Abstract

The Job Creation Law contains various changes to the Environmental Protection and Management Law, one of which is the public's right to access environmental information. This can be seen in Article 22 of the Job Creation Law which amends Article 26 paragraph (2) of the Environmental Protection and Management Law, which stipulates that the public, especially environmental observers, must be involved in every activity carried out by business actors or activities, by providing open and complete information before the activity is carried out. The concept of Business Licensing in the environmental sector regulated in the Environmental Protection and Management Law using a permit-based approach has been changed to the application of standards and risk-based in Law Number 6 of 2023 concerning Job Creation, this means that the granting of permits will be carried out by the central government based on calculations of the level of danger and the potential value of danger to aspects of health, safety, the environment and/or utilization of resources. In addition, there is also the loss of participation of the affected community in all forms of decisions in the Environmental Impact Analysis (AMDAL) process which previously involved potentially affected communities, now only involving directly affected communities.

Abstract

A terrorist group called the Papuan Armed Criminal Group (KKB) located in Papua Province. KKB was formerly known as the Free Papua Organization (OPM) which was founded in 1965 with the aim of breaking away from Indonesia (committing separatist acts) and making various efforts to conduct a referendum in order to become independent from the Unitary State of the Republic of Indonesia. This Normative Legal Research Method is an internal research in the discipline of law that uses sources of legal material in the form of laws and regulations, court decisions / decrees, contract agreements, contracts, legal theories and opinions of scholars. The 1945 Constitution and humanitarian law also accommodate the protection of civilians in conflict areas. This basic principle upholds the basic principle of respect for individuals, as well as the protection of human rights victims. The Special Autonomy Law is considered a strategic policy in order to improve services, accelerate, develop, and empower all people in the Papua region. One of the obligations that must be fulfilled by the State is the protection of every citizen. Indonesia as a country that upholds human rights should protect all its citizens, not only fulfilling obligations, the state has also fulfilled the human rights of its citizens. The government has adopted several policies, one of which is Law Number 21 of 2001 concerning Special Autonomy for Papua, also known as Otsus Papua.

Abstract

Putusan perkara pidana merupakan keputusan yang dijatuhkan oleh pengadilan terhadap pelaku tindak pidana atau kejahatan. Sesuai dengan ketentuan hukum acara pidana yang berlaku di Indonesia, terdapat 3 (tiga) jenis putusan yang dapat dijatuhkan kepada terdakwa antara lain keputusan untuk membebaskan terdakwa, melepaskan terdakwa, atau menjatuhkan pidana. Jenis putusan yang akan dijatuhkan kepada terdakwa, selain mengacu pada ketentuan hukum acara pidana mengenai jenis-jenis putusan juga didasarkan pada hasil pemeriksaan terhadap bukti-bukti dan fakta-fakta yang terungkap selama persidangan. Namun pasca disahkannya Undang-Undang Nomor 1 Tahun 2023, ketentuan hukum pidana Indonesia mengatur mengenai asas rechterlijk pardon. Dimana hakim diberikan kewenangan untuk tidak menjatuhkan pidana atau tidak menjatuhkan tindakan kepada terdakwa meskipun dia telah terbukti melakukan tindak pidana. Kewenangan yang demikian dapat menimbulkan permasalahan baru terutama jika asas rechterlijk pardon di implementasikan dalam putusan perkara pidana yaitu tidak adanya jenis putusan yang sesuai dengan substansi asas tersebut. Berdasarkan latar belakang tersebut, penulis tertarik untuk membahas lebih lanjut mengenai Implikasi Penerapan Asas Rechterlijk Pardon Dalam Putusan Perkara Pidana Ditinjau Dari Perspektif Kepastian Hukum.

Abstract

The existence of the Constitutional Court in the life of the nation and state is in order to guarantee and prove the existence of positive law, especially laws, so that these laws remain in accordance with the constitution so that later the constitutional rights of citizens can be maintained. The purpose of this research is as evaluation material and learning material for law enforcers, students and other parties. This type of research is included in the juridical-normative category, namely research carried out by examining theories, concepts, legal principles and regulations that are appropriate and related to the object of research. The Constitutional Court decision that has been issued against Anwar Usman cannot be challenged in the State Administrative Court because the Constitutional Court's decision is not a state administrative decision so it does not fall within the scope of what can be litigated in the state administrative court. Another reason that could be the basis for approval or inaccuracy of the State Administrative Court's lawsuit in relation to the Constitutional Court's decision is related to the ad hoc nature inherent in the Constitutional Court. Compliance with ethical standards in the decision-making process in law enforcement agencies is a crucial element in maintaining the trust and reputation of state administration in the eyes of the public. The presence of ethical standards in the Constitutional Court is considered the basis for upholding constitutional principles which are moral and behavioral guidelines for all members of the judiciary.

Abstract

Penerapan "putusan nihil" oleh hakim di Indonesia menciptakan ketidakpastian hukum dan moralitas dalam pengadilan, sebuah permasalahan yang perlu diatasi dengan pendekatan yang lebih komprehensif daripada mengandalkan kepastian hukum semata. Dalam konteks ini, prinsip-prinsip filosofis yang lebih luas seperti yang disampaikan oleh Dworkin menjadi relevan. Penelitian ini mengkaji sudut pandang filasafat hukum dalam eksistensi putusan nihil. Di satu sisi, sebagai produk interpretatif kewenangan hakim, putusan nihil dikaji melalui pemaparan filosofis milik Dworkin. Penelitian ini mengevaluasi putusan nihil dengan memeriksa dasar hukumnya dan menggunakan pendekatan peraturan perundang-undangan serta konseptual. Selain itu, penelitian ini mengkaji konsep hukum interpretatif dalam hukum civil law dan memanfaatkan konsep filsafat hukum Ronald Dworkin. Studi ini bertujuan untuk menganalisis eksistensi putusan nihil dalam kerangka hukum sipil serta menguji validitasnya dengan konsep Ronald Dworkin. Eksistensi putusan nihil berasal dari ketidakmampuan sistem hukum Indonesia dalam menangani permasalahan teknis. Kewenangan interpretatif hakim menjadi solusi, yang lambat laun menjadi praktek lazim. Hal ini menciptakan paradoks antara karakteristik civil law dan common law di Indonesia. Ketidakpastian muncul dalam penerapan hukum dan pertimbangan etika dalam hukuman pemidanaan yang adil, menimbulkan dilema prioritas di mana putusan nihil sering kali lebih mengutamakan kepastian hukum daripada kebenaran materiil. Penelitian ini menemukan putusan nihil sebagai jawaban dari celah sistemik sistem hukum Indonesia yang berkarakter civil law. Dalam sudut pandang teori Dworkin, putusan nihil menjadi suatu dilema prioritas antara kepastian hukum dalam system hukum civil law, dengan kebenaran materiil. Abstract

Equality before the law is one of the most important and powerful principles in Indonesia's system of law enforcement. As a law-abiding state, certainly the application of this principle illustrates that every citizen has the same degree or position in the law without exception. The law presented no distinction for any party, it was expressly explained in chapter 27 of the verse (2) the 1945 law. The study aims to see if there is a link between the principle of equality before the law and Indonesia's criminal justice system and how it applies. In writing the study using the normative type of legal study method using the research approach: a legal approach, a conceptual approach and compartive approach. From this study, the conclusion is that the implemntation of equality before the law must be interpreted dynamically, not statically, both in Indonesia and other countries. This means that Indonesia, Jerman and Belanda view that equality before the law must be harmonized with the same treatment for everyone. Justice carried out by the state must provide benefits to all people, and the ask of law is to maintain justice so that it can reach all people without exception. Everyone has the same acces to justice regardless of whether they are rich or poor.

Abstract

The Criminal Procedure Code (KUHAP) and the Attorney General's Act give the public prosecutor and the Attorney General the authority to terminate prosecution, close cases in the interests of the law and set aside cases in the interests of the public. After Prosecutor's Regulation Number 15 of 2020 brings new problems because there is a termination of prosecution based on restorative justice which was previously unknown in both the Criminal Procedure Code and the Attorney General's Act. The purpose of this paper is to determine the position of termination of prosecution based on restorative justice as an extension of the meaning of termination of prosecution,  closing cases in the interests of the law or setting aside cases in the interests of the public, and to determine the legal consequences of termination of cases based on restorative justice. The research method used is doctrinal research to find consistency and legal certainty in the termination of prosecution based on restorative justice.

Abstract

This study examines customary land disputes among indigenous communities in Papua, focusing on the alignment of existing legal mechanisms with the justice values held by these communities. Employing a normative legal approach and socio-legal analysis, this research explores the philosophical, cultural, and legal dimensions of the land, emphasizing its communal and spiritual significance. Findings reveal that Indonesia’s formal legal framework, grounded in individual ownership and state-centric policies, often overlooks indigenous rights, causing unresolved conflicts and cultural disenfranchisement. The research proposes a hybrid dispute resolution model integrating customary practices with state recognition, including specialized customary land tribunals and mandatory consultation processes. This model seeks to bridge the gap between formal and customary laws, promoting equitable dispute resolution and safeguarding the cultural heritage of Papua’s indigenous communities. Recommendations aim to enhance legal recognition and foster sustainable land management in Papua.

Abstract

Indonesia as a developing country is actively pursuing strategic policies to bring about change to become a more advanced country.  One of its main initiatives is to utilize abundant natural resources, especially through nickel concessions, with the aim of positioning Indonesia as a center for the electric vehicle industry.  However, the implementation of these policies often shows deviations in compliance with regulations, technical practices in the field, and aspects of humanitarian rights enshrined in the constitution. Although the goal is to minimize environmental damage, deviations in regulations and technical implementation often occur.  Achieving balance is critical, emphasizing environmental preservation and citizens' inherent right to life.  Effective execution requires the government to consistently comply with applicable laws and regulations in Indonesia.  In addition, strict supervision of private entities involved in nickel mining concessions on important lands is essential.  This monitoring ensures environmental sustainability and encourages the realization of sustainable development goals. The government's commitment to environmental protection must be in line with humanitarian principles, and not ignore the welfare of communities affected by nickel mining activities.  Achieving a harmonious balance between economic development and ecological conservation is paramount.  Therefore, the government must strengthen its regulatory framework, strengthening the legal basis that guides this strategic initiative. Indonesia's journey towards becoming a developed country depends on its ability to face the challenges posed by the nickel industry. Prioritizing environmental conservation and respecting citizens' rights are non-negotiable elements in this progress.  By enforcing and strengthening the regulatory framework, the government can not only ensure sustainable development but also encourage a responsible and ethical approach to utilizing the country's natural resources.

Abstract

The phrase of Indonesian citizen that quotes in Article 51 Paragraph 1 of Law Number 8 of 2011 about the Constitutional Court provides the widest possible opportunity for the Indonesian people to contest their rights. A Constitutional Court’s judge as an Indonesian citizen has the same rights in filing a lawsuit regarding his legal interests related to the review of the Constitutional Court Law. This study contains two results. First, the right to file a petition is the right to file a lawsuit or petition to the Constitutional Court. However, in reviewing Legal Certainty in the second discussion, a Constitutional Court judge should be prohibited from reviewing the Constitutional Court Law as it violates Legal Principles, that a Judge cannot be a Judge for himself. From a multicultural perspective, every Indonesian citizen regardless of ethnic, religious or gender background has equal rights to file a judicial review petition to the Constitutional Court. This reflects the spirit of unity in diversity and equality contained in the 1945 Constitution. However, there still needs to be restrictions to avoid conflicts of interest. By upholding the principles of legal certainty and justice, the Indonesian judiciary system can realize the noble ideals of the nation..
