Abstract

Technological advances in the field of the internet and its supporting ecosystem have changed human lives. The way humans communicate, transact, trade and play games has changed massively. Along with the progress of the internet ecosystem, it has led to the emergence of trading platforms, both webservices and smartphone applications. Developments that change how people trade and pay for trade transactions cause vulnerabilities that can be used by criminals or to commit criminal acts. Criminal acts of fraud, unauthorized use of personal data, bribery through e-commerce media, and money laundering are criminal acts that have emerged along with the rampant use of e-commerce. Various methods of money laundering can be done using e-commerce media. One of the mitigations that can be done by the Government is to classify e-commerce media as a Reporting Party in the anti-money laundering regime.

Abstract

Kewenangan pengujian peraturan perundang-undangan (judicial review) yang sama-sama diberikan kepada Mahkamah Konstitusi (MK) dan Mahkamah Agung (MA) menimbulkan problematika khusus di dalam sistem kekuasaan kehakiman di Indonesia. Permasalahan tersebut terlihat jelas utamanya dalam implementasi kewenangan baik yang dimiliki MK maupun MA, sebagaimana tidak jarang norma hukum yang dihasilkan oleh putusan MK dan MA saling bertolak belakang. Dengan menggunakan metode penelitian yuridis normatif, artikel ini berupaya untuk mendiskusikan bagaimana kekuatan mengikat putusan pengujian undang-undang pada MK terhadap putusan pengujian peraturan perundang-undangan di bawah undang-undang pada MA. Selain itu artikel ini juga hendak memberikan gambaran bagaimana menyelesaikan problematika pertentangan putusan antara pengujian peraturan perundang-undangan dibawah undang-undang pada MA dan pengujian undang-undang pada MK. Artikel ini berkesimpulan bahwa perlu dilakukan integrasi pengujian satu atap peraturan perundang-undangan dibawah MK. Puncaknya, artikel ini merekomendasikan untuk melakukan sinkronisasi dan harmonisasi dengan cara melakukan perubahan terhadap UUD NRI 1945, Undang-Undang Kekuasan Kehakiman, Undang-Undang MA dan Undang-Undang MK.

Abstract

Indonesia is a state based on laws and regulations which are formed as basic rules in the state and society. The law as the main basis must be formed in accordance with the principles of establishing good laws and regulations so that it is hoped that later it can be applied and has binding legal force for all levels of society. The current situation is far from expectations for the formation of a good law, for example the formation of a job creation law which is considered not to actively involve the community, many articles are contrary to legal principles, are harmonized and synchronized between statutory regulations, the formation of laws that seem rushed so there are many errors in writing (typo) and much more. Therefore, it is necessary to reconstruct stages in order to at least achieve the desired expectations in the formation of a good law. This paper uses normative research with a statutory approach, a comparative approach, and finally concludes with a conceptual approach where concepts that are considered suitable can be applied in Indonesia. 2 things that become important highlights in this paper are First, the practice of harmonization, synchronization and consolidation of conceptions that have been well implemented but only exist at the planning and drafting stages of the Draft Law, while after the discussion/Mutual agreement (plenary) there are great opportunities regarding changes the changes that occurred which made it very possible for the disharmony and synchronization of the bill to be ratified, then secondly, the issue of public participation which seemed to be a complementary ingredient in the formation of the law, therefore this paper provides the best solution for reviewing (preview) a bill before it is passed so that there is a review. harmonization and also means of education, consultation and publication of pre-ratification and promulgation of laws to be ratified

Abstract

Saat debat Pemilihan Presiden dan Wakil Presiden 2019 Pasangan Joko Widodo dan Ma’ruf Amin menjanjikan membentuk  lembaga khusus untuk mengurus pembentukan regulasi. Ide tersebut perlu dikaji urgensinya maupun fungsinya dalam rangka meningkatkan kualitas regulasi di Indonesia. Melalui penulisan gagasan kritis konseptual dengan menggunakan pendekatan yuridis normatif diketahui bahwa urgensi mengadopsi lembaga khusus adalah pertama, tersebarnya tahapan pembentukan perundang-undangan ke berbagai institusi menyulitkan untuk memastikan rancangan peraturan perundang-undangan mendukung tujuan pembangunan pemerintah. Kedua, ketiadaan wewenang lembaga pemerintah untuk melakukan penilaian kebutuhan pembentukan regulasi baru telah memunculkan obesitas regulasi. Ketiga,untuk menindaklanjuti Pasal 95A UU 15/2019 yang telah mengakomodir adanya pemantauan dan peninjauan terhadap Undang-Undang. Keempat, pasca putusan MK yang membatalkan kewenangan pemerintah membatalkan Perda perlu strategi baru untuk memastikan agar Perda tidak melanggar peraturan perundang-undangan yang lebih tinggi. Fungsi utama lembaga khusus ini ada 3 yaitu melaksanakan perencanaan regulasi yang sesuai dengan perencanaan pembangunan, harmonisasi rancangan regulasi dengan regulasi lainnya, dan melakukan pemantauan dan evaluasi terhadap regulasi yang berlaku. Saran penulisan ini agar pemerintah segera melaksanakan perintah UU 15/2019 dengan membentuk kementerian atau lembaga khusus di bidang pembentukan Peraturan Perundang-undangan. Selanjutnya melakukan revisi lagi UU 12/2011 dengan mengatur lebih lengkap fungsi kementerian/lembaga khusus tersebut.

Abstract

Abstract Background: Some of the problems in the criminal process in court include the accumulation of settlement of criminal cases and the bureaucracy of a long trial The Plea Bargaining concept that has been implemented in the United States can be adopted in Indonesia while considering the values of Pancasila based on integrative theory (integratif theory) and the theory of dignified justice (keadilan bermartabat theory). Research Metodes: The research method used is normative juridical. This research uses a conceptual approach, a statutory approach, a comparative approach and a historical approach. Findings: The results of this research involve the reformulation and explanation of the ontological, epistemological, and axiological aspects of the concept of plea bargaining. There are provisions in the Draft Criminal Procedure Law that do not yet reflect the concept of plea bargaining. Reformulation of the concept of plea bargaining is based on the theory of dignified justice (keadilan bermartabat theory), so that the creation of the purpose of the law of dignified justice that is rooted in the values and the national spirit or the soul of the nation (volksgeist). Conclusion: By adopting the concept of plea bargaining that has been formulated based on dignified justice, it can solve the problem of stacking criminal case settlement in courts and trial bureaucracy and as a form of Criminal Procedure Law Reform in Indonesia. Abstrak Latar Belakang: Sebagian permasalahan dalam persidangan pidana di pengadilan antara lain penumpukan penyelesaian perkara pidana dan birokrasi persidangan yang cukup lama. Konsep Plea Bargaining yang telah diterapkan di negara Amerika dapat di adopsi di negara Indonesia dengan tetap mempertimbangkan nilai-nilai Pancasila berdasarkan teori integratif dan teori keadilan bermartabat. Metode Penelitian: Metode penelitin yang digunakan adalah yuridis normatif. Penelitian ini menggunakan metode pendekatan konseptual (conceptual approach), pendekatan perundang-undangan (statute approach), pendekatan perbandingan (comparative approach) dan pendekatan historis (historical approach). Hasil Penelitian: Hasil penelitian ini adalah mereformulasi dan menjelaskan aspek ontologi, epistimologi dan aksiologi konsep plea bargaining. terdapat pasal di Rancangan Hukum Acara Pidana yang belum mencerminkan konsep plea bargaining, reformulasi Konsep plea bargaining yang berbasis teori keadilan bermartabat dapat diejawantahkan dalam Rancangan Hukum Acara Pidana. Reformulasi konsep plea bargaining ini berdasarkan teori keadilan bermartabat, sehingga terciptanya tujuan hukum yaitu keadilan bermartabat yang berakar pada nilai-nilai dan semangat nasional atau jiwa bangsa (volksgeist). Kesimpulan: Dengan mengadopsi konsep plea bargaining yang telah direformulasi berbasis keadilan bermartabat dapat menyelesaikan permasalahan penumpukan penyelesaian perkara pidana di Pengadilan dan birokrasi persidangan serta sebagai bentuk pembaruan hukum acara pidana di Indonesia. Abstract

The principle of equality before the law, as an integral part of the rule of law doctrine that is often applied by developing countries such as Indonesia, is an important key in creating justice, especially in the context of implementing restorative justice in law enforcement in certain cases. Although this concept does not eliminate criminal sanctions, the importance of restoring losses and reconciliation between perpetrators and victims is the main focus in determining the appropriate punishment, which is in line with the principle of the principle of equality before the law. The results of the study are that the principle of equality before the law is used as a reference for standardization in the paradigm of restorative justice law against the judge's decision trying the defendant Galan Julianda Bin Z Bulungan, it is seen that the judge used the teachings of restorative justice as a guideline in sentencing the defendant. The teachings of restorative justice are seen as restoring the relationship between the perpetrator and the victim, as well as an act of atonement by the perpetrator of the crime. The principle of equality before the law as one of the principles in law that is important in implementing the Galan Julianda Bin Z Bulungan Case, the construction of restorative justice in the judge's decision is a significant change in the paradigm of criminal law.

Abstract

The purpose of this article is to analyse the revocation of the political right of former convicts to candidacy as public officials in the Indonesian context based on positive law and decisions of the Indonesian Constitutional Court. In addition, this article aims to conduct a comparative study analysis of the issue, namely, between the arrangements in Indonesia and those in the United States and Australia. In Indonesia, everyone has the right to stand as a candidate for public office, including former prisoners, with certain conditions in accordance with positive law. However, the matter of revoking the political rights of former convicts remains a matter of debate, especially before the General Election. The Constitutional Court affirmed that the political right of former convicts to hold elected public office must fulfil several requirements. The political rights of former convicts are still guaranteed, but there are certain limitations. In Australia and the United States, the political rights of former convicts are also maintained, but with exceptions for some instances, such as corruption or treason against the state. Looking at the existing debate, it is necessary to safeguard civil and political rights universally, while paying attention to the specific cases that underlie the prohibition on former convicts from running for public office.KEYWORDS: Elections, Political Rights, Former Convicts.

Abstract

Digital transformation has emerged as a crucial component of Indonesia’s national development strategy, recognized for its capacity to stimulate economic growth, enhance public services, and improve social welfare. However, the current approach tends to be technocratic, often overlooking vital legal, institutional, and justice-related issues. This study critically assesses examine the adequacy and coherence of Indonesia’s legal and institutional frameworks governing digital transformation to promote inclusive economic growth and social welfare. It identifies regulatory and institutional gaps and recommends strategic reforms for equitable digital governance. Employing a socio-legal methodology that merges doctrinal legal analysis with interdisciplinary insights from political science, economics, and sociology, this research evaluates key legal instruments and institutional practices, alongside global best practices, to determine Indonesia’s readiness for digital transformation. The findings indicate that Indonesia’s progress is hampered by fragmented and reactive legal frameworks, notable regulatory gaps—particularly in data protection and labor rights within the gig economy—and weak institutional coordination. These issues lead to policy inconsistencies, implementation delays, and the exacerbation of existing inequalities. To address these challenges, this study advocates for a systemic reconfiguration of digital governance grounded in democratic principles and inclusive participation. It proposes six strategic pillars: infrastructure, digital human capital, business climate and cybersecurity, research and innovation, funding and investment, and robust legal-regulatory frameworks, to ensure a just and sustainable digital transition.

Abstract

Perkembangan ekonomi dan teknologi yang pesat pada era Industri 5.0 menuntut adanya lulusan hukum yang tidak hanya memahami hukum secara teknis tetapi juga memiliki keterampilan kewirausahaan dan teknologi. Program LawPreneur merupakan suatu langkah strategis untuk mencetak lulusan hukum yang memiliki keahlian tambahan dalam bidang bisnis berbasis hukum dan teknologi. Program ini bertujuan untuk menjembatani kesenjangan antara kemampuan lulusan hukum dan kebutuhan pasar akan profesional hukum yang siap bersaing, dan berinovasi di sektor legal-tech. Dalam beberapa tahun terakhir, lulusan hukum dihadapkan pada tantangan baru di pasar kerja. Selain peran tradisional seperti advokat, jaksa, atau hakim, muncul kebutuhan terhadap peran inovatif seperti konsultan hukum bagi bisnis teknologi, pengelola startup hukum, dan profesional hukum di perusahaan digital. Sebagai respons, Program LawPreneur menawarkan pendidikan yang mengintegrasikan hukum, kewirausahaan, dan teknologi, didukung oleh mitra-mitra bisnis, salah satunya HeyLaw. Melalui pelatihan dan magang, mahasiswa mendapatkan pengalaman praktis dalam mengelola bisnis hukum berbasis teknologi. Penelitian ini bertujuan untuk menganalisis konsep dan implementasi Program LawPreneur di fakultas hukum dalam membentuk profil lulusan yang kompeten dalam kewirausahaan hukum berbasis teknologi, serta mengidentifikasi arah pengembangan LawPreneur untuk meningkatkan daya saing lulusan di dunia kerja dan memenuhi kebutuhan industri 5.0.  Metode yang digunakan adalah penelitian kualitatif untuk memperoleh pemahaman menyeluruh tentang pelaksanaan program. Teknik pengumpulan data meliputi wawancara mendalam, observasi partisipatif, dan studi dokumentasi. Analisis dilakukan secara kualitatif interaktif, dengan memvalidasi data melalui triangulasi sumber. Luaran yang diharapkan dari penelitian ini mencakup rekomendasi strategis bagi pengembangan Program LawPreneur, peningkatan keterampilan lulusan, dan pemetaan kompetensi yang sesuai dengan kebutuhan industri 5.0. Penelitian ini selaras dengan roadmap Riset Unggulan UNEJ yang berfokus pada daya saing lulusan dan kesiapan menghadapi era digital.

Abstract

Indonesia mendapatkan bonus dan tantangan sebelum menuju Indonesia emas pada saat genapberumur 100 tahun pada 2045. Tantangan yang dihadapi oleh Indonesia dalam mempersiapkanbonus demografi ini juga cukup besar. Salah satunya adalah masuknya paham radikalisme danideologi anti Pancasila di Indonesia. Tantangan tersebut bukan hanya menjadi tanggung jawabpemerintah untuk menyelesaikannya namu juga seluruh lapisan masyarkat. Menghadapi bonusdemografi ini, seluruh lapisan manusia Indonesia harus melihat bahwa diperlukan sebuahpenguatan nilai-nilai Pancasila agar menjadi sebuah ideologi yang hidup. Penguatan nilai-nilaikepada generasi muda Indonesia harus dengan cara-cara yang kreatif, kontekstual dan tetapberlandaskan pada akar budaya Indonesia.
