Abstract

Penerapan Pancasila sebagai cita hukum bangsa Indonesia dan sekaligus sumber segala sumber hukum negara masih menghadapi sejumlah permasalahan salah satunya kemauan politik pembentuk peraturan perundang-undangan yang merupakan anggota Partai politik. Akibat pembentukan yang tidak bersumber pada Pancasila maka peraturan perundang-undangan yang diberlakukan di pusat maupun daerah menimbulkan permasalahan. Permasalahan yang dibahas dalam tulisan ini mengenai cara meningkatkan peran partai politik untuk mewujudkan peraturan perundang-undangan yang berdasarkan kepada nilai-nilai Pancasila. Metode pendekatan yang dipergunakan dalam tulisan ini adalah dengan pendekatan konseptual, dengan mendasarkan pada kedudukan Pancasila sebagai cita hukum, serta fungsi partai politik dalam negara demokratis. Temuan yang didapat yaitu fungsi legislasi sering dikesampingkan dibanding fungsi pengawasan dan anggaran, politik mayoritas menjadi dasar pemikiran para pembuat peraturan perundang-undangan dan bukan ukuran ideologi atau konstitusional, pragmatisme perekrutan calon anggota parlemen, serta adanya perilaku korupsi legislasi. Untuk meningkatkan peran partai politik mewujudkan peraturan perundang-undangan yang berdasarkan pada Pancasila dapat dilakukan dengan cara mewajibkan Parpol di semua tingkatan menyusun desain politik legislasi dalam masa kampanye Pemilu, kepengurusan Parpol dibagi ke dalam 3 (tiga) komponen salah satunya calon anggota lembaga perwakilan, ketegasan Parpol untuk menarik atau mengganti anggotanya di lembaga perwakilan yang lalai dalam menjalankan politik legislasi Pancasila, memasukkan kurikulum pendidikan Pancasila dalam pengkaderan anggota Parpol secara berjenjang dan berkelanjutan, dan negara segera membuat panduan atau pedoman sebagai dokumen resmi dalam menafsirkan dan memahami sila-sila Pancasila.The application of Pancasila as the legal idealsm of the Indonesia and as the source of all legal sources still dealing with some problems, one of which were the political will of laws and regulations maker which are the members of political parties. As a result of the formation that does not originate from Pancasila, the laws and regulations that are enforced at the central and regional levels cause problems. The issues discussed in this paper are about how to increase the role of political parties to refine laws and regulations based on Pancasila values. The method of approach used in this paper is a conceptual approach, based on the standing of the Pancasila as a legal idealism, as well as the function of political parties in a democratic country. The findings obtained are that the legislative function is often ruled out compared to the controlling and budgeting functions, political majorities become the rationale for legislators and not ideological or constitutional measures, pragmatism for recruiting parliament candidates, and the existence of corrupt behaviour in the legislation. To increase the role of political parties in refining laws and regulations based on Pancasila can be done by requiring the political parties at all levels to construct political legislation design in the election campaign period, management of political parties are divided into three (3) components one of which members of the legislature candidate, the firmness of political parties to withdraw or change the members in the legislature that fail to implement the Pancasila political legislation, including the Pancasila education curriculum in the cadre of political party members gradually and continuously, and the state immediately made guidelines as official documents in interpreting and understanding the Pancasila principles.

Abstract

Decent work and livelihoods for humanity are part of human rights for everyone, including people with disabilities, so the 1945 Constitution provides guarantees and legal protection for their implementation. The problem is the discriminatory attitude towards persons with disabilities and the low level of education of persons with disabilities as a gap between people with disabilities and non-disabled workers. The absence of exact data related to the number of workers with disabilities both in the private sector and non-private sectors (PNS, BUMN and BUMD) raises its own problems in the protection of persons with disabilities. The quota of minimum requirement is 2 percent as a mandatory for the government, local government, BUMN, and BUMD and 1 percent for private companies from the number of employees or workers in the Disability Act is apparently not enough to provide protection for people with disabilities. This research is a normative legal research to examine the laws and regulations in order to obtain justice for persons with disabilities. This becomes very important as a form of government commitment through supervision and improvement of policies becomes very important so that persons with disabilities get decent work and livelihoods.

Abstract

Artikel ini berjudul Kebijakan Pemulangan WNI eks ISIS Ditinjau dari Perspektif Hukum. Latar belakang dari penulisan ini dimana kewarganegaraan merupakan hal yang sangat penting karena adanya perlindungan hukum oleh negara terhadap warga negaranya. Sejak ISIS dinyatakan kalah, sebagian warga negara Indonesia yang bergabung dengan ISIS berkeinginan untuk kembali ke Indonesia. Munculnya wacana pemulangan WNI eks ISIS menjadi suatu hal yang dilematis, namun kebijakan tersebut harus tetap diambil oleh pemerintah demi menjaga stabilitas keamanan nasional. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan undang-undang dan pendekatan analitis. Berdasarkan hasil penelitian tulisan ini dapat disimpulkan bahwa dalam pasal 23 Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan Republik Indonesia menyatakan seseorang kehilangan kewarganegaraanya berkaitan dengan tindakan sesorang terhadap negara lain. Namun disisi lain negara berkewajiban memberikan hak kepada seluruh warga negara dalam segala aspek sebagai bentuk tanggung jawab negara terhadap hak asasi manusia. Kata Kunci: Warga Negara Indonesia, ISIS, Status Kewarganegaraan, Hak Asasi Manusia

Abstract

Indonesia is a state of law that relies on a rule of law formed as a basic rule in the state and society. The law as the primary basis must be made following the principles of the Formation of good law so that it is expected that later it can be applied and has binding legal force for all levels of society. However, the current situation is far from the expectation of the formation of good law. For example, the Formation of a job creation law which is considered not to involve the community actively, many articles are contrary to legal principles, disharmonized and unsynchronized between law. The formation of law seems in a hurry so there are many errors in writing (typo) and many other things. Therefore, it is necessary to reconstruct the stages in making good law. This paper uses normative research with a statutory approach, a comparative approach, and finally concludes with a conceptual approach where concepts that are considered suitable can be applied in Indonesia. This article provides two conclusions. First, the practice of harmonization, synchronization and consolidation of conceptions that have been well implemented but only exist at the planning and drafting stages of the Bill. While after the discussion/mutual agreement (plenary), no further harmonization and synchronization are carried out. Second, the post-discussion (plenary) re-harmonization stage can provide space for the implementation of educational facilities, consultations and publications of pre-validation and enactment of law that will be ratified in the form of meaningful public participation

Abstract

The difficulty of obtaining or using the earth's surface in urban areas has resulted in people starting to look for a number of plots of land below the earth's surface. Thus, a development breakthrough innovation is needed that can address the development of community needs, namely the space below the earth's surface. The use of basements, namely UUPA, automatically refers to property rights in discussing the use of basements. The aim is to find a system for granting land rights or management rights to basements in Law Number 5 of 1960 concerning Basic Agrarian Regulations and Law Number 11 of 2022 concerning Job Creation for individuals. This research is a normative juridical research with collection techniques from the literature which consists of primary and secondary legal materials. The results of this study are the system of granting land rights or management rights to basements in the BAL by basing it on the provisions of Article 2 paragraph (2) of the BAL, the term "management" and "organizes". The Job Creation Law is for individuals or legal entities that are given HGB and HP for a period of time as contained in the concept of basement management in Article 146 paragraph (1) to (5) of the UUCK, namely paragraph (1) The land or space formed in the upper room or underground and used for certain activities can be given HGB, HP, or HPL. In conclusion, the State Authority relates to (a) the use and/or allotment, supply and maintenance of the earth, air, space and natural resources in the territory of the Republic of Indonesia; (b) payment or arrangement of types of land rights; (c) paying or arranging several legal relations between people and legal entities with land as objects.

Abstract

Sudah hampir setahun lebih WHO menetapkan Covid-19 menjadi Pandemi, wabah ini hampir menjangkiti seluruh negara di dunia dan membuat berbagai sektor terdampak. Sebagai negara hukum, Indonesia mengeluarkan berbagai produk hukum untuk mengatasi dampak Pandemi Covid-19 khususnya dari sektor kesehatan dan ekonomi, artikel ini akan menjelaskan apa saja produk hukum yang dibentuk pemerintah untuk menangani pandemi dan membahas permasalahan produk hukum yang berlaku dalam mengatasi pandemi. Metode penelitian yang digunakan dalam penelitian ini adalah Yuridis Normatif dengan pendekatan konseptual, pendekatan perundang-undangan dan pendekatan perbandingan. Penelitian ini akan melakukan evaluasi terhadap produk hukum yang dibentuk Pemerintah karena terdapat permasalahan seperti disharmonisasi, selain itu masalah lain yakni adanya pembentukan undang-undang yang dibentuk oleh DPR bersama dengan pemerintah yang tidak memiliki keterkaitan dengan percepatan penanganan Pandemi Covid-19 dan dinilai abai terhadap sense of crisis. Salah satu rekomendasi yang dapat dijalankan oleh Pemerintah yakni focus pada pembentukan peraturan perundang-undangan terkait penanganan Pandemi dan melakukan evaluasi terhadap peraturan perundang-undangan yang dibuat dalam rangka penanganan Pandemi setahun kebelakang

Abstract

There is an unclear formulation in Article 10 paragraph (1) letter b of Act Number 12 of 2011 as amended by Act Number 15 of 2019, that the act can delegate the authority to form acts. This is contrary to Hans Kelsen's theory, namely legal norms accept delegation from norms that are considered valid or have a higher hierarchy, in other words the legal norms contained in the P3 Act cannot get validity. The purpose of this study is related to the main problem, namely conducting a study to find and analyze the delegation of authority to form Acts by Act. The type of research in this legal research is normative juridical research. Normative legal research or doctrinal legal research uses three problem approaches, namely the legal approach, conceptual approach, and comparative approach with the Netherlands and France. Based on the above thinking, the author uses a normative legal research method. In the discussion the author finds that the Act cannot delegate the authority to form Acts, because it is contrary to the principle of lex superior derogat legi inferiori, in the legal politics of delegating the formation of legislation there is also nothing that explains that this can be enforced. These problems include the delegation of authority to form acts by act, causing many polemics, namely the occurrence of overlapping and disharmony of acts with one another, and the occurrence of over-regulation in the acts and regulations in Indonesia.

Abstract

Permasalahan yang diteliti dalam penulisan ini adalah Apa hakikat wakaf terhadap Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf, dan apa yang menjadi urgensi pembaharuan pengelolaan wakaf di Indonesia. Penelitian ini menggunakan tipe penelitian yuridis normatif, serta menggunakan pendekatan perundang-undangan serta pendekatan konseptual dan perbandingan. Hasil penelitian ini adalah perlunya pengawasan tingkat kabupaten mengenai pengelolaan wakaf sehingga dan penunjukan nadzhir yang kompeten sebagai pengelola wakaf, hal ini bertujuan agar tidak terjadinya wakaf yang terbengkalai serta adanya gugatan ahli waris setelah wakif dan nadzhir meninggal dunia, pelaksanaan pengelolaan wakaf ini dapat melihat dari sistem pengelolaan yang telah terlebih dahulu dilaksanakan di Negara mesir. Maka sebagai langkah memajukan dunia perwakafan di Indonesia, Pemerintah melalui Kementerian Agama harus kembali menjalankan fungsi dan tugasnya, guna memfasilitasi pengelolaan dan pemberdayaan wakaf sesuai dengan tuntutan perkembangan masyarakat maka saat ini pengelolaan wakaf di Indonesia perlu Pendayagunaan wakaf secara produktif mengharuskan pengelolaan secara sistem nasional dengan melibatkan sistem  manajemen.  Kata kunci: Wakaf, Nadzhir, Ahli Waris The problem examined in this paper is what is the essence of waqf in relation to Law Number 41 of 2004 concerning Waqf, and what is the urgency of renewing waqf management in Indonesia. This research uses a normative juridical research type, and uses a statutory approach as well as a conceptual and comparative approach. The results of this research are the need for district level supervision regarding waqf management so that and the appointment of competent nadzhir as waqf managers, this aims to prevent abandoned waqf and the existence of lawsuits from heirs after the wakif and nadzhir die, the implementation of waqf management can be seen from the system management that had previously been implemented in Egypt. So as a step to advance the world of waqf in Indonesia, the Government through the Ministry of Religion must return to carrying out its functions and duties, in order to facilitate the management and empowerment of waqf in accordance with the demands of community development. Currently, waqf management in Indonesia needs to be used. Abstract

Artikel ini mengkaji tentang aliran filsafat hukum utilitarianisme dan relevansi terhadap konstruksi pengaturan pengawasan pemilu. Metode penelitian yang digunakan untuk mengkaji isu hukum ini adalah penelitian hukum normatif dengan pendekatan statute approach dan conceptual approach. Hasil penelitian ini menunjukkan bahwa, Utilitarianisme merupakan suatu konsep aliran filsafat hukum yang menekankan eksistensi hukum harus memiliki nilai manfaat dan membawa kebahagiaan pada masyarakat. Kedua, relevansi konstruksi pengawasan pemilu dalam Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum dengan aliran filsafat hukum utilitarianisme terletak pada semangat dalam mewujudkan nilai-nilai kemanfaatan kepada msyarakat. Karena pengawasan pemilu memiliki tujuan untuk memastikan Pemilu sebagai bagian dari demokrasi berjalan sesuai dengan nilai-nilai kosntitusional yaitu, bersifta langsung, umum, bebas, rahasia, jujur, adil dan berkualitas. Pemilu yang seperti ini akan memiliki implikasi terhadap implementasi tata kehidupan dalam berbangsa dan bernegara.  Kata Kunci: Filsafat Hukum, Utilitarianisme, Pengaturan dan Pengawasan Pemilu This article examines the legal philosophy of utilitarianism and its relevance to the construction of election supervision arrangements. The research method used to study this legal issue is normative legal research using a statute approach and a conceptual approach. The results of this research show that Utilitarianism is a concept of legal philosophy which emphasizes that the existence of law must have beneficial value and bring happiness to society. Second, the relevance of the construction of election supervision in Law no. 7 of 2017 concerning Elections with the legal philosophy of utilitarianism lies in the spirit of realizing beneficial values ​​for society. Because election supervision has the aim of ensuring that elections as part of democracy run in accordance with constitutional values, namely, being direct, public, free, secret, honest, fair and of good quality. Abstract

Equality before the law is one of the most important and powerful principles in Indonesia's system of law enforcement. As a law-abiding state, certainly the application of this principle illustrates that every citizen has the same degree or position in the law without exception. The law presented no distinction for any party, it was expressly explained in chapter 27 of the verse (2) the 1945 law. The study aims to see if there is a link between the principle of equality before the law and Indonesia's criminal justice system and how it applies. In writing the study using the normative type of legal study method using the research approach: a legal approach, a conceptual approach and compartive approach. From this study, the conclusion is that the implemntation of equality before the law must be interpreted dynamically, not statically, both in Indonesia and other countries. This means that Indonesia, Jerman and Belanda view that equality before the law must be harmonized with the same treatment for everyone. Justice carried out by the state must provide benefits to all people, and the ask of law is to maintain justice so that it can reach all people without exception. Everyone has the same acces to justice regardless of whether they are rich or poor.
