only bring other problems into the existing system.

In Indonesia, the control function of the House of Representatives (DPR) includes interpellation rights, inquiry rights and the right to express opinions. In 2017, the DPR's inquiry rights to the Corruption Eradication Commission (KPK) were considered unconstitutional because the law did not include the KPK as the object of the inquiry mechanism. However, the Constitutional Court (MK) in Decision Number 36 / PUU-XV / 2017 defined KPK as an executive so that this institution can be monitored through the inquiry mechanism. This court's decision, however, contradicts to the four previous decisions which classified KPK as an independent institution. This article examines the validity of the DPR's inquiry rights to the KPK by considering the DPR's inquiry rights as a form of a mechanism for mutual checks and balances to the other state institutions. In practice, there are both formal and material rules that must be fulfilled so that their implementation is legally valid and the DPR's inquiry rights to the KPK in cases of the electronic KTP corruption ignore these conditions. This article recommends that the DPR be careful when using inquiry rights as a monitoring mechanism. Keywords: Inquiry rights, House of Representatives, Corruption Eradication Commission

A covernote is a statement letter containing the notary's ability to carry out what the debtor wants. The notary has full responsibility for the contents contained in a cover note. Covernotes are not textually part of the authority of a Notary, this is interesting to study in more depth regarding the form of notary responsibility for the covernote that has been made. The research method used in this research is a normative juridical method. The conclusion obtained is that covernotes are not part of the authority of a notary as regulated in the Law on the Position of Notaries, but are a habit that grows and develops in society and is made into customary law. So that the notary's responsibility regarding the covernote that is made can be called for criminal, civil or moral sanctions imposed by the community.

The criminal law paradigm has begun to change since the emergence of the new Criminal Code (KUHP), where criminal punishment is emphasized not only as retaliation but also as recovery. Diyat punishment is one solution to restore victims. By giving property to the victim, you can make the victim's life easier financially. However, it is different from the diyat punishment for perpetrators of murder, not torture, which in this case has a perspective from the view of Islamic inheritance law. How is the diyat punishment given to the victim who is the heir of the murder victim from the perspective of Islamic inheritance law? This research uses normative legal research methods, namely by examining legal norms regarding diyat punishment from the perspective of Islamic inheritance law. Meanwhile, this research approach uses a statutory approach and a case approach related to diyat punishment. The results of research into the diyat punishment which should be the victim's right will be transferred to the victim's heirs considering that the victim has died as a result of murder. The concept of diyat punishment from the perspective of Islamic inheritance law is one of the appropriate solutions and is in accordance with the principles of the new Criminal Code.

The Job Creation Law contains various changes to the Environmental Protection and Management Law, one of which is the public's right to access environmental information. This can be seen in Article 22 of the Job Creation Law which amends Article 26 paragraph (2) of the Environmental Protection and Management Law, which stipulates that the public, especially environmental observers, must be involved in every activity carried out by business actors or activities, by providing open and complete information before the activity is carried out. The concept of Business Licensing in the environmental sector regulated in the Environmental Protection and Management Law using a permit-based approach has been changed to the application of standards and risk-based in Law Number 6 of 2023 concerning Job Creation, this means that the granting of permits will be carried out by the central government based on calculations of the level of danger and the potential value of danger to aspects of health, safety, the environment and/or utilization of resources. In addition, there is also the loss of participation of the affected community in all forms of decisions in the Environmental Impact Analysis (AMDAL) process which previously involved potentially affected communities, now only involving directly affected communities.
